COUNCIL MEETING, May 20, 1957
111 A regular meeting of the City Council was called to order by Mayor R. C.
Fernstrom at 8:05 P.M.
Invocation was given by Rev. Ben Brudevold of the Aldersgate Methodist
Church.
The following Councilmen were present at roll call:
H. J. Bolmgren
H. C. Davis
Robert Ehrenberg
Torval Jorvig
Gene Schadow
Kenneth Wolfe
Also present were the City Manager, City Attorney, City Manager Interne,
Donald Sorenson, Engineer Department and the Secretary.
Minutes
On motion of Councilman Jorvig, seconded by Councilman Ehrenberg, the
minutes of meeting held May 13, 1957, were approved, by unanimous vote of all
members of the Council present.
Public Hearing on Proposed Rezoning of Lots 1 thru 8. Blk. 3. Hanke's Nkda. Terrace
,,Proposed rezoning of Lots 1 thru 8, Block 3, Hanke's Minikanda Terrace
Addition (Excelsior Boulevard between Inglewood and Huntington Avenues) from Re-
sidential Use District to Limited Commercial Use District, requested by E. Novak
and others (hearing adjourned from May 13, 1957).
John Yngve, attorney for petitioners, presented a proposed agreement contain-
ing restrictive covenants to be written into the ordinance for rezoning the above
mentioned property. Also present were Mr. fe Mrs. Donald C. Allen, 3620 Huntington
Ave., Roy Friberg, 3625 Inglewood Ave., Otto Gulbrandson, 3615 Inglewodd Ave., Mrs.
Jacob Silver, 3619 Inglewood Ave., who asked a number of questions and indicated
their opposition to the rezoning.
A motion was made by Councilman Schadow, seconded by Councilman Bolmgren,
directing the City Attorney to prepare an ordinance for first reading on May 27,
1957, embodying the agreement presented by Attorney Yngve and providing for re-
cording of agreement in the deeds. Motion was lost by the following roll call vote:
Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, nay; Council-
man Jorvig, xray; Councilman Schadow, yea; Councilman Wolfe, nay; Mayor Fernstrom,
nay.
On motion of Councilman Davis, seconded by Councilman Jorvig, the request of
petitioner to rezone Lots 1 thru 8, Block 3, Hankers Minikanda Terrace Addition,
from Residential Use District to Limited Commercial Use District was denied by
unanimous vote of all,members of the Council present. ,

Public Hearing on Rezoning of Tract B and C. RLS No. 176 etc.
Proposed rezoning of Tract B and C, Registered Land Survey No. 176, plus
adjacent parcel to the west (Virginia Avenue and Minnetonka Boulevard) from
Residential Use District to Commercial Use District, requested by A. Fine
(adjourned from May 13, 1957), and report relative to access to the property,by
the Director of Public Works.
On motion of Councilman Davis, seconded by Councilman Schadow, the adjourned
hearing was declared completed and the matter tabled until the petitioner requests
further consideration, and after giving of published notice as required for the
original hearing, by six Councilman members voting yea and Councilman Ehrenberg
voting nay.
Petition for Rezoning Part of Lots 3 and 4. Block 1. Hankers Minikanda Terrace
Request for rezoning the following property: Commencing at the NE Corner
of Lot 3, thence Southeasterly 165 5/10 feet along the Northeasterly line thereof,
thence deflecting right 127 degrees 42 minutes a distance of 106 2/10 feet,
thence deflecting left 18 degrees 1 minute a distance of 36 feet to the South-
westerly line of Lot 4, thence Northwesterly along the Southwesterly line of
Lot 4 to the NW corner of Lot 4, thence Northeasterly to beginning except State
Highway, Block 1, Hankers Minikanda Terrace (Excelsior Boulevard and Glenhurst
Avenue) from Residential Use District to Limited Commercial Use District, also
a request for waiver of setback, presented by The Clinton Corporation.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
above petition for rezoning to •Limited Commercial Use District/6d the former
petition dated January 16, 1957, for rezoning to Multiple Dwelling Use on the
same described property was referred to the Planning Commission for advice and
recommendation, by unanimous vote of all members of the Council present.
Petition for Rezoning South One-half of Lot 26 and of Lot 27. Norwaldo
Request for rezoning south one-half of Lot 26 and all of Lot 27, Norwaldo
Addition (3129 Webster Avenue) from Residential Use District to Multiple Use
District was presented by David R. Anderson.
On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the above
request was referred to the Planning Commission for advice and recommendation, by
six Councilman voting yea and one Councilman voting nay, Councilman Schadow voted
nay.
Petition for Rezoning Lots 9 Ei 10. Blk. 7, Wooddale Park
Request for rezoning Lots 9 and 10, Block 7, Wooddale Park (Wooddale Avenue
and Morningside Road) from Residential Use District to Multiple Use District was
presented by Howard H. Hardacker, Inc.
On motion of Councilman Bolmgren, seconded by Councilman Ehrenberg, the
above request was denied, by unanimous vote of all members of the Council
present.

