COUNCIL MEETING - May 27, 1957
A regular meeting of the City Council was called to order by Mayor R. C.
Fernstrom at 8:18 P.M.
Invocation was given by Rev. Lester Nelson of the Evangelical Free Church.
The following Councilmen were present at roll call:

Also present were the City Manager, City Attorney, City Manager Interne
and the Secretary.
Minutes
On motion of Councilman Schadow, seconded by Councilman Wolfe, the minutes
• of meeting held May 20, 1957, were approved, by unanimous vote of all members of
the Council present.
Public Hearing on Proposed Vacation of Alley between Wooddale E Alabama Avenues
betProposed vacation of alley between Wooddale and Alabama Avenues, and
ween West 36th i West 37th Streets, as described in Notice of Hearing pub-
lished May 16, 1957, requested by Minnesota Rubber Properties Inc.
George Carlson representing the petitioner was present. Councilman Davis
says that the Planning Commission suggested that 5 feet along 36th Street be
requested from petitioner, for widening of 36th Street. Councilman Davis also
recommended that the Council request the deeding of this 5 feet before acting
onlpetition to vacate alley. Mr. Carlson said that this arrangement would be
satisfactory.
On motion of Councilman Wolfe, seconded by Councilman Davis, the City
Attorney was directed to prepare Ordinance for first reading June 3, 1957, con-
tingent upon the petitioner deeding the north 5 feet of Lots 4 & 5, Block 43,
St. Louis Park Center and Lots 16, 17, 18, 19, 20 and 21, Block 43, Rearrangement
oflSt. Louis Park to be used for widening of 36th Street, by unanimous vote of
all members of the Council present.
Request for consideration of Sidewalks
Request for consideration of sidewalk construction in areas near the new
Aquila and Cedar Manor Schools, by Harold Enestvedt, Superintendent of Schools,
dated May 15, 1957.
On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the
above request was referred to the Director of Public Works and the Assessor
for advice and recommendation, by unanimous vote of all members of the Council
present.

Request for Consideration of Sidewalks continued
Councilman Ehrenberg suggested the following amendment to the above motion,
which was not accepted, that the Director of Public Works be instructed to refer
the subject of the need of sidewalks leading to all schools to the Safety Engineer.
Communication Concerning Disturbances - C. W. Hollenbeck
Communication concerning disturbances at Dakota Avenue and Minnetonka
Boulevard, dated May 19, 1957, by C. W. Hollenbeck, 3104 Colorado Avenue was
presented to the Council.
A motion was made by Councilman Wolfe, seconded by Councilman Bolmgren,
that the above communication be filed and that Mr. C. W. Hollenbeck be notified,
by the City Manager, what steps are being taken to eliminate this situation.
Motion was passed by unanimous vote of all members of the Council present.
Petition for Rezoning - Charles M. Freidheim
Petition for rezoning all that part of the southwest 1/4 of Section 30,
Township 29, Range 24 and of the northwest 1/4 of Section 31, Township 29,
Range 24, lying southerly of Cedar Lake Road, easterly and northerly of County
Road No. 16 and westerly of Highway No. 100 from Open Development, Residential,
Light Industrial and Heavy Industrial Use Districts to Light Industrial Use
District, by Charles M. Freidheim.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above
petition was referred to the Planning Commission for advice and recommendation,

by unanimous vote of all members of the Council present.
Communication Concerning Use of Trunk Hwys. for Local Celebrations
Communication concerning laws prohibiting use of Trunk Highways for local
celebrations, by L. P. Zimmerman, Commissioner of Highways, dated May 7, 1957.
On motion of Councilman Davis, seconded by Councilman Wolfe, the above
communication was received and ordered filed, by unanimous vote of all members
of the Council present.
Request for Waiver of Sideyard Setback - Wm. Hardacker, 1801 Melrose Avenue
Request for waiver of the sideyard setback requirement of the Zoning
Ordinance to permit location of a garage within 3' of the property line, by
Mr. & Mrs. Wm. Hardacker, 1801 Melrose Avenue, was presented to the Council.
On motion of Councilman Davis, seconded by Councilman Jorvig, the above
request was referred to the Planning Commission for advice and recommendation,
by unanimous vote of all members of the Council present.

