COUNCIL MEETING - AUGUST 20, 1956
A regular meeting of the City Council was called to order by Acting Mayor
IIITorval Jorvig at 8:08 p.m. . s,
Invocation was given by Rev. Lyle M. Halverson of the First English Luth-
eran Church. .
The following Councilmen were present at roll call:

Also present were the City Manager, 6ity-Attentey3-and Secretary and City
Manager Interne.
Minutes
On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the
minutes of meeting held August 13, 1956, were approved, by unanimous vote of all
members of the Council present.
Public Hearing on Proposed Sanitary Trunk Sewer Construction - 56-52
Pursuant to notice published in the St. Louis Park Dispatch August 9 and 16,
ill1956, a public hearing was had on proposed sanitary sewer construction designated
as Improvement No. 56-52 described therein. The following persons appeared:
Mr. William Merlin, 3735 Sumter Avenue; Mr. Harvey Ratner, 2700 Xenwood Avenue;

M . Victor Anderson, 2633 Xenwood Avenue; Mr. Robert Courtnage, 2740 Hampshire
Avenue; Mr. F. J. Gosselin, 2709 Xenwood Avenue; Mr. Robert Rischmiller, 2525
Hampshire Avenue; these people appeared for information regarding the sanitary
sewer construction. Letter received from Landers-Norblom-Christenson Company,
• dated August 20, 1956, was read.
On motion of Councilman Schadow, seconded by Councilman Wolfe, Resolution
No. 277, Ordering Sanitary Trunk Sewer Construction, Improvement NO. 56-52 was
adopted by unanimous vote of all members of the Council present.
Request for Variation of Setback Requirements to Permit the Location of a
5t-0" Diameter Sign
Request for variation of Setback requirements of the Zoning Ordinance under
the authority,of Section 20.4-6 thereof to permit the location of a Plastic hangout
Sign 51=0" Diameter at 3920 W. Lake Street, by Shell Oil Company, was read.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above
request was.treferred to the Planning Commission for checking and recommendation by
unanimous vote of all members of the Council present.

Requests for variation of Setback requirements of the Zoning Ordinance
under the authority of Section 20. 4-6 thereof to permit the location of two
51-0" Diameter harg ut signs at 3916 Vernon Avenue, by Shell Oil Company, was
read.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above
request was referredtto--the Planning Commission for checking and recommendation,
by unanimous vote of all members of the Council present.

Letter: from M. J. Hoffman, Commissioner of Highways, regarding Use of Highways
Communication received from M. J. Hoffman, Commissioner of Highways, concern-
ing Laws Prohibiting Use of Trunk Highways for local celebrations, was read.
On motion o "Councilman Wolfe, seconded by Councilman Schadow, the above
letter was ordered filed, by unanimous vote of all members of the Council present.
Communication from` Director of Public Works Regarding Grading etc. of Maryland
Avenue from W. 14th to W. 16th Street.
, Communication received from the Director of Public Works concerning the
grading, gravelaing and bituminous stabilizing of Maryland Avenue from West 14th
Street to West'l6th Street, was read.
On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above re-
quest was referred to the City Manager? City Attorney to prepare a Resolution to
delete Maryland Avenue from W. 14th Street to W. 16th Street from the Contract
No. 293, as requested and to approve the new grade recommended by the City Eng-
ineer as shown on profile dated January 5, 1955. The City Engineer was requested
to bring in to the City Council a proposal for storm sewer for drainage at this
location; by unanimous vote, of all members of the Council present.

and Sanitary Trunk Sewer Projects
Letter concerning the engineering work 'connected with the proposed storm
and sanitary trunk sewer projects, from Toltz, King, Duvall, Anderson and Assbc-
icateS, Inc. was read.,
On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the above
letter was ordered filed, by unanimous vote of all members of the Council present.

