CALL TO ORDER A regular meeting of the City Council was called to order by MaY°r Kenneth Wolfe at 8:05 p, m. 2. INV OCA TION Invocation was given by Reverend Ralph Erickson of the Prince of Peace Lutheran Church. 3. ROLL CALL Tbe following Councilmen we re present at roll call: Robert Ehrenberg James Heltzer Frank Howard Curtis Pearson Leonard Thiel Kenneth Wolfe A1so present were the City Manager, City Attorney, and the Secretary. Gouncilman Reynolds arrived at 8:18 p. m. 4. MINUTES On rnotion of Councilman Pearson, seconded by Councilman Howard, ihe minutes of the regular meeting held February 15, 1965 were approved by a six yea vote. Councilman Reynolds was not presen�. 5. PUBLIG HEARINGS (a) PROPOSED PRELIMINARY PLAT OF VIiESTERN COURT ADDITION (NORTHWEST CORNER OF JOPPA AVENUE AN� MTNNETONKA BOULEVARDj REQUESTED BY C. W. pETERSON. Mayor Wolfe opened the hearing on the preliminary plat of Western Court A.ddition. Mr. C. W. Peterson was present. and assured the Council proper easements would be observed in the final plat. Mayor Wolfe declared the hearing closed. It was rrioved by Council- man Ehrenberg, seconded by Councilman Howard, to approve the 31 Council Minutes - March 1, 1965 5. (a) preliminary plat of V�.Testern Court Addition. Motion passed by a six yea vote. Councilman Reynolds was not pre sent. 6. PE TITIONS, REQ UES TS A.ND C OMMUNICATIONS (a) APPLICATION FQR RENEWAL OF LICENSE TO SELL NON- INTOXICATING MALT LIQUOR OFF SALE BY BUDDY=S, 4000 MINNE TONKA B OU LE VARD. It was moved by Councilman Howard, seconded by Councilman Pearson, to approve issuance of a license to sell non-intoxicat- ing malt liquor off sale by Buddy's, 4000 Minnetonka Boulevard. Motion passed by seven yea vote. Councilman Reynolds arrived at 8:18 p. m. (b) A.PPLICATION FOR LICENSE TO HOLD A PUBLIC DANCE AT THE AMERICAN LEGION HALL, XEN'WOOD A.VENUE AND EXCELSIOR BQULE VARD B Y THE S T. LOUIS PARK PARKE TTES. It was moved by Councilman Howard, seconded by Councilman Thiel, to approve issuance of a license to hold a public dance by the St. Louis Park Parkette s. Motion pas s ed by a s ix ye a vote. Upon hearing no objection, Mayor V�Tolfe ordered the commuaica.- tion received for filing. 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION APPROVING CLASSIFICATION LIST "60?-C" AND APPROVING SALE OF LA.NDS THEREIN. A motion was made by Councilman Ehrenberg, seconded by Councilman Heltzer, to defer action on Clasaification List "607-C" until March 15, 1965. Motion passed by a seven yea vote. (b} RESOLUTION NO. 2759 It was moved by Councilman Reynolds, seconded by Councilman Howard, to waive reading and adopt Resolution No. 2�59 entitled "Resolution Amending Resolution No. 2744 Approving Securities for Collateral from Park Plaza State Bank of St. Louis Park, Minnesota, " Motion passed by a seven yea vote. RESOLUTION NO. 2760 It was moved by Councilman Howard, seconded by Councilman Reynolds, to waive reading and adopt Resolution No. 2?60 entitled "Resolution Authorizing the Release of Securities and Approval of Substituted Securities of Park Plaza State Bank of St. Louis Park, Minnesota. " Motion passed by a seven yea vote. (d) RESOLUTION URGING PASSAGE OF LEGISLATION RELATING TO THE i�EIMBURSEMENT OF PUBLIC �FFICERS AND EMPLOYEES FOR THE USE OF PRIVA.TELY OWNED AUTOMOBILES IN THE �'ERFORMANCE OF THEIR DUTIES S. F. 638. RESOLUTION NO. 2761 It was moved by Councilman Heltzer, seconded by Councilman Thiel, to waive reading and adopt �esolution No. 2?61 entitled "Resolution Urging Passage of Legislation Relating to the Reim- bursement of Public Officers and Employees for the Use of Pri- vately Owned Automobiles in the Performance of Their Duties S. F. 638, " Motion passed by a roll call vote of four yeas and three nays. Councilmen Ehrenberg, Howard, and Pearson voted nay. After further discussion a motion was made by Councilman Thiel, seconded by Councilman Reynolds, to amend the above resolution by adding the following paragraph: "And Be It Further Resolved that if the State Legislature in its wisdom should consider the creation of such a policy on a state-wide basis, the City Council of the City of St. Louis Park would also be in favor of such legis- lation. " Motion passed by a six yea vote. RESOLUTION NO. 2762 It was moved by Councilman Ehrenberg, seconded by Councilman Thi:el, to waive reading and adopt Resolution No. 2762 entitled "Resolution Authorizing Application for Conveyance of Tax For- feited Lands. " Motion passed by a seven yea voie. (d) REPORT OF THE MAYOi�.'S COMMITTEE ON A. COMMUNITY CENTER. A motion was made by Councilman Ehrenberg, seconded by Council- man Howard, that the City Council invite the Parks & Recreation A.dvisory Commission, Planning Commission, and the Mayoris Committee on a Community Center, to meet with the Council on Tuesday, March 9, at 8:00 o'clock p. m. in the Council Chambers to discuss a community center. Mr. John Carlson, 1602 Edgewood Avenue, was present repre- senting the neighborhood in a protest against the burning. A- motion was made by Councilman Pearson, seconded by Council- man Ehrenberg, that a letter be written by the staff to Mr. Terry that the City Council will not renew his authorization to burn on the property south of �Tayzata Boulevard and east of Hampshire Avenue. A motion was made by Councilman Pearson, seconded by Council- man Heltzer, to defer the matter until March 15, 1965. Motion passed by a seven yea vote. 10. BUS SERVICE TO THE UNIVERSITY OF MINNESOTA. A motion was made by Councilman Reynolds, seconded by Council- man Thiel, that the staff study and report on the feasibility of bus service for students attending the University of Minnesota. Motion passed by a seven yea vote. 12. CLAIMS, APPROt :RIATIONS AND CONTR.ACT PAYMENTS (a) cb� VERIFIED CL.AIMS. On motion of �ouncilman Heltzer, seconded by Councilman Reynolds, the lists of verified claims prepared by the Director of Fina.nce and presented to the Council, dated March 1, 1965 in the total amounts of $4, 412. ?3 for payroll and $29, 620. 29 for vendors were approved as amended by adding the claim for Postmaster in the amount of $3, 000. 00, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same. Motion passed by a seven yea vote. CONTRACT PAYMENTS. 1. Partial Payment No. 2 for construction of 1lITe11 #14, Improve- ment No. 63-33B. Contractor, Bergerson-Caswell, Inc. Amount, $14, 115. 60.
