Fernstrom at 8:09 p. m. Invocation was given by Rev. Lloyd Nordstrom of the Park Baptist Church. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis Torval Jorvig Kenneth Wolfe Also present were the City Manager, Assistant City Manager, City Attorney, Don Sorensen and the Secretary. Councilman Schadow arrived at 8:35 P. m. Minutes - 4 On motion of Councilman Wolfe, seconded by Councilman Jorvig, the minutes of meeting held June 10, 1957, were approved as corrected on page 9, by unanimous vote of the Council. Hearing on Proposed Rezoning of Lots 5 & 6, 14 & 15, Block 4, Sunset Gables 2nd - 5a Hearing on proposed rezoning of Lots 5 and 6, 14 and 15, Block 4, Sunset Gables Second Addition (Minnetonka Boulevard, Inglewood and Joppa Avenue) from Residential Use District to Commercial Use District - requested by B. Horovitz (adjourned from June 10, 1957). A motion was made by Councilman Davis, seconded by Councilman Jorvig, to adjourn the hearing until August 12, 1957, when recommendation of the Planning Commission has been received. Motion was passed by unanimous vote of the Council. Hearing on Proposed Curb and Gutter Construction Impr. Nos. 57-6 thru 57-13 - 5b Hearing on proposed curb and gutter construction, Improvement Nos. 57-6 thru 57-13, as described in Notice of Hearing published June 6 and June 13, 1957, in the St. Louis Park Dispatch. Resolution No. 405 On motion of Councilman Davis, seconded by Councilman Bolmgren, Resolution No. 405, entitled Resolution Ordering Curb and Gutter Construction, Improvement No. 57-6 thru 57-13, bids to be taken July 3, 1957, was adopted by unanimous vote of the_Council. Hearing on Proposed Sidewalk Construction Impr. 57-18 thru 57-23 - 5c Hearing on proposed sidewalk construction, Improvement Nos. 57-18 thru 57-23, as described in Notice of Hearing published June 6 and 13, 1957, in the St. Louis Park Dispatch. No one appeared. On motion of Councilman Jorvig, seconded by Councilman Bolmgren, Resolution No. 406, entitled Resolution Ordering Sidewalk Construction, Improvement Nos. 57-18 thru 57-23, bids to be taken July 3, 1957, was adopted by unanimous vote of the Council. 2 0-3 June 17, 1957 Hearing on Proposed Water Main and Bituminous Stabilized Base Construction, Improvement Nos. 57-14 thru 57-17 - 5d Hearing on proposed water main and bituminous stabilized base con- struction, Improvement Nos. 57-14 thru 57-17, as described in Notice of Hearing published June 6 and June 13, 1957 in the St. Louis Park Dispatch. Ben. Harrison, 3012 Alabama Avenue, was present and asked for inform- ation regarding 57-16. He was given the estimate cost of $1 .26 per front foot. He also wanted to know if Blackstone was going to be opened through the Park. The answer was no. On motion of Councilman Bolmgren, seconded by Councilman Wolfe, Resolution No. 1107, entitled Resolution Ordering Water Main Construction and Bituminous Stabilized Base, Improvement Nos. 57-14 thru 57-17, bids to be taken July 17, 1957, was adopted by unanimous vote of the Council. Communication Concerning Alley in Area Bounded by Oregon Avenue, 31st St., etc - 6a Communication, dated June 9, 1957, concerning alley condition in area bounded by Oregon Avenue, 31st Street, Pennsylvania Avenue and Minnetonka Blvd. (petition to Council April 29, 1957) by F. T. Nelson; 3045 Pennsylvania Avenue, was presented to the Council. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above communication was referred to the Director of Public Works for advice and re- commendation, by unanimous vote of the Council. Request for Rezoning N 20' of Lot 3111 & Lot 315, Richmond Addition - 6b Request, dated June 12, 1957, for rezoning N. 20' of Lots 314 and all of Lot 315, Richmond Addition (1601 Kentucky Avenue) from Residential Use District to Multiple Dwelling Use District, by Milton P. Pius; 1601 Kentucky Avenue, was presented to the Council. A motion was made by Councilman Bolmgren, seconded by Councilman Jorvig, that the above request be referred to the Planning Commission for advice and recom- mendation. Motion was lost by 4 nays and 1 yea. The request was then withdrawn by Mr. M. P. Pius. Request for Variation of Setback b Roto Rooter Sewer Service - 6c Request, dated June 114, 1957, for variationlof the setback requirements of the Zoning Ordinance under authority of Section 20.4-6, to permit location of an office building without the required setback, on the south side of Wayzata Boulevard between Louisiana Avenue and Pennsylvania Avenue, by Roto-Rooter Sewer Company, was presented to the Council. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above request was referred to the Planning Commission for advice and recommendation, by unanimous vote of the Council. 13 June 17, 1957 Request for Building Permit at Georgia Ave. & West 26th Street - 6d _. _ _ _ Request;_dated J_tne; 14," 1957,._for_approval .of the issuance of -a building permit for the construction of a warehouse building at Georgia Avenue and West 26th Street, by Roto-Rooter Sewer Service Company, was presented to the Council. Leland Gootstein was present asking for permit. Kenneth Johnson, 2557 Georgia Avenue and others appeared and discussed this matter. Mayor Fernstrom explained that no action can be taken on issue of permit without a set of plans on hand. He suggested that item 8b of tonights meeting, regarding rezoning this property be taken up, as the neighbots were present at the meeting. • Communication Relative to Fares by T. C. Motor Bus Company - 6e d Communication, dated June 12, 1957, concerning Notice of Hearing relative to increase of fares by the Twin City Motor Bus Company, by Oliver A. Ossanna, Secretary of Railroad and Warehouse Commission, was presented to the Council. On motion of Councilman Davis, seconded by Councilman Jorvig, the above communication was referred to the City Attorney for handling, by unanimous vote of the Council. Communication Relative to Fares by Mpls. St. Ry. Company - 6f Communication, dated June 12, 1957, concerning Notice of Hearing relative 111 to increase of fares by the Minneapolis Street Railway Company - by Oliver A. Ossanna, Secretary of Railroad and Warehouse Commission, was presented to the Council. On motion of Councilman Davis, seconded by Councilman Schadow, the above communication was referred to the City Attorney for handling, by unanimous vote of the Council. Petitions Concerning "Myrt's Diner" - 6q Petitions concerning "Myrt's Diner" at Dakota Avenue and Minnetonka Boule- vard, by Harry F. Aldell, 3020 Colorado Avenue and others were presented to the Council. Rev. Lester Nelson of the Evangelical Free Church was the spokesman for the group. The following also spoke on the problem: Ed. Cameron, 3016 Dakota Ave; D. Lebowski, 3121 Colorado Ave. ; Mrs. M. J. Eckert, 3017 Edgewood Ave., W. J. Wallace, 2925 Colorado Ave.; L. M. Odden, 3042 Dakota Avenue; H. Glocke, 3020 Brunswick Avenue; Mr. T. Solle, 3046 Dakota Avenue; Mrs. Aberle, 2913 Dakota Ave.; G. L. McKinney, 3101 Dakota AvenIie; R. Thompson, 3038 Dakota Aveneu; and others. Councilman Schadow made the following statement and asked that it be entered in the minutes. 2 Problems: 1. Misunderstanding of orders and unfortunate consequences. 2. Regulation of the Cafe in a manner that will not constitute a nuisance factor. 14 June 17, 1957 Petitions Concerning Myrt's Diner continued Re: Myrt's Diner My first knowledge of an unusual situation here arose when I asked one of our patrolmen if they were having any trouble with this operation. He told me that an order had come from a City Official to 122poff the place (Myrt's). At this point I begin to receive some calls and complaints. This was the week of May 6th. On the following Monday at Council meeting a motion was made that the City Manager send a memo to the Police Department instructing them to enforce our curfew ordinance. This memo -was sent out May 15th. The next week I spoke to some of the businessmen on the corner and they advised me that Myrt's Cafe was not bothering them except for the loitering outside, and the accompanying profane remarks to passersby. At this stage of the development I started checking Myrt's Cafe every night - before that I had merely spot checked it on an every other night basis. I was out of town most o,if Memorial Day week; but took up the nightly checks again on June 3rd. On dune 5th I talked to the board that sets up the rules at Myrt's Cafe. There