Letter received from G. M. Orr Engineering Co., dated August 20, 1956,
concerning• the engineering work connected with the proposed storm and sanitary
trunk sewer projects, was read.
On motion of Councilman Schadow, second by Councilman Ehrenberg, the above
letter was ordered filed, by unanimous vote of all members of the Council present.
Letter from Banister Engineering Co. Regarding Engineering Work
Letter received from Banister Engineering Co., dated August 15, 1956, con-
cerning the engineering work connected with the proposed storm and sanitary
trunk sewer projects, was read.
On motion of Councilman Schadow, seconded by Councilman Ehrenberg; the
above letter was ordered filed, by unanimous vote of all members -of the Council
present.
Request for Vacation of Easement, Lots 14 thru 19 inclusive, Blk. 1, Westwood
Hills 1st, by Presbytery of Minneapolis. Inc.
' Request for the vacation of a 51 Utility easement along the rear lines of
Lots 14-19 inclusive, Block 1, Westwood Hills, First Addition (Cedar Lake Road
and Quebec Avenue) by Presbytery of Minneapolis Inc., was read.
On motion of Councilman Ehrenberg, seconded by Councilman Bolmgren, the above
IIIrequest was referred to the City Attorney to prepare a Resolution to vacate a 51
Utility Easement along the rear lines of Lots 14-19 inclusive, Block 1, Westwood
Hills, First Addition, by unanimous vote of all members of the Council present.
Claims for Damages - Mrs. David Arneson, 4700 W. 41st Street
Claim for damages allegedly resulting from weed spraying, by Mrs. David
Arneson, 4700 W. 41st Street, was read.
On motion of Councilman Davis, seconded by Councilman Bolmgren, the above
request for damages was referred to the City Attorney for advice and recommenda-
tion, by unanimous vote of all members of the Council present.
Request for Building Permit - For Gasoline Station at Minnetonka fe Louisiana Ave.
Request for the issuance of a building permit for the construction- of a
Gasoline Station at Minnetonka Boulevard and Louisiana Avenue, by Socony Mobile
Oil Co., was read.
On motion of Councilman Bolmgren, seconded by Councilman Davis, to approve
the issuance of the permit subject to execution of the agreement between the appli-
cant and the City and subject to compliance with all applicable codes, by unanimous
vote of all members of the Council present, except Councilman Schadow who was not
in the room at the time the vote was taken, and Mayor Fernstrom who abstained from
voting.

Approving Planting Plan as Submitted by Socony Mobil Oil Company
On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the plant-
ing ,plan as submitted by Socony Mobile Oil Company, dated June 4, 1956, was
approved and the Mayor and City Manager was authorized to execute an agreement
for same between the City and Socony Mobile Oil Company, by unanimous vote of all
members of the Council present except Councilman Jorvig who voted nay, as it only
provides for 10 years.
Petition - Curb and Sidewalk on NS of 41st Street Between Vernon and Webster Ave.
by St. Luke's Lutheran Church
Petition, dated August 15, 1956, for curb and sidewalk on the north side of
41st Street between Vernon Avenue and Webster Avenue, by St. Lure's Evangelical
Lutheran Church, was read.
On Motion of Councilman Bolmgren, seconded by Councilman Ehrenberg. ,the
Director of Public Works was instructed to construct Curb and Gutter and Sidewalk
on the North Side of 41st Street between Vernon Avenue and Webster Avenue, and to
include same with the present Contract with Victor Carlson & Sons for Curb &
Gutter Improvement Nos. 56-47, 56-48, 56-49 Ei 56-50, awarded by City Council, July
30, 1956, by unanimous vote of all members of the Council present.
Claim for Damages - Mrs. Mary Aydt, 3301 Colorado Avenue
Claim for damages allegedly resulting from tar sprayed by the Street Depart-
ment, by Mrs. Mary Aydt, 3301 Colorado Avenue, was read.
On motion of Councilman Schadow, seconded by Councilman Wolfe, the above
claim for damages was referred to the Director of Finance for advice and recomm-
endation, by unanimous vote of all members of the Council present.
Request for Variation of Setback by Arnold R. Lidfors._ 2801 Quentin Avenue
Request for variation of setback requirements of the Zoning Ordinance to
permit the construction of a porch, by Arnold R. Lidfors, 2801 Quentin Avenue,
was read.
On motion of Councilman Ehrenberg, seconded by Councilman Davis, the above
request was referred to the Planning Commission for advice and recommendation, by
unanimous vote of all members of the Council present.
Resolution No. 278
On motion of Councilman Schadow, seconded by Councilman Wolfe, Roaolution
No. 278 Amending Resolution No. 244 entitled Resolution Adopting Rules Governing
Employment of City Personnel, adopted May 21, 1956,(Section 1:315 Overtime Payment)
having been read by the Secretary, was adopted by unanimous vote of all members of
the Council present.
Proposed Zoning Ordinance- Rezoning Lots 10, 11 and 12. Blk. 8, High Holborns cond
On motion of Councilman Schadow, seconded- by Councilman Davis, the/read-
ing of Proposed Ordinance Rezoning Lots 10, 11, and 12, Blk. 8, High Holborn Addi-
tion was deferred for one week in order to secure additional information regard-
ing proposed construction, by unanimous vote of all members of the Council present. , •

