HomeMy WebLinkAbout1958/08/04 - ADMIN - Minutes - City Council - Regular 8 'Council Meeting - August 4, 1958 A regular meeting of the City Council was called to order by Mayor Herbert P. Lefler at 8:02 p.m. Invocation was given by Father Thurner of the Most Holy Trinity Church. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis Robert Ehrenberg D. C. Messer Kenneth Wolfe H. P. Lefler Also present were the City Manager Assistant City Attorney and the Secretary. Councilman Jorvig arrived at 8:06 p.m. Minutes - 4 On motion of Councilman Bolmgren, seconded by Councilman Ehrenberg, the minutes of meeting bled July 28, 1958, were approved by unanimous vote of six members of the Council present. Public Hearing on Rezoning_- G. R. Peterson - 5a Public hearing was had on the proposed rezoning of part of Lots 8 and 9 not taken by State Highway, and all of Lots 10 thru 17, Block 6, Latham's Minnetonka Boulevard Tract (31st to 32nd on Toledo Avenue) from Residential Use District to Multiple Dwelling Use District, from 2z to 3 Story Height District, and from "C" to "D" Density District (Case No. 58-51-Z), requested by G. R. Peterson. G. R. Peterson was present in support of his request - and showed two proposed plans. One building with 40 units or two buildings with 20 units each. Frank Edey of 3101 Toledo Avenue and three other neighbors expressed approval of the proposed plans, but were still of the opinion that the area should stay as is and not be rezoned for Multiple Dwelling Use. G. R. Peterson left a letter dated August 4, 1958 stating that all access to the property would be from 32nd Street and agree to vacate alley if majority were in favor; and further agreeing to a density of 1200 sq. ft. per dwelling and to orient all buildings to the south end of the property. Mayor Lefler declared the public hearing closed. Councilman Davis suggested that G. R. Peterson prepare a detailed letter of intention, based on promises made this evening and have same ready for next meeting, Monday August 11, 1958. 9 August 4, 1958 Public Hearing on Rezoning CONTINUED A motion was made by Councilman Davis, seconded by Councilman Ehrenberg, to waive the firsti.eading of Ordinance amending the Zoning Ordinance and to set date for secon&reading on August 11, 1958. After considerable discussion - Councilman Wolfe moved the previous question, seconded by Councilman Ehrenberg and passed by a vote of seven yeas. Mayor Lefler called for vote on original motion. Motion passed by six 11-'7 . yeas and one nay. (Councilman Jorvig voting nay.) CC CD Public Hearing on Rezoning - James Resoo - 5b Public hearing-was had on proposed rezoning of Lot 19, Huntington Woods First Addition (4118-20 West 36th Street) from Residential Use District to Multiple Dwelling Use District and from "A" to "B" Density District (Case No. 58-54-Z), requested by James Resop. Win. Fuzzy was present in support of the rezoning. A motion was made by Councilman Wolfe, seconded by Councilman Ehrenberg, to waive first reading of Ordinance and to set date for second reading on August 11, 1928. Motion passed by unanimous vote of seven members of the Council present. Public Hearing on Curb and Gutter. Grading. Surfacing etc. - 5c Public hearing continued on proposed curb and gutter construction, Improve- ment Nos. 58-60, 68, 69; proposed oil stabilized base, Improvement Nos. 58--55, 56, 57, 62; proposed grading and bituminous surfacing, Improvement Nos. 58-65; proposed stabilized base and bituminous surfacing, Improvement No. 58-61, (hearing adjourned from July 28, 1958). No one present that was interested in Improvement Nos. 58-55, 56, 57, 60, 62, 69, 65. In regard to Improvement Nos. 58-61 and 58-68, Curb and Gutter, Stabilized Base and Bituminous surfacing fro Cambridge Street from Alabama Avenue to Edge- wood Avenue - Philip C. Starkey spoke for the group in opposition and called attention to the petition filed with the Department of Public Works on July 17, 1958, signed by Howard Hallgren and others, in opposition to these two improvements. - Allan Garrison and Mr. O'Falland of Magnetic Control Company spoke in support of the improvement; but stated that they would be satisfied to have it put in West of Railroad Bridge only. Roger Geis, 6300 Cambridge Street and Howard Johnson, 6420 Cambridge Street, spoke in opposition to the improvement West of the Railroad Bridge. 