A regular meeting of the City Council was called to order by President
Pro Tem Robert Ehrenberg at 8:06 p. m.
2. INVOCATION
Invocation was given by Rev. W illard Albertson of the Prince of Peace
Lutheran Church.

4. MINUTES
On motion of Councilman I�oward, seconded by Councilman Reynolds,
the rr�inutes of the regular meeting held July 19, 1965 were approved by
a six yea vote. Mayor W olfe was not present.

dated February 10, 1965 for street purposes, described as the

east one-quarter of the Northeast one-quarter of Section 8, Town-
ship 117, Range 21, except the South 33 feet taken for street purposes,
and to authorize the City Clerk to file same for record. Motion
passed by a six yea vote.

Heltzer, to waive reading and adopt Resolution No. 2854 entitled
"Resolution Giving Approval for Final Plat of Hampshire Court

It was moved by Councilman Howard, seconded by Couacilman
Reynoids, to eliminate the one year provision under Section Z:604
Public Dance Halls. After discussion Councilinan Reynolds with-
drew his second to the motion. Motion 2ost for lack of a second.
A motion was made by Councilman Heltze r that the one day public
dance hall license fee be changed to $10.00 and no license be re-
quired for any group which is a nonprofit organization. Motion lost
for lack of a second.
A motion was made by Councilman Pearson, seconded by Councilman
Heltzer, that a license issued under Section 2:604 of this ordinance
for Public Dance Halls may be for one day only at $10. 00 each.
Motion passed by a five yea vote. Councilrnan Howard voted r�ay.
It was moved by Councilman Reynolds, seconded by Councilman
Howard, to waive first reading of the proposed ordinance as amended,
and to set date for second reading on August 16, 1965. Motion pas sed
by a six yea vote.

A motion was made by Councilman Pearson, seconded by Council-
man Reynolds, to waive reading and adopt Resolution No. 2857
entitled "Approving Final Plans for Improvement of County Road
18 Within the Limits of St. Louis Park. " Motion passed by a six
yea vote.
8. REPORTS OF OFFICERS, BOA.RDS AND COMMITTEES
(a} REPORT OF CITX ATTORNEY REGARDING ORDINANCE REGU-
LATING BOAT AND TRAILER PARKING.
A motion was made by Councilman Heltzer, to remove Subdivision
1, Section 3:137. 1 entitled "Front Yard". Motion lost for want of
a second.
A motion was made by Councilman Reynolds, seconded by Council-
man Heltzer, to add a provision "Excepting parking on driveway"
in Section 1:137. 1, Subdivision 1. Motion lost.
It was moved by Councilman Heltzer, seconded by Councilman
Reyaolds, to waive first reading of proposed ordinance and to set
date for second reading on August 16, 1965. Motion lost by a five
nay vote. Councilman Heltzer voted yea.
It was moved by Counci).man Thiel, seconded by Councilman Heltzer,
to refer the proposed ordinance to staff for further study with rep�rt
prior to Oct.ober 1, I965. Motion passed by a five yea vote. (amended

It was moved by Councilmaa Reynolds, aeconded by Councilman
Thiel, to c oncur with the recommendation of the Gity Manage r to

PA 2, Step A, effective August 2, 1965. Motion passed by a six
yea vote.

MEETING HELD JULY 14, 1965.
A motion was made by Councilman Thiel, seconded by Councilman
Howard, that a communication be sent to the Parks and Recreation
Advisory Commission with a listing of free Monday nights for Council
that they may choose a night with one alternative, or any time mutually

