A motion was made by Councilman Pearson, seconded by Councilman Howard, to approve issuance of the license to sell non-intoxicating malt liquor off sale. Motion passed by a six yea vote. ?. No. 64-43, hot mix aephalt paving and curb and gutter oa West 26th Street between Dakota Avenue and Hampshire Avenue. 51 Council Minutes - March 29, 1965 S• td� RESOLUTION NO. 2??4 A motion was made by Councilman Thiel, seconded by Councilman Reynolds, to waive reading and adopt Resolution No. 2774 entitled "Resolution Receiving Reports and Ca1li.ng Hearing on Improvement Nos. 62-66, 63-30, 64-2, 64-12, 64-41, 65-5, 65-13, 64-43.'r Before a vote wa8 taken a motion was made by Councilman Heltzer, seconded by Councilman Thiel, to delete Improvement No. 64-43 from the resolution for hearing. Motion passed by a six yea vote. Vote was taken on the original motion as amended and passed by a six yea vote. Hearing on the above improvements, wi.th the exception of Improvement No. 64-43, will be held A.pril 19, 1965. 9. UNFINISHED BUSINESS (a) COMMUNICATION FROM HERBERT C. DAVIS RE�2UESTING ADJUST- MENT OF ASSESSMENT ON BEHALF OF KENNETH R. FLETCHER FOR WA.TER MAIN AND MAIN TRUNK SEWER AT 6101 CEDAR LAKE ROAD (DEFERRED FROM MARCH 15, 1965). The City Manager proposed that the City purchase the south 120 feet of the property at 6101 Cedar Lake Road for drainage purposes. A motion was made by Councilman Thiei, seconded by Councilma.n Howard, that the City acquire the south 120 feet of the above property for $330. 00 and assume the balance of assessments against the prop- erty acquired by the City, as recommended by the City Manager. Motion lost by a roll call vote of four nays and two yeas. Councilmen Ehrenberg, Heltzer, Pearson, and Reynolds voted nay. It was moved by Councilman Reynolds, seconded by Councilman Pearson, to table the request of Mr. Davis for adjustment of assess- ments at 6I01 Cedar Lake Road. Motion passed by a six yea vote. 10. NE� B US INESS Eaj TABULA.TION OF BIDS ON MIST BLOWER UNIT A.ND TRAILER. A motion was made by Councilman Heltzer, seconded by Councilman Reynolds, to designate Public �Vorks Equipment Company as the low- est responsible bidder for a mist blower unit and trailer, and to accept bid in the amount of $6, 935. 00. A motion was made by Councilman Howard, seconded by Councilman Heltzer, that the communication from Morningaide regarding the feasibility of combining the skating rinks of Minikahda Vista Park and Morningside Park be referred to the Parks and Recreation Advisory Commission for recommendation. Motion passed by a six yea vote. (d) IMPOUNDING OF DOCS. Councilman Heltzer requested that the schedule of rates for impound- ing dogs be reviewed for the same type of arrangements as surround- ing c ommunitie s . (e ) TRUNK HIG�-€WAY 169 SOUTHINEST DIAGONAL. The City Manager read a communication from the State Highway Departme nt concerning a public hearing on Trunk Highway 169 south- west diagoaal from its junction with Trunk Highway 100 northerly of Excelsior Boulevard to its junction with Trunk Highway 12 west�rly of Dunwoody Institute. A motion was made by Councilman Reynolds, seconded by Gounci.lman Heltzer, that the communication be placed on the Council Agenda of April 5, with a resume of past history prepared by Staff. (a} A. r�ciotion was made by Coun�ilman Reynolds, seconded by Councilman Howard, to file claims with the City Clerk for proper action by the City Manager and City Attorney. Motion passed by a six yea vote. 12. CLAIMS, APpROPR�.TIONS AND CONTRACT PAYMENTS �aj VERIFIED CLAIMS. On motion of Councilman Reynolds, seconded by Councilman Howard, the lists of verified claims prepared by the Director of Finance and presented to the Council, dated March 29, 1965 in the total amounts of $2, 441. 5? for payroll, and $30, 087. ?9 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checke covering same, by a six yea vote. (b) CONTRAC T PAYMENTS. 1. Partial Payment No. 2 for Pump and Pump House No. 13, Improvernent No. 64-52. Contractor, Keys Well Drilling Company. Amount, $15, 089. 40. On motion of Councilman Heltzer, seconded by Councilman Howard, the above payment on contract work presented by the City Engineer was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue a check, by a six yea vote. 13.