10' • August 4, 1958 Hearing on Curb & Gutter. Grading& etc. CONTINUED It, was moved by Councilman Davis, seconded by Councilman Jorvig, that the hearing on Improvement Nos. 58-61 and 58-68 be adjourned until August 11, 1958, with the suggestion that the petitioners give an exact description of where the improvement is desired. Motion passed by roll call vote of six yeas and one nay. (Councilman Bolmgren voting nay.) RESOLUTION NO. 633 A motion was made by Councilman Wolfe, seconded by Councilman Bolmgren, to waive the reading and adopted Resolution No. 633 Approving Plans and Order- ing Improvements except Improvement Nos. 58-61 and 58-68. Motion passed by unanimous vote of seven members of the Council present. Request for Approval of Final Plat of Country Club Second Add. to Westwood Hills - 6a Request for approval of final plat of Country Club Second Addition to Westwood Hills, and advice from Secretary to Planning Commission concerning conformance of the final plat to the approved preliminary plat was presented to the Council. On motion of Councilman Ehrenberg, seconded by Councilman Wolfe, the above request was referred to the Planning Commission for advice and re- commendation by unanimous vote of seven members of the Council present. Communication from Northwestern Bell Telephone Co. Regarding Telephone Booths - 6b Communication from Northwestern Bell Telephone Company requesting amendment to the Zoning Ordinance to permit location of coin operated telephone booths at property line where necessary, was received by the Council. ' Mr. Morneau, District Manager, was present in support of the petition. On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the abbve request was referred to the Planning Commission for advice apd recomm- endation, by unanimous vote of seven members of the Council present. Communication from Henn. County Park Reserve District - 6c Communication was received from the Hennepin County Park Reserve District relative to county park reserve system financing. On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the above matter was referred to the City Manager to include in the 1959 budget, by unanimous vote of seven members of the Council present. i is August 4, 1958 Petition to Vacate Alley - Roger E. Krause -.64 Petition to vacate that portion of the east-west alley in the block bounded by Zarthan and Yosemite Avenues, Lake and 33rd Streets, which lies west of the north-south alley - by Roger E. Krause and others,' (referred to Planning Commission meeting of August 6, 1958), was presented to the Council. RESOLUTION NO. 634 A motion was made by Councilman Ehrenberg, seconded by Councilman Jorvig, to waive reading and adopt Resolution No. 634 Setting Hearing on Petition to CZ Vacate Alley, hearing August 25, 1958, Motion passed• by unanimous vote of CD seven members of the Council present. Relative to Storm Drain - 26th Street near Hampshire Avenue - 6e A group from 26th Street near Hampshire Avenue asked regarding storm drain contract that was to be done last year. It was explained that it is being held up by court order. City Attorney will be asked for report as he will be present next Monday. Councilman Messer told Mr. Schueller, 6904 W. 26th Street, that he would call him as soon as he had some information. Resolution Authorizing Advertisement for Bids - 7a Resolution Authorizing Advertisement for Bids Street Work, Nos. 58-55, III , 56, 57, 62, 65, deferred from July 28, 1958, was presented to the Council. RESOLUTION NO. 635 A motion was made by Councilman Messer, seconded by Councilman Boimgren, too -waEive the reading and adopt Resolution No. 635 Ordering Advertisement for Bids', to be taken August 18, 1958. Motion passed by unanimous vote of seven members of the Council present. First -Reading of Prop. Ord. Auth. Execution of Deed to Transfer Tract Back to Minnesota Rubber Properties - 7b Proposed Ordinance Authorizing Execution of Deed to Transfer Tract Back to Minnesota Rubber Properties (West 36th Street between Wooddale and Alabama Avenues), was presented for first reading. A motion was made by Councilman Davis, seconded by Councilman Messer, to waive the first reading of the above proposed ordinance and to set date for the second reading on August 11, 1958. Motion passed by a vote of six yeas. Councilman Wolfe abstained from voting, however, he consented to waiving the the first reading. August 4, 1958 Second Reading of Proposed Ord. Amending Zoning