MINUTES OF CITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
October 26, 1959
1. CALL TO ORDER
A regular meeting of }the City Council was called to order by
Councilman Wolfe at 8 p.m.
2. INVOCATION
Invocation was given by Rev. K. Wester of the Cross of Christ
Lutheran Church.
2a. ELECTION OF PRESIDING OFFICER
A motion was made by Councilman Owen, seconded by Councilman
Ehrenberg, that Councilman Wolfe be elected as Temporary Presiding Officer.
Motion passed by a four yea vote.
3. ROLL CALL
The following Councilmen were present at roll call:
H. C. Davis
Robert Ehrenberg
D. C. Messer
Ed. Owen
Kenneth Wolfe
Also present were the City Attorney, Director of Public Works and
the Secretary.
4. MINUTES
On motion of Councilman Messer, seconded by Councilman Owen, the
minutes of regular meeting held October 19, 1959 and the adjourned
meeting of October 19 held October 21, 1959, were approved by a five
yea vote.
5. PUBLIC HEARINGS
(a) None

7. RESOLUTIONS AND ORDINANCES
(a) RESOLUTION AMENDING RESOLUTION NO., 937 ORDERING PREPARATION OF
PLANS AND SPECIFICATIONS, IMPROVEMENT NO. 59-25.
RESOLUTION NO. 1120
A motion was made by Councilman Messer, seconded by Councilman
Owen, to waive reading and adopt Resolution No. 1120, entitled,
"Resolution Amending Resolution No. 937 Ordering Preparation of Plans
Improvement No. 59-25". Motion passed by a five yea vote. Council-
man Davis not present when vote was taken.
(b) SECOND READING OF PROPOSED ORDINANCE REGULATING PARKING IN STREETS
BY PEDDLERS AND BAKERY PEDDLERS.
ORDINANCE NO. 724
A motion was made by Councilman Messer, seconded by Councilman
Owen, to waive second reading and adopt Ordinance No. 724, entitled,
"An Ordinance Regulating Parking in Streets by Peddlers and Bakery
Peddlers", as amended to read"20 minutes" instead of "10 minutes",
Motion passed by a five yea vote. Councilman Davis not present
when vote was taken.
(c) SECOND READING OF PROPOSED ORDINANCE AMENDING' THE ZONING ORDINANCE
(STORAGE OF GOODS, ETC. IN SETBACK AREA).
ORDINANCE NO. 725
A motion was made by Councilman Ehrenberg, seconded by Council-
man Jorvig, to waive second reading and adopt• Ordinance No. 725,
entitled, "An Ordinance Amending the Zoning Ordinance of the City
of St. Louis Park, No. 349, Adopted December 19, 1949, entitled ;_,,
"An Ordinance Amending the Zoning, Ordinance of the Village of Si.'
Louis Park". Motion passed-by a five yea vote. Councilman Davis
not present when vote was taken.

8. REPORTS OF OFFICERS. BOARDS AND COMMITTEES
(a) FINANCIAL REPORT OF THE CITY FOR SEPTEMBER 1959 - BY THE CITY MANAGER.
' On hearing no objections the Presiding Officer ordered the report
received for filing.

