Fernstrom at 8104 p.m. Invocation was given by Rev. Engstrom of the Aldersgate Methodist Church. The following Councilmen were present at roll call: H. C. Davis Robert Ehrenberg Torval Jorvig Gene Schadow Kenneth Wolfe Also present were the City Manager, City Attorney, City Manager Interne, Don Sorenson and the Secretary. - Minutes On motion of Councilman Jorvig, seconded by Councilman Ehrenberg, the minutes of meeting held February 25;1957, were approved, by unanimous vote of all members of the Council present. Application for Renewal of License to Sell Non-Intoxicating Malt Liquor On-Sale Veterans of Foreign Wars #5632 On motion of Councilman Wolfe, seconded by Councilman Schadow, the application of the Veterans of Foreign Wars #5632 for renewal of license to sell non-intoxica- ting malt liquor on-sale (Club bicense) was approved by udanimous vote of all members of the Council present. Communication from Adolph Fine regarding Parking for Bowling Alley Request from Adolph Fine regarding use of residential zoned land at NW corner of Virginia Avenue and Minnetonka Boulevard for parking for proposed ' bowling alley (letter dated March 4, 1957 brought in by Ralph Wormebecker) was read. - _On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above matter was ordered placed on the agenda for March 11, 1957 and referred to the Planning Commission for advice and recommendation, by unanimous vote of all mem- bers of the Council present. Request for Building Permit for Service Station at 4701 Excelsior Blvd.-Standard Oil Request from Standard Oil Company, dated March 1, 1957, for approval of the issuance of a building permit for the construction of a service station at 4701 Excelsior Boulevard was read. On motion of Councilman Ehrenberg, seconded by-Councilman Shadow, the City Manager was directed to get further -information as to finish of building and approaches and also requested that a representative of the Company be present at a Council meeting, by unanimous vote of all members of the Council present. 396 Gm6�f March 4, 1957 Request for Special Sign Permit - 4501 Excelsior Blvd. , Macey Signs Inc. Request for special permit under authority of Section 10.3-20 of the Zoning Ordinance for erection of a 10' x 17' (170 sq.ft.) sign and also a request for variation of the setback requirements of the Zoning Ordinance. under authority of Section 20.4-6 to permit location of the same sign with- out the required setback at 4501 Excelsior Boulevard (Gross-Kronick Cleaners) from Macey Sign was presented to the Council. On motion of Councilman Wolfe, seconded by Councilman jorvig, the above request was referred to the Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. Re Request for Building Permit at 3351/Public Avenue by Clarence Bros. Request for approval of the issuance of a building permit for the addition to the south side of 3351 Republic Avenue (machine shop) by Clarence K. Bros was presented to the Council. On motion of Councilman Jorvig, seconded by Councilman Schadow, the building inspector was authorized to issue permit Pet' for an addition to the south side of 3351 Republic Avenue (machine shop) subject to compliance with all applicable codes, by unanimous vote of all members of the Council present. Request for Rezoning Lots 14. 15, Block 4, Sunset Gables 2nd Add. - Horovitz Request from Bernard Horovitz, dated February 25, 1957, for rezoning - of Lots 14 and 15, Block 4, Sunset Gables 2nd Addition (joppa Avenue between Minnetonka Boulevard and Sunset Boulevard) from Residential Use District to Commercial Use District was read. On motion of Councilman jorvig, seconded by Councilman Ehrenberg, the above request to rezone lots 14 and 15, Block 4, Sunset Gables 2nd Addition was referred to the Planning Commission for advice and recommendation by unanimous vote of all members of the Council present. On motion of Councilman Wolfe, seconded by Counok man Schadow, the Plann- ing Commission is requested to consider the same type use on Lots 5 and 6, Block 4, Sunset Gables' 2nd Addition by unanimous vote of all members of the Council present. Mr. Nelson Regarding Storm Sewer Pipe Line on 16th Street Mr. Nelson of Ford Road inquired if City would now permit Village of Minnetonka to construct a storm sewer pipe on 16th Street to Highway No. 18. The Council explained that the situation had not changed since the last dis- cussion with him. y•� 397 March 4, 1957 Fees First Reading of Proposed Ordinance Amending Ordinance 525 Re. Exemption of Permit/ First reading of Ordinance Amending Ordinance No. 525 with regard to ex— emptions- of Permit fees was waived by unanimous consent of all, Members of ;the Council present. It was moved by Councilman Schadow, seconded by Councilman Ehrenberg, that the second reading of Proposed Ordinance be made on March 11, 1957.-- Motion was passed by unanimous vote of all members of the Council present. First Reading of Proposed Ordinace Prohibiting the Sale of Baby Chicks etc. First reading of Proposed Ordinance Prohibiting the Sale of Baby Chicks, Other Fowl and Rabbits was waived by unanimous consent of all members of the Council present. It was moved by Councilman Wolfe, seconded by Councilman Jorvig, that the second reading of Proposed Ordinance be made oh March 11, 1957. Motion was passed by three yeas and two nays. Mayor Fernstrom abstained from voting. On motion of Councilman Davis, seconded by Councilman Jorvig, the City Attorney was, requested to carefully delineate the specific animals and fowl the sale 6f which is to be prohibited and bring in change for March 11th meeting, by four Councilman,voting yea and tiro ,Councilman voting.nay. Hirst Reading of Proposed Ordinance Regulating Gasoline Service Stations First reading of Proposed Ordinance Regulating Gasoline Service Stations was waived by unanimous consent of all members of the Council present. It was moved by Councilman Ehrenberg, seconded by Councilman Schadow, that the second reading of Proposed Ordinance be made on March 11, 1957. Motion was passed by unanimous vote of all members of the Council present. First Reading of Proposed Ordinance Prescribing the Term of all Licenses First reading .of Proposed Ordinance prescribing the term of all licenses issued by the City Manager was waived by unanimous consent of all members of the Council present. • It was moved by Councilman Schadow, seconded by Councilman Jorvig, that the second reading of the"Proposed Ordinance be made on March 11, 1957, Motion was passed by unanimous vote of all members of the Council present. Financial Report — January 31. 1957 The City Manager presented the Financial Report for the period ending January_•31, 1957. On motion of Councilman Schadow, seconded by Councilman ,Jorvig, the Financial Report for the period ending January 31, 1957 was received for filing, by ungnimous vote of all members of the Council present. 398 c—D March 4, 1957 Report on Storm Sewer for Area of Minnetonka Boulevard Report from the Director of Public Works, dated March 1, 1957, on storm sewer for area of Minnetonka Boulevard — 28th Street, France Avenue to Quentin Avenue,as requested January 21, 1957, was read. On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the above--matter was referred to the Committee of the Whole for the meeting of March 7, 1957, by unanimous vote of all members of the Council present. Report Regarding Proposed Procedures and Standards for Establishing Uniform Practices in Construction and Maintenance of Streets and Utilities Report from the Director of Public Works regarding Proposed Procedures and Standards for Establishing Uniform Practices in Construction and Maintenance of Streets and Utilities, as requested by the City Council in fall of 1956) was read. On motion of Councilman Davis, seconded by Councilman Schadow, the City Attorney was directed to prepare a resolution adopting the above Procedures and Standards for Establishing Uniform Practices in Construction and Maintenance of-Streets and Utilities as a Policy of the Council to be ready for the March 11, 1957 meeting, by unanimous vote of all members of the Council present. Request of Mary K. Harris For A Temporary Special Permit The request of Mary K. Harris for a temporary special permit, under the provisions of Section 10.2 (5) of the Zoning Ordinance for the operation of a nursing home in a Residential Use District (deferred from February 11, 1957) was discussed. Attorney John Yngve was present at the meeting. On motion of Councilman Wolfe, seconded by Councilman Ehrenberg, hearing date on the request of Mary K. Harry for a temporary special permit, under the provisions of Section 10.2(5) of the Zoning Ordinance for the operation of a nursing home in a Residential Use District was set for March 18, 1957, by unani— mous vote of all members of the Council present. 1}eport on Costs of the Northside Sanitary Trunk Sewer Report by the City Assessor, dated March 1, 1957, on the costs of the Northside Sanitary Trunk Sewer (deferred from February 25, 1957) was read. On motion of Councilman Schadow, seconded by Councilman Davis, it was determined that the assessment of the Northside Sanitary Trunk Sewer, be made on a front foot basis, with the City Property excluded from assessment, by five Councilman voting yea and Councilman Ehrenberg voting nay. 399 March 4, 1957 Termination of employment of Clerk II. Street Department A motion was made by Councilman Wolfe, seconded by Councilman Schadow, to consent and approve the termination of employment of Clerk II, Street Departments effective March 20, 1957, by 'unanimous vote of all members of the Council present. Bonds On motion of Councilman Davis, seconded by Councilman Jorvig, the following bonds which have been approved by the City Attorney were accepted by unanimous vote of all members of the Council present. Swanson i Schiager Plumbing Company - Plumbing Verified Claims On motion of Councilman Jorvig, seconded by Councilman Wolfe, the lists of verified claims prepared by the Director of Finance and presented to the Council, dated March 4, 1957, in the total amounts of $1,144.74 for payroll, and $16,290.05 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by unanimous vote of all members of the Council present.
