MINUTES OF COUNCIL MEETING — APRIL 6. 1959
A regular meeting of the City Council was called to order by Mayor
Herbert P. Lefler at 8 pi m.
Invocation was given by Rev. Herman Soderberg of the Church of Reform—
ation.
The::following Councilmen were present at roll call:
Robert Ehrenberg
Torval Jorvig
D. C. Messer
Ed Owen
Kenneth Wolfe
Herbert P. Lefler
Also present were the City Manager, City Attorney, Director of Public Works
and the Secretary.
Councilman Davis arrived at 8:03 p. m.

On motion of Councilman Messer, seconded by Councilman Ehrenberg, the
minutes of meeting held March 30, 1959, were approved by unanimous vote of
all members. of the Council present.
Public Hearing on Proposed Rezoning — Wm. Ecoff (Case No. 59-17—Z) — 5a
Public hearing was had on proposed rezoning of that part of the SE4 of
Sid of Section 30, Township 29, Range 24, as, described in Notice of Hearing pub—
lished March 19, 1959 (south side Cedar Lake Road between Ottawa and Princeton
Avenues) from Residential and Light Industrial Use District to Multiple Dwell—
ing Use District and from "C" to "D-4" Density District, requested by Wm. B.
Ecoff (Case No. 59-17—Z) .
No one appeared in opposition.
Wm. B. Ecoff was present in support of the above request. Leon Maanum of
4905 Cedar Lake Road was also present in favor of this request. --
Mayor Lefler declared the hearing closed.
A motion was made by Councilman Ehrenberg, seconded by Councilman Owen,
to waive first reading of ordinance and to set date for second reading on
April 13, 1959. Motion passed by unanimous vote of seven members of the
Council present.
Request by E. G. Clinton Company — 6a
Request for preliminary approval of exterior finish building materials
on appeal from denial of request by Building Inspector by E. G. Clinton Company
was presented to the Council.
Mr. A. L. Toepel was present in support of this request.

Councilman Davis made a motion, seconded by Councilman Ehrenberg, to con-
cur with the recommendation of the Building Inspector and deny the request for
a building permit at approximately 2700 Louisiana Avenue, based on the plans
submitted, with the right of the E. G. Clinton Company to submit new plans to
the building Inspector for approval. Motion passed by a vote of six ayes with
Mayor Lefler voting nay.
Resolution Amending Personnel Rules Etc. Public Health Officer - 7a
Resolution amending personnel rules and regulations, Position Classifi-
cation Assignment Table (Public Health Officer) was presented to the Council.

RESOLUTION NO. 811
® A motion was made by Councilman Ehrenberg, seconded by Councilman Wolfe,
to waive reading and adopt Resolution No. 811, entitled, "Resolution Amending
Personnel Rules And Regulations, Position Classification Assignment Table".
Motion passed by unanimous vote of seven Council Members present.
Resolution RegErding Hearing on Map of Future Streets Etc. -- 7b
Resolution receiving and calling hearing on map of future streets or other
public use (Block 2Minikanda Vista 2nd Addition --deferred from March 9, 1959)
was presented to the Council.
RESOLUTION NO. 812
It was moved by Councilman Ehrenberg, seconded by Councilman Owen, to
waive reading and adopt Resolution No. 812, entitled, "Resolution Receiving i
Calling Hearing on Map of Future Streets or Other Public Use (Proposed West-
moreland Street and West 36 1/2 St.)". Motion passed by unanimous vote of all
members of the Council present.
Second Reading of Proposed Ord. by Kenneth Cronstrom (Case No. 58-126-Z) - 7c
The proposed ordinance Amending the Zoning Ordinance (requested by Kenneth
Cronstrom - Case No. 58-126-Z) was presented for second reading.
Attorney W. F. Thiel was present, representing petitioner Kenneth Cron-
strom. - - -
- On motion of Councilman Wolfe, seconded by Councilman Messer, action was
deferred until April 13, 1959 in order to determine if the Planning Commission
&' Planning Consultant would approve the extension of Lynn Avenue, south of
36th Street as indicated with red lines on sketch left by Attorney W. F. Thiel,
by unanimous vote of seven Council Members present.
Second Reading of Proposed Ord. by Vincent Johnson (Case No. 58-864) - 7d
The proposed ordinance (as amended) Amending the Zoning Ordinance (requested
by Vincent Johnson - Case No. 58-86-Z) was presented for second reading.
On motion of Councilman Davis, seconded by Councilman Jorvig, action was
deferred until April 27, 1959, by unanimous vote of seven members of the Council
present. •

