Invocation was given by Rev. Landes of Grace Presbyterian Church. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Minutes On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the minutes of meeting held May 21, 1956, were approved, by unanimous vote of all-- members of the Council present. Public Hearing Pursuant to notice published in the St. Louis Park Dispatch, May 17 and 24, 1956, apublic hearing was had on proposed curb and gutter improvements 56-5 thru 56-14; and sidewalk improvements 56-15 thru 56=21. The following persons appeared: The following appeared in favor of Improvement No. 56.21, ,Mrs. Reuben Norling, 3309 Sumter Avenue; Mrs. K. E. Cannon, 3357 Sumter Avenue, Mr-. RESOLUTION No. 245 On motion of Councilman Schadow, seconded by Councilman Wolfe, Resolution No. 245, ordering Improvement Nos. 56-5 thuu 56-14 Curb and Gutter; Improvement Nos. 56-15 tthru 56-21 Sidewalk, in accordance with the plans and specifications prepared by the City Engineer, having been read by the Secretary, was adopted by unanimous vote of all members of the Council present. Request for Special Zoning Exception to Permit Sign Request for special zoning exception to permit the replacement of a 101 x 121 "V9 type ground sign at 4725 Excelsior Boulevard 01 - 0" setback) by Macey Signs, Inc. was read. On motion of Councilman Davis, seconded by Councilman Jorvig, the request for a permit to replace a 101 x 121 "V" type ground sign at 4725 Excelsior Blvd., by Macey Signs, Inc. was denied by unanimousvote of all members of the Council present. 81 June 4, 1956 Request for Withdrawal of Application for Rezoning and a Petition for Rezoning - Wm. Hodroff Request to withdraw application filed with the Council April 16, -1956, petitioning for rezoning of Lots 10, 11 and 12, Block 8, High Holborn (Mtka. and Louisiana) from Residential Use District to Limited Use District, and a Petition for rezoning the same area from Residential Use District to Commerical Use District, by William Hodroff, owner of said lots. On motion of Councilman Davis, seconded by Councilman Schadow, the request to replace the sign at 33rd Street and Texas Avenue, was denied by unanimous vote of all members of the Council present. Request for Permit for Variation of Setback Requirements Request for permit for variation of setback requirements for Lots' 8, 9, 10, 11, and 12, Block 1 of John A. Johnson's Addition (Wayzata Boulevard and County Road 41 - a City Street) to permit the construction of 'proposed office, repair shop and warehouse building, by Keleket X-Ray Sales Corporation of Minnesota, Inc. was read. They were advised no set back required and therefore no special permit is necessary. Request for Approval of Building Permit for New Brookside Drug Store Request for approval of issuance of a building permit for the construction of a new Brookside Drug Store, by L. W. Hermann, was read. On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the re- quest to approve issuance of permit for construction of a new Brookside Drug Store on Corner of Brookside Avenue and Excelsior Boulevard was approved, and the Building Inspector was authorized to issue same subject to compliance with all applicable codes and ordinances, by unanimous vote of all members of the Council present. Request for Damages to Property at 3300 Wyoming and 3301 Xylon Request for damages to property at 3300 Wyoming Avenue and 3301 Xylon Avenue resulting from application of dust coat materials on 33rd Street, by H. G. Gooderun and A. F. Violette On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above request was referred to the City Attorney, by unanimous vote of all members of the Council present. Request for Refund of Residential Garbage Assessment Request for refund of residential garbage assessment at 3924 Randall Street, by Walter L. Scott, Administrator for the estate of Robert E. Scott, was read. On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the request for refund of residential garbage assessment at, 3924 Randall Street, by Walter L. Request for Permit for Construction of an Addition to Building Request for approval of issuance of permit for the construction of an addition to the office building of the Lithium Corporation of American, Inc. at 2400 Dakota Avenue, was read. On motion of, Councilman Bolmgren, seconded by Councilman Jorvig, the Building Inspector was authorized to issue permit for construction of above requested addition to building, subject to compliance with all applicable codes and ordinances, by unanimous vote of all members of the Council present. 