9. UNFINISHED BUSINESS
- (a) PROPOSED SPECIAL PERMIT UNDER AUTHORITY OF SECTION 10.3-25 OF
THE ZONING ORDINANCE FOR A BUILDING SERVING FOOD, SOFT DRINKS,
ETC. AT 4220 MINNETONKA BOULEVARD (LOTS 11, 12, 13, BLOCK 4,
SUNSET GABLES SECOND DIVISION, CASE NO. 59-78-SP, REQUESTED BY
BERNARD HOROVITZ, HEARING HELD SEPTEMBER 28, 1959, ACTION TABLED).
A motion was made by Councilman Davis, seconded by Councilman
Ehrenberg, that this matter be taken from the, table. Motion
passed by a five yea vote. Councilman Jorvig not present when
vote was taken.
A motion was made by Councilman Ehrenberg, seconded by Council-
man Davis, that action on this matter be deferred until November
2, 1959 and that a written report be received from Jim Hawks and also
that he pe present at the meeting. Motion passed by a five yea
vote. Councilman Jorvig not present when vote was taken.
(b) PROPOSED SPECIAL PERMIT UNDER AUTHORITY OF SECTION 10.1-9 OF THE
ZONING ORDINANCE TO USE RESIDENTIAL LAND ADJACENT TO COMMERCIAL
PROPERTY FOR PARKING AT 2921-2927 JOPPA AVENUE (LOTS 14 and 15,
BLOCK 4, SUNSET GABLES SECOND DIVISION, CASE NO. 59-113-SP, RE-
QUESTED BY BERNARD HOROVITZ, HEARING HELD SEPTEMBER 28, 1959,
ACTION TABLED). _ \ Ill
A motion was made by Councilman Davis, seconded by Councilman
Ehrenberg, that this matter be taken from the table. Motion
passed by a five yea vote. Councilman Jorvig not present when
vote was taken.

man Davis, that action on this matter be deferred until November
2, 1959 and that a written report be received from Jim Hawks and also

(c) REPORT OF THE PLANNING COMMISSION (CASE NO. 59-77-V) RECOMMENDING
FAVORABLY UPON THE REQUEST OF BERNARD HOROVITZ FOR A VARIANCE OF
SETBACK UNDER AUTHORITY OF SECTION 20.4 AND 20.5 OF THE ZONING
ORDINANCE FROM THE REQUIRED 20 feet TO 5 FEET AT 4220 MINNETONKA
BOULEVARD (LOTS 11, 12, 13, BLOCK 4, SUNSET GABLES SECOND DIVISION
(DEFERRED FROM OCTOBER 19, 1959).
A motion was made by Councilman Ehrenberg, seconded by Council-
man Davis, that action on this matter be deferred until November 2,
- , 1959 and that a written report be received from Jim Hawks and also
that he be present at the meeting. Motion passed by a five yea
vote. Councilman Jorvig not present when vote was taken.

10. NEW BUSINESS
(a) APPOINTMENT OF CLERK II (POLICE DEPARTMENT)
A motion was made by Councilman Ehrenberg, seconded by Council-
man Owen, to consent and approve the following appointment by the
City Manager: Beth Bernice Murdock, Probationary Clerk II, Police
Department, effective October 27, 1959. Motion passed by a five
yea vote. Councilman Davis not present when vote was taken.

(b) OFF STREET PARKING ON LOTS 5 AND 6, BLOCK 4, SUNSET GABLES 2nd
DIVISION.
It was moved by Councilman Ehrenberg, seconded by Councilman
Messer, that the use of Lots 5 and 6, Block 4, Sunset Gables Second
division for Public Off Street Parking be referred to the Planning
Commission for study and recommendation. Motion passed by a four
yea vote. Councilman Davis and Councilman Jorvig not present when
vote was taken.
11. MISCELLANEOUS
(a) PURCHASE OF WESTWOOD HILLS PARK.
A motion was made by Councilman Ehrenberg, seconded by Council-
man Owen, to approve the verified claims presented by the Director of
Finance, and to authorize payment as follows:
1. The Murri-Mac Company $201,664.77
2. The Murri-Mac Company and
• Treasurer of Hennepin County 20,835.23 $222,500.00
3. Treasurer of Hennepin County 1,781.71
Motion passed by a five yea vote. Councilman Davis not present when
vote was taken.
12. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS
(a) VERIFIED CLAIMS.
On motion of Councilman Ehrenberg, seconded by Councilman Owen,
the lists of verified claims prepared by the Director of Finance and
presented to the Council, dated October 26, 1959 in the total amounts
of $1,922.67 for payroll, and $6,503.88 for vendors were approved,
and the City Manager, City Clerk, and City Treasurer were authorized
to issue checks covering same, by a roll call vote of five yeas.
Councilman Davis not present when vote was taken.

13. ADJOURNMENT
On motion of Councilman Ehrenberg, seconded by Councilman Messer,
the meeting was adjourned at 10:20 p.m., by a five yea vote. Council-
man Davis not present when vote was taken.