Second Reading of Proposed Ord. requested by Benn Harasyn (Case No. 59-16-Z)-7e
The proposed ordinance Amending the Zoning Ordinance requested by Benn
Harasyn - Case No. 59-16-Z) was presented for ,second reading.
Benn Harasyn was present in support of this request.
ORDINANCE NO. 678
A motion was made by Councilman Ehrenberg, seconded by Councilman Jorvig,
to_waive second reading and adopt Ordinance--N . 678,- entitled; "Ari Ordinance
Amending the •Zoning Ordinance of the City of St. Louis -Park". Motion passed by
unanimous vote of seven Council Members present.
On motion of Councilman Ehrenberg, seconded by Councilman Messer, a special "'
permit was granted to allow a two family dwelling in "C" Density District on Lot a"
28, Block 2, Del Monte Heights Addition. Motion passed by unanimous vote of all
members of the Council present.
Second Reading of Proposed Ord. by Charles Freidheim (Case No. 59-6-Z) - 7f
The proposed ordinance Amending the Zoning Ordinance requested by Charles
M. Freidheim (Case No. 59-6-Z) was presented for second reading.

C. K. Eckerstrom, 4914 Cedar Lake Road, was present and expressed
opposition to the Public Garage proposed to be built on property in question.
Also present in support of the request were J. Ryland representing
Charles Freidheim , Charles Freidheim Jr. and a representative of the Archie
Walker Company.
ORDINANCE NO. 679
A motion was made by Councilman Ehrenberg, seconded by Councilman Wolfe,
to waive second- reading and adopt Ordinance No. 679, entitled, "An Ordinance
Amending The Zoning Ordinance Of The City Of St. Louis Park". Motion passed by
unanimous vote of seven members of the Council present. _
Report No. 10 Covering State Legislation - 8a
City Attorney report No. 10 covering state legislation introduced during
the period following the last report (deferred from March 30, 1959), was pre-
sented to the Council.
It was moved by Councilman Ehrenberg, seconded by Councilman Owen, that
the Council go on record as supporting S. F. No. 990. Motion passed by a four
aye vote, Councilmen Ehrenberg, Jorvig, Messer and Owen voting in favor and
Councilmen Davis and Wolfe and Mayor Lefler voting nay.
A motion was made by Councilman Davis, _seconded by Councilman Messer, that
the Council go on record as opposing S. F. No. 1092. Motion passed by unanimous
vote of seven Council Members present.
On motion of Councilman Davis, seconded by Councilman Wolfe, the Council
would go on record as supporting S. F. No. 1160, by unanimous vote of seven
Council Members present.
It was moved by Councilman Davis, seconded by Councilman Messer, that the
Council go on record as opposing H. F. No. 1146. Motion passed by unanimous
vote of seven members of the Council present.
A motion was made by Councilman Davis, seconded by Councilman Wolfe, that
the Council go on record as opposing H. F. No. 1261. Motion passed by unanimous

vote of seven members of the Council present.
A motion was made by Councilman Jorvig, seconded by Councilman Owen, that
the Council go on record as supporting H. F. No. 1269. Motion passed by a six
aye vote, Councilman Ehrenberg abstaining.
Councilman Davis left at 10:55 p. m.
It was moved by Councilman Jorvig, seconded by Councilman Ehrenberg, that
the Council go on record as supporting H. F. No. 1277. Motion passed by a six
yea vote of the Council Members present.

A motion was made by Councilman Messer, seconded by Councilman Jorvig, that
the Council go on record as opposing H. F. No. 1293. Motion passed by unanimous
C:.4 vote of six members of the Council present.
Report No. 11 Covering State Legislation — 8b
_ City Attorney report No. 11 covering state legislation introduced during
the period following the last report, was presented to the Council.
A motion was made by Councilman Ehrenberg, seconded by Councilman Wolfe,
that the Council go on record as opposing H. F. No. 1440. Motion passed by
unanimous vote of six members of the Council present.
Preliminary Report of Director of Public Works. Improvement No. 59-18 — 86
Preliminary report of the Director of Public Works and endorsement of the
City Assessor with respect to petitioned grading and incidental storm sewer,
Improvement No. 59-18, was presented to the Council.
On motion of Councilman Wolfe, seconded by Councilman Jorvig, action on
this matter was deferred until a new report is received from the Director of
Public Works, by unanimous vote of six members of the Council present.
Preliminary Report of Director of Public Works. Improvement No. 59-16 — 8d
Preliminary report of the Director of Public Works and endorsement of the
City Assessor with respect to petitioned was main, Improvement No. 59-16, was
presented to the Council
On motion of Councilman Wolfe, seconded by Councilman Jorvig, action on
this matter was deferred until a new report is received from the Director of
Public Works, by unanimous vote of six members of the Council present.