(e) REPORT OF CITY ATTORNEY RELATIVE TO CASE OF LARRY
A. MURPHY VS.. CITY OF ST. LOULS PAR}�, ETAL.
A motion was made by Councilman Reynolds, seconded by Counci.l-
man Pearson, to confirm the appointment of Maurice W. Graham
as special attorney in this matter with fee arrangement to be pay-
ment of one-third of any sum so collected. Motion passed by a six
yea vote.
�f ) FINANCIAL REPORT OF THE CITY FOR MAY 1965 B Y THE CIT Y
MANAGER.
Upon hearing no objection President Pro Tem Ehrenberg ordered
the report received for filing.
(g) PRELIIVIINARY REPORT OF I)IRECTOR OF PUBLIC WORKS
WITH RESPECT TO IMPROVEMENT NO. 64-51, STREET GRADING
AND RIGHT OF WAY FOR NEW PROPOSED STREET FROM LAKE
STREET TO OREGON AVENUE EAST AND NORTH OF LAKELAND
DOOR C OiviPAN Y.
The City Manager outlined on the map present,the proposed new road.
Kenneth Anderson, 3737 Oregon Avenue, and Frank Bou1e, ?720
Edgebrook Drive, were present representing the neighborhood. A
Motion was made by Councilman Thiel, seconded by Councilman
Reynolds, to approve the preliminary plans subject to State Highway
Department designating it as a state-aid road, then staff to prepare
final plans. Motion passed by a four yea vote. Councilman Pearson
abstained and Councilman Ehrenberg voted nay. The proposed plan
calls for a barricade on Lake Street west of the new road to divert
traffic to the road. Mr. Boule suggested posting load limit signs and
designating a truck route in this area.

(a) WATER C�N.I�ITION ON LAKE STREET BETWEEN ALASAMA.
AVENUE A_ND BRUNSWICK AVENUE: (REQUESTED JULY 6, 1965),
The City Manager stated that it was the opinion of staff that the
temporary solution suggestecl was too costly and that the first stage
of storm sewer could be developed. A motion was made by Council-
man Thiel, seconded by Councilman Reynolds, that staff prepare pre-
liminary report of the Lake Street area for storm sewer including
method of financing and recommendation for financing. Motion
passed by a six yea vote.

A communication was received from the State Highway Department
regarding trunk highway right of way taking in the future which etated
they cou].d see no justification for with�olding permit at this time.
A motion was made by Councilman Pearson, seconded by Council-
man Heltzer, to amend resolution for special permit by making
three changes under conditions as follows: In paragraph 2, change
"30 feet north of I3th Lane" to "19 feet north of 13th La,ne "; in
paragraph 5, delete "except for that portion used for driveway";
change paragraph 7,to read "That ingress and egress at 13th Lane
be closed. " Motion passed by a five yea vote. Councilman
Ehrenberg voted nay.

RESOLUTION NO. 2861
It was moved by Councilman Howard, seconded by Councilman Thiel,
to waive reading and adopt Resolution No. 2861 entitled "Resolution
Refunding Special Assessments in Part, Improvement No. 62-6. "

(dj CITY ATTORNEY REPORT ON RIDGWAX ZONING SUIT (DEFERRED
FROM JUNE Z I, 1965 }.
A motion was made by Councilman Thiel, seconded by Councilman
Yoward, to authorize the City Attorney to enter into the stipulation
with conditions incorporated as follows: In the proposed resolution
granting the special permit, paragraph 4 of the portion of the resolu-
tion determining certain facts shall read: "The plan conforms to the
requirements of the use districts in which it is located and with
respect to the requirements of Section 6:176.4, Subd. 1 through 16
excepting Subd. 3 which is hereinafter explained as paragraph 4 in
the conditions of this permit where applicable further shows:"; said
Subd. 3 shall be omitted as above mentioned; Subd. 15 of the pro-
posed resolution in the portion thereof determining facts shall read:
"There shall be no vertical limitations on any structure except as
found in setback or density control provisions in the district in
which the land is located and in Section 6:176.4 of the Zoning Ord-
inance of St. Louis Park, and as provided in Section 2� Subd. 3,
below in this resolution setting conditions"; paragraph 1 of the pro-
posed resolution in the portion setting forth conditions shall read:
"That the site be used and built upon in substantial compliance with
the site and landscape plan, and the two perspectives, filed with
said application as Exhibits 1, 2, and 3, respectively"; conditions
in paragraph 2 of the conditions shall be amended by eliminating
reference to Exhibit 4; �o the portion of the proposed resolution
setting forth the conditions shall be added a fourth section which

