HomeMy WebLinkAbout1957/03/25 - ADMIN - Minutes - City Council - Regular 418 COUNCIL MEETING - March 25, 1957 A regular meeting of the City Council was called to order by Mayor R. C. Fernstrom at 8:06 p.m. • Invocation was given by Rabbi Liebhaber of the Btnai Abram Synagogue. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis - Robert Ehrenberg - Gene Schadow Kenneth Wolfe Also present were the City Manager, City Attorney and the City Manager Interne. Minutes On motion of Councilman Schadow, seconded by Councilman Bolmgren, the minutes of meeting held March 18, 1957, were approved, by unanimous vote of all members of the Council present. Request to Play Bingo by Oak Hill -- Park Knoll P.T.A. Notification of intent of the PTA,groups of Park Knoll and Oak Hill Schools to hold a bingo game on April 27, 1957 at the Park Knoll School was read. On motion of Councilman Wolfe, seconded by Councilman Davis, the above letter was ordered filed, by unanimous vote of all members of the. Council present. Request for 'Approval of Replat of Blk. 1 ' 2. Westdale Addition Request for approval of final replat of Block 1 and 2, Westdale Addition, by Wallace T. Bruce, Inc. , and report from the Director of-Public Works were read. On motion of Councilman Schadow, seconded by Councilman Wolfe, action on the above request for approval of final replat of Block 1 and 2, Westdale Addition, was deferred until Director of Public Works reports that requirements have been met, by unanimous vote of all members of the Council present. Request for Rezoning Part of Tracts B and C. R.L.S. No. 176. etc. Request for rezoningart of Tracts B and C, of Registered Land-Survey No. 176, and part of the SE 1/4 of -the SE 1/4 of Section 7 Township 117, Range 21, (2900 block between Virginia Avenue and Wyoming Avenue) from Residential Use District -to Commercial Use District by Texa Tonka Shopping Center Inc, dated March 22, 1957, was read. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the above request for rezoning was referred to the Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. 1 419 March 25, 1957 Request for approval of Preliminary Plat of Minnehaha Gables 2nd Addition Request for approval of preliminary plat of Minnehaha Gables Second Addition, by M. P. Johnson, and advice from Secrdtary of the City Planning Commission that plat is in proper form. A motion was made by Councilman Wolfe, seconded by Councilman Schadow, to place the plat on file and to refer to the City Planning Commission and City Engineer for examination and report,/by unanimous vote of all members of the Council present. and carried On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the City Clerk was directed to publish notice of public hearing before Planning Commi- ssion on April 3, 1957, by unanimous vote of all members of the Council present. Communication from Northwestern Bell Telephone Company Regarding Senate Bill 1358 Communication of the Northwestern Bell Telephone Company soliciting the City's support of Senate Bell 1358 relating to reimbursement of the cost of re- locating utility facilities in connection with the Federal Interstate System of Highways, dated March 22, 1957, was read. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the above letter was ordered filed, by unanimous vote of all 'members of the Council preseht. Request to Erect Two Signs at 5600 West Lake Street-Western Oil & Fuel Company Request for variation of the setback requirements of the Zoning Ordinance under authority of Section 20.4-6, to permit location of two signs without the required setback at 5600 West Lake Street, by Western Oil & Fuel Company, dated March 22, 1957 was read. On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, the above request was referred to the Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. Second Reading of Proposed Ordinance Amending Ordinance No. 481 -Ordinance No. 568 On motion of Councilman Ehrenberg, seconded by Councilman Wolfe, the second reading of Ordinance No. 568, Amending Ordinance No. 481 Relating to Fire Hazards, was waived and the Ordinance was adopted by unanimous vote of all members of the Council present. Second Reading of Proposed Ordinance Amending Ordinance No. 524 Relating to Disposal of Garbage and Refuse - Ordinance No. 569' _ On Motion of Councilman Davis, seconded by Councilman Ehrenberg,-the second reading of Ordinance No. 569, Amending Ordinance No. 524 Relating to Disposal of Garbage and Refuse, was waived and the Ordinance was adopted by unanimous vote of all members of the Council present. 420 March 25, 1957 Second Reading of Proposed_Ordinance Re: Taxicabs and Drivers — Ordinance No.570 A motion was made by Councilman Davis, seconded by Councilman Wolfe, to remove the first clause of Section 2:2324 from Ordinance No. 570 Regulating ' and Licensing Taxicabs and Taxicab Drivers and Providing Penalties for the Violation Thereof. Motion was passed by unanimous vote of all members of the Council present. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the second reading of ,Ordinance No. 570 Regulating and Licensing Taxicabs and Taxicab Drivers and Providing Penalties for the Violation Thereof was waived and the Ordinance was adopted as corrected, by unanimous vote of all members of the Council present. Second Reading of 'Proposed Ordinance Prohibiting Sale of Baby Chicks etc. Ord. 571 Second reading of Proposed Ordinance Prohibiting the Sale of Baby Chicks, other Fowl and Rabbits and Providing Penalty for Violation,•-Ordinance No. 571, was read. On motion of Councilman Wolfe, seconded by Councilman Davis, Ordinance No. 571 was adopted by the following ,roll.'call ,vote; Councilman Bolmgren, yea; Councilman Davis, Yea; Councilman Ehrenberg, nay; Councilman Schadow, nay; Councilman Wolfe, yea; Mayor Fernstrom, yea. Second Reading of Proposed Ordinance Vacating Portion of Independence Ave. Second Reading of Proposed Ordinance Vacating Portion of Independence Avenue (deferred from February 18, 1957). _ On motion of Councilman Schadow, seconded by Councilman Wolfe, action on above ordinance was deferred until Director of Public Works has reported that replat of Block 1 and 2, Westdale Addition is acceptable, by unanimous vote of all members of the Council present. Communication from the Metalbestos Division of William Wallace Company Communication from the Metalbestos Division of the William Wallace Company regarding masonry chimneys (deferred from March 18, 1957). On motion of Councilman Schadow, seconded by Councilman Davis, the above letter was ordered filed, by unanimous vote of all members of the Council present. Re: Construction of Retaining Wall — Nevada Avenue and Minnetonka Blvd. Construction 'of retaining wall along the west property line of Nevada Avenue' from Minnetonka Boulevard to a point 1711 north thereof (7400 Minnetonka Boulevard) was discussed, and the decision was reached that the City has no obligation in this case. 421 March 25, 1957 Re: Storm Drainage in Front of Dr. Porter's Property Councilman Bolmgren discussed the problem of storm drainage in front of Dr. Porter's, property on Highway No. 7. On motion of Councilman Schadow, seconded by Councilman Bolmgren, the City Manager was directed to write to the State Highway Commission with regard to storm drainage on Highway No. 7, by unanimous vote of all members of the Council present. Regarding Asbury Methodist Hospital Building Mr. Retherford, Vice President of the Board of Asbury Methodist Hospital, appeared. He had several questions concerning the proposed hospital building, particularly in regard to easements and drainage-on the property. After consider— able discussion, it was decided that the southernmost storm sewer' outlet on the property might be diverted, and that Mr. Reterford would submit a letter detailing his various requests. A motion was' made by Councilman Davis, seconded by Councilman Wolfe, that the City Manager and City Attorney investigate the situation; search for permission or easements for Brooklawns storm sewer outlet; and report back to the Council. Motion was passed by unanimous vote of all members of the Council present. Regarding Temporary Clubhouse at Westwood Hills James Pitts, Westwood Hills Construction, requests permit for temporary clubhouse at Westwood Hills Golf Course. He was informed that the building permit could be issued by the Building Inspector's office without Council approval. Regarding Footing for Cambridge Avenue Bridge Discussion of footing for proposed Cambridge Avenue bridge (requested by Councilman Davis) Councilman Davis reported that the Railroad has now designed bridge with footing over sanitary sewer line. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the above matter was referred to the City Manager for advice and report on April 1, 1957, by unanimous vote of all members of the Council present. Letter from Society of Residential Appraisers Mayor Fernstrom read a letter from the Society of Residential Appraisers concerning a recent panel discussion which included the City Assessor, and asked that it be placed on file. 422 March 25, 1957 Verified Claims On motion of Councilman Bolmgren, seconded by Councilman Schadow, the lists of verified claims prepared by the Director of Finance and presented to the Council, dated March 25, 1957, in the total amount of $18,346.03 for vendors was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by unanimous vote of all, members of the Council present.