Director of Public Works Report on Petition to Eliminate Truck Traffic on
Cambridge Avenue
Report from the Director of Public Works on petition to eliminate truck
traffic on Cambridge Avenue from Brunswick Avenue to Highway No. 100 (Requested
August 6, 1956) was read by Secretary of the Council.
The City Manager was instructed to investigate the possibility of having
Cambridge made no trucks except for delivery, from Alabama Avenue to Highway No.
100 and the City Manager was requested to order an Ordinance prepared by the
City Attorney to make Alabama Avenue a truck route running from Excelsior Blvd.
to Highway No. 7 and Cambridge Avenue from Edgewood Avenue to Alabama Avenue.
Director of Public Works Report on Drainage basin at County Road No. 18
Report from the Director of Public Works, dated August 16, 1956, on drain-
age-basin at County Road No. 18 and West 16th Street,(Requested July 2, 1956)
was read.
On motion of Councilman Bolmgren, seconded by Councilman Schadow, it was
suggested that the Director of Public Works be asked to contact the County
Highway Department to see if there is a way of relief through a present County
drain, and the City Manager was requested to advise the folks in Minnetonka
Township regarding above report, by unanimous vote of all members of the Council
present.
Report on Comparisons of Building Permits Issued
Report from the Building Inspector on comparisons of building permits issued
in 1955 and 1956, was read.
On motion of Councilman Wolfe, seconded by Councilman Schadow, the above
report was ordered filed, by unanimous vote of all members of the Council present.
Report from Director of Public Works and City Assessor Re: Sidewalk on North Side
of- Lake Street
Report from the City Engineer, dated August 16, 1956, and the recommendations
from the City Assessor, dated August 7, 1956, with respect to the construction of
sidewalk on the North Side of Lake Street between Minnetonka Boulevard and Louisiana
Avenue (requested July 2, 1956), was read.
On motion of Councilman Davis, seconded by Councilman Schadow, the above re-
ports were ordered placed on file until such time that the improvement of Lake
Street is directed, by unanimous vote of all members of the Council present.
Report from the Director of Public Works on the extension of Yosemite Avenue
Report from the Director of Public Works, dated August 16, 1956, on the
extension of Yosemite Avenue South of West 27th Stret and the installation of
water serer and pavement)requested July 16, 1956), was read.
The City Manager was instructed to contact Mr, Goldfarb and and explain to
him the way that this can be accomplished.

Report from the Director of Public Works and City Assessor on Opening of Flag Avenue
Report from the Director of Public Works, dated August 16, 1956, and the City
Assessor, dated August 8, 1956, on the opening of Flag Avenue north of Minnetonka
Boulevard (requested July 23, 1956), was read.
On motion of Councilman Schadow, seconded by Councilman Bolmgren, it was
suggested that Mr. Bogen be advised of the cost factors and also 'of the Assessors
reportand ask him if he still wants to pursue the project, by unanimous vote of
all members of the Council present.
Preliminary Report from Engineer fe City Assessor -Re: Watermain on W 28th St.
The Preliminary. Report of the City Engineer and the recommendation of the
City Assessor, dated August 16, 1956, with respect to petitioned watermain on
West 28th Street from Ottawa Avenue to Monterey Avenue, Improvement No. 56-58,
was read.
On motion of Councilman Davis, seconded by Councilman Bolmgren, the City
Manager was instructed to have resolution prepared setting hearing for above
petitioned watermain and also authorizing the City Clerk to publish notice for
same, by unanimous vote of all members of the Council present. _
Report from City Attorney Re: Proposed Subdivision Regulations
Report from the City Attorney, dated August 20, 1956, on original draft re-
garding Proposed Subdivision Regulations, was read.
On motion of Councilman Schadow, seconded by Councilman Jorvig, action on
the above report was deferred to August 27, 1956, by unanimous vote of all
members of the Council present.
Report from Sherman Hasbrouck-Carl L. Gardner and Associates-Re: Subdivision
Regulations
Report from Sherman Hasbrouck-Carl L. Gardner and Associates, City Planning
Commission regarding Subdivision Regulations as revised by the Planning Commission
and their recommendations thereof, was read.
On motion of Councilman Schadow, seconded by Councilman Jorvig, the action
on the above report was deferred to August 27, 1956, by unanimous vote of all
members of the Council present.
Re: Request of Mr. Robert J. Root. 3425 Alabama Ave. for Rezoning
Tabulation-of petitioners favoring and opposing the request of Robert J.
Root, 3425 Alabama Avenue, for rezoning of Lots 24 add 25, Block 9, Rearrangement
of St. Louis Park (3425 Alabama Avenue) from Residential Use District to Multiple
Dwelling Use District. Mr. Lester G. Grue, 5916 Hamilton Avenue, was present and
discussed this matter with the Council and suggested that it be tabled temporarily.
Mr. Grue will discuss this matter with neighbors.

