Council Meeting — June 24, 1957
A regular meeting of the City Council was called to order by Mayor R. C.
Fernstrom at 8 P.M.
Invocation was given by Father Turner of the Most Holy Trinity Catholic
'Church.
The following Councilmen were present at roll call:

Also present were the City Manager, City Attorney, Assistant City Manager
and- the Secretary.
Minutes
On motion of Councilman Davis, seconded by Councilman Jorvig, the minutes
of meeting held June 17, 1957, were approved as corrected, by unanimous vote of
the Council.
Hearing on 2" Bituminous Surfacing. Improvement Nos. 57-31 thru 57-34
Public hearing on proposed 2" bituminous surfacing, Improvement Nos. 57-31
thru 57-34, as described in Notice of Hearing published June 13 and 20, 1957 in
the St. Louis Park Dispatch. No persons appeared.
On motion of Councilman Schadow, seconded by Councilman Jorvig, Re'solu—
tiom No. 409 entitled Resolution Ordering Bituminous Surfacing Street Improvements
(Nos. 57-31 thru 57-34) was adopted by unanimous vote_,of the Council.
(Bids to be taken July 17, 1957)
Hearing on 4" Stabilized Base. Improvement Nos. 57-39 and 57-40
Public hearing on proposed 4" stabilized base, Improvement Nos. 57-39
and 57-40 as described in Notice of Hearing published June 13 and 20, 1957 in
the St. Louis Park Dispatch. No persons appeared. A letter was received from
Mr. E' Mrs. C. B. Miller, 3840 Rhode Island Avenue in opposition.
On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the above
letter was ordered filed and Resolution No. 410, entitled Resolution Orderifig
Stabilized Base Street- Improvements (Nos. 57-39 and 57-40)(bids to be taken
July 17, 1957) was adopted by unanimous vote of the Council.
Hearing on rroposed Relief Ditch — Improvement No. 57-41
Public hearing on proposed relief ditch to serve as outlet for Storm Sewer
District No. 25, Improvement No. 57-41, as described in Notice of Hearing published
June 13 and 20, 1957 in the St. Louis Park Dispatch. The following persons
appeared:

Sewer would relieve this situation, the answer was no. In favor: Dick
Knutson, 6916 W. 26th Street; Mrs. M. Holzhen, 6820 W. 26th Street;
S. Schneller, 6904 W. 26th Street; N. B. Brisley, 6909 W. 26th Street.
A motion was made by Councilman Davis, seconded by Councilman Wolfe, to
deny petition and refer this matter to Engineering Department to determine where
this problem will fit into the overall storm sewer plan now being contemplated,
and make this one of the first projects. Motion was lost by the following roll
call vote: Councilman Bolmgren, nay; Councilman Davis, yea; Councilman Ehrenberg,
nay; Councilman Jorvig, nay; Councilman Schadow, nay; Councilman Wolfe, yea;
Mayor Fernstrom, nay.
On motion of Councilman Schadow, seconded by Councilman Bolmgren, Res-
oution No. 411, entitled Resolution Ordering Relief Ditch for Storm Sewer
District No. 25 and to advertise for Bids for July 10, 1957, was adopted by six
yeas and one nay, Councilman Davis voting nay.
Myrt's Cafe - 6325 Minnetonka Boulevard
Councilman Schadow asked the City Manager for a report. The City Manager
reported that corrections had been made - that we have received no calls and
have made repeated checko and find no violations.
Councilman Wolfe asked Councilman Schadow if this report was satisfactory
and Councilman Schadow replied that he-felt that the City Manager had made the
necessary corrections. The following persons were present: Leon Schultz, 3125
Dakota Avenue; Roger Thompson, 3038 Dakota Avenue; Ed. Cameron, 3016 Dakota
Avenue; Bill Wallace, 2925 Colorado Avenue; Wm. Arthus, 3015 Colorado Avenue;
T. Solle, 3046 Dakota Avenue; C. Orbeck, 3025 Colorado Avenue; Frank Palmer,_
3044 Edgewood Avenue, who discussed the matter at some length. No Council
action taken.
Regarding 1957 Audits - George Hansen
Communication, dated June 13, 1957, was received from George M. Hanson,
advising of the approximate cost of an audit for the accounts and records of
the City for the 1957 fiscal year.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, Resolu-
tion No. 412. entitled A Resolution Providing for the Deployment of George M.
Hansen to Audit the Accounts and Reoords •of the City for the 1957 Fiscal Year,
was adopted by unanimous vote of the Council.
Request for Variation of Setback for Garage at 1651 Melrose Avenue - Melchild
Request for variation Of the setback requirements-of the Zoning Ordinance
under authority of Section 20.4-6, to permit location of a garage without the
required setback at 1651 Melrose Avenue, dated June 24, 1957, was received from
J. Fred Melchild.