Consideration of Proposed State Legislation — 9a
It was moved by Councilman Messer, seconded by Councilman Jorvig, that the
Council go on record as supporting H. F. No. 1693. Motion passed by unanimous
vote of six Council Members present. -
A motion was made by Councilman Messer, seconded by Councilman Jorvig, that
„the Council go on record as supporting S. F. No. 1504. Motion passed by unani—
mous vote of six members of the Council present.

Financial Report of City For February 1959 - 8e
Financial report of the City for February 1959 was presented by the
City Manager.
On hearing no objections, Mayor Lefler ordered the report received for
filing.
Report of Planning Commission (Case No: 59-5-SP) - 9b
Report of the Planning Commission (Case No. 59-5-SP) recommending favor--
ably with conditions upon the request of Charles M. Freidheim for special per-
mit under authority of Section 10.3-18 of the Zoning Ordinance to use the
property at Highway No. 100 (east side between old and new Cedar Lake Road) for
a public garage (deferred from March 30, 1959), was presented to the Council.
After considerable discussion, on motion of Councilman Davis, seconded by
Councilman Jorvig, this matter was tabled for one week, by a five aye vote,
Councilmen Ehrenberg and Owen voting nay.
On motion of Councilman Davis, --se-conded by Councilman Wolfe, the 'Law
Department was directed to prepare resolution which would approve special per-
mit with condition under authority of Section 10.3-18 to use the property at High-
way No. 100 (east side between old and new Cedar Lake Road) for a public garage:
1. That the signs, billboards or other advertising media to be erected
and used to advertise this business, be restricted to four square feet sign
area for each foot of frontage of building area facing east along interchange
of Highway No. 100 and Cedar Lake Road and excluding any frontage that faces
northerly or southerly, -
2. That a front yard setback of not less than 30 feet be maintained on
the property from Trunk Highway No. 100 to the underpass and fhat no planting
exceeding three feet in height be permitted therein,
3. That the driveway entrances be as shown on Exhibit "A",
4. Location and size of any used car lot be approved by the City Manager
with consideration given to traffic and influence on adjacent property values,
5. _That the driveway leading to the sales area with'the building be not
less than 20 feet from the right of way line.
Motion passed by unanimous vote of seven.members of the Council present.
Award of Contract for Sanitary Sewer. Etc. Improvement No. 59-32 - 9c
The tabulation of bids for sanitary sewer, lift station revisions, water-
mains and services, Improvement No. 59-32 (southwest area) was received from
the consulting engineer.
RESOLUTION NO. 813
A motion was made by Councilman Davis, seconded by Councilman Jorvig, to
waive reading and adopt Resolution No. 813, entitled, "Resolution Accepting Bid
For Sanitary Sewer, Lift Station Revisions, Watermains 'and Services, Improvement
No. 59-32" and authorizing the Mayor and the City Manager to execute the contract
in behalf of the City. Motion passed by unanimous vote of seven Council Members.

Appointment of Ellen Z. Fifer. Public Health Officer — 10a
On motion made by Councilman Owen, seconded by Councilman Wolfe, the
Council gave its consent and approval to the City Manager's appointment of Ellen
Z. Fifer as Probationary Public Health Officer, 1/4 Part Time, effective April
20, 1959, by unanimous vote of six members of the Council present.
Damage Claim%bv Flour City Trunk Company and Donald C. Schmidt — ila
A motion was made by Councilman Ehrenberg, seconded by Councilman Jorvig,
to refer the damage claim of Flour City Trunk Co. , 4601 Highway No. 7 (referred
I.:: to Law Department March 31, 1959) to the Law Department for advice and recommend—
ation. Motion passed by unanimous vote of six members of the Council present.

A motion was made by Councilman Ehrenberg, seconded by Councilman Jorvig,
.1f to refer the damage claim of Donald C. Schmidt, 1601 Maryland Avenue(referred to
CI.. Law Department April 1, 1959) to the Law Department for advice and recommenda—
tion. Motion passed by unanimous vote of six members of the Council present.

Verified Claims — 12
On motion of Councilman Messer, seconded by Councilman. Jorvig, the lists
of verified claims prepared by the Director of Finance and presented to the
Council, dated April 6, 1959 in the total amount of $19,499.65 for vendors
were approved, and the City Manager, City Clerk, and City Treasurer were auth—
orized to issue checks covering same, by unanimous vote of six members of the
III Council_present. . _

On motion of Councilman Wolfe, seconded by Councilman Ehrenberg, the
meeting was adjourned at-11:40 p. m., by unanimous vote of six members of the
Council present.
