MINUTES On motion of Councilman Howard , seconded by Councilman Shank , the minutes of the regular meeting held November 26 , 1962 , were approved by a six yea vote . Councilman Ehrenberg arrived at 3 : 1S p . m . 5 . PUBLIC HEARINGS ( a) PROPOSED REZONING OF LOTS 3 AND 45 BLOCK 3 , ADOLPH FINE ` S ADDITION ( 3000 BLOCK ON COLORADO AVENUE) FROM R - 2 DISTRICT` TO R - B DISTRICT , REQUESTED BY MEYER A . Before vote was taken on above motion there was consider - able discussion . A motion was then made by Councilman Pearson , seconded by Councilman Heltzer , calling for the question . Motion passed by a vote of six yeas and one nay . Councilman Shank voting nay . The Mayor called for a vote on the original motion which was passed by the following roll call vote . PETITIONS , REQUESTS AND COMMUNICATIONS ( a) APPLICATION OF THE GAIL COMPANY TO BUILD ON LOTS 75 THROUGH 02 , RICHMOND ADDITION (EAST SIDE OB IDAHO AVENUE BETtIEEN 16TH STREET AND lQTH STREET ) . Present viere Sol Berkovitz and Simon Mashb ` shar , owners of lots on both s .idas of Idaho Avenue between 16th and lunth Street . Mr . & Mrs . In response to questions from the City Attorney the City Engineer stated that the present fill on Lot 32 would back up surface waters to stand in City streets which would be injurious to theme that none of thea str ; ats in tho area draining into this property have diverted water onto this property which otherwise would not have gone onto it . ThCity Engineer explained that Lo e t s 75 thru 31 ;were on the lowest area of this entire drainage shed and that there was no place for surface waters to drain out , and that they pond on these lots and the lots aetoss Idaho Avenue . Morris Klugman stated that they would dig a ditch on the east side of Lot 02 if the City Engineer would make the plans for same , It was movod by Councilman Howard seconded by Council - man Thiel , that the City Council approve the action of the Building Inspector , placing hold order on Lots 75 thru U01 , Richmond Addition and -the stop order on Lot 82 to be released when proper drainage is re - stablished .
