MINUTES OF CITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
September 14, 1959
1. CALL TO ORDER
A regular meeting of the City Council was called to order by
President Pro Tem Jorvig at 8 p.m.
2. INVOCATION
Invocation was given by Rabbi Moses Sach of the Bnai Abram
Church.
3. ROLL CALL
The following Councilmen were present at roll call:
H. C. Davis
Robert Ehrenberg
Torval Jorvig
D. C. Messer
Ed. Owen
Kenneth Wolfe
Also present were the City Manager, City Attorney, Director of
Public Works, Planning Consultant, Supervisor of Zoning and Inspection,
City Assessor and the Secretary.
4. MINUTES
On motion of Councilman Ehrenberg, seconded by Councilman Owen,
the minutes of meeting held September 8, 1959, were approved by a six
yea vote.
5. PUBLIC HEARINGS
(a) PROPOSED SPECIAL ASSESSMENTS FOR IMPROVEMENTS COMPLETED WITHIN
_ THE CITY, AS-DESCRIBED- IN NOTICE OF HEARING PUBLISHED AUGUST 27,
1959, WATERMAIN IMPROVEMENT NOS. 58-66, 58-72, 58-73 and 57-47.
President Pro Tem Jorvig opened the hearing on this matter.
No one present was interested in this matter. President Pro Tem
Jorvig declared the hearing closed.
RESOLUTION NO. 1071
. It was moved by Councilman Wolfe, seconded by Councilman
Messer, to waive reading and adopt Resolution No. 1071, , entitled,
"Resolution Adopting Assessment" (Impr. Nos. 58-66, 58-72, 58-73
and 57-47) . Motion passed by a six yea vote.

6. PETITIONS, REQUESTS AND COMMUNICATIONS
(a) COMMUNICATION FROM THE CITY COUNCIL OF HOPKINS, MINNESOTA
CONCERNING DISPOSAL OF HOPKINS REFUSE AND GARBAGE IN THE ST.
LOUIS PARK INCINERATOR. -
It was moved by Councilman Wolfe, seconded by Councilman
Messer, that this matter be referred to the City Manager to
® communicate to the Hopkins Council that this Council is favor-
`� ably interested in this proposal. Motion passed by a five yea

(b) COMMUNICATION FROM JAMES J. BURY CONCERNING ASSESSMENT OF NORTH-
SIDE MAIN TRUNK SEWER.
It was moved by Councilman Ehrenberg, seconded by Councilman
Messer, that this matter be referred to the Law Department for
recommendation. Motion passed by a five yea vote. Councilman
Davis not present when vote was taken.
(c) COMMUNICATION FROM JOHN W. BRENNER, JR. RELATIVE TO ASSESSMENT
OF NORTHISDE MAIN TRUNK SEWER.
It was moved by Councilman Ehrenberg, seconded by Councilman
Owen, that this matter be referred to the Law Department for
recommendation. Motion passed by a five yea vote. Councilman
Davis not present when vote was taken.
(d) COMMUNICATION FROM DOROTHY R. SPEICER CONCERNING TAXES ON PROPERTY
AT 3737 OTTAWA AVENUE.
It was moved by Councilman Wolfe, . second by Councilman
Messer, that this matter be referred to the City Manager for
report. Motion passed by a five yea vote. Councilman Davis not
present when vote was taken.
7. RESOLUTIONS AND ORDINANCES
(a) RESOLUTION SETTING ANNUAL SERVICE CHARGE FOR COLLECTION OF
GARBAGE FROM DWELLINGS.