were received by the City Manager at 10 A:M. this date for'the furnishing of

The City Engineer's tabulation of the above bids and his recommendation
for the award of contract for same was read.
On motion of Councilman Davis, seconded by Councilman Bolmgren, on recomm-
endation of the Director of Public Works the bid of Badger Meter Company for the
furnishing of above described water meters was determined to be the lowest bid of
a responsible bidder, and the Mayor and City Manager were authorized to execute
a contract in behalf of the City with the Bidder for same in the amount of bid
($33,082.66), by unanimous vote of all members of the Council present.
Report from the Directorof Public Works Re: Stop Signs on West 28th St.
Report from the Director of Public Works regarding the removal of stop signs
on West 28th Street at Ottawa Avenue(deferred from August 13, 1956), was read.
On motion of Councilman Jorvig, seconded by Councilman Schadow, it was
suggested that the stop signs be replaced at 28th Street and Ottawa Avenue and be
included in the Ordinance relating to Stop Signs, by unanimous vote of all members
of the Council present.
Regarding Sidewalk on W. 28th Street
On motion of Councilman Ehrenberg, seconded by Councilman Davis, the rector
of Public Works and Assessor were directed to make a preliminary report to/Council
on the construction of sidewalk on either North or South side of 28th Street from
Ottawa to Joppa Avenues and a similar report from Ottawa to Toledo Avenue, by unani-
mous vote of all members of the Council present.
Regarding Sidewalk on West Side Texas Avenue from 33rd to 36th Streets
On motion of Councilman Wolfe, seconded by Councilman Jorvig, the Director
of Public Works and Assessor were directed to make a preliminary report to the
Council on the construction of sidwwalk on the West Side of Texas Avenue from 33rd
Street to 36th Street, by unanimous vote of all members of the Council present.

Appointment of William S. Newdall
On motion of Councilman Schadow, seconded by Councilman Davis, the appoint-
ment of William S. Newdall as Laborer, Range 11, Step C, bi-weekly salary of
$145.60, effective August 20, 1956,(A replacement for Park Department employee Ill
who has resigned) was approved by unanimous vote of all members of the Council
present.
Resolution No. 279 Setting Assessment Hearing - September 17, 19'56
On motion of Councilman Schadow, seconded by- Councilman Bolmgren, Resolu-
tion No. 279 Setting Assessment Hearings for September 17, 1956, on Installation
of Ornamental Street Lights, Sidewalk Repairs and Sidewalk and Curb and Gutter
Construction was adopted by unanimous vote of all members of the Council present.
Intoxicating Liquor Licenses Denied
On motion of Councilman Davis, seconded by Councilman Wolfe, the following
Intoxicating Liquor Licenses were denied:

Petition for Rezoning by Leonard T. Bjorklund
Petition received from Leonard T. Bjorklund, 6624 Cheyenne Trail, Minneapolis
24, Minnesota, dated August 15, 1456, to rezone the following property from Open
Use District to Light Industrial Use District was read:
The NW-14 of the NW4 of Section 31, T.29, R.24, described as follows:
Commencing at the point of intersection of the Southerly right of
way line of the Great Northern Railroad with the Westerly right
of way line of State Highway No. 100; thence Southerly along said

On motion of Councilman Davis, seconded by Councilman Jorvig, the above

petition for rezoning was referred to the Planning Commission for advice and
recommendation and Hearing date was set for September 10, 1956, by unanimous vote
of all members of the Council present.
Verified Claims
On motion of Councilman Davis, seconded by Councilman Bolmgren, the lists
of verified claims prepared by the City Clerk and presented to the Council,
dated August 20, 1956, in the total amounts of $517.75 for payroll, and $28,510.26
for vendors were approved, and the City Manager, City Clerk, and City Treasurer
were authorized to issue checks covering same, by the following roll call vote:
Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, yea;
Councilman Jorvig, yea; Councilman Schadow, yea; Councilman Wolfe, yea; eounei1-

Meeting Adjourned
On motion of Councilman Schadow, seconded by Councilman Bolmgren, the
meeting was adjourned at 12:39 A.M. by unanimous vote of ail'Members of the