- On motion of Councilman Davis, seconded by Councilman Jorvig, the above
request was referred to the Planning Commission for advice and recommendation,
by unanimous vote of the Council.
Communication Re: Notice of Hearing - Robert F. Fitzsimmons
- Communication, dated Jund 14, 1957, concerning Notice of Hearing on An
Application to Activate a Hennepin County Park District was received from Robert
F. Fitzsimmons, County Auditor and Secretary to the Hennepin County Boards of
Commissioners.

communication was ordered filed by unanimous vote of the Council.

`'Z Communication Re: Harris-O'Hara Bill - Minneapolis Gas Company
Communication, dated June 18, 1957, concerning the proposed Harris-O'Hara
natural gas bill was received from the Minneapolis Gas Company.
On motion of Councilman Schadow, seconded by Councilman Wolfe, the above
communication was ordered filed by unanimous vote of the Council.
Regarding Opposition to Harris-O'Hara Bill
A motion was made by Councilman Davis, seconded by Councilman Jorvig, that
the City Attorney prepare a resolution expressing opposition to the Harris-O'Hara
Bill and to be presented to our Representative in Washington. Motion passed by
unanimous vote of the Council.
Request for Adjustment of Assessment for Watermain Etc. - Mrs. Joing
Request for adjustment of assessment for watermain, Improvement No. 51-18,
and sanitary sewer, Improvement 52-308, by Mrs. H. Joing, 3419 Aquila Avenue,
and reports of the City Assessor and City Attorney with respect thereto were
presented to the Council.
A motion was made by Councilman Davis, seconded by Councilman Ehrenberg,
that the above request be referred to the City Attorney to work out a manner
in which this adjustment can be made. Motion passed by unanimous vote of the
Council.
Request for Special Permit to Locate Motel on Hwy. 7 & 36th Street - V. A.- Ryan
Request for special permit to locate a motel on commercially zoned pro-
perty between Highway No. 7 South Service Road and 36th Street between Dari-Vi
and Culligans, by Vincent A. Ryan.
On motion of Councilman Wolfe, seconded by Councilman Schadow, the above
request was referred to the Planning Commission for advice and recommendation,
by unanimous vote of the Council.

Request for Building Permit ,- Millberg Building. 3404 Louisiana Ave. - S & H Constr.
Request for approval of the issuance of a building permit for the con-
struction of an addition to the Millberg Building, 3404 Louisiana Avenue, by
S. & H. Construction Company.
On motion of Councilman Bolmgren, seconded by Councilman Davis, the
Building Inspector was authorized to issue -permit for the construction of an
addition to the Millberg Building'at 3404 Louisiana Avenue, subject to com-
pliance with all applicable codes, by unanimous vote of all members of the
Council.
Petition for Watermain S. Service Drive of Hyw. 12 - Roto Rooter Service
Petition for watermain on the south service drive of Highway No. 12,
from Louisiana Avenue to Texas Avenue, by Roto-Rooter Sewer Service Company.
On motion of Councilman Bolmgren, seconded by Councilman Ehrenberg, the
above petition P-1744, was referred to the Director of Public Works and City
Assessor for advice and recommendation, by unanimous vote of the Council.
Petition for Vacation of Oregon Avenue Etc.-Rodgers Hydraulic Inc. & Others
Petition for vacation of Oregon Avenue between the southerly line ex-
tended easterly of Lot 3, Block 316, Rearrangement of St. Louis Park and
Highway No. 7, the alley between Walker Street and Highway No. 7 (between
Oregon and Pennsylvania Avenues), and the alley in Block 323, Rearrangement of
St. Louis Park adjacent to Lot 12 (remainder of alley vacated in 1942), by
Rodgers Hydraulic Inc. and others.
On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the
above petition was referred to the Planning Commission for advice and recomm-
endation, by unanimous -vote of the. Council.
Petition for Watermain on Texas Avenue - Richard Neslund and others
Petition for watermain on Texas Avenue from Franklin Avenue to West 16th
Street, by Richard Neslund, 1601 Quentin Avenue and others.
On motion of Councilman Bolmgren, seconded by Councilman Ehrenberg, the
above petition (P-1745), was referred to the Director of Public Works and the
City Assessor for advice and recommendation, by unanimous vote of the Council.
Application -for License to Sell Liquor Off-Sale - Eli Budd
- Application for license to sell intoxicating liquor off-sale, by Eli
Budd-, 2709 Salem Avenue and Louis Solender, 2715 Salem Avenue was presented to
the Council.
On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the
above application for license to sell intoxicating liquor off-sale was denied,
by unanimous vote of the Council.