83 June 4, 1956 Request for Reconveyance of Property Previously Conveyed to the City Request from Edina Homes, Inc. for reconveyance of property on the west side of Utah Avenue, south of Minnetonka Boulevard, previously conveyed to the City in error. City Manager to determine if Adolph Fine will move the sewer and what the cost of relocating the Storm Sewer will be and report back to the City Council June 11, 1956.for action. Request for Permit to Construct a Drive-In Laundry Building Request for approval of issuance of a building permit for the construction of a Drive-In Laundry building at 4501 Excelsior Boulevard, by Mr. Gross, was read. Mr. Gross was at the meeting. On motion of Councilman Schadow, seconded by Councilman Wolfe, the above request for a building permit was approved, and the Building Inspector was auth- orized to issue same subject to compliance with all applicable codes and ordinan- ces, by unanimous vote of all members of the Council present. Request for Permit for Variation of Setback Requirements , Request for permit for variation of setback requirements to permit the construction of a side porch at 3425 Alabama Avenue, by Robert Root, which was originally presented to the Council on May 21, 1956, permit was to be granted if neighbors signed a statement saying they had no objections, and to go back on the agenda for this meeting for further Council consideration if statement was not forthcoming, was presented to the Council. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the request to grant permit for waiver of set back to permit the construction of a side porch at 3425 Alabama Avenue, by Robert Root, was granted by a Roll Call vote: Councilman Bolmgren, yea; Councilman Davis,nay; Councilman Ehrenberg, yea; Councilman Schadow, yea; Councilman Wolfe, yea; Councilman Jorvig, yea, and Mayor Fernstrom, not voting. Request to Rezone 3108 Monterey Avenue from Residence Use District to Limited Use District. by C. A. Lund On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above request was referred to the City Planning Commission for advice and recommenda- tion subject to proper petition and payment of $25.00 as required by ordinance, by unanimous vote of all members of the Council present. Request for Adjustment of Sewer Assessment at 3149 Salem Avenue Request for adjustment of sewer assessment on property at 3149 Salem Avenue was read. On motion of Councilman Wolfe, seconded by Councilman Schadow, the above communication was refeFred-to-the denied by unanimous vote of all members of the Council present. Petition to Vacate a Portion of Colorado Avenue Petition to vacate Colorado Avenue south of 36th Street to the RR Tracks, adjacent to Lot 1, Block 40, St. Louis Park Center by Haws Realty Company which was presented to the Council on May 21, 1956 and referred back to the petitioner for additional information, was read; also letter from Holt Construc- tion Cpmpany dated June 1, 1956 giving requested information. On motion of Councilman Jorvig, seconded by Councilman Davis, the above petition was referred to the City Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. 84 egt June 4, 1956 Letter: Re: Water conditon on 25th and Nevada Avenue Mr. Mitchel Weiner, 2565 Oregon Avenue appeared presenting a letter from Dwight H. Neifert, 2553 Oregon Avenue regarding the undesirable condition that exists in the area of Nevada Avenue and Depot Avenue about one block south of Cedar Lake Road. There is an accumulation of water which cannot escape because of the lack of any drainage outlets. They urge prompt attention to this condition. vo On motion of Councilman Wolfe, seconded by Councilman Bolmgren, the above matter was referred to the City Manager for investigation and report back to the Council June 11, 1956, also what it would cost to clean up this area until the Storm Sewer comes in this district, by unanimous vote of all members of the Council present. Request for Building Permit - American Provision Co. (3986 Alabama Ave.) Paul Resop appeared for the American Provision Company requesting a building permit for 3986 Alabama Avenue. On motion of Councilman Schadow, seconded by Councilman Jorvig, the • request to approve issuance of permit for construction of a building at 3986 Alabama Avenue was approved•, and the Building Inspector was authorized to issue same subject to compliance with all applicable codes and ordinances (assuming Commercial Zoning is ok) also subject to screen planting. City Attorney, E. T. Montgomery was asked to prepare an agreement. (Legal descrip- tion of 3986 Alabama Avenue - Part of Lot 9, Block 3, Brookview Park Addition), by unanimous vote of all memkiers of the Council present. Resolution No. 246 - Restricting Lawn Sprinkling Oh motion of Councilman Bolmgren, seconded by Councilman Jorvig, Resol- ution No. 245 Restricting Lawn Sprinkling, effective June 11, 1956, was adopted by unanimous vote of all members of the Council present. Resolution No. 246 in Book 1 of Resolutions. ° Reports of Department Heads On motion of Councilman Schadow, seconded by Councilman Jorvig, the follow- ing reports of City Department Heads for May 1956 were read and ordered filed,, by unanimous vote of all Members of the Council present: Animal Fire Police Report on Procedure for Adjustment of Special Assessment Report of procedure for adjustment of special assessments by the City Attorney was read. On motion of Councilman Davis, seconded by Councilman Schadow, action on above report was deferred to June 11, 1956, by unanimous vote of all members of the Council present. 