9. (d) shall read as fo�lows: "That with respect to Subd. 3 of Section
6:17b. 4 the plaintiff shall submit a preliminary plan for drainage

ing the proposed locations of all fire hydrants and manholes, designed,
signed and stamped by a professional civil engineer, registered in the
State of Minne s ota; s aid plan s hall be pr e s ented to the City Engine e r
for his advice and recommendation and shall be subject to the approval
of the City Council prior to the is suance of any building permit. "

It was moved by Councilman Pearaon, seconded by Counci.lman Thiel,
to authorize the City Attorney to execute the stipulation for settlement.

(e) COMMUNICATION FROM ROBERT J. MCNULTY OFFERING PROP-
ERTY TO CITV (OUTL�T ONE, SECOND COUNTRY CLUB ADDIT'ION
OF �ESTWOOD HILLS).
A motion was made by �ouncilman Thiel, seconded by Councilman
Pearson, to defer actior_ until August 16, 1965. Motion passed by
a six yea vote. �
�f) SOUTH SIDE FIRE STATION (DEFERRED FROM MAY 17, 1965).
It was moved by Councilman Thiel, seconded by Councilman Howard,
to approve plans and specifications and authorize advertisement for
bids for F`ire Station No. 1, with deletions totaling an estimated
$14, 350. 00. Motion passed by a six yea vote.
(g) ENFORCING SPECIAL PERMITS.
Councilman Heltzer requested action to enforce the conditions in
the special permit granted to Boulevard Delicatessen, particularly
with regard to the fence between the parking lot and residential prop-
erty on the north side. A motion was made by Counci.lman Pearson,
seconded by Councilman Heltzer, that the City Manager prepare a
report for the August 16 Council meeting with regard to the status
of this matter. Motion passed by a six yea vote.

(a) MOT4R BIKES AND SKOOTERS.
A motion was made by Councilman Howard, seconded by Council-
man Reynolds, requesting the City Attorney to prepare an ordinance
incorporating the provision that no children u.rider twenty-one years
of age can rent a motor scooter without parental permission, and
that reasonable insurance including liability and passenger liability
be carried by the renter. Motion passed by a six yea vote.

1. Raymond C. Hansen, i7605 12th Avenue North, Wayzata.
A rriotion was made by Councilman Pearson, seconded by Councilman
Thiel, to fiie claim with the City Clerk for proper action by the City
Manager and City Attorney. Motion passed by a six yea vote.
12. CLAIMS, APPROPRIATIONS AND CONTRA.GT PA.YMENTS

(a) VERIFIED CLAIMS,
Qn motion of Councilman Pearson, seconded by Councilman Thiel,
the lists of verified claims prepared by the Director of Finance and
presented to the Council dated August Z, 1965 as amended by chang-
ing the claim of Traff & A.ssociates, Inc. to read $30.84 were
approved in the total amounts of $8, 125. 61 for payroll, and $56, 20?. 46
for vendors, and the City Manager, City Clerk, and City Treasurer
were authorized to issue checks covering same by a six yea vote.
(b) CONTRA.CT PA'vMENTS.
I. Partial Payment No. 2 for sanitary aewer, water main, storm
sewer, Improvement Nos. 64-1, 64-59, 65-19, 65-32, 65-37,
and b5-38. Contractor, Union Central Contracting Inc. A.nnount,
$6, 546. 87.
On motion of Councilman Heltzer, seconded by Councilman Reynolds,
the above payment on contract work presented by the City Engineer
was approved, and the City Manager, City Clerk, and City Treasurer
were authorized to issue a check by a six yea vote.
