Councilman Pearsoa arrived at 8:22 p. m. and Councilman Reynolds
arrived at 8:25 p. m.
4. MINUTES
On motion of Councilman Heltzer, aeconded by Coun�ilman Howard, the
minutes of the regular rneeting held May 24, 1965 were approved by a
five yea vote, as� amenled by add�tng under item 5b, "The request to
vacate• wae deni�d by a five yea vote. " Oa motion of Councilman Heltze�`�
seconded by Councilman Howard, the minutes of the special meetiag hel�
June 1, 1965 were approved by a five yea vote.

Sybrant, 5601 Glenwood North, Minneapolis, was present in favor
of the variance.
Councilman Pearson arrived at 8:22 p. m. Councilman Reynolde
arrived at 8:25 p. m.
Mayor Wolfe declared the hearing ciosed. Councilman Thiel
made a motion, s econded by Councilman Ehrenberg, to deny the
request for variance. Before a vote was taken on Lhe above motion
discussion was held concerning drainage, detrinient to the neighbor-
hood,and solutions. A motion was made by Councilman Pearson,
seconded by Councilman Reynolda, to defer the matter for two weeks.
Motion passed by a roll call voie of four yeas and three nays. Coun�il-
men Ehrenberg, Howard,and Thiel voted nay.

Frank Meyers, 2812 Nevada Avenue, was present in opposi f�e o
the project, R. J. Barthel, ZSO1 Mar}� and, was in favor o
improvement but concerned with excess traffic. John Steinman
requested a stop sign on 28th Street. Staff will study means of
alleviating the problems. Mayor Wolfe dec�ared the hearing
cloaed.
RESOLUTION NO. 2821
A. motion was made by Councilman Heltzer, seconded by Council-
man Reynolds, to waive reading and acbpt Resolution No. 2821
entitled "Resolution Ordering Improvement and Ordering Prepara-
tion of Plans Improvement No. 63-19. " Motion passed by a seven
yea vote.
(e) IMPROVEMENT NO. 65-43, PROPOSED ASPHA.LT CONCRETE
PA.VING AIVD CU1�B AND GUTTERON WEST 28TH STREET FROM
TEXAS AVENUE TO VIRGINIA AVENUE, AS DESCRIBED IN
NOTICE OF HEARING PUBLISHED MAY 27, 1965 A.ND JUNE 3,
1965.
Mrs. Rose Wernick, 2801 Virginia Avenue, appeared in oppositivn
to the improvement. Kenneth Gaslin, 2801 Sumter A.venue,was not
opposed to the project but would like the street cleaned up and filled.
The Engineering Department will see if it can be fixed. Mrs. -
Richard Shedd, 280? Virginia Avenue,was concerned with assess-
ments for the project. The assessment hearing will be held at a
later time. Mayor Vdolfe declared the hearing closed.
RESOLUTION NO. 2822
It was moved by Councilman I-�oward, seconded by Councilman
Thiel, to waive reading and adopt Resolution No. 2822 entitled
"Resolution Ordering improvement and Ordering Preparation of
Pla.ns Improvement No. 65-43. " Motion passed by a seven yea
vote .

K. A. JOHNSON PROPERTY ON WEST 26TH STREET.
It was moved by Councilman Ehrenberg, seconded by Counci3man
Thiel, to defer action until June 21, 1965. Motion passed by a six
yea vote, Councilman Reynolds voting nay.

MEETING HELD MA.Y IZ, 1965.
It was moved by Councilman Pearson, seconded by Councilman
Howard, that a preliminary report and map be prepared by staff
indicating park sites and park areas that have been developed or
should be developed to the extent of grading, landscaping,and other
basic inciprovements. iVlotion passed by a aeven yea vote. T`he
minutes of the Parks and Recreation A.dvisory Commission meeting
held May I2, 19b5 were ordered by ihe Mayor to be received for
filing.

TO RETENTION OF CITY EMPLOYEE BEYOND MANDATORY
RETIREMENT AGE.
A motion was made by Counciirrian Howard, seconded by Councilman
Reynolds, to concur with the City Manager's recommendation allow-
ing Nathan H. Epstein to remain in the employ of the City until
August 13, 1966. Motion passed by a seven yea vote.