Ord. - C. Freidheim - 7c Proposed Ordinance Amending the Zoning Ordinance (Case No. 58-62-Z) 'Charles Freidheim, was presented to the Council for second reading. Charles Freidheim and Jerry Bylund were present in support of request. There was considerable discussion as to the set backs to be used in building to be constructed on this property. ' ORDINANCE NO. 632 A motion was made by Councilman Wolfe, seconded by Councilman Messer, to waive the second reading and adopt Ordinance No. 632 Amending the Zoning Ordinance of the City of St. Louis Park. Considerable discussion ensued. Councilman Ehrenberg moved the previous question, seconded by Councilman Bolmgren and passed by seven yeas. Mayor Lefler called for vote on original motion. Motion was passed by six yeas and one nay. Councilman Davis voting nay, however, he consented to waive the second reading. Relative to Carl Gardner Submitting Zoning Ordinance - 74 On motion of Councilman Wolfe, seconded by Councilman Jorvig, the City Manager was directed to get in touch with Carl Gardner Associates and get a written committment as to when the Zoning Ordinance would be submitted, by unanimous vote of seven members of the Council present. 8a Preliminary Report of the D of P W with Respect to Water Main Impr. No. 58-66/ Preliminary report of the Director of Public Works and endoresement of the City Assesor with respect to petitioned water main, Improvement No. 58-66,0 was presented to the Council. RESOLUTION No. 636 A motion was made by Councilman Davis, seconded by Councilman Ehrenberg, to waive reading and adopt Resolution No. 636 Receiving Reports and Calling Hearing on Improvements (hearing August 25, 1958). Motion passed by unanimous vote of seven members of the Council present. Minutes of Special Planning Commission - 8b Minutes of the Special Planning Commission meeting of June 25, 1958, approving the "Major Thoroughfare Plan" as submitted by the Planning ConA sultant with conditions, was presented to the Council. A special meeting of the City-Council was called for Thursday, August 7, 1958 at 7 p.m., to consider the "Mayor Thoroughfare Plan". 111 On hearing no objections the Mayor ordered the above Minutes of the Planning Commission meeting of June 25, 1958, received for filing. August 4, 1958 Promotion of Esther Helmer from Clerk I to Clerk II The City Manager reported the promotion of Esther Helmer from Clerk I to Probationary Clerk II, effective August 11, 1958. On motion of Councilman Ehrenberg, seconded by Councilman Wolfe, the Council approved the promotion as reported, by unanimous vote of seven members of the Council present. No. 58-72€ 73-8d CD CD Preliminary report of the Director of Public Works on petitioned water 01. main, Improvement Projects 58-72 and 73, were presented to the Council. 01 0.+ RESOLUTION NO. 637 A motion was made by Councilman Ehrdnberg, seconded by Councilman Jorvig, to waive reading and adopt Resolution No. 637 Receiving Reports and Calling Hearings on Improvements (hearing August 25, 1958). Motion passed by unanimous vote of seven members of the Council present. Report of Planning Commission (Case No. 58-48-V) Request of Ben Horovitz for a Variance to Erect Sign also Special Permit to Erect Sign - 9a Report of the Planning Commission (Case No. 58-48-V) recommending un- favorably upon the request of Bernard Horovitz for a variance under authority of Section 20.4-6 of the Zoning Ordinance to permit a sign with a 51 setback instead of the required 201 setback at 3901 Highway No. 7 (Park Delicatessen - Lot 21, Block 2, Calhoun Lakeside Park); and also a request from Bernard Horovitz for a special permit under authority of Section 10.3-20 of the Zoning Ordinance to erect a 151 x 121 sign at 3901 Highway No. 7 (deferred from July 14, 1958). Ben Horovitz phoned the City Clerk, August 1, 1958, and requested that action on the above request be deferred to September 8, 1958. On motion of.Councilman Wolfe, seconded by Councilman Jorvig, action on the above request wasideferred until September 8, 1958, by unanimous vote of seven members of the Council present. Re: Traffic Conditions at Entrance to Minkanda Vista Playground - 9b Traffic conditions at south entrance road to Minikanda Vista Playground (deferred May 26, 1958). Report from Director of Public Works explaining the methods being used to correct the traffic condition, was read. A motion was made by Councilman Davis, seconded by Councilman Jorvig, that the above report be received for filing and that the City Manager be directed to write a letter to Mayor Robb of Morningside explaining what has been done. Motion passed by unanimous vote of seven members of the Counci]1 present. 