CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Kenneth Wolfe at 8:05 p. m. 2. INV OCATION No invocation wae given. 3. Councilman Ehrenberg arrived at 8:24 p. m. 4. MINUTES On motion of Councilman Thiel, seconded by Councilman Howard, the minutes of the regular meeting held June 28, 1965 were approved by a eix yea vote. Councilman Ehrenberg was not present. 5. PiTBLIC HEARINGS (aj IMPROVEMENT NO. 64-29, P��PQSED 9IDEWALK CONSTRUCTION ON NORTH SIDE OF ELIOT VIEW ROA.D FROM FLORIDA AVENUE TO HA.MPSHIRE AVENUE, AS DESCRIBED IN NOTICE OF HEA.RING PUBLiSHED JUNE 24, 1965 AND JULY 1, 1965. Kenneth Brooks, 6724 Eliot View Road, stated there were four residents against the project. John Zobana, 6? 18 Eliot �iew Road, and Rose Peterson, 6730 Eliot View Road, spoke against the project. Eric H. Lindberg, 6626 Eliot View Road was present representix�g those who signed the petition for sidewalk. Mayor Wolfe declared the hearing closed. Councilman Ehrenberg arrived at 8:24 p. m. 124 Council Minutes - July 6, 1965 5, (a) RESOLUTION NO. 2832 A motion was made by Councilman Pearson, seconded by Councilman Howard, to waive reading and adopt Resolution No. 2832 entitled "Resolution Ordering Improvement and Ordering Preparation of Plana Improvement No. 64-29, " amending the description to read "on north side of Eliot View Road from Florida Avenue to the west line of Lot 12, Eliot View Addition. " Motion passed by a seven yea vote. RESOLUTION NO. 2833 It was moved by Councilman Howard, seconded by Councilman Reynolds, to waive reading and adopt Resolution No. 2833 entitled "Resolution Ordering Improvement No. 65-47 Be Not Made. " Motion passed by a seven yea vote. RESOLUTION NO. 2836 It was moved by Councilman Pearson, seconded by Councilman Heltzer, to waive reading and adopt Resolution No. 2836 entitled "Resolution Amending Resolution No. 2819 Ordering Improvement and Ordering Preparation of Plans Improvement No. 65-40, " as amended by adding a description of the area. A motion was made by Councilman Helt zer, seconded by Council- man Reynolds to waive reading and adopt resolution. Before a vote wa� taken on the above motion it was moved by Councilman Peareon, seconded by Councilman Thiel to defer the matter until July 19, 1965 for staff to investigate the poesibility of putting the hold harmless clause in the resolution and the contract. Motion passed by a seven yea vote. (e) SECOND READING OF PROP06ED ORDINANCE A.MENl?ING THE ST. LOUIS PARK ZONING ORDINANCE CHANGING BOUNDARIES OF ZONING DISTRICTS (5b23 WEST LAKE STREET - CASE NO. 65-14-Z) REQUESTED BY SAMUEL SHAPIRO. Samuel Shapiro was present. ORDINA.NCE NO. 942 It was rrioved by Councilman Pearson, seconded by Coun�ilma.n Howard, to waive second readiag and adopt Ordinance No. 942 entitled "An Ordinance Amending the St. Louis Park Zoning Ordinance Changing Boundaries of Zoning Districta. " Motion passed by a six yea vote. Councilman Thiel voted nay. (f} RESOLUTION ACCEPTING i�10RK FOR SUBDIVISION CONTRACT C ONS TR UC TION AQ UI LA PARK ADDITION . It was moved by Councilman Thiel to postpone action for two weeks for staff to investigate the problem of eroding land. Motion lost for wa.nt of a second. RESOLUTION NO. 2g38 A motion was made by Councilman Ehrenberg, seconded by Councilrrian Howard, to waive reading and adopt Resolution No. 2838 entitled "Resolution Accepting Work for Subdivision Con- tract Construction Aquila Park Addition. " Motion passed by a seven yea vote. Councilman Thiel requested staff to prepare a letter for him explaining that the problem of erosion is not part of the contract and that the City has no control over it. 12? It was moved by Councilman Heltzer, seconded by Councilman Thiel, to concur with the following appointments: Kathryn Carlson, City Ma.nager's Office, Probationary Clerk I, Range GC 5, Step A, effective July 6, 1965. UNFINI�SHED BUSINESS (a) REP�RT OF CITY MANAGER (M. & C. NO. b5-14) CONCER1vING WOLFE PARK (DEFERRED FROM JUNE 21, 1965). A motion was made by Councilman Thiel, seconded by Councilman Ehrenberg, that the amount of money taken for gravel operation be allocated to developing a program for Wolfe Park, and staff to prepare prelirriinary plans to coincide with money available. A motion was made by Councilman Howard, seconded by Councilman Reynolds, that staff prepare preliminary plans for a comprehensive storm sewer for the area to be scheduled for possible construction in the early spring. Motion passed by a seven yea vote. It was moved by Councilman Thiel, seconded by Councilman Reynolds, that the City Manager report by August 2, 1965 regard- ing measures to be taken on a temporary basis to alleviate flood conditions on Lake Street between Alabama �venue and Brunswick Avenue. Motion passed by a seven yea vote. (c) REPORT OF CITY MANAGER (M. & C. NO. 65-18) W ITH RESPEC T T O REVISION OF LICENSE A ND PERMIT FEES (I3E FE�ZRE D FROM JUNE 28, 19 65 ). A motion made by Councilman Ehrenberg, seconded by Councilman Reynolds, to defer the report to budget meetings was withdrawn by Councilman Ehrenberg. It was moved by Councilman Pearson, seconded by Councilman Reynolds, that Council give general approval to the first four pages of the fee changes with additional information to be prepared by staff for the items on pages five and six, and prior to discuseion by Council of these items the persons involved be notified. Motion passed by a seven yea vote. CLAIMS, A.PPROPRIATIONS AND CONTRACT PAYMENTS (a) VERIFIED CLA�MS. On motion of Councilman Thiel, seconded by Councilman Heltzer, the lists of verified claims prepared by the Director of Finance and presented to the Council, dated July 6, 1965 in the total amount of $60, 322. 32 for vendors were approved, and the City Manager, City Clerk, aad City Treasurer were authorized to issue checks covering same by a seven yea vote. (b) CONTRACT PA YMENTS. 1. Partial Payment No. 1 for sanitary sewer, water main, storm sewer, improvement Nos. 64-1, 64-59, 65-19, 65-32, 65-37, 65-38. Contractor, Union Central Cantracting, Inc. Amount► $6, 179. 04. �n motion of Councilman Reynolds, seconded by Councilman Howard, the above payment on contract work presented by the City Engineer was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue a check by a seven yea vote. 131 Council Meeting - July 6, 1965 13.