Parking Layout in Connection with Alerations to La Miracle Dining
A parking layout in connection with alterations to the La Miracle Dining
Building (Excelsior Boulevard and Wooddale Avenue) was presented by Mr. John
Billman
On'motion of Councilman Davis, seconded byCouncilman Bolmgren, the Build-
ing Inspector was authorized to issue permit for the alterations to the La Miracle
Dining Building (Excelsior Boulevard and Wooddale Avenue) subject to compliance
with all applicable codes, by unanimous vote of the Council.

of'the Zoning Ordinance for erection of two wall mounted signs, 4' x 56' and

On motion of -Councilman Ehrenberg, seconded by Councilman Bolmgren, the
above request was referred to the Planning Commission for advice and recommenda-
t ion, by unanimous vote of the Council.
Second Reading of Proposed Ordinance Amending Zoning Ord. Sec. 1.3-39
Second reading of proposed ordinance amending the Zoning Ordinance (set-
backs - Section 1.3-39) .
On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, action
on the above ordinance was deferred for one week to allow for rewriting of
ordinance, by unanimous vote of the Council.
Second Reading of Proposed Ordinance Regulating Consumption of Intox. Liquor etc.
On motion of Councilman Schadow, seconded by Councilman Wolfe, second read-
ing of Ordinance No. 577 entitled An Ordinance Regulating Consumption of Intoxi-
cating Liquor and Serving of Liquids for Mixing with Intoxicating Liquor in Public`
Places was waived and adopted by unanimous vote of the Council.
Relative to City Wide Storm Sewer System
Report relative to proposals concerning the design of the propose city-
wide storm sewer system, by the CityManager (M & C 57-15) and the Director of
Public Works (requested June 10, 1957) .
A motion was made by Councilman Davis, seconded by Councilman- Wolfe, that
the above matter be re-referred to the City Engineer and that he be requested -to
answer the Councils question of June 10, 1957. Motion was lost by two yeas -and
five nays.
A motion was made by Councilman Ehrenberg, seconded by- Councilman Jorvig,
that the City Manager and the City Attorney be instructed to prepare an agreement
with Bannister Engineering Company for proposed City_ wide Storm Sewer system, in
accordance with their proposal- of April-11, 1957. Motion passed by the following
roll call vote: Councilman Bolmgren, nay; Councilman Davis, abstained from voting;
Councilman Ehrenberg, yea, Councilman Jorvig, yea; Councilman Schadow, yea;
Councilman Wolfe, yea; Mayor Fernstrom, nay.

Minutes of the Parks and Recreation Advisory Commission
Minutes of the Parks and Recreation Advisory Commission meeting of -
June 12, •1957 were presented to the Council. •
On motion of Councilman Schadow, seconded by Councilman Jorvig, the
'above minutes were received for filing by, unanimous vote of the Council,
Financial Repert of the City'for May 1957
Financial report of the City for May 1957 was presented by the City
Manager.
On motion of Councilman Schadow, seconded by Councilman Jorvig, the
above Financial report of the City was received for filing by unanimous vote
of the Council.
Reports with Respect to Petitioned 2" Bituminous Surfacing — No. 57-42
Preliminary report of the Director of Public Works and recommendation of
the City Assessor with respect to petitioned 2" bituminous surfacing Improve—
ment No. 57-42, were presented to the Council.
On motion of Councilman Wolfe, seconded by Councilman Jorvig, Resolution
No. 413, entitled Resolution Setting Hearing on Street Improvements, Impr. No.
57-42, for July 15, 1957, was adopted by unanimous vote of the Council.

Approval of the final plat of Aretz•4th• Addition, by Harald R. Aretz,
Aretz Jlealty Company, (deferred from June 3 and June 10 — M C 57-14).
1 A motion was made by Councilman Davis, seconded by Councilman Jorvig,
that the final plat of Aretz 4th Addition be accepted and approved as a prelim—
• , inary and final plat, subject to execution by the applicant of an agreement
with the city to furnish improvements as required by ordinance and approval of
the applicant's title by the City Attorney. Motion passed by unanimous vote of
the Council.

Councilman Bolmgren requested that the following be entered in the minutes:
"I think this is highway robbery to make him enlarge the lots after the Council -
has accepted the preliminary plat showing smaller--lots, and I object to the
pressure put on him to enlarge his lotP!
Relative to Parking Space at 3230 Gorham Avenue
Communication, dated June 18, 1957, relative to parking space at 3230
Gorham Avenue (requested by Council April 22, 1957) was presented by A. J. Wright,
of the J. H. Ea W. Corporation 6500 West Lake Street.
On motion of Councilman Davis, seconded by Councilman Wolfe, the Parking
Plan submitted to the Council was approved by unanimous vote of the Council.