were 30 - 40 teenagers there. Officer Dave Schaefer was also present in plain clothes - this was his night off. When I spoke to the kids I explained to them about the phone calls we had received, what the people objected to and how they could help by not racing around in their cars, not loitering outside etc. The teen agers asked some good questions and my observation indicated it did some good on the follow- ing nights it looked like they were trying. Myrt's attitude, however, although not one of complete cooperation; indicated to me that she would make an effort to improve the situation. My general feeling was that if everyone would pitch in and make an effort to improve on the problem I wanted the teenagers to know that we were (at least I was) not picking on them and would help them in any way I could. About this time I heard that the business men had been having trouble for the past week and they came to the City Manager's office and complained about the car racing and outside loitering. Our officers were put on 30 minute cruise orders for the place I was told. After I talked to the teen agers on June 5th we didn't have a call in the police station until Jurie 12th. This indicates a willingness on the teen-agers part to cooperate and I think deserves special mention. Just before this time (June 12th) however, I started receiving several calls - day and night. My calls started June 10, 1957. Complaints were on outside loitering and car racing. On June 13th I had stopped by to talk to several people on Dakota Avenue that I had talked to before. While I was there a convertible pulled out of the lot at Myrt's and was going 50 MPH when it hit 31st Street. I could not get the license number due to his speed. Shortly after that one of the boys was out in back of Myrt's cracking a 10-15' bull whip. I had the patrol car called and I went down and sent the boys inside. The officer was sent inside when he arrived to tell the boy that we would book him if this ever occurred again. That same night at 8:30 p. m. I drove back down to Myrt's and there were at least 20 kids in the parking lot. I looked inside, neither Mr. or Mrs. Hedwall were behind the counter so I told the boys to either go in- side or go home. On my way home I stopped a squad car and told him to be certain that they were dispersed. On Friday a. m. June ll4th I stopped by the City Manager's office and talked to the Assistant City Manager and our Juvenile officer. During the past two weeks I had been riding in the patrol cars every night I was not at another meeting and was concerned that our Juvenile officer was not working on this at all. I talked to him in the City Manager's office where he told he had been 15 June 17, 1957 given orders to stay away from there unless he was called in by the proprietors. I left the City Manager's office with an understanding that Myrt's Cafe would be given a spot check that night, tagged if anyone was there under 18 years old. Later that day I talked to the Juvenile officer, the Assistant City Manager and the Chief of Police. The Chief was to warn Myrt's Cafe in advance that they would be checked after 10 p. m. and tagged if they were in conflict with the curfew ordinance. The Assistant City Managericked me up and we watched the check made at 10:05 - 10:10 and there were over 1/2 dozen children under 18. One 9 year old, two 12 year olds and a couple were under 18. The Sgt. gave Myrt a warning - he told me his orders were not to tag her, this is in spite of the definite under- standing we had Friday, earlier. The police received a call later that night at 2 a.m. - a complaint. As a result of the conflict in orders Friday evening I went CD in to Myrt's Saturday evening when the check was made. There were two boys there under 18. Neither was from the Park. The Sgt. had orders not to tag her. We had do a little discussion and the Chief of Police arrived. A tag was issued. A few of my phone callers suggested I was doing nothing; this report will refute those statements. If I am guilty of anything it is interference with administration to . the extent that our law was enforced. I want a complete report on the handling of this situation during an