85 June 4, 1956 Financial Report of City for Period Ending April 30, 1956 The Financial Report of the City of St. Louis Park for period ending April 30, 1956 by the City Manager was read. On motion of Councilman Schadow, seconded by Councilman Bolmgren, the above report was ordered filed, by unanimous vote of all members of the Council present. Report on 1956 Traffic Signal Program Report on 1956 traffic signal installation program, by Director of Public Works was reviewed. On motion of Councilman Schadow, seconded by Councilman Davis, the 1956 portion of traffic signal installation program was adopted by the following roll call vote: Councilman -Bolmgren, nay; Councilman Davis, yea; Councilman Ehrenberg, yea; Councilman Jorvig, 'yea; Councilman Schadow, yea; Councilman Wolfe, yea; Mayoe Fernstrom, not voting. Councilman On motion of/Davis, seconded by Councilman Schadow, all sidewalks required in this report were referred to the City Engineer for recommendation as to need and cost, and the City Assessor regarding the assessment area, by unanimous vote of all members of the Council present. Report on Petition for Sanitary Sewer in Brook Lane Report on petition for Sanitary Sewer in Brook Lane, by Director of Public Works was read. On motion of Councilman Bolmgren, seconded by Councilman Davis, the above report was referred to the City Assessor for a report of cost per resident, on each plan and report to the Council June 11, 1956, by unanimous vote of all members of the O; uncil present. Report on 1956 Street Maintenance Program Report on the 1956 street maintenance program by the Director of Public Works was reviewed by the Council. On motion of Councilman Schadow, seconded by Councilman Bolmgren, the above report was accepted by unanimous vote of all members of the Council present. Reports on Request for Permit to Connect to Water Main Reports on request of Mauric$ Swiller for permit to connect to water main at 8531 West 29th Street, by the Director of Public Works and City Attorney were discussed. Councilman On motion of/Wolfe, seconded by Councilman Jorvig, the request of Maurice Swiller for permit to connect to water main at 8531 West 29th Street, was granted upon compliance with ordinance, by unanimous vote of all members of the Council present. On motion of Councilman Davis, seconded by Councilman Schadow, the City Attorney was instructed to change ordinance so that a property owner may pay cash or consent to an assessment for a special permit to connect to existing sewer or water main, by unanimous vote of all members of the Council present. June 4, 1956 Report on Application for Modification of Assessment for Tar Mat Report on the application of Frank Hissocks for modification of assess- ment for tar mat #511 against Lot 7, Beebes Outlots (1640 Texas Avenue), by the City Attorney, was read. On motion of Councilman Wolfe, seconded by Councilman Davis, the hearing on assessment for tar mat #511 was set for June 25, 1956, by unanimous vote of . all membess of the Council present. Recommendation re Stop Sign Locations City Engineer's recommendation re: Stop sign locations was read. By unanimous consent of the Council the action on the above recommendation was deferred to June 11, 1956. Second Re-draft of Proposed Agreement with School Board Re: Recreation, Etc. On motion of Councilman Schadow, seconded by Councilman Wolfe, action on Re-draft of proposed agreement with School Board regarding Recreation, etc. was deferrdd to June 11, 1956, by unanimous vote of all members of the Council present.. Petition Requesting Withdrawal of Signatures for Annexation, Etc. Petition dated May 25, 1956 requesting withdrawal of signatures for annexation for all of the lots in Cedar Crown Addition and Cedar Crown Addition Second Addition, was read. By unanimous consent of the City Council, the City Attorney was asked to make an investigation as to legality of request on above petition. Action deferred until June 11, 1956. /AN ORDINANCE ANNEXING "TEMPLE'S GARDEN LOTS" AND OTHER UNPLATTED LANDS Petitioned Annexation in Minnetonka Township SITUATED IN SECTION 12, T.117, R.22. ntixlc First reading of ordinance/leaving out Cedar Crown Addition and Cedar Crown Addition 1st was read by the City Attorney. The following staterhentr. wassread by Councilman Davis: I have expressed my opposition to the annexa- tion of the properties covered by the present petitions for annexation upon the grounds that: First: I could not discern any benefit to St. Louis Park in annexing added lands to be used for residence purposes, if those properties were to be developed in the same manner that other areas have developed which are now within our territorial limits, and Second: I felt that to annex the prpperties without an effort to work with Township officers and residents would unnecessarily create bad feeling between the Town Board and our Council, which might lead to unwise and precipi- tous action by Township residents in an attempt to incorporate the Township in a municipal corporation and thus close our only remaining open boundary. After the joint meeting between the Council and the Town Board, I am convinced that a substantial effort has been made by the St. Louis Park Council to better relations between the two governing groups and to achieve a basis for understanding between their members. I am therefore satisfied that my second objection is no longer significant. The first objection stated is the more important of the two, and it is to this subject that I devote the balance of my remarks. fi June 4, 1956 Petitioned Annexation in Minnetonka Township continued As I have previously indicated, I have never opposed