On,motion of Councilman Jorvig, seconded by Councilman Schadow, the above

Petition for .4" bituminous stabilizing on North Street from Rhode Island
to Pennsylvania Avenue, dated April 16, 1957, signed by Gerry Quilling, 7729
North Street and others was presented to the Council.
On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, the
above petition P-1729 was referred to the Director of Public Works and City
Assessor for advice and recommendation by unanimous vote of all members of the
Council present.
Petition for 4" Bituminous on Rhode Island from Lake Street to South Street
Petition for 4" bituminous stabilizing on Rhode Island from Lake Street
to South Street, dated May 12, 1957, signed by Gerry Quilling, 7729 North Street
and others was presented to the Council.
On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, the
above petition P-1730 was referred to the Director of Public Works and City
Assessor for advice and recommendation by unanimous vote of all members of the
Council present.
Resolution No. 391 Authorizing Correction of Deed
Resolution No. 391, entitled Resolution Authorizing Correction of Deed was
read by the secretary.
On motion of Councilman Schadow, seconded by Councilman Wolfe, Resolution
No. 391 was adopted by unanimous vote of all members of the Council present.
Proposed Ordinance Amending Ordinance No. 407 Regulating Signs and BillBoards
On motion of Councilman Davis, seconded by Councilman Ehrenberg, the first
reading of proposed ordinance amending Ordinance No. 407 Regula-ting=Signs and
Bill Boards was deferred for one week, by unanimous vote of all members of the
Council present.
Re: Proposed Ordinance Amending Zoning Ordinance Relative Wholesale Bakeries

A motion was made by Councilman Ehrenberg, seconded by Councilman Wolfe,
that the secretary of the Council give the first reading of the proposed ordinance.
- Councilman Schadow moved to amend above motion to define the word substantial
in Ordinance,; as that amount of goods that cannot be delivered by 2 trucks.
Amendment lost due to no second.
At the direction of the Mayor the Clerk thereupon read the proposed Ord-
inance as follows: '

Proposed Ordinance Relative to Wholesale Bakeries Continued
Section 6.1-1 Bakery Wholesale
A bakery shall be construed as a wholesale bakery if a substantial
portion of the products produced in the bakery are sold or distributed
to the ultimate consumer through one or more outlets at separate
locations from the bakery premises where they are produced. A bakery
shall also be excluded from the commercial district if located within
150 feet of a residential or multiple dwelling district unless the
construction of the bakery building and the machinery and equipment
in use therein shall be so designed, operated and maintained as to
eliminate odors from the bakery memises, and eliminate noise of such intensity
as to constitute a nuisance, and if more than two vehicles are used for
delivery of bakery products from the premises, and hours of delivery
are other than between 7:00 A.M. and 9:00 P.M. of any day.
A motion was made by Councilman Ehrenberg, seconded by Councilman Wolfe,
that the second reading of the Proposed Ordinance amending the zoning ordinance
relative to wholesale bakeries be made on May 27, 1957. Motion passed by the
following roll call vote, Councilman Bolmgren, yea; Councilman Davis, nay;
Councilman Ehrenberg, yea; Councilman Jorvig, nay; Councilman Schadow, nay;
Councilman Wolfe, yea; Mayor Fernstrom, yea.
Resolution No. 392 - Approving Securities
Resolution No. 392, entitled Resolution Approving Securities for Collateral
from Northwestern National Bank of Minneapolis, Minnesota was read by the secretary.
On motion of Councilman Wolfe, seconded by Councilman Schadow, Resolution
No. 392 was adopted by unanimous vote of all members of the Council present.
Promotion of John Hane from City Manager Interne to Assistant to City Manager
The City Manager reported the promotion of John Hane from City Manager Interne
to Assistant to City Manager, effective June 1, 1957.
On motion of Councilman Ehrenberg, seconded by Councilman Wolfe, the Council
approved the promotion as reported, by unanimous vote of all members of the Council
present.
Financial Report for April 1957
Financial report of the City for April 1957 was presented by the City Manager.
On motion of Councilman Jorvig, seconded by Councilman Wolfe, the financial
report was received for filing by unanimous vote of all members of the Council
present.