execu- tive session of the Council; but right now these people deserve relief and some assurance that they can receive it from our enforcement agency. I merely wanted to present these facts so that the complete story might be known. After considerable discussion a motion was made by Councilman Wolfe, seconded by Councilman Jorvig, that the above matter be referred to the Committee of the Whole and that the meeting be held as soon as possible for a thorough investigation of the matter. Motion was passed by unanimous vote of the Council. Petition for Watermain on Quebec Ave. from Cedar Lake Road East etc. - 6h Petition for watermain on Quebec Avenue from Cedar Lake Road to the East line of Lot 15, Block 1, South Westwood Hills Addition, by John L. Skog, 2571 Quebec Avenue and others, was received. On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the above petition P-1739 was referred to. the Director of Public Works and City Assessor for advice and recommendation, by unanimous vote of the Council. Petition for Curb and Gutter ES of Pennsylvania Ave. W. 16th to 18th St. - 6i Petition for curb and gutter on the East side of Pennsylvania Avenue from West 16th Street to West 18th Street, by Charles Isenberg, 1635 Pennsylvania Avenue and others, was received. On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the above petition P-1741 was referred to the Director of Public Works and City Assessor for advice and recommendation, by unanimous vote of the Council. Petition for Curb and Gutter WE of Pennsylvania Ave. W. 16th to 18th St. - 6j Petition for curb and gutter on the West side of Pennsylvania Avenue from West 16th Street to West 18th Street - by R. J. Petition for Curb and' Gutter ES Sumter Ave. W. 23rd St. to CLR - 6j1 Petition for, curb & gutter on the East side bf Sumter Avenue Adj. to Lots 1 thru 14, Block 6, Westwood Hills 1st Addition (Westil23rd Street to Cedar Lake Road), by D. Robert Johnson, 2321 Sumter Avenue and others, was received. On motion of Councilman Schadow, seconded by Councilman Jorvig, the above petition P-1742 was referred to the Director of Public Works and City Assessor for advice and recommendation, by unanimous vote of the Council. Petition for Curb and Gutter WS Sumter Ave. W. 23rd S,t. to CLR - 6j2 , Petition for curb and gutter on the West side of Sumter Avenue Adj. to Lots 1 thru 14, Block 7, Westwood Hills 1st Addition (West! 23rd Street to Cedar Lake Road), by Herbert Soule, 2310 Sumter Avenue and others, was received. On motion of Councilman Schadow, seconded by Councilman Jorvig, the above petition P-1743 was referred to the Director of Public Works and City Assessor for advice and recommendation, by unanimous vote of the C'ounc il. Request for Special Permit to Erect Sign at 4911 Excelsimr Blvd. - 6k Request for special permit under authority of Section 10.3- O and 10.5 of the Zoning Ordinance for erection of a 12' x 70' (840 sq. ft. ) sign at 4911 Excelsior Boulevard (Pilgrim Cleaners) by Suburban Sign Company, was presented to the Council. - On motion of Councilman Davis, seconded by Councilman Bolmgren, the above request was denied by unanimous vote .of the Council. First Reading of Proposed Ordinance Regulating Consumption of Intoxicating Liquor etc. - 7a It was moved by Councilman Schadow, seconded by Councilman Jorvig, that the first reading of proposed ordinance Regulating Consumption of Intoxicating Liquor and Serving of Liquids for Mixing with Intoxicating Liquor in Public Places, be waived and that the second reading of Ordinance be made on June 24, 1957. Motion passed by unanimous vote of the Council. A motion was made by Councilman Davis to amend ordinance to substitute word "invited" for the word "permitted". Motion wasllost because of no second. First Reading of Proposed Ordinance Amending Zoning Ordinance (setbacks) - 7b It was moved by Councilman Schadow, seconded by Councilman Wolfe, that the first reading of proposed ordinance Amending the Zoning Ordinance (setbacks - Sec- tion 1.3-39) be waived and that the second reading of Ordinance be made on June 24, 1957. Motion passediby unanimous vote of the Council. I l 1 F June 17, 1957 Report of City Activities for May, 1957 was presented by the City Manager. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above report was received for filing, by unanimous vote of all members of the Council. Planning Commission Report (Case 57-5-Z) - 8b Report of the Planning Commission (Case 57-5-Z) recommending unfavorably on the request of the City Council to rezone property in the Light Industrial Use District, lying south of the Great Northern tracks from the M N & S Railroad tracks westerly to approximately Idaho Avenue, to Open Development Use District. CD A number of neighbors in the vicinity of 26th & Georgia Avenue discussed this matter with the Council. A motion was made by Councilman Bolmgren, seconded by Councilman Wolfe, that action be deferred on this matter until July 3, 1957. Motion was lost by the following roll call vote, Councilman Bolmgren, yea; Councilman Davis, nay; Councilman Jorvig, nay; Councilman Schadow, nay; Councilman Wolfe, nay; Mayor Fernstrom abstained from voting. A motion was made by Councilman Davis, seconded by Councilman Schadow, that a public hearing be set to rezone to Open Development for July 8, 1957. Motion was lost by the following roll call vote, which was a tie, Councilman Bolmgren, Nay; Councilman Davis, yea; Councilman Jorvig, nay; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, nay. Councilman Bolmgren speaking against the motion said the Planning Commissioh recommends that we leave it Light Industrial and we are setting a bad precedent to change this to Open Development. A motion was made by Councilman Davis, seconded by Councilman Wolfe, that the Planning Commission report be filed and we turn to next matter of business. Motion was lost by the following roll call vote, which was a tie, Councilman Bolmgren, nay; Councilman Davis, yea; Councilman Jorvig, nay; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, nay. A motion was made by Councilman Schadow, that the above matter be rereferred to the Planning Commission and Planning Consultant for reconsideration of their last recommendation. Motion was lost because of no second. Mayor Fernstrom ruled that the Council proceed to next order of business. Planning Commission Report (Case 57-37-Z) - Clinton Corporation - 8c Report of the Planning Commission (Case 57-37-Z) recommending favorably upon the request of the Clinton Corporation to change the zone on the northern portion of Lots 3 and 4, Block 1, Minikanda Terrace Addition, from Residential Use District to Limited Commercial Use District (Excelsior Boulevard and Glenhurst Avenue). On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 21 , 1957, by unanimous vote of the Council. 18 'I I June 17, 1957 Planning Commission Report (Case 57-40-S) Richard Neslund - 8d Report of the Planning Commission (Case 57-40-S) recommending favorably upon the request of Richard Neslund for preliminary approval of Texas Terrace Subdivision (7 lots). On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957 by unanimous vote of the Council. Planning Commission Report (Case 57-36-Z) Bar-Ett Construction Company - 8e Report of the Planning Commission (Case 57-36-Z) recommending favorably on the request of the Bar-Ett Construction Company to, change the zone from Residential Use District to Multiple Use District on the west 55'1 of Lots 29 and 30, Block 2, Del Monte Heights Addition (Blackstone Avenue and Minnetonka Boulevard). On motion of Councilman Schadow, seconded by' Councilman Jorvig, hearing date was set for July 8, 1957 on the above rezoning, by unanimous vote of the Council. Planning Commission Report (Case 57-38-Z) E. Freidheim - 8f Report of the Planning Commission (Case 57-38-Z) recommending favorable on the request of C. Freidheim to reaone, "All that part' of the southwest 1/4 of Section 30, Township 29, Range 24, and of the northwest 1/4 of Section 31, Township 29, Range 24, lying southerly of Cedar Lake Road, easterly and northerly of County Road No. 16 and westerly of Highway #100 to Light Industrial Use District. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957,1 by unanimous vote of the Council. Planning Commission Report (Case 57-32-Z) E. A. Johnson - 8g Report of the Planning Commission (Case 57-32-Z) recommending favorably with conditions upon the request of E. A. Johnson and others for rezoning part of Lot 8, Section 4, Township 117, Range 21 (east of Zarthan Avenue and south of Cedar Lake Road) from Commercial Use District to Light Industrial Use District. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957,' by unanimous vote of the Council. \ Planning Commission Report on Request of Assembly of God Church - 8h Report of the Planning Commission recommending favorably on the request of the Assembly of God Church for a special use permit for a church in a residential district (16th and Texas Avenue). Rev. Patz appeared in favor of request. On motion of Councilman Wolfe, seconded by Councilman Jorvig, Resolution No. 408, entitled Resolution Granting Permit under Section 10.3 of the Zoning Ordinance of the City of St. Louis Park, was adopted by unanimous vote of the Council. • 19 June 17, 1957 Minutes of the Planning Commission Meeting June 12, 1957 - 8i On motion of Councilman Schadow, seconded by Councilman Bolmgren action on the Minutes of the Planning Commission meeting of June 12, 1957, was deferred until June 24, 1957, by unanimous vote of the Council. Planning Commission Report (Case 57-33-Z) C. Maxwell 8 ' Report of the Planning Commission (Case 57-33-Z) recommending favorably upon the request of C. Maxwell to change the zone on Lot 20, Huntington Woods First Addition, from Residential Use District to Multiple Use District. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action CD on the above report was deferred until June 24, 1957, by unanimous vote of the Council. kn Planning Commission Report (Case 57-34-V) Suburban Sign Company - 8k Report of the Planning Commission (Case 57-34-V) recommending unfavorably upon the request of Suburban Sign Company for a variance of the setback requirements of the Zoning Ordinance to permit the location of a sign at 6108 Excelsior Boulevard (Ranger's Chow Mein) within the setback area. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957, by unanimous vote of the Council. Planning Commission Report (Case 57-39-V) Wm. Hardacker - 81 Report of the Planning Commission (Case 57-39-V) recommending favorably with conditions, the request of Wm. Hardacker, 1801 Melrose Avenue, for waiver of the sideyard setback requirement of the Zoning Ordinance to permit location of a garage within 3' of the property line. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957, by unanimous vote of the Council. Planning Commission Report (Case 57-43-S) - 8m Report of the Planning Commission (Case 57-43-S) upon the proposed plat of Westwood Hills Subdivision, and recommending that the plat be referred to the City Council for establishing a date for public hearing. On motion of Councilman Schadow, seconded by Councilman Bolmgren, action on the above report was deferred until June 24, 1957, by unanimous vote of the Council. Communication Concerning Bass Lake Area - 9a Communication concerning Bass Lake Area (referred to the Planning Comm- ission, Planning Consultant and the Park and Recreation Commission June 3, 1957) by Wm. G. Dohrer, 3631 Inglewood Avenue was presented to the Council. 2 . June 17, 1957 - Concerning Bass Lake Area - continued On motion of Councilman Schadow, seconded byCouncilman Bolmgren, action on the above communication was deferred until June 24; 1957, by unanimous vote of the Council. 1111 1 Bonds - lla On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the following bond which has been approved by the City Attorney was accepted by unanimous vote of the Council. . Madsen Service - Heating Verified"Claims - 12a On motion of Councilman Bolmgren, seconded by Councilman Schadow, the list of verified claims prepared by the Director of Finance and presented, to the Council, dated June 17, 1957, in the total amount of $25,641.93 for vendors was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by unanimous vote of the Council. Payment on Contract Work - 12b I On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the following payment on contract work, presented by the City Engineer was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue check for the respective amount, by unanimous vote of the Council.