Request for Grading and Developing Zarthan Avenue etc. - by Bud Moldestad
Request for grading and developing Zarthan Avenue from the dead-end
to 28th Street, and 28th Street between Zarthan Avenue and the existing alley,
by Bud Moldestad, was presented to the Council.
On motion of Councilman Davis, seconded by Councilman Jorvig, the above
petition No. P-1719, was referred to the Director of Public Works and the City
Assessor for advice and recommendation, by unanimous vote of all members of the
Council present.
Request for Special Permit to Erect Sign at 2350 Highway No. 100 - LeRoy Signs
Request for a special permit under authority of Section 10.3-20 and 10•.x5
of the Zoning Ordinance for erection of a 2.6' x 20' (50 sq. ft.) sign at 2350
Highway #100 (Twin City Lino Service), by LeRoy Signs Inc., was, presented to
the Council.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, Resolu-
tion No. 393. entitled Resolution Granting Permit Under Section 10.3 of the
Zoning Ordinance of the City of St. Louis Park (upon payment of double sign
permit fee), was adopted by unanimous vote of all members of the Council present.
A motion was made by Councilman Davis, seconded by Councilman Jorvig, that
the License of-LeRoy Signs Inc. be revoked by the City Manager, and that the City
Manager direct a letter to all Sign contractors licensed in St. Louis Park and
call their attention to irregularities that have come to our attention. Motion
passed by unanimous vote of all members of the Council present.
Petition for Blacktop Surfacing of Alley - Edward Haynes, 2709 Toledo Avenue
Petition for blacktop surfacing of alley bounded by Toledo Avenue and
Salem Avenue, and West 27th and West 28th Street, by Edward Haynes, 2709 Toledo
Avenue and others, was presented to the Council.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for blacktop surfacing of alley No. P-1734, was referred to the
Director of Public Works and the City Assessor for advice and recommendation, by
unanimous vote of all members of the Council present.
Petition for Curb and Gutter - Martin Ring. 4230 Basswood Road.
I Petition for curb and gutter on North side of Basswood Road adjacent to
east 90' of Lot 5, Block 1, Cedarwodd 2nd Addition, by Martin Ring, 4230 Basswood
Road, was presented to the Council.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for curb and gutter No. P-1733, was referred to the Director of
Public Works and the City Assessor for advice and recommendation, by unanimous
vote of all members of the Council present.

Petition for curb and gutter on east side of Boone Avenue from West 25th
Street (adjacent to Lots 1 and 2, Block 8, West Texa-Tonka Hills) to Club Road,
by James Tillet, 2451 Boone Avenue, was presented to the Council.
On- motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for curb and gutter No. P-1732, was referred to the Director of
Public Works and the City Assessor for advice and recommendation, by unanimous
vote of all members of the Council present.
Petition for Sidewalk - James Tillet, 2451 Boone Avenue
Petition for sidewalk on east side of Boone Avenue from West 25th Street
(adjacent to Lots 1 and 2, Block 8, West Texa-Tonka Hills) to Club Road, by
James Tillet, 2451 Boone Avenue, was presented to the Council.
, On motion of Councilman Ehrenberg, seconded by Councilman Schadow, , the
above petition for sidewalk No. P-1731, was referred to the Director of Public
Works and the City Asseseor for advice and recommendation, by unanimous vote of
all members of the Council present.
Petition for Watermain - Brookside Builders Inc.. 6119 Excelsior Boulevard
Petition for water main on South Street from Hurst Avenue to Taft Avenue,
by Brookside Builders Inc. , 6119 Excelsior Boulevard, was presented to the
111 Council.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for watermain No. P-1735, was referred to the Director of Public
Works and the City Assessor for advice and recommendation, by unanimous vote
of all members of the Council present.
Petition for Street Grading - Brookside Builders Inc. . 6119 Excelsior Boulevard
Petition for street grading on South Street from Hurst Avenue to Taft
Avenue, by Brookside Builders Inc., 6119 Excelsior Boulevard, was presented to
the Council.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for street grading P-1736, was referred to the Director of Public
Works and the City Assessor for advice and recommendation, by unanimous vote of
all members of the Council present.
Resolution No. 394 - Authorizing Condemnation of Street Right-of-Way
Resolution No. 394, entitled Resolution Setting Hearings on Proposed
Street Extensions, was read by the Secretary.
On motion of Councilman Schadow, seconded by Councilman Wolfe, Resolution
111 No. 394, was adopted by unanimous vote of all members of the Council present.

