On motion of Councilman �Ioward, seconded by Councilman Reynolds, the
minutes of the regular mseting held A.pril 27, 1964, were approved as
amended by a five yea voL-e. Mr. �earson requeated that the minu�es be
amended to include Resolution No. 2575 in its entirety. Councilman
Heltzer was not present.

Kurt Pinke, 2916 �3oone Avenue, representing about 80% of the people
in the area; Mrs. �`.rthur Tilsen, u545 j�Test 28th Street; Dr. Vlilton
Reiser, 8531 li�Test 2�th Street; Sheldon 1Nert, 2806 Boone Avenue; Nrs.
Jack Salomon, 85�2 i�.Test 28th Street; Norman Herman, 8525 ���est 28th
Street; Morris Sher:�nan, 2841 Cavell Avenue.
Mr. �'inke presented a petition from the homeowners in the area
opposed to the rezoning which was marked Exhibit "A", and also pre-
sented statements of residents in the area marked Exhibit "B". iv�rs.
Arthur Tilsen, Dr. Iv-ilton Reiser, iVir. Sheldon ?tdert, Mrs. Jack
Solomon and Mr. Norman Herman gave tneir statements to the Council,
copies of which are incorporated in Exhibit "B",
�/Ir. Morris Sherman stated that the basic issue is whether the Council
feels this type of thing belongs in the neighborhood. The residents
feel they are living in an outstanding neigh�orhood. i�hat the �riestlinga
are asking for is out of character with the neighborhood. It will bring
in many people - cause traffic problems, The �eople who eigned the
petition all feel and wish the Council would concur that the apartment
is out of character with R-1 zoning.

Councilman Pearson moved tha� �he r�quest for rezoning be denied
on the basis that:
1. It would be spot zoning�
2. It would be detr. iment-al t;o tche neighborhood and property
• value s,
3. The developer began buildin� residential buildings long
before the area was changed from open development to �? -1.
4. On the whole the land is reasonable and can be developec�
without 2n economic hardship.
5. The people v�ho purchased �he property deperided on the
zoning ordinance to protect i:hemo
6. If this zoning is forced on us by the court our ordinance
means nothing. This is a fla�rant attempt to profit and
will benefit only the party who originally owned ihe lanc�.

The City Nanager reported that many people in the area were
interested ii1 the �ark. A. petition from residents of St. Louis
Park and a petition irom residents of the Village of Minnetonka
has been received in favor of a park,
Carl Beddo�rs, 22G 1�t�indsor Lake Drive,and Leo Hylbak, 10216
Windsor Lane, were pre�ent in opposition, Mrs, Gerold Silver,
1805 Ford Road,was prese�t in favor.
A motion was �nade b}� Councilman Reynolds, seconded by Council-
man Heitzer, to �,efe�� Kilmer Park to the �arks and Recreation
1�.dvisorST Commi��ion f�-� recommendation, and that the City 1Vanager
