LOUIS PARK, MINNESOTA December 19,' 1959 The aijourned meeting of December 14, 1959 was called to order by Mayor Herbert P. Lefler at 8:15 a.m. The following Councilman were present: He Ca Davis Robert Ehrenberg Torval Jorvig Po Ce Messer Ed Owen Kenneth Wolfe • Herbert P. Lefler Also present were the City Manager, Planning Consultant, City Attorney , ' and the Secretary° • •Citizens present were Tom Renner, Jerry Bylund and Charles f reidheim Jr. of ;' Text changes proposed during the hearings of the St. Louis Park Zoning Ordinance 1959 were discussed. Section 6:0424 It was moved by Councilman Davis, seconded loy Councilman Ehrenberg, that Se.xtion 6:04204 be amended by striking out "lawful non—conforming and that 50% be increased to 60%he Motion passed by a seven yea vote. Section 6:042,1 It was moved loy Councilman Wolfe, seconded ty Councilman Messer, that "Structures" be taken out of heading and have section read as follows: ' any use of lands or structures lawfully existing upon the effective date of this ordinance may be continued at the size and in a manner of operation existing upon such date except as hereinafter specified". Motion passed by a seven yea vote. Section 6:0427 It was moved by Councilman Ehrenberg, seconded by Councilman Davis, that Section 6:04207 read as follows: "Any structure for which a building permit has been lawfully granted prior to the effective date of this ordinance or amendments thereto, may be completed in accordance with the approved plans: provided construction is started within 90 days of the 9 effective date". Motion passed by a seven yea vote. 111 II_ Council Minutes December 19, 1959 Section 6:032.45 It was moved by Councilman Davis, seconded by Councilman Ehrenberg, that the definition of Uses - Non Conforming read as follows: "Any building or land lawfully occupied by a use at the time of the passage of this ordinance or on amendments thereof which does not conform after the passage of this ordinance or on amendment thereto with the use re- gulations of the district in which it is located". Motion passed by a seven yea vote. - Section 6:041 It was moved by Councilman Davis, seconded by Councilman Ehrenberg, to add, after word Ordinance in first line - "Except as in this ordinance specifically provided". Motion passed by a seven yea vote. Section 6:03239 It was moved by Councilman Davis, seconded by Councilman Messer, that definition given in Section 6:032039 be deleted from ordinance. Motion passed by a seven yea vote. Section 6:042.6 It was moved by Councilman Ehrenberg, seconded by Councilman Davis, to change amount to $500000 and strike out "The above regulation shall apply to signs and billboards which if not brought into conformance, shall be removed from the site". Motion passed by a seven yea votes It was moved by Councilman Wolfe, secondee: by Councilman Messer, to change to 48 monts in Section 6:042.6. Motion passed by five yeas and two nays. Councilman Ehrenberg and Councilman Jorvig voting nay. Section 6:042010 It was moved by Councilman Ehrenberg, seconded by Councilman Jorvig, to strike out "when they will improve the livability thereof" and "or bulk of the building". Motion passed by a seven yea vote. �r 112 12�.' 111 Council Minutes December 19, 1959 Section 6:045.2 Sub. 1 It was moved by Councilman Davis, seconded by Councilman Messer, to ada the following: "Yard lights, and name plate signs for one and two family dwellings in the R-1, R-2 and R-3 Districts. Floodlights or other sources of light illuminating authorized illuminated signs, or rilluminating parking areas, loading areas, or yards for safety and security purposes, provided the direct source of light is not visible from the public right of way of adjacent residential property'. Motion , passed by a seven yea vote. Section 6:045.2 Sub. 2 It was moved by Councilman Messer, seconded by Councilman Wolfe, to strike out word "and" in second line after "height" and add in third line after extend "more than two and one-half (22) feet" and add 'at er . of Sub. 2 "Flag poles, bird baths and other ornamental features 'de- tached from principal building". Motion passed by a seven yea vote,. Section 6:044.3 II{J .ro i It was moved by Councilman Davis, seconded by Councilman Messer, 11 to change "An accessory" to read "A detached". Motion passed by a seven yea vote. Section 6:045.3 It was moved by Councilman Ehrenberg, seconded by Councilman