Report Concerning Meas of Eliminating Existing Painted Wall Signs
Rort concerning means of eliminating existing painted wall /signs
over 48 square feet in area was given by the City Attorney.
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, action
on the above def erred 'until May 27, 1957, by unanimous vote of all members of the
Council present.
Report Relative to Spray Pool Project
Report relative to Spray Pool project, dated May 17, 1957, was presented
by the City Manager.
On motion of Councilman Schadow, seconded by Councilman Jorvig, the City
Manager was directed to prepare plans for a combination spray and wading pool
for presentation to the Council 'on June 10, 1957, by unanimous vote of all members
of the Council present.
Auditor's Report for 1956
Independent auditor's report for the fiscal year of 1956, by George M.
Hansen, Certified Public Accountant.
On motion of Councilman Jorvig, seconded by Councilman Schadow, action on
the above report was deferred one week for study, by unanimous vote of all
members of the Council present.
Acceptance of Deed
Acceptance of deed for the east five feet of Lot 5, Block 7, J. F. Lyons
Fourth Addition (south side of Minnetonka Boulevard between Flagg and Gettysburg
Avenues).
On motion of Councilman Jorvig, seconded by Councilman Bolmgren, the 'above
quit claim deed from Brookside Builders Inc, dated May 20, 1957, for drainage
purposes was accepted and the City Attorney was directed to file same with the
Register of Deeds, Hennepin County, by unanimous vote of all members of the
Council present.
Regarding Painted Sign at 4900 County Road #16
Painted sign at 4900 County Road No. 16, Donald R. Frantz Construction, Inc.
(deferred by Council May 13, 1957).
On motion of Councilman Davis, seconded by Councilman Jorvig, action on the
above matter was deferred to May 27, 1957, by unanimous vote of all members of the
Council present.

Award of Contract for Northside Sanitary Trunk Sewer
`' Award of contract for Northside Sanitary Trunk Sewer, Improvement No. 56-52
On motion of Councilman Wolfe, seconded by Councilman Schadow, Resolution
No. 390 Determining Lowest Responsible Bidders for Sewer Improvement No. 56-52
was adopted by six yeas and one nay, Councilman Jorvig, voting nay.
Utility Connections at Asbury Hospital Site
The City Manager submitted the suggested reply to Asbury Hospitals letter
of April 15, 1957 regarding utility connections, which was given council approval.
Re-Advertisement for Bids on Bituminous Surfacing etc.
Re-advertisement for bids on Bituminous surfacing and stabilizing projects
requested by the Director of Public Works.
On motion of Councilman Schadow, seconded by Councilman Wolfe, the City
Clerk was authorized to re-advertise for bids on bituminous surfacing and stabil-
izing projects, bids to be received on June 5, 1957, by unanimous vote of all
members of the Council present.

A motion was made by Councilman Davis, seconded by Councilman Schadow,
that the bid of Dahlberg Bros. for furnishing item No. 2 - one 1957 Ford 250V8,
3/4 ton Pick-Up Truck and the bid of Astleford Equipment Company for furnishing
item No. 4 - One International Harvester, 1-350, Industrial Type Tractor, be
designated as the lowest bids of responsible bidders. Motion was passed by un-
animous vote of all members of the Council present.

Request for approval of the issuance of a building permit for the construction

On motion of Councilman Schadow, seconded by Councilman Jorvig, action on
the aybove request be deferred for one week, by unanimous vote of all members of
the Council present.
Appointment of Rex Walker as Probationary Appointment Suprv. Zoning &' Inspection
The City Manager proposed the appointment of Rex Walker as probationary
Supervisor of Zoning and Inspection, effective June 10, 1957.
IIIOn motion of Councilman Davis, seconded by Councilman Jorvig, the Council
gave its consent and approval to the City Manager's appointment of Rex Walker as
probationary Supervisor of Zoning and Inspection, effective June 10, 1957, by
unanimous vote of all members of the Council present.

erified claims prepared by the Director of Finance and presented to the
Council, dated May 20, 1957, in the total amount of $9,443.06 for vendors were
approved, and the City Manager, City Clerk, and City Treasurer were authorized
to issue checks covering same, by unanimous vote of all members of the Council
present.

On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the follow-
ing payments on contract work, presented by the City Engineer were approved, and
the City Manager, City Clerk, and City Treasurer were authorized to issue cheeks
