Council Meeting - July 8, 1957
A regular meeting of the City Council was called to order by Mayor R. C.
Fernstrom at 8:03 P.M.
Invocation was given by Rabbi Marc Liebhaber of the Bnai Abram Congregation.
The following Councilmen were present at roll call:

Also present were the City Manager, City Attorney and the Secretary.

On motion of Councilman Davis, seconded by Councilman Ehrenberg, the
minutes of meeting held July 1, 1957, were approved as corrected, by unanimous
vote of all members of the Council present.
Hearing on Rezoning- of-W 55' of Lots 29 and 30. Block 2. Del Monte Heights Add. - 5a
Hearing on proposed rezoning of the West 551 of Lots 29 and 30, Block
2, Del Monte Heights Addition (Blackstone and Minnetonka Boulevard) from Resi-
dential Use District to Multiple Dwelling Use District. (Bar-Ett Construction Co.)
Mrs. B. W. Emerson, 6012 W. Lake Street and others were present and
wanted to know what was going to be built on this property. Mr. Baratz was
present and said that he would like to build a two family dwelling. The people
appeared to be satisfied with the explanation.
On motion of Councilman Schadow, seconded by Councilman Wolfe, the City
Attorney was directed to prepare an ordinance ,to rezone the above property, first
reading to be made on July 15, 1957, by unanimous vote of all members of the
Council present.
Hearing on Proposed Grading. Improvement No. 57-37 - 5b
Hearing on proposed grading, Improvement No. 57-37, as described in Notice
of Hearing published June 20 and 27, 1957 (adjourned from July 1, 1957), and report
from the Director of Public Works.
Paul Auer and others were present and protested the grading of Blackstone
Avenue thru Delmonte Park.
Resolution No. 417
On motion of Councilman Bolmgren, seconded by Councilman Wolfe, Resolu-
tion No. 417, Ordering Street Improvement for Improvement No. 57-37 - Grading of
Blackstone Avenue from Minnetonka Boulevard to Lot 17, Block 2, Del Monte Heights,
bids to be opened on July 17, 1957, was adopted by unanimous vote of all members
of the Council present.

Addendum to Specifications - Water Main Project No. 57-16 - 5c
On motion of Councilman Davis, seconded by Councilman Schadow, the
Director of Public Works was directed to issue an addendum to specification
for Water Main Project No. 57-16 - - Blackstone Avenue from Minnetonka Boulevard
to the North property line of Lot 17, Block 2, Delmonte Heights, reserving the
right to- reject all bids received for that improvement although a bid for all
other improvements advertised at the same time, may be accepted, by unanimous
vote of all members of the Council present.
Addition to Del Monte Park Suggested - 5d
A motion was made by Councilman Schadow, seconded by Councilman Wolfe,
that the acquiring of Lots 25, 26, 27, 28, Block 2, and easterly portions of
Lots 1 through 14, Block 3, Del Monte Heights be referred to the Planning
Commission, Planning Consultant, Recreation Department and the Park and Recrea-
tion Commission, for their advice and recommendation as to their potential use
for Park purposes. The specific question the Council is considering is the
expansion of the Park and Recreation facilities and would like your opinion as
to the advisability of acquiring these lots at this time, and with the request
that the report be returned to the City Manager by the morning of July 19, 1957.
The motion was passed by the following roll call vote: Councilman Bolmgren, nay;
Councilman Davis, yea; Councilman Ehrenberg, nay; Councilman Jorvig, nay;
Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea.
5e - (The City Manager was directed to write a letter to Mr. Rasmussen and Mr.
Kane, owners of property described above in 5d, and explain to them the action
taken and also advise them that bids will be taken for Water main Project No.
57-16 and Grading Project No. 57-37 on July 17, 1957.)
Communication Accepting Emplovment. to Audit Accounts - George Hansen - 6a
Communication, dated June 28, 1957, accepting employment to audit the
accounts and records of the City for the 1957 fiscal year, subject to Provisions
of Resolution No. 412, was received from George Hansen.
On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above
communication was ordered filed by unanimous vote of all members of the Council
present.
Communication Requesting Permit for Parking Purposes - Lott 2, Block 4, Hankers
Minikanda Terrace - James Toung Fi-Wong Ten Ming - 6b
Communication requesting a permit to use Lot 2, Block 4, Hankers Minikanda
Terrace for parking purposes (Inglewood Avenue and Excelsior Boulevard) was received
from James Wong Toung and Wong Ten Ming, Foo Chu Cafe, 4215 Excelsior Boulevard.
Attorney Olson representing James Wong Toung and Wong Ten Ming, was present
and spoke in favor of the request. -- They were told to bring in a petition for
the rezoning of Lot 2, Block 4, Hankers Minikanda Terrace- to Limited Commercial Use.
Attorney Olson asked that the letter requesting permit for commercial
parking on Lot 2, Block 4, Hankers Minikanda Terrace be withdrawn, and said that
they would present the suggested petition to the Council for action on Monday,
July 15, 1957.