First Reading of Proposed Ordinance Amending Ord. No. 407 - Signs Ei Bill Boards
First reading of proposed ordinance amending Ordinance No. 407 Regulating
Signs and BillBoards (deferred from May 20, 1957), was waived.
It was moved by Councilman Davis, seconded by Councilman Schadow, that the
second reading of the Proposed Ordinance be made on June 3, 1957. Motion passed
by unanimous vote. of all members' of the Council present.
Second Reading of Proposed Ordinance Amending Zoning Ordinance - Bakeries
Second reading of proposed ordinance amending the zoning ordinance
(wholesale bakeries).
A motion was made by Councilman Davis, seconded' by Councilman Bolmgren,
that the Ordinance on Bakeries be amended as presented by Councilman Davis and
set this evening for second reading. Motion was passed by the following roll
call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg,
nay; Councilman Jorvig, nay; Councilman Schadow, yea; Councilman Wolfe, nay;
Mayor Fernstrom, yea.
The Secretary was requested to make second reading of Ordinance as amended.
A motion was made by Councilman Davis, seconded by Councilman Bolmgren,
that the Ordinance be adopted as amended. Motion was lost by the following roll
call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg,
nay; Councilman Jorvig, nay; Councilman Schadow, yea; Councilman Wolfe, nay;
Mayor Fernstrom, Nay.
Report Relative to Laws Regulating Spiking with Alcoholic Beverages
Report relative to existing ordinance and laws regulating spiking with
alcoholic beverages in public places was presented by the City Attorney (re-
quested by Council April 29, 1957) .
A motion was made by Councilman Schadow, seconded by Councilman Wolfe,
that the above report be referred back to the City Attorney for preparing a
proposed amendment for first reading for June 10, 1957, as recommended in letter
of May 20, 1957. Motion was passed by unanimous vote of all members of the Council
present.
Engineer's Report on Improvement Nos. 57-14 thru 17
Preliminary report of the Engineer and recommendation of the City Assessor
with respect to petitioned water main and bituminous stabilized base, Improvement
Nos. 57-14 thru 17, was presented to the Council. -
On motion of Councilman Davis, seconded by Councilman Jorvig, Resolution
No! 395, entitled Resolution Setting Hearing on Watermain and Bituminous Stabil-
ized Base, on June 17, 1957, was adopted by unanimous vote of all members of the
Council present.