14 August 4, 1958 Proposed Sidewalk Construction Impr. No. 58-51, Curb ei Gutter Impr. No 58-44 and 50 letc. - 9b Proposedlsidewalk construction, Improvement No. 58-51, proposed curb and gutter construction, Improvement Nos. 58-44 and 50; proposed water main con- struction, Improvement Nos. 58-24, 25, 33, 40, 41, 42, 43, 58 and 59 (Hearing held July 21, 1958 - deferred from July 28, 1958) . RESOLUTION No. 638 A motion was made by Councilman Bolmgren, seconded by Councilman Jorvig, to waive reading and adopt Resolution No. 638 Approving Plans and Ordering Improvements. Motion passed by unanimous vote of seven members of the Council present. • Proposed Construction of Lateral Sanitary Sewers and Street Surfacing Improvement No. 58-70 - 9d Proposed construction of Lateral Sanitary Sewers and Street Surfacing, Improvement No. 58-70 (Hearing held July 21, deferred from July 28, 1958). Letters were received from B. B. Whitman, 2730 Glenhurst Avenue and , Robert Hirschthal, 2620 Glenhurst Avenue, withdrawing their objections to construction of sewer on Glenhurst Avenue. Councilman Ehrenberg reported that a majority of the home owners were now in favor of construction of sewer in Glenhurst Avenue from 28th Street to France Avenue; France Avenue from Glenhurst Avenue to. W. 25th Street and France Avenue from 160 ft. No. of 28th Street to Cedar Lake-Avenue and thence in Cedar Lake Avenue to Glenhurst Avenue. RESOLUTION No. 639 A motion was made by Councilman Ehrenberg, seconded by Councilman Davis, to waive reading and adopt Resolution No. 639 Ordering Improvement No. 58-70. Motion passed by unanimous vote of seven members of the Council present. After above action was taken Mr. Boeferding and Mr. Herbert Applequist were told that the assessment of the Gettysburg and 22nd Lane extensions, which would effect them, would be on an equal basis of other lots abutting this extension Award of Contract for Water Main. Impr. Nos. 58-20. 24. 25 etc. - 9e Award of contract for water main, Improvement'Nos. 58-20 24, 25, 33, 40, 41, 42, 43, 52, 53, 54, 58 and 59 (deferred from July 28, 1958). RESOLUTION NO. 640 _ A motion was made by Councilman Wolfe, seconded by Councilman Bolmgren, to waive reading and adopt Resolution No. 640 Accepting Bid for Watermains, (Northern Contracting Co, Hopkins, Minnesota in the amount of $70,134.80). Motion passed by unanimous vote of seven members of the Council present. - �r5 August 4, 1958 Proposed 1959 Budget - lOa Proposed 1959 Budget was presented by the City Manager. On motion of Councilman Jorvig, seconded by Councilman Bolmgren, action on the above proposed 1959 Budget was deferred to September 8, 1958, by unanimous vote of seven members of the Council present. �.7 Application of Uniform Practices in Construction and Improvement of Streets Cp etc. - 10b C Application of Uniform Practices in Construction and Improvement of Streets to streets where the Northside Sanitary Trunk Sewer was installed (M. i C. No. 58-35), was presented to the Council. On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, action on the above matter was deferred to August 25, 1958, by unanimous vote of seven members of the Council present. Relative to Minnetonka Village Sanitary Sewer.- lla The Asst. City Attorney- gave a report on the agreement he has been negotia- ting with the Minnetonka School Board for connecting to the St. Louis Park Sanitary Sewer. The proposed agreement was approved in a general way as to cost and technical provisions. The Law Department was instructed to negotiate with the Minnetonka School Board relative to connection charges in copperation with the Engineering Department, as to a connection charge, which would be comparable to the amount assessed against our own schools and other users of North Side Trunk Sewer. Verified Claims - 12a On motion of Councilman Davis, seconded by Councilman Wolfe, the lists of verified claims prepared by the Director of Finance and presented to the Council, dated August 4, 1958 in the total amounts of $5,745.53 for payroll, and $130,358.56 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by unanimous vote of seven members of the Council present.