Regarding Sign Ordinance - Jerry Longebaugh - 6b2
Jerry Longebaugh asked about sign ordinance that is not being enforced.
He was asked to see the City Manager and cite specific violations. Jerry
Longebaugh said he would do so.
Notice of Hearing - Commissioner of Highways - 6c
Notice of hearing relative to .Rules and Regulations for County - State
Aid Highways and Municipal - State Aid Streets on August 7, 1957, at 10:00
o'clock a.m. was received from the Commissioner of Highways of the State of
Minnesota.
On motion of Councilman Schadow, seconded by Councilman Wolfe, the above
communication was ordered filed and also that the Council be given a reminder of
the meeting, by unanimous vote of all members of the Council present.
Regarding Rest Home at 3047 Toledo Avenue - Mark Co. , Inc. - 6d
Communication, dated July 3, 1957, requesting a hearing before the Council
relative to rest home at 3047 Toledo Avenue was received from Mark Co., Inc.
The- City Manager was directed to call Mark Company and tell them about
the Harris permit.
Councilman Ehrenberg left the meeting at 11:07 p.m.
Request for Building Permit - Dean Belsheim , 3126 Utah Avenue - 6e
Request to build an extension on a house with less than the 15' rear
yard requirement of the density regulation of the Zoning Ordinance (Section 15.4)
was made by Dean Belsheim, 3126 Utah Avenue.
On motion of Councilman Schadow, seconded by Councilman Jorvig, the Build-
ing Inspector was authorized to issue permit to build an extension on a house with
less than the 15' rear yard' requirement of the density regulation of the Zoning
Ordinance at 3126 Utah Avenue subject to compliance with all applicable codes,
was carried by six yeas.
Petition for Curb and Gutter - P-1748 - Ernest Glazer and others - 6f
Petition for curb and gutter on Lots 19 thru 32, Block 4, Westwood Hills
1st Addition (Rhode Island Avenue from West 24th Street to Sumter Avenue, and
West 23 Street from Sumter Avenue to Texas Avenue) signed by Ernest Glazer, 7918
West 23 Street and others was presented to the Council.
A motion was made by Councilman Davis, seconded by-Councilman Wolfe, that
the above petition P-1748 be referred to the Director of Public Works and the City
Assessor for advice and recommendation. Motion was passed by six yeas.
Petition for 2" Bituminous Surfacing/- Fred Radin and others - 6g
' Petition for 2" Bituminous surfacing on T-alley,_Block 8, Lenox Addition
(Kentucky Avenue to Louisiana Avenue and Minnetonka Boulevard to W 31st Street)
signed by Fred Radin, 3016 Kentucky Ave. and others was presented to the Council.
A motion was made by Councilman Davis, seconded by Councilman Wolfe, that
the above petition P-1749 be referred to the Director of Public Works and the City
Assessor for advice and recommendation. Motion was passed by six yeas.

Petition for Sanitary Sewer - Irving Stern and others - 6h (P-1747)
Petition for sanitary sewer on Oregon Avenue from 16th Street to 18th Street
signed by Irving Stern, 1635 Oregon Avenue and others was presented to the Council.
A motion was made by Councilman Davis, seconded by Councilman Wolfe, that
the above petition P-1747 be referred to the Director of Public Works and the City
Assessor for advice and recommendation. Motion was passed by six yeas.
Request for Special Permit for a Drive-In at Nevada Ave. i Cedar--Lake Road - 6i
Request for a special permit under authority of Sections 10.3-25 and 10.5
CD CD of the Zoning Ordinance to permit the location of a drive-in eating establishment
at the southeast corner of Nevada Avenue and Cedar Lake Road, dated July 5, 1957,
et was presented to the Council by James D. Zien.

Attorney Murray appeared and spoke for the granting of this request and
explained the type of business anticipated.
-A-motion was made by Councilman Wolfe, seconded by Councilman Jorvig, that
the above request be referred to the Planning Commission for advice and recomm-
endation. Motion was passed by six yeas,and one nay, Councilman Davis voting nay.
(this item was taken up before Councilman Ehrenberg left the meeting.)
Resolution No. 418 - Authorizing Adv. for Bids for Purchase of Bonds - 7a
A motion was made by Coundilman Davis, seconded by Councilman Jorvig,
that Resolution No. 418, entitled A Resolution Authorizing Advettisement for Bids
for Purchasaof Improvement Bonds, to be opened July 29, 1957, in the amount of
$1,025,000.00 be adopted. Motion was passed by six yeas.
Resolution No. 419 - Regarding Harris-O'Hara Bill - 7b
A motion was made by Councilman Jorvig, seconded by Councilman Bolmgren,
that Resolution No. 419, entitled A Resolution Memorializing the Congress of the
United States In Opposition to the Harris O'Hara Natural Gas Bill, be adopted.
Motion was passed by six yeas.
Report Concerning Earnings of Minneapolis Gas Company - 8a
Report concerning earnings of Minneapolis Gas Company for 1955-1956 was
presented by the City Manager (requested July 1, 1957).
A motion was made by Councilman Davis, seconded by Councilman Schadow,
that the above report be/tiled and a-copy of report be forwarded to Mr. Hoper and
that he be requested to report the progress of his study to date. Motion was
passed by six yeas.
Oral Report Relative to Lowering Cedar Lake Road Etc. - 8b
Oral report relative to lowering Cedar Lake Road at the Cedar Manor Elem-
entary School site (requested June 10, 1957) was given by Mayor Fernstrom.