Enginar's Report on Improvement Nos. 57-6 thru 13
-Preliminary report of the Engineer and recommendation of the City Assessor
with respect to petitioned curb and gutter, Improvement Nos. 57-6 thru 13, was
presented to'the Council.
On motion of Councilman Davis, seconded by Councilman Jorvig, Resolution
No. 396, entitled Resolution Setting Hearing on Curb and Gutter, on June 17,
1957, was adopted by unanimous vote of all members of the Council present.
Engineer's Report on Improvement Nos. 57-18 thru 23
Preliminary report of the Engineer and recommendation of the City Assessor
with respect to petitioned sidewalks, Improvement Nos. 57-18 thru 23, was
presented to the Council.
On motion of Councilman Davis, seconded by Councilman Jorvig, Resolution
No. 397, entitled Resolution Setting Hearing on Sidewalk, for June 17, 1957,
was adopted by unanimous vote of all members of the Council present.
Re: Eliminating Existing Painted Wall Signs
Means of eliminating existing painted wall signs over 48 square feet in
area (deferred by Council from May 20, 1957), was discussed and reference made
to Zoning Ordinance. No action taken.
Auditor's Report for the Fiscal Year of 1956
Independent auditor's report for the fiscal year of 1956, presented by
George M. Hansen, Certified Public Accountant (deferred by Council from May 20,
1957) .
On motion of Councilman Davis, seconded by Councilman Wolfe, the above
report was received and ordered filed and a letter of commendation be given to
the Supervisor of Accounts, by unanimous vote of all members of the Council
present.
Rel Painted Sign at 4900 County Road #16
Painted sign at 4900 County Road #16 - Donald R. Frantz Construction, Inc.
(deferred by Council May 13 and May 20, 1957) was discussed-.
On motion of Councilman Davis, seconded by Councilman Wolfe, the letter
received from Donald R. Frantz Construction, Inc., dated May 4, 1957, was ordered
filed, by unanimous vote of all members of the Council present.
Request for Building Permit - 7300 South Street' Brookside Builders. Inc.
Request for approval of the issuance of a building permit for the construc-
tion of an industrial building at 7300 South Street, by Brookside Builders, Inc.
(deferred by Council May 13 and May 20, 1957.

Request for Building Permit Continued
On motion of Councilman Jorvig, seconded by Councilman Wolfe, the Building
Inspector was authorized to issue permit for the construction of an industrial
building at 7300 South Street, subject to compliance with all applicable codes
and subject to brick facing on the South Street side, by unanimous vote of all
members of the Council present.
Re: City-Wide Storm Sewer Master Plan
Recommendation relative to proposals, for engineering services in connection
with city-wide storm sewer Master Plan presented by the City Manager (requested
by Council April 29, 1957) (M C No. 10)
On motion of Councilman Wolfe, seconded by Councilman Schadow, action on
the above matter was deferred for one week, by unanimous vote of all members of
the Council present.
Storm Sewer at Idaho Avenue ei W 26th Street
! Storm sewer at Idaho Avenue and West 26th Street (requested by Councilman
Schadow). The Clerk was requested to secure a petition for drainage and deliver
same to Sylvester Schueller, 6904 W. 26th Street.
On motion of Councilman Wolfe, seconded by Councilman Schadow, the above
matter was referred to Director of Public Works and City Assessor for advice
and recommendation, by six Councilman voting yea and one Councilman voting nay.
Councilman Davis voted nay.
Re: Northside Sanitary Trunk Sewer Assessments
Length of time to spread assessments for Northside Sanitary Trunk Sewer
was discussed. No action taken.
Bonds
On motion of Councilman Davis,' seconded by Councilman Wolfe, the following
, bonds which have been approved by the City Attorney were accepted by unanimous
vote of all members of the Council present,

Mill City Heating Ee Air Conditioning Co. - Heating
Rainmaker Soft Water Inc. - Water Softening Devices
Verified Claims
On motion of Councilman Schadow, seconded by Councilman Jorvig, the lists
of verified claims prepared by the Director of Finance and presented to the
Council, dated May 27, 1957, in the total amounts of $2,134.72 for payroll' and
$13,434.45 for vendors were approved, and the City Muiager, City Clerk, and
City Treasurer were authorized to issue checks covering same, by unanimous vote
of all members of the Council present.

Payments on Contract Work
On motion of Councilman Schadow, seconded by Councilman Davis, the follow-
ing payments on contract work, presented by the City Engineer were approved, and
the City Manager, City Clerk, and City Treasurer were authorized to issue checks
for their respective amounts, by unanimous vote of all members of the Council
present.