(g) PRELIMINA.RY REPORTS OF THE DIRECTOR OF PUBLIC WORKS
AND ASSESSMENT REPORTS WITH RESPECT TO THE FOLLOW-
ING IMPROVEMENTS:
1. No. 64-31, Portland cement concrete alley paving between
Hampshire A.venue, Idaho Avenue, West 33rd Street and West
32nd Street.
2. No. 64-40, Portland cemen.*. �o�crere alley paving betwe en

Street.
3. No. 64-53, Portland cement concrete alley paving of T alley
between Idaho Avenue, Hampshire Avenue, south of Minnetonka

Toledo Avenue, Salem Avenue, 42nd Street and MorningBide
Road.
It was moved by Councilman Pearson, seconded by Councilman
Heltzer, to waive reading and adopt resolution receiving reports
and calling hearing on improvements on June 21, 1965. A dis-
cussion follwed relative to Portland cement concrete paving as
opposed to hot mix asphalt paving, Before a vote was taken on
the above motion Councilman Howard made a mation, seconded
by Councilman Heltze r, to defe r action until June 21, 1 g 65.
Motion passed by a seven yea vote.
(h) REPORT OF EMPLOYEE APPpINT�NT (FIREFIGHTER).
It was moved by Councilman Thiel, seconded by Co���man
Ehrenberg, to consent and approve the appointment of John F,
Riordan as Firefighter, Range �S Z, Step A, effective June 7 1965.

ORDINANCE TO PROVIDE OFF-STREET PARKING IN R-2 DLS-

It was moved by Councilman Ehrenberg, seconded by Councilman
Howard to defer action until June 21, 1965. Motion passed by a
seven yea vote.
(bj AWARD OF CONTRACT FOR HOT MIX ASPHALT PAVING AND
CURB AND GUTTER, IMPROVEMENT NOS. 62-66, 63-30, 64-2,
64-12, 64-41, 65-5, 65-13, 65-36.
RESOLUTION NO. 2825
A motion was made by Councilman Ehrenberg, seconded by Council-
man Reynolds, to waive reading and adopt Resolution No. 2825
entitled "Resolution A.ccepting Bid for Hot Mix Asphalt Paving
and Curb and Gutter Improvement Nos. 62-66, 63-30, 64-2, 64-12,
64-41, 65-5, 65-13, 65-36." Motion passed by a seven yea vote.
Contract was awarded to Black Top Service Company in the amount
of $99, 953. 93.
(c) PROPERTY AT �-IAMPSHIRE A.VENUE AND WAYZATA BOULE-
VA.RD.
The City Manager explained the background of the property, and
that the owner, Daniel Otten, 5? 11 Colfax Avenue South, Minneapolis �
was requesting the Council to grant a temporary permit to burn only
w�t is on the property at the present time. Mr, Otten was present
and asked the Council for permission for one continuous burning to
clean up the property. Mr. Irwin Riven, 1468 Hampshire Avenue,and
Dave King, 1460 Hampshire Avenue, were concerned about a con-
tinuous burning.
A motion was made by Councilman Reynolds, to give Mr. Otten a
burning permit on the basis of one continuous burning not to exceed
three days, subject to approval of the Fire Department as to time
and direction of wind. Motion lost for want of a second.
Councilman Thiel made the same motion amending three days to
seven days. Motion lost for want of a second.

9. (c) It was moved by Councilman Pearson, seconded by Councilman
Ehrenberg, that Council approve a burning permlt for Daniel
Otten to burn the canbustible material presently on the site, sa�.d
permit to be conditioned as follows:
1. Fire to be started only with approval of the Fire Chief or
his designated agent.
"L. Said burning to continue no longer than seventy-two hours
and under the supervision of the St. Louis Park Fire Depart-
ment.
3. That the applicant poet a$1000. 00 bond to be conditioned to
limit the burning, and that the bond remain in force one year
f rom date the burning pe rmit 'is is sued.
4. That any remaining debris from the combustible material
being burned be buried within sixty days after the end of the
s eventy- two hour burning pe riod.
5. That no further combustible material be hauled onto the site.
After additional discussion Councilman Hov�a rd called for the
question. Motion passed by a seven yea vote.
10. NEW BUSINESS
(a) COUNCIL MEETING JUNE I4, 1965.
A motion was made by Councilman Howard, seconded by Council-
man Thiel, that no Council meeting be held June 14, 1965. Motion
passed by a seven yea vote,

A motion was made by Councilman Reynolds, seconded by Council-
man Thiel, to file claim with the City Clerk for proper action by
the City Manager and City Attorney. Motion passed by a seven
yea vote.

� motion of Councilman Thiel, seconded by Councilman Howard,
the lists of verified claims prepared by the Director of Finance
and presented to the Council, dated June 7, 1965 in the total amounts
of $1, 977, ?8 far payroll, and $37, 145. 75 for vendors were approved,
and the City Manager, City Clerk, and City Treasurer were author-
ized to issue checks covering same by a seven yea vote.

1. Partial Payrnent No. 3, etorr�n sewer Improvement No. 62-b8.
Contractor, Lametti & Sons, Inc. Amount, $8, 364. 15.
On motion of Councilman Ehrenberg, seconded by Councilman
Thiel, the above payment on contract work preaented by the City
Engineer was approved, and the City Manager, City Clerk, and
City Treasurer were authorized to issue checks for the respective
amount by a seven yea vote.
13. ADJDURNMENT
� On motion of Councilman Howard, seconded by Councilman Ehrenberg,
the meeting was adjourned at 12:18 a. m. by a seven yea vote.
