CALL TO ORDER I A regular meeting of the City Council was called to order by Mayor Kenneth Wolfe at 0:03 p.m. 2. INVOCATION Invocation was given by Rev. Stewart N. Dale of the First Lutheran Church, 3. ROLL CALL The followinu Councilmen were present Robert Ehrenberg Curtis Pearson D. C. Messer Robert Shank Leonard Thiel Kenneth Wolfe at roll call. Also present were the City Manager, City Attorney, Director of Public Works, Planning Director and the Secretary. Councilman Jorvig arrived at 8:10 p.m. 4. MINUTES On motion of Councilman Pearson, seconded by Councilman Thiel, the,minutes of the regular meeting held February 27, 1961, as amended - (7g to read as follows: "Second reading of iding the removal of Snow, Ice and proposed Ordinance prov Rubbish from Sidewalks, the elimination of Weeds from Public and Private Property, the repair of Sidewalks and the collection of costs of such work when done by the City as Special Assess- mints against the property benefited") (Add to 3b as follows: 'tl►s an alternate to the denial, setting hearing on this matter was discussed") , were approved by a six yea vote. GARRISON* (CASE ) Mayor Wolfs opened the hearing on -this matter. The following persons were present at the meeting: Mr. Spry, Administrator of Methodist Hospital, requesting information . Mr. Allan Garrison in favor of request, Mayor Wolfe declared -the hearing closed. It was moved by Councilman Pearson, seconded by Councilman Jorvig, to waive first reading of proposed ordinance and to set date for second reading on March 131 1961. Motion passed by a seven yea vot`. (b) PROPOSED TEMPORARY PAVING IMPROVEMENT N0. 60-77 (BEST 29TH STREET, ALABAMA AVENUE TO BLACKSTONE AVENUE), AS D DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 16 AND 23, 1961; ALSO PETITION FROM RESIDENTS IN AREA. May.?or Wolfe Openjd the hearing on this matter. Mrs. V. P. Olsen, 2032 Alabama Avenue, and others were present at the meeting. Mrs. Olsen referred to petition, on hand, in opposition signed by Vernon P. Olsen, 2832 LUabama Avenue and others. Mayor Wolfe declared the hearing closed. It was moved by Councilman Jorvig, seconded by Councilman Thiel, that petition be denied. Motion passed by a vote of six yeas and one nay. Councilman Messer voting nay. Discussion was had regarding notification to property owners when improvement hearings are to be held. It was moved by Councilman Pearson, seconded by Councilman Jorvij, that the City Manager b2 directed to make study and report as to the feasibility and method of notification regarding hearing on improvements. (c) PROPOSED TEMPORARY PAVING IMPROVEMENT NO. 6044 (West 29TH STREET, OREGON AVENUE TO PENNSYLVANIA AVEME), AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 16 AND 233 1961. Mayor Wolfe opened the hearing on this matter. Mr. Richard Loftus, 2900 Louisiana Avenue, was present at the meeting and inquired as to the method of assessment, The City Manager mentioned that this would be a one half block assessment and maybe should be set up as an area project, It was moved by Councilman Jorvig, seconded by Councilman Messer, that the hearing be adjourned to March 20, 1961. Motion passed by a vote of six yeas and one nay. Councilman Ehrenberg voting nay. (d) PROPOSED TEMPORARY PAVING IMPROVEMENT NO. 60-86 (VIRGINIA CIRCLE NORTH FROM XYLON AVENUE TO VIRGINIA CIRCLE SOUTH AND ALL OF VIRGINIA CIRCLE SOUTH) AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 16 AND 23, 1961. Mayor Wolfe opened the hearing on this matter. Mr. H. Wittenberg, 2419 Xylon Avenue, was present and discussed with the Council the period of assessment payments. Mayor Wolfe declared the hearing closed. It was moved by Councilman Ehrenberg, seconded by Councilman Shank, to waive reading and adopt t'Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No. 604611. Motion lost by a vote of five yeas and one nay. Councilman Pearson voting nay and Councilman Jorvig abstained from voting. Mayor Wolfe declared the motion lost as same requires six affirma- tive votes. It was moved by Councilman Pearson, seconded by Councilman Messer, to reconsider the above motion. Motion passed by a seven yea votes Council Thiel requested that the minutes show that this project approved is based on 20 year assessment. (e) PROPOSED TEMORARY PAVING IMPROVEMENT NO. OHIG(VERNON AVENUE FROM SOUTHERLY RIGHT-OF-WAY LINE TRUNK HWAY NO:, 12 TO A POINT 1286 FEET SOUTH) AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 16 AND 23, 1961. Mayor Wolfe opened the hearing on this matter. No j one present was interested in this matter. Mayor Wolfe declared the hearing) closed. RESOLUTION NO. 1638 It was moved by Councilman Messer, seconded by Councilman Thiel, to waive reading and adopt Resolution No. 1638, entitled "Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No. 60-101". Motion passed by a vote of six yeas-. Councilman Pearson out of the room when vote was taken. Mayor Wolfe opened the hearing on this matter. No one present was interested in this fatter. Mayor Wolfe declared the hearing closed. RESOLUTION NO, 1639 It was moved by Councilman Thioal, seconded by Councilman Jorvig, to waive reading and adopt Resolution No. 1639, entitled "Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No. 60=127". Motion passed by a six yea vote. RESOLUTION N0. 1641 It was moved by Councilman Jorvig, seconded by Councilman Messer, to waive reading and adopt Resolution No. 1641, .ntitled "Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No. 60-1301' . Motion passed by a six yea vote. Councilman Pearson out of the room when the vote was taken. The following persons were present in opposition: Mrs. Block, 3339 Gorham Avenue; Mrs. D. L. Olson, 3358 Brownlow Avenue; Mrs. H. Maul, 3343 Gorham Avanue and Kenneth Dubbe, 3360 Brownlow Avenue. There was discussion as to whether this alley shoulti be open to truck traffic and whether residential property required concrete alley. It was moved by Councilman Pearson, saconded by Councilman Jorvig, that the Council approves S.F. 872 Evidences of Collusive Bidding. Motion passed by a seven yea vote. Ma;ior Wolfe reported Legislation meetings. 9. UNFINISHED BUSINESS on the Metropolitan Sewer (a) REPORT OF THE CITY ATTORNEY ON LAND ACQUISITION (DEFERRED FROM FE BRUPIRY 27, 19 61) . It was moved by Councilman Pearson, seconded by Councilman Thial, authorizing the Mayor and City Manager to execute amendment of Easement No. 9, dated December 41 1939, filed January 3, 1940, pertaining to parking lot facilities at Carpenter Park.