Oral Report Relative to Lowering of Cedar Lake Road - continued
A meeting was held with the ruraj."County Commissioner and the County
Engineer. The County has agreed to provide the bituminous surface if the City
did the grading. It was concluded that the improvement should be done at this time,
as, water mains are to be extended on Cedar Lake Road this summer.
Communication Concerning Adjustment of Assessment Impr. Nos. 51-18 & 52-308 - 9a
Communication from the City Attorney concerning request for adjustment
of assessment for watermain, Improvement 51-18'and sanitary sewer, Improvement
No. 52-308 as requested by Mrs. H. Joing, 3419 Aquila Avenue, and report from
the City Assessor.
A motion was made by Councilman Wolfe, seconded by Councilman Schadow,
that the above communication be referred to the City Attorney and that he be
directed to draw up the proper resolution. Motion passed by six yeas.
Award of Contract for Curb and Gutter Construction - Improvement Nos. 57-1 thru
57-4 and 57-6 thru 57-13 - 9b
A motion was made by Councilman Davis, seconded by Councilman Wolfe, that
the bid of Victor Carlson and Son for furnishing labor and material for construc-
tion of curb and gutter Improvement Nos. 57-1 thru 57-4 and 57-6 thru 57-13, in
the amount of $14,305.45 be determined to be the lowest bid of a responsible
bidder and the Mayor and City Manager were authorized to execute a contract in
behalf of the City. Motion was passed by six yeas.
Award of Contract for Sidewalk Construction - Improvement Nos. 57-5 and 57-18
thru 57-23 - 9c
A motion was made by Councilman Schadow, seconded by Councilman Davis,
that the bid of Victor Carlson & Son for furnishing labor and material for con-
struction of Sidewalk Improvement Nos. 57-5 and 57-18 thru 57-23, in the amount
of $9,335,92 was determined to be the lowest bid of a responsible bidder and the
Mayor and City Manager were authorized to execute a contract in behalf of the
City, based on the report of the City Manager that the difference between their
bid and Acme Construction Company was a minor amount and due to favorable ex-
perience the City has had with Victor Carlson & Son, the City Manager did not
deem it advisable to use a firm which we had not previously had experience with,
which was located out of the city, and particularly due to the fact that in many
incidents the sidewalk is being constructed at the same location as curb and
gutter by Victor Carlson & Son. Motion was passed by six yeas.
Employee's Vacation Policy - 10a
Employee's vacation policy - requested by Mayor Fernstrom.
The Mayor asked for clarification regarding vacations in Employee's Hand
Book, Page 12. The ordinance was explained and the City Manager said he would
study the wording in the Employee's Hand Book to see if it could be made more
clear.

On motion of Councilman Davis, seconded by Councilman Jorvig, the lists
of verified claims prepared by the Director of Finance and presented to the Council,
dated July 8, 1957, in the total amounts of $6,457.39 for payroll, and $19,889.86
for vendors were approved, and the City Manager, City Clerk, and City Treasurer
were authorized to issue checks covering same,was passed by six yeas.
Regarding Overall City Plan - 12b
Councilman Bolmgren brought up for discussion the overall City Plan being
O worked up by Carl Gardner Associates. He felt that the Council should have more
'--i reports on what has been done up to date.

vlvl Councilman Davis explained what had been done and pointed out that the
Council- had received all reports that the Planning Commission had received. He
also explained the Citizens Committee program etc. -- The explanation appeared
to be satisfactory.
Report Relative to New City Manager Interne - 12c
The City Manager reported that he had accepted the offer of the Graduate
Program of University of Pennsylvania, Institute of Local and State Governments,
to train an interne as part of the schools program for giving the degree of
Master of Governmental Administration. - - Under this program the interne serves
III 6 months under the sponsorship of an accredited City Manager with no compensation.
In return the Manager must plan and guide the training of the interne. The interne
is to start July 22, 1957.

On motion of Councilman Davis, seconded by Councilman Wolfe, the meeting
was adjourned at 12:55 a.m., by unanimous vote of all members of the Council
present.
