HomeMy WebLinkAbout1957/02/18 - ADMIN - Minutes - City Council - Regular 384 Council Meeting — February 18, 1957 A regular meeting of the City Council was called to order by Mayor R. C. Fernstrom at 8:06 p.m. Invocation was given by Rev. Lloyd Nordstrom of the Park Baptist Church. The following Councilmen were present at roll call: H. C. Davis Robert Ehrenberg Torval Torvig Gene Schadow Kenneth Wolfe Also present were the City Manager, City Manager Interne, Don Sorenson and the Secretary. The City Attorney arrived at 8:45 p.m. Minutes On motion of Councilman Jorvig, seconded by Councilman Ehrenberg, the minutes of meeting held February 11, 1957, were approved, by unanimous vote of all members of the Council present. Request for Special Use Permit to Authorize a Recreational Building Letter received from Attorney Maurice W. Graham, dated Febrary 8, 1957, representing Standard Plumbing Company, for (1) special use permit/authorize a recreational' building in a .Commercial Use District, -for (2) special permit to authorize commercial parking in a Residential Use District -and for (3) a waiver of set back requirements along Utah Avenue; all in connection with a proposed . bowling alley at 8015 Minnetonka Boulevard, (This was informally before the Planning Commission February 6, 1957, at which time it was tabled pending a formal request and a complete site plan) was read. On motion of Councilman Jorvig, seconded by Councilman Ehrenberg, the above request was referred to the Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. Resolution No. 368 — Setting Hearing Date for Improvement No. 56-52 Resolution No. 368, entitled Resolution Setting Supplementary Hearing on Proposed Sanitary Sewer Construction (Northside Sanitary Trunk Sewer, Improvement No. 56-52) for March 11, 1957, was .read by the Secretary. On motion of Councilman Schadow, seconded by Councilman Jorvig, Resolution No. 368 was adopted by unanimous vote of all members of the Council present First Reading of Proposed Ordinance Regulating the Licensing of Persons Installing Water Softeners First reading of Proposed Ordinance Regulating the Licensing of Persons installing water softeners (deferred from February 11, 1957) was waived by unani— mous consent of all members of the Council present. 385 February 18, 1957 111 First_Reading of Proposed Ordinance Licensing Persons Installing Water Softeners continued It was moved by Councilman Wolfe, seconded by Councilman Jorvig, that the second reading of Proposed Ordinance Licensing Persons Installing Water Softeners be made on February 25, 1957. Motion passed by unanimous vote of all members 'of the Council present. First Reading of Proposed Ordinance Vacating a portion of Independence Avenue First Reading of proposed ordinance vacating a portion of Independence Avenue in Westdale Addition was waived by unanimous consent of all members of the Council present. It was moved by Councilman Davis, seconded by Councilman Wolfe, that the second reading be deferred until the Council has been presented with a final plat of replat of Westdale Addition, Block 1 and 2. Motion passed by unanimous vote of all members of the Council present. Report of City Activities for January 1957 The City Manager's report -of City Activities for January 1957 was pre— ' sented to the Council. On-motion,of Councilman Schadow, seconded by Councilman Jorvig, the City Manager's report was accepted and ordered placed on file, and the City Manager and staff be commended, by unanimous vote of all members of the Council present. -Report Concerning the Heating and Air Conditioning Examination Board. The City Manager explained that the Heating and Air Conditioning Examina— tion Board is a voluntary board. It is their desire that the City Ordinance state th'),t applicants for license should be examined by such a Board. On motion df Councilman Davis, seconded by Councilmanjorvig, it was re— referred to the City Manager to watch the progress of,this Board and report back to the Council when he/ Iething to report, by unanimous vote of all members of the Council present. Report Concerning Condition of Property at Hampshire Ave. and Wayzata Boulevard The City Manager explained the situation of the Elliot Anderson property located at Hampshire Avenue and Wayzata Boulevard. On motion of Councilman Davis, seconded by Councilman Ehrenberg, the City Manager was directed to direct the City Attorney to proceed under the Bond-placed at the time permit was issued in 1954, to enforce the requirements of the permit, by unanimous vote of all members of the Council present. 111 386 • February 18,1957 Report on Sidewalk, Boulevard Grading, Steps and Sodding. Improvement No. 57-5 Preliminary report, dated February 14, 1957, of the Engineer and re- commendation of City Assessor with respect to petitioned sidewalk, boulevard grading, steps and sodding, Improvement No. 57-5 was read. Resolution No. 369 Resolution No. 369, entitled Resolution Setting Hearing on Proposed Sidewalk, Boulevard Grading, Steps and Sodding, to be March 4, 1957, was read by the Secretary. (Improvement No. 57-5) On motion of Councilman Schadow, seconded by Councilman Ehrenberg, Re- solution No. 369 was adopted by unanimous vote of all members of the Council present. Report on Curb and Gutter Improvement Nos. 57-1 thru 57-4 Preliminary report, dated February 13, 1957, of the Engineer and re- commendation of the City Assessor with respect to petitioned curb and gutter, Improvement Nos. 57-1 thru 57-4 was read. Resolution No. 370 Resolution No. 370, entitled Resolution Setting Hearing on Proposed Curb and Gutter Improvements Nos. 57-1 thru 57-4 to be March 11, 1957, was read by the Secretary. On motion of Councilman Schadow, seconded by Councilman Jorvig, Resolu- tion No. 370 was adopted by unanimous vote of all members of the Council present. Report of Assessable Costs on Northside Sanitary Trunk Sewer (Lnpr. No.56-52) etc. Report from the City Assessor, dated February 15, 1957 to compare assess- -able costs used in connection with the August 20th hearing on the Northside Sanitary Trunk Sewer (Improvement No. 56-52) with assessable costs resulting from the G. M. Orr preliminary design and cost estimates was read. No action taken, Award of Contract for Pumps, Piping, Appurtenances etc. As advertised in the St. Louis Park Dispatch, January 31, 1957, sealed bids were received by the City Manager at 10 o'clock a.m. February -14, 1957 for furnishing and installing a new booster pump, piping, electrical equipment and appurtenances in the pump house Well No. 7/ from the following bidders. etc. Max Renner Well Co. , Inc. $15,481.00 Bergerson-Caswell Inc. 19,000.00 The Director of Public Works recommended that the Contrat be awarded to Max Renner Well Co., Inc. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the bid of Max Renner Well Co. , Inc. at $15,481.00, was determined to be the lowest bid of a ; responsible bidder and the Mayor and City Manager were authorized to execute contract in behalf of the City for same by unanimous vote of all members of the Council present. 387 February 18, 1957 Request of Bernard Horovitz for Special Use Permit- Deferred from February 4, 1957 On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the request of Bernard Horovitz for special use permit under sections 10.3-23 and 10.3-25 of the Zoning Ordinance to construct a commercial building on the north side of Lake Street between Inglewood and Joppa Avenues was deferred to February 25, 1957, by unanimous vote of all members of the Council present. Request of Allan Garrison for Approval of Building Permit-Deferred from Feb. 11, 1957 On motion of Councilman Jorvig, seconded by Councilman Schadow, the re- quest of Allan Garrison for approval of the issuance of a building permit for the construction of an office and warehouse at 3855 Edgewood Avenue was deferred until the Council hears from Mr. Garrison, by unanimous vote of all members of the Council present. Request of Mary K. Harris for a Temporary Special Permit-Deferred from Feb. 11, 1957 On motion of Councilman Wolfe, seconded by Councilman Schadow, the request of Mary K. Harris for a temporary special permit, under the provisions of Section 10.2 of the Zoning Ordinance for the operation of a nursing home in a Residential Use District was deferred until the Council hears further from the petitioner, by unanimous vote of all members of the Council present. Preliminary Design of the Northside Sanitary Sewer On motion of Councilman Davis, seconded by Councilman Schadow; the Prelim- inary design of the Northside-Sanitary Trunk Sewer prepared and submitted by G. M. Orr Engineering Company was approved and the G. M. Orr Engineering Company was directed to prepare and submit the finished design as soon as possible, by unani- mous vote of all members of the Council present. Exemptions from Requirements of Building Code (Ord. 525) and Mechanical Codes (Ord. 555) Exemptions from requirements of Building Code (Ordinance 525) and Mech- anical Codes (Ordinance 555) with respect to permit 'fees was discussed by the City Manager and the City Attorney was requested to prepare amend ments to ord- inance regarding exemptions to permit fees. Tom Renner - Regarding Well Users Tom Renner spoke about well users, who take out their pumps and use the wells for sumps. He said,! that the Well-Diggers Association was quite concerned, relative to possible contamination of water by this usage. He was asked to bring in some material for City Attorney to study. 111 388 February 18, 1957 City Attorney Report on Alley Block 3, Park Manor A motion was made by Councilman Davis, seconded by Councilman Ehrenberg, to approve the City Attorney's recommendation for stipulation between the City and the Minneapolis, Northfield and Southern Railway in proceeding for condemna- tion of alley in Block 3, Park Manor providing for dedication by the Railway of alley right of way over Lots 29 and, 30 at no cost to the city in consideration of waiver by the city of assessment against said lots for cost of grading and original improvement of said alley. Councilman Jorvig to go to Annual Planning Conference of American Society of Planning Officials On motion,of Councilman Schadow, seconded by Councilman Wolfe, Councilman Jorvig was authorized to attend the Annual Planning Conference of the American Society of Planning Officials to be held at San Francisco, California, March 17 thru 21,' 1957 with necessary expenses paid, and carried by six Councilman voting yea. Councilman Jorvig, not voting. Verified Claims On motion of Councilman Schadow, seconded ,by Councilman Jorvig, the lists of verified claims prepared by the Firector of Finance and presented to the Council, dated February 18, 1957, in the total amounts of $1,300.90 for payroll, and $64,530.23 for vendors were approved, and the City.Manager, City Clerk, and City __Treasurer were authorized to issue checks covering same, by five Councilman voting yea. Councilman Ehrenberg was out of the room at the time the vote was taken. • Payment on Contract Work On motion of Councilman Schadow, seconded by Councilman Wolfe, the follow- ing payment on contract work, presented by the City Engineer was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks for their respective amounts, by unanimous vote of all members of the Council present. PAYMENT NO. 10 Joint Improvement for the Village of Golden Valley and the City of St. Louis Park Contract Price, $678,536.50 Contractor, Nodland-Barbarossa Company Amount of this payment, $89,514.00 St. Louis Park's Share, $22,378.50 Meeting Adjourned On motion of Councilman Davis, seconded by Councilman Wolfe, the meeting was adjourned at 11:04 P.M. , by unanimous vote of all members of the Council present.