annexation-* new land to our City upon the basis that all annexation is deleterious. It would appear from our estimates and previous experience in the Ecklund-Swedlund addition that the likihood of financial loss to present Park residents is remote, if not totally non-existent - the reverse is true. If any prediction can be made, it seems clear that the prospect for profit to the City is reasonably assured. This is true because the taxpayers of ;the Park will not have an obligation to provide schooling for children living in the area, the capital improvements are to be financed through development capital or from special assessment levies applicable to the particular property benefitted and the reports of our department heads indicate that the added cost of general municipal services can be met within the structure of added revenues anticipated after development of the area. The financial considerations are, however, only incidental to the question of benefit. The true measure of benefit is whether annexation of the area will meet a significant need to the present community, and it has been concern over this problem which has been the basis of my objection. We of the Park do have a need1.f pr residence areas to furnish housing for every income level. We have an abundance (perhaps even an over abundance) of so-called budget or low-cost housing within our boundaries.. We also have some moderate to high-cost homes available but, in my opinion, these are not numerous enough to satisfy the needs of our present and prospective citizens. I have been concerned to see some of our residents who have been active in community affairs move to other suburban areas to find satisfactory housing facilities. And, in addition to satisfying the needs of our present residents, we must recognize that our industrial community is growing and a housing supply in all income levels is necessary to furnish our workers and businessmen a home near their work. It is important to us to encourage those who work in the Park to live in the Park since they, because of their dual interest, can be expected to provide leadership in the solution of municipal and civic problems. I do not mean to imply that those of our residents who work outside St. Louis Park cannot and have not made important contributions to the welfare of our community, be- cause many have done so in the past and will, I am sure, continue their efforts in future years, but, perhaps because of prozimity, if for no other reason, much of the responsibility for civic activities has fallen upon the shoulders of those who work in the city. I therefore assume that annexation of land, if development is properly controlled, can benefit the City as a whole. When these petitions for annexation were first presented, I was not satisfied that we could control the development of the area to satisfy the need to which I have referred. Since the time, however, significant steps have been taken to impose appropriate restrictions upon use and development of property. Some of these are as follow: The Council has approved the incorporation of the Pacific Coast Building Code, the Minneapolis electrical, plumbing and heating ordinances in the codified ordinances of the city; the city has contracted with the firm of Carl Gardner and Associates to provide consultant planning services to the city for future 8 . r June 4, 1956 Petitioned Annexation in Minnetonka Township continued development of capital improvements, both public and private, and finally, and with particular reference to the_present problem, the members of the Council have unanimously agreed that they will not approve any plats in the annexed area until Mr. Gardner has made his recommendations upon sizes of lots, percentage of lot to be occupied by a structure, zoning, development of utilities services and other improvements, and until the Council has adopted the recommendations in the form of zoning amendments and complete subdivision regulations. I feel that relying on these actions and assurances, the controls which will achieve a benefit to St. Louis Park in the annexation of this property will be adopted and.the benefit can be realized. This does not-mean that all lots in the annexed area will be of any particular size or that the houses built will all be the same price. It does mean that the Council has committed itself to the development of the area so that each parcel will be developed to achieve its optimum usefulness. Upon this basis, I will vote in favor of annexation. The following statement was read by Councilman Ehrenberg: I would like to set forth for the record my objections to further consideration of annexation petitions before us at this time. I am not an absolute anti-annexationist. I believe that eventually many of these areas will eventually want to join with the City of St. Louis Park. However: (1) I can see no immediate advantage to the City of St. Louis Park at this time. I can see immediate additional expense factors. These are the costs of additional fire protection to a department that is already speead very thinly. They are the demands for additional police protection over a large area by a department that is already undermanned. They are the cost of routine street maintainance, winter and summer, