C. Fernstrom at 8:12 P.M. Invocation was given by Rev. Stewart Dale of the First Lutheran Church. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis Robert Ehrenberg Torval Jorvig Gene Schadow Kenneth Wolfe Also present were the City Manager, City Attorney, City Manager Interne and the Secretary. Minutes On motion of Councilman Jorvig, seconded by Councilman Schadow, the minutes of meeting held January 14, 1957, were approved, by unanimous vote of all members of the Council present. Claim for Damages - Samuel Ilstrup. 3800 Natchez Avenue Claim for damages from Samuel Ilstrup, 3800 Natchez Avenue, dated December 20, 1956, allegedly resulting from improper maintenance of street at 3800 Natchez Avenue was presented to the Council. On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, the claim of Samuel Ilstrup, 3800 Natchez Avenue, for damages, dated December 20, 1956 was referred to the City Attorney for advise and recommendation, by unani- mous vote of all members of the Council present. Communication from the St. Louis Park Firemen's Relief Association Regarding Laws Communication from the St. Louis Park Firemen's Relief Association concerning propsed changes in the State Firemen's Relief Association law was read. Maynard Kays, Donald Glassing and Irving Freeland were present and considerable discussion was had. A motion was made by Councilman Jorvig, seconded by Councilman Bolmgren, to approve the proposed Bill as revised by City Attorney except for escalator provi- sion and the City Attorney to prepare resolution approving the proposed bill for passage by the legislature at meeting of January 28, 1957. •O A motion was made to mend the above motion. //motion of Councilman Schadow, seconded by Councilman Wolfe, 7above motion was amended to include the escalator clause, by unanimous vote of all members of the Council present. 1359 January 21, 1957 Regarding St. Louis Park Firemen's Relief Association Laws continued A vote was then taken on motion as amended and passed by unanimous vote of all members of the Council present. Communication from Northern States Power Company regarding Rates for 1957 Communication from Northern States Power Company, dated January 11, 1957, concerning rates for 1957, was read. On motion of Councilman Wolfe, seconded by Councilman Ehrenberg, the above communication was ordered placed on file, by unanimous vote of all members of the Council present. Request for Approval of Building Permit at 23rd Street and State Highway No. 100 Request from Twin City Lino Service, Inc, 700 South Fourth Street, dated January 11, 1957, for approval of the issuance of a building permit for the con- struction of. an office, display and storage building at 23rd Street and State Highway No. 100 was read. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the building inspector was authorized to issue permit for construction of building at 23rd Street and State Highway No. 100, subject to compliance with all applicable codes, by unanimous vote of all members of the Council present. Request to Play Bingo by Most Holy Trinity Home-School Association Notification from the Home-School Association -of Most Holy Trinity Parish, dated January 16, 1957, of their intent to hold a Bingo game, January 28, March 11, and April 29, 1957 in the School Hall for the benefit of the School Library, was read. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, .the above . Letter was ordered placed on file, by unanimous vote of all members of the Council present. Request for Special Permit for Erection of Sign at 6315 Minnetonka Blvd. - General Outdoor Advertising Co. Request from General Outdoor Advertising Company, dated January 17, 1957, for a special permit Under authority of Sections 10.3-20 and 10.5 of the zoning Ordinance for erection of a 12 x 24 1/2' (294 sq. ft.) sign at 6315 Minnetonka Boulevard was read. Resolution No. 360 Resolution No. 360, entitled Resolution Granting Permit Under Section 10.3 of the Zoning Ordinance of the City of St. Louis Park, was read by the Secretary. On motion of Councilman Jorvig, seconded by Councilman Bolmgren, Resolution, No. 360 was adopted by all Councilmen voting yea except Councilman Ehrenberg voting nay. 360 tittl January 21, 1957 Petition for Vacation of Part of Independence Avenue Petition from Wallace T. Bruce, Inc., dated January 14, 1957, for Vacating "All that part of Independence Avenue as dedicated in the Plat of Westdale, lying north of the Southerly line of Lot 19, Block 2, Westdale extended westerly to the west line of Independence Avenue, dedicated in the preliminary plat of Westdale, was read. On motion of Councilman Davis, seconded by Councilman Jorvig, February 11, 1957 was the hearing date set for the vacation of part of Independence Avenue dedicated in the preliminary plat of Westdale, by unanimous vote of all members of the Council.present. Request for Building Permit for Addition to Super Value Store 'attLilac Way Request from-N. B. Phillips, dated January;18, 1957, for approval of the issuance of a building permit for the construction of an;addition to the Super Value Store at the Lilac Way Shopping Center was read. On motion of Councilman Schadow, seconded by Councilman Jorvig, the building inspector was authorized to issue permit for construction of above addition to building subject to compliance with all applicable codes, by unani- mous vote of all members of the Council present Communication from Adolph Fine Concerning Preliminary Plat by R. J. Westling Communication from Adolph Fine, dated January 17, 1957, concerning pre- liminary plat submitted by R. J. Westling on January 14, 1957 was read. On motion of Councilman Davis, seconded by Councilman Wolfe, the above communication was referred to the Planning Commission for advise and recommenda- tion by unanimous vote of all members of the Council present. Communication from Sidney Blacker, 2915 Glenhurst Ave. Regarding zoning of Property South of Eliot View Road Communication received from Sidney G. Blacker, 6905 W. 23rd Street, dated January 17, 1957, concerning zoning of property south of Eliot View Road and East of Hampshire Avenue was read. Mr. Blacker was present and discussed this matter in line with petition filed December 3, 1956. The Council.determined that no action be taken at this time. On motion of Councilman Wolfe, seconded by Councilman Bolmgren, the above communication was ordered placed on file by unanimous vote of all members of the Council present. Resolution Regarding Suburban Gas Rates - Resolution No. 361 Resolution No. 361, entitled Resolution Authorizing Joint Agreement Relating to Investigation of Suburban Gas Rates, (deferred from January 14, 1957) was read by the Secretary. H 361 January 21, 1957 Resolution No. 361 continued On motion of Councilman Davis, seconded by Councilman Ehrenberg, Resolution No. 361 was adopted by unanimous vote of all members of the Council present. Resolution No. 362 Approving Securities from Citizens State Bank Resolution No. 362, entitled Resolution Approving Securities for Collateral From Citizens State Bank of St. Louis Park, was read by the Secretary. 7 On motion of Councilman Wolfe, seconded by Councilman Holmgren, Resolution No. 362 was adopted by unanimous vote of all members of the Council present. First Reading of Proposed Ordinance Relating to Membership of Planning Commission The First reading of proposed ordinance relating to membership of the Mann- _ ing Commission was deferred. On motion of Councilman Wolfe; seconded by Councilman Jorvig, the First Reading was deferred to January 28,, 1957, 'by unanimous vote of all members of the Council present. First Reading of Proposed Ordinance Regulating the Construction, etc. , of Incinerators First reading of proposed ordinance, entitled An Ordinance Regulating the Construction, Operation and Maintenance of Commercial Incinerators, was made by the Secretary. ° On motion off' Councilman Schadow, seconded by Councilman Jorvig, the above proposed Ordinance was referred to the City Manager for more information and report to the Council February 4, 1957, by unanimous vote of all members of the Council present. First Reading of Proposed Ordinance Relating to Disposal of Garbage etc. First reading of Proposed Ordinance Amending Ordinance No. 524 Relating to Disposal of Garbage and Refuse, was made by the Secretary. On motion of Councilman Schadow, seconded by Councilman Jorvig, the above Proposed Ordinance was referred to the City Manager for more information and report to the Council February 4, 1957, by unanimous vote of all members of the Council present. Second Reading of Proposed Ordinance Regulating Plumbing, Electrical Wiring. etc. Second Reading of Proposed Ordinance Regulating Plumbing, Electrical Wiring, Gas Piping, Heating, Ventilating and Air Conditioning Installation Adopting by Reference Ordinance Codes Relating Thereto, and Repealing Inconsistent Ordinances was waived by unanimous consent of all members of the Council present. 362 January 21, 1957 Proposed Ordinance Regulating Plumbing, Electrical Wiring etc.-continued On motion of Councilman Wolfe, seconded by Councilman Schadow, Ordinance No. 5551. An Ordinance Regulating, Plumbing, Electrical Wiring, Gas Piping, Heating, Ventilating and Air Conditioning Installation, was adopted as amended by suggested amendments prepared by City Attorney to Sections 5.203 - 5.304 - 5.404 and 5.503a authorizing permits to unlicensed persons. Motion to amend above motion: On motion of Councilman Davis, seconded by Councilman Jorvig, the above motion was amended, "to remove from Sec. 5.502 the elimination of Section 13(D) of the Minneapolis Electrical Code", by unanimous vote of all members of the Council present. A vote was then taken on motion as amended and the Ordinance No. 555 as amended was adopted by six yeas and Councilman Jorvig voting nay. Councilman Jorvig requested that the records show that his objection was to the Amendment to 5.203 as follows or: "to persons making application to do any such work wholly within a residence owned and occupied by the applicant to whom the permit is to be issued". City Manager's Report on Salaries Report from the City Manager, dated January 17, 1957, on salaries of sel- ected employees of Suburban Municipalities was read. (M & C 57-2) Six of the City Employees, and Union Representative of Local No. 49, Mr. Mc Lellan were present at the meeting. A motion was made by Councilman Ehrenberg, seconded by Councilman Davis, that the recommendation of City Manager, dated January 17, 1957,( M C No. 57-2) be accepted and that there be no change in the range of pay of Equipment Operator II. Motion was passed by six yeas and one nay, Councilman Jorvig voting nay. Report on Re-Routing of Storm Sewer On Inglewood Avenue - Report from Director of Public Works, dated January 18, 1957, on the re- routing of Storm Sewer at Inglewood Avenue and--Sunset Boulevard was read. A motion was made' by Councilman Ehrenberg, seconded by Councilman Wolfe, that the matter be referred to the City Manager for additional information as to possibility of serving a larger area and to obtain cost etc. Motion was passed by unanimous vote of all members of the Council present. Petition for Acceptance of Dedication of Street at 23rd - Twin City Lino Service Petition received from Twin City Lino Service and others, deferred from Jan- uary 14, 1957 meeting, requesting the acceptance of dedication of street at 23rd Street and Highway No. 100 was withdrawn. 111 363 January 21, 1957- 111 Plans and Specifications for Wells No. 1. 2 and 7 Plans and Specifications for pumping equipment at Wells No. 1, 2 and 7 were presented to the Council. On motion of Councilman Bolmgren, seconded by Councilman Davis, the above Plans and Specifications were approved and the City Manager was authorized to advertise for Bids by unanimous vote of all members of the Council present. Appointment of Florence L. Schmidt as Probationary Clerk I The City Manager proposed the appointment of Florence L. Schmidt as proba- tionary Clerk I, effective January 22, 1957. On motion 'of Councilman Ehrenberg, seconded by Councilman Jorvig, the Council gave its consent and approval to the City Manager's appointment of Florence L. Schmidt as probationary Clerk 1, effective January 22, 1957, by unanimous vote of all members of the Council present. Overhead Street Lighting Contract with Northern States Power Company The City Manager presented to the Council, for their approval, the new five year Proposed Overhead Street Lighting Agreement' with Northern States Power Company (M&C- No. 57-3) commencing March 1, 1957. On motion of Councilman Davis, seconded by Councilman Wolfe, the agreement between the City and the Northern States Power Company was approved and the Mayor and City Manager were authorized to execute same in behalf of the City, by unani- mous vote of all members of the CounciI present. Bonds On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the follow- ing bonds which have been approved by the City Attorney were accepted by unanimous vote of-all members of the Council present: Public Employees Faithful Performance Blanket Position Bond Cal Scholtz - Bus Benches Plumbing Heating Hopkins Plumbing EY Heating Co. Auto-See-Ads, Inc. 364 himi January 21, 1957 Mrs. Harvey Wilensky of 4009 Sunset Boulevard was Present at Meeting Mrs. Harvey Wilensky of 4009 Sunset Boulevard was in attendance to observe the procedures of the City Council. She was concerned about a summons , that she and her neighbors had received regarding a set back restriction of the Firemen's Insurance Building at Huntington Fe Minnetonka Boulevard. Councilman Ehrenberg explained that this was a matter of civil action, to provide for change in the Deed restrictions that applied to set back of the Firemen's Insurance Building and was not a matter for Council action. Application of Frederic C. Johnson for Off-Sale Intoxicating Liquor License The Application of Frederic C. Johnson for Off-Sale Intoxicating Liquor License at 6006 Excelsior Boulevard was presented to the Council. On motion of Councilman Schadow, seconded by Councilman Jorvig, the appli- cation of Frederic C. Johnson, 6006 Excelsior Boulevard, for an Off-Sale Intox- icating Liquor License was referred to the Committee of the Whole for checking, by unanimous vote of all members of the Council present. Mr. Krinke - Trailer The City Manager reported on the inhabiting of a trailer by Mr. Krinke, including the matter of Grading of Texas Avenue. He said the Council would have the Street grade set by the City Engineer and to be approved at the January 28, 1957 meeting. Ill Verified Claims On motion of Councilman Schadow, seconded by Councilman Jorvig, the lists of verified claims prepared by the City Clerk and presented to the Council, dated January 21, 1957, in the total amounts of $1,180.45 for payroll, and $82,569.83 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by unanimous vote of all members of the Council present. Meeting Adjourned On motion of Councilman Bolmgren, seconded by Councilman Jorvig; the meeting was adjourned at 1:18 a.m. , by unanimous vote of all members of the Council present. R. C.