RESOLUTION NO. 1072
It was moved by Councilman Wolfe, seconded by Councilman
Messer, to waive reading and adopt Resolution No. 1072, entitled,
"Resolution Setting Annual Service Charge for Collection of
Garbage From Dwellings". Motion passed by a five yea vote.
Councilman Davis not present when vote was taken.
(b) RESOLUTION LEVYING ASSESSMENT FOR COLLECTION AND DISPOSAL OF
GARBAGE AND REFUSE.
RESOLUTION NO. 1073
It was moved by Councilman Wolfe, seconded by Councilman Messer
to waive reading and adopt Resolution No. 1073, entitled,
"Resolution Levying Assessment for Collection and Disposal
of Garbage and Refuse". Motion passed by a five yea vote.
Councilman Davis not present when vote was taken.
8. REPORTS OF OFFICERS. BOARDS AND COMMITTEES
(a) REPORT OF CITY ACTIVITIES FOR AUGUST 1959 - BY THE CITY MANAGER.
On hearing no objections the President Pro Tem Jorvig
ordered the report received for filing.
(b) MINUTES OF PLANNING COMMISSION MEETING HELD SEPTEMBER 2, 1959.
On hearing no objections the President Pro Tem Jorvig
ordered the minutes received for filing.
(c) REPORT OF THE PLANNING COMMISSION (CASE NO. 59-27-S) RECOMMEND-
ING FAVORABLY UPON THE REQUEST OF M. P. JOHNSON FOR APPROVAL OF
FINAL PLAT OF KNOLLWOOD COUNTRY CLUB ADDITION.
John Balich was present in support of the request.
It was moved by Councilman Davis, seconded by Councilman
Ehrenberg, that action on this matter be deferred until September
21, 1959 and that the City Manager be directed to contact developer
regarding the deeding to the City Outlot No. 1. Motion passed
by a six yea vote.
(d) REPORT OF THE PLANNING COMMISSION (CASE NO. 59-92-S) RECOMMENDING
FAVORABLY UPON THE REQUEST OF WILLIAM WYNN FOR APPROVAL OF THE
PRELIMINARY PLAT OF WYNN'S SECOND ADDITION.

ING FAVORABLY UPON THE REQUEST OF ADOLPH FINE FOR APPROVAL OF THE
PRELIMINARY PLAT OF TEXA-TONKA TERRACE ADDITION.

COMMENDING FAVORABLY UPON THE REQUEST OF THE PARKS AND RECREATION
ADVISORY COMMISSIOItO MODIFY THE PARK PLAN BY ADDING LOTS 2, 3
AND 8, BLOCK 1, TUXEDO PARK, TO THE PROPOSED FERN HILL PARK.
Robert Corvine was present at the meeting.
It was moved by Councilman Ehrenberg, seconded by Councilman
Wolfe, that the Park Consultant go ahead with plans as ordered,
excluding Lot 8, Block 1; Tuxedo Park. '
It was moved by Councilman Owen, seconded by Councilman
Wolfe, that the above motion be tabled until Septeffiber 21, 1959.
Motion passed by a six yea vote.
(j) REPORT OF THE PLANNING COMMISSION(CASE NO. 59-110-MISC.) RECOMM-
ENDING FAVORABLY UPON THE REQUEST OF TEE PARKS AND RECREATION
ADVISORY COMMISSION FOR ACQUISITION OF LOTS 4 THROUGH 9, AND
PART OF LOT 53, BLOCK 291, REARRANGEMENT OF ST. 1.,OUIS PARK FOR
EXPANSION OF OAK HILL PARK.
Robert Corvine was present at the meeting.
_ It was moved by Councilman Messer, seconded by Councilman
Owen, to direct the Law Department to prepare resolution auth-
orizing acquisition by eminent domain of addition to Oak Hill
Park.
It was moved by Councilman Davis, seconded by Councilman
Owen, that the above motion be tabled until September 21, 1959.
Motion passed by a six yea vote.
(k) REPORT OF THE PLANNING COMMISSION (CASE NO. 59-111-MISC.) RE-
COMMENDING FAVORABLY UPON THE REQUEST OF THE PARKS AND RECREATION
ADVISORY COMMISSION TO MODIFY THE PARK PLAN BY RELOCATING NORTH-
SIDE PARK (NOW ON LOTS 7 AND 8, HOME ADDITION) ON LOTS 3 and 4,

GOD WARD, CONSULTING ENGINEER FOR REES-THOMSON, CONCERNING
PARK ACQUISITION OF BASS LAKE.
It was moved by Councilman Ehrenberg, seconded by Council-
man -Owen, to defer action on this matter until receipt of report
from Parks and Recreation Advisory Commission. Motion passed
by a five yea vote. Councilman Davis not present when vote was
taken.
(v) REPORT OF THE PLANNING COMMISSION (CASE NO. 59-125-MISC.) RE-
COMMENDING FAVORABLY UPON THE REQUEST OF ROBERT G. CORWINE THAT
THE CITY ACQUIRE FROM THE ST-. LOUIS PARK SCHOOL BOARD THE SOUTH-
ERLY 30 FEET OF THEIR PROPERTY FROM THE GREAT NORTHERN RAILROAD
RIGHT-OF-WAY TO XYLON AVENUE AS ACCESS TO AQUILA PARK.
It was moved by Councilman Wolfe, seconded by Councilman
Messer, -to authorize the City hanager and Law Department to,
negotiate with the School Board for acquisition of 30 feet for
- street purposes. Motion passed by a six yea vote.
(w) -REPORT OF THE PLANNING .COMMISSION (CASE NO. 59-105-VAC) REm
COMMENDING FAVORABLY UPON THE REQUEST OF ROY F. PORTER AND
OTHERS TO VACATE WEST 31ST STREET FROM RHODE ISLAND AVENUE TO