- Minutes of the Planning Commission meeting June 12, 1957 (deferred from
June 17, 1957) were presented to the Council.
- On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above
minutes were received for filing, by unanimous vote of the Council.
Report of Planning Commission on Rezoning Requested by E: A. Johnson
Report of the Planning Commission (Case 57-32-Z) recommending favorably
with conditions upon the request of E. A. Johnson and others for rezoning part
of Lot 8, Section 4, Township 117, Range 21 ([east of Zarthan Avenue and south
of Cedar Lake Road) from Commercial Use District to Light Industrial Use District.

upon the request of Suburban Sign Company for a variance of the setback require-
ments of the Zoning Ordinance to permit the location of a sign at 6108 Excelsior
Boulevard (Ranger's Chow Mein) within the setback area. (deferred from June 17,
1957) .
A motion was made by Councilman Bolmgren, seconded by Councilman Ehrenberg,
to concur with the recommendation of the Planning Commission that the permit be
denied. Motion passed by unanimous vote of the Council.
Report of Planning Commission on Rezoning Requested by C. Freidheim
Report of the Planning Commission (Case 57-38-Z) recommending favorably
on the request of C: Freidheim to rezone, "All that part of the southwest x/4 of
Section 30, Township 29, Range 24, and of the northwest 1/4 of Section 31, Town-

! Report of the Planning Commission (Case 57-40-S) recommending favorably
upon the request of Richard Neslund for preliminary approval of Texas Terrace
Subdivision - 7 lots - (Deferred from June 17, 1957) (applicant requests action
be tabled until new plan presented).
A motion was made by Councilman Davis, seconded by Councilman Ehrenberg,
that the plat be filed and a letter written to Mr. Neslund stating that the
plat will not be considered until such a time as he initiates further action.
Motion passed by unanimous vote of the Council.
Report of Planning Commisssion upon Prbposed Plat of Westwood Hills Subdivision -9k
Report of the Planning Commission (Case 57-43-S) upon the proposed plat
of Westwood Hills Subdivision, and recommending that the plat be referred to the
City Council for establishing a date for public hearing (deferred from June 17,
1957).
. A motion was made by Councilman Davis, seconded by Councilman Jorvig,
that the above plat be- referred to the Planning Commission and City Engineer
for examination and report, and that the hearing date be set for July 10, 1957.
Motion passed by unanimous vote of the Council.

Communication concerning area north of Excelsior, generar1ly between

Planning Commission, Planning Consultant and the Park and Recreation Commi-
ssion June 3, 1957 - Planning Commission tabled action for further study.

On motion of Councilman Davis, seconded by Councilman Schadow, the above
communication was.referred to the Planning Commission, Planning Consultant and
the Park and Recreation Commission, by unanimous vote of the Council.

--1 Report of the Planning Commission (Case 57-5-Z) recommending unfavorably
to upon the request of the City Council to rezone property in the Light Industrial
Use District, lying southof the Great Northern Tracks from the M N fe S Railroad
tracks westerly to approximately Idaho Avenue, to Open Development Use District.
(no action taken June 17, 1957) .
On motion of Councilman Schadow, seconded by Councilman Ehrenberg, hearing
date on the above rezoning was set for July @2, 1957, by the-following roll call
vote: Councilman Bolmgren, nay; Councilman Davis,- yea; Councilman Ehrenberg, yea;
Councilman Jorvig, nay; Councilman Schadowi yea; Councilman Wolfe, yea; Mayor
Fernstrom abstained from voting.
Bonds
On motion of Councilman Bolmgren, seconded by Councilman Schadow, the
following bonds which have been approved by the City Attorney were accepted by
unanimous vot 6f all members of the Council.
Earl A. Sewall Co., Inc. - Contractors Bond for Bituminous Surfacing and
Stabilizing
Wm. Doroshchak - Cement Contractor's Bond $10,000.00
Verified Claims
On motion of Councilman Davis, seconded by Councilman Jorvig, the lists
of verified claims prepared by the Director of Finance and presented to the
Council, dated June 24, 1957, in the total amounts of $1,469.23 for payroll,
and $90,386.11 for vendors were approved, and the City Manager, City Clerk, and
City Treasurer were authorized to issueichecks covering same, by unanimous vote
of the Council.
Meeting Adjourned
On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the
meeting was adjourned at 2:17 A.M. , by unanimous vote of all members of the
Council.