Jorvig, in first line add "or sideyard" and strike out "of an interior lot and no Front yard or gide yar4 abbitting b i a street of a ceiriner lot". Motion passed by a seven yea vote. Section 6:046 It%was moved by Councilman Ehrenberg, seconded by Councilman Jorvig, to change reference to F:162.3 to 6:172.3. Motion passed by a seven yea vote. Section 6:048 It was moved by Councilman Ehrenberg, seconded by Councilman Jorvig, to change 600 sq. feet to 540 square feet. Motion passed by a vote of six yeas and one nay. Councilman Wolfe voting nay. 1 5 1,i'a A Council Minutes December 19, 1959 Section 6:049 It was moved by Councilman Messer, seconded by Councilman Jorvig, that in first paragraph leave out letter "B"o Motion passed-.by a seven yea votes Section 6:049°6 It was moved by Councilman Ehrenberg, seconded by Cpuncilman Owen, that Section 6:049.6 read as follows: "all delivery service entrances to a building in the "R-B" and "B-1" districts shall be from a public alley, service alley, -off street parking lot, or all deliveries shall be madeffrom the curb" Motion passed by a seven yea vote. Section 6:049-7 A motion was made by Councilman Ehrenberg, seconded by Councilman Owen to add "In "B" and "I" districts". Motion passed by a seven yea vote. Section 6:04908 It was moved by Councilman Ehrenberg, seconded by Councilman Owen, to read as follows: Section 6:049.8 - Land reclamation under this ordinance is the reclaiming of land by depositing of material so as to elevate the grade. Land reclamation shall be' permitted only by special permit in all districts on any lot or parcel upon which four hundred (400) cubic yards of fill is to be deposited for land reclamation. The permit shall include as a condition thereof a finished grade plan which will not adversely affect the adjacent land, and as conditions thereof shall regulate the type of fill permitted, plans for rodent control, fire control, and general maintenance of the site and adjacent area and make provision for control of material dispersed from wind or hauling of material to or from the site. Motion passed by a seven yea vote. Section 6:049.9 It was moved by Councilman Wolfe, seconded by Councilman Messer, to read as follow: Section 6:04909 - The extraction of sand, gravel, or other material from the land in the amount of four hundred (400) cubic yards or more and removal thereof from the site without processing shall be mining, In all districts, the conduct of mining shall be permittee: only upon issuance of a special permit. Such permit shall include, as a condition thereof, a plan for a finished grade which will not adversely 113-A /73 - B . Section 6:049.10 It was moved by Councilman Ehrenberg, seconded by Councilman Owen, to read as follows: Section 6:049,10 - The operation of processing of sand, gravel, or other material mined from the land shall be permitted only by special permit and only in the "I-1" and "I-lei District. Such special permit shall include a site plan where the processing is to be done, showing the location of the plant, disposal of water, route of trucks, moving to and from the site in removing processed materials from the site, and in the 7eI-2°i District such permit shall not be granted for a period of longer than twelve months, Motion passed by a seven yea vote. Section 6:062.3 It was moved by Councilman Messer, seconded by Councilman Jorvig, that the entire section of 6:062.3 be deleted. Motion passed by a seven yea vote. Section 6:06405 It was moved by Councilman Wolfe, seconded by Councilman Messer, that side yard widths read as follows: Front Yard Iiie Yard Widths Rear Yark }- Depth Depth 35 feet ' 9 feet on one yard and 6 feet on other yard 35 feet except when there is an attached garage or when lot abuts an alley both may be 6 feet. 35 feet 9 feet on one yard and 11 feet on other yard 35 feet except when there is an attached garage, or when lot abuts an alley both may be 9 feet. Motion passed by six yeas and one nay. Councilman Ehrenberg voting nay. 113-B C. Il Council Minutes - December 19, 1959 i Section 6:07405 It was moved by Councilman Davis, seconded by Councilman Messer, that side yard widths be changed to read the same as in Section 6:06405 amended. Motion passed by a seven yea vote. Section 6:0$405 It was moved by Councilman Davis, seconded by douncilman Jorvig, that side yard widths be changed to read the same as in Section 6:064.5 amended.