IN THE VICINITY OF THE -NEW JUNIOR HIGH SCHOOL (REQUESTED AUGUST
24, 1959) .
It was moved by Councilman Ehrenberg, seconded by Councilman
Wolfe, that the City Attorney be directed to prepare a Resolution
directing the Director of Public Works to prepare preliminary
plans for-construction of sidewalk. Motion passed by a five yea
vote. Councilman Davis not present when vote was taken.

for detailed study, for size and locations for off-street parking.

Messer, to waive first reading of proposed ordinance amending the
St. Louis Park Code relating to nomination petitions-for city -
elections,- Section-1:1066, Entitled "Nomination by Petition", and
to set date for second reading on September 21, 1959. Motion
passed by a five yea vote. Councilman Davis not present when vote
was taken.
It was -moved by Councilman Ehrenberg; senonded by Councilman
Messer, to waive first reading of proposed ordinance amending the
St. Louis Park Code relating to "Primary City Elections" Section
1:1063, entitled"Primary Elections", and to set date for second
reading on September 21, 1959. Motion passed by a five yea,vote.

9. UNFINISHED BUSINESS - -
(a) ALIGNMENT OF TRUNK- HIGHWAY NO. 169. -
Planning Consultant gave a talk and showed maps- of the
- proposed alignment of Trunk Highway No. 169.
It was moved by Councilman Messer, seconded by Councilman
Ehrenberg, that the Council approve the plan,as outlined for
No. 169,recommended by Planning Commission, and refer them to
Edina and Hopkins Councils for their consideration and a future

RESOLUTION NO. 1081
It was moved by Councilman Wolfe, seconded by Councilman
Messer, to waive reading and adopt Resolution No. 1081, entitled,
"Resolution Modification in Proceedings in Condemnation of Ease-
ments for Relief Ditch Authorized by Resolution No. 448". Motion
passed by a six yea vote.
(c) RE: CONDEMNATION FOR 26th STREET - ATTORNEY E. T. MONTGOMERY SPOKE.
It was moved by Councilman Messer, seconded by Councilman
Wolfe, authorizing E. T. Montgomery, attorney for the City in
condemnation proceedings entitled, "City of St. Louis Park vs
Bankers Life Etal", to change Parcel 9(b) to provide for taking
the South 25 feet of the East 250 feet of the West 580.7 feet
of that part of S4 of SE4, of NEL-1- of Section 8, Township 117,
Range 21 lying South of the Great Northern Railroad Right of Way,
in place of taking the South 33 feet of the said tract as provid-
ed in the original petition. Motion passed by a six yea vote.
(d) RE: PERMIT FROM GREAT NORTHERN RAILROAD.
It was moved by Councilman Ehrenberg, seconded by Councilman
Wolfe, that Permit No. 65374, dated August 24, 1959, for the in-
stallation of 12 inch water line under the Great Northern Railroad
Tracks in St. Louis Park be approved and that the Mayor and City
Manager be authorized to execute same for the City. Motion passed
by a five yea vote. L'ouncilman Davis not present when vote was
taken.

(a) DAMAGE CLAIMS
1. Sylvan Levitan, 1647 Ford Road (referred to L. D. September
10, 1959) .
It was moved by Councilman Ehrenberg, seconded by Councilman
Messer, that the claim be referred to the Law Department for advice
and recommendation. Motion passed by a five yea vote. Councilman

12. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS
(a) Verified Claims
On motion of Councilman Wolfe, secondedby Councilman
Ehrenberg, the lists of verified claims prepared by the
Director of Finance and presented to the Council, dated
September 14, 1959, in the total amounts of $2,204.92 for
payroll, and $16,955.76 for vendors were approved, and the
City Manager, City Clerk, and City Treasurer were authorized
to issue checks covering same, by a roll call vote of five
yeas.
13. ADJOURNMENT
On motion of Councilman Ehrenberg, seconded by Councilman
Wolfe, the meeting was adjourned to 4 p.m., September 15, 1959,
at 12:15 a.m., by a five yea vote. Councilman Davis not
present when vote was taken.
