Council Meeting - February 17, 1958
A regular meeting of the City-Council was called to order by Mayor
Herbert P. Lefler at 8:00 p.m.
Invocation was given by Rev. Arnold Anderson of the Westwood Lutheran
Church.
The following Councilmen were present at roll call:
H. J. Bolmgren
H. C. Davis
Torval Jorvig
, D. C. Messer
Kenneth Wolfe
H. P. Lefler
Also present were the City Manager, City Attorney, Assistant to the
City Manager, City Manager Interne and the Secretary.

On motion of Councilman Jorvig, seconded by Councilman Bolmgren, the
reading of the minutes of meetings held February 10, February 12, 1958,
was waived and the minutes were approved by unanimous vote of six members
of the Council present:
Public Hearing on Proposed Curb i Gutter Construction, Impr. No. 58-1 - 5a
Public hearing was had on proposed curb and gutter construction, Improve-
ment No. 58-1,, as described in Notice of Hearing published January 30 and
February 6, 1958 in the St. Louis Park Dispatch.
Art Weisberg, Attorney for Mr. i Mrs. Westling, appeared as their attorney
and as a citizen in the area. Mr. Weisberg referred to his letter of February
10, 1958 written in opposition to the improvement. He said that they would
like to have improvement deferred - - - It was explained to Mr. Weisberg that
curb and gutter would not be constructed until the developer was ready to con-
struct pavement as per contract for imprOVements in-West Lynn 3rd Addition, and
it was indicated that a later completion date of the contract could be requested
and possibly granted.
A motion was made by Councilman Wolfe, seconded by Councilman Messer, to
adopt Resolution No. 541 Ordering Curb and Gutter Construction Improvement No.
58-1. Before vote was taken Councilman Jorvig took the chair as Mayor Lefler
left the room. Motion was passed by unanimous vote of five members of the
Council present.
Petition for Sanitary Sewer - P-1847 - 6a
Petition for sanitary sewer on Club Road from Boone to Flag Avenues,
signed by Niels W. Jensen and others was presented to the Council.
The City Manager explained that this has already been ordered. On
hearing no objections Acting Mayor Jorvig ordered the petition P-1847 received
for filing.

Acting Mayor Jorvig continued in the Chair until item 7c when Mayor Lefler
returned to the Chair.
Claim for Damages Sam Walzer - 6b
Claim for damages allegedly resulting from break in watermain at 1844
Oregon Avenue, by Mrs. Sam Walzer, 1844 Oregon Avenue (referred to the City
Attorney February 10, 1958) was presented to the Council.
On motion of Councilman Davis, seconded by Councilman Wolfe, the above
c]aim for damages was referred to the City Attorney for recommendation, by
1-1 unanimous vote of five members of the Council present.

''P Resolution No. 542 - Amending the General Administrative Code - 7a
Resolution Amending the, General Administrative Code (relating to Civil
Defense) , was presented to the Council.
On motion of Councilman Wolfe, seconded by, Councilman Messer, Resolution
No. 542, entitled Resolution Amending the General Administrative Code was adopted
by a vote of four yeas. Councilman Bolmgren not voting.
First Reading of Proposed Ordinance Amending Ord. No. 79 Relating ,to
Public Exhibitions, etc. - 7b
Proposed Ordinance Amending Ordinance No. 79 Relating to Public Exhibi-
tions, Shows and Performances, was presented to the Council.for first reading.
A motion was made by Councilman Davis, seconded by Councilman Bolmgren,
to waive the first reading of above proposed ordinance and to set date for the
second reading on February 24, 1958 with removal of "or for a baseball or
football game". Motion passed by unanimous vote of five members of the Council
present.
Second Reading of Proposed Ordinance Amending Ord. No. 555 Relating to
• Fees for Plumbing Permits - 7c (Ordinance No. 608)
Proposed Ordinance Amending Ordinance No. 555 Relating to Fees for Plumb-
ing Permits, was presented to the Council for second reading.
A motion was made by Councilman Wolfe, seconded by Councilman Bolmgren,
to waive the second reading and that Ordinance No. 608 Amending Ordinance No.
555 Relating to Fees for Plumbing Permits be adopted. Motion passed by unanimous
vote of five members of the Council present.
Second Reading of Proposed Ordinance Vacating Portion of West 26th Street - 7d
Proposed Ordinance Vacating a portion of West 26th Street (requested by
the Lutheran Church of the Reformation), was presented to the Council for
second reading. (Ordinance No. 609)
A motion was made by Councilman Davis, seconded by Councilman Jorvig, to
waive the second reading and that Ordinance No. 609 Vacating a Portion of West
26th Street be adopted. Motion passed by unanimous vote of six members of the
Council present.

Second Reading of Proposed Ordinance Amending Zoning Ordinance - 7e
Proposed Ordinance Amending the Zoning Ordinance (requiring public
hearing for certain special permits) , was presented to the Council for
second reading. (Ordinance No. 610)
A motion was made by Councilman Messer, seconded by Councilman Jorvig,
to waive the second reading and that Ordinance No. 610 Amending the Zoning
Ordinance be adopted. Motion passed by unanimous vote of six members of the
Council present.
Report Relating to Council Meetings - 8a
Report on Chapter 773, Laws 1957 relating to Council Meetings was presented
to the Council by the City Attorney.
On hearing no objections the Mayor ordered the report received for filing.
Report of City Activities for January 1958 - 8b
Report of City Activities for January, 1958 was presented to the Council
by the City Manager.
On hearing no objections the Mayor ordered the report received for filing.
Regarding Purchase of Street Materials - 10a
The Purchase of annual requirement of street maintenance materials was
presented to the Council.
It was moved by Councilman Davis, seconded by Councilman Wolfe, to approve
the taking of bids for the purchase of annual requirement of street maintenance
materials. Motion was passed by unanimous vote of six members of the Council
present.
Report Regarding Minnesota Rubber Gasket Company - 10b
Councilman Davis made an oral report on his discussion of the Minnesota
Rubber Gasket Company proposed plans - with the Planning Commission.
Mayor Lefler reported that Mr. George Carlson of Minnesota Rubber Gasket
Company said that they would present a written request for the property they
will require.
Regarding Unpaid Taxes on Land Purchased from Hennepin Lake Co. - 10c
The matter of unpaid taxes on land purchased from Hennepin Lake Company
for extension of 39th Street east of 100, was presented to the Council.
The City Attorney was requested to investigate this matter and make a
report.

Regarding Names for Charter Commission - 10d _
Mrs. Morris asked regarding names for Charter Commission.
Mayor Lefler stated that he had report of Council Committee and would
have same on Agenda for February 24, 1958.
Verified Claims - 12a
On motion of Councilman Wolfe, seconded by,•Councilman Messer, the lists
of verified claims prepared by the Director of Finance and presented to the
Council, dated February 17, 1958 in the total amounts of $1,528.03 for pay-
roll, and $21,261.46 for vendors were approved, and the City Manager, City
Clerk, and City Treasurer were authorized to issue checks covering same,
by unanimous vote of six members of the Council present:

On motion of Councilman Jorvig, seconded by Councilman Wolfe, the meeting
was adjourned at 9:39 p.m., by unanimous vote of six members of 'the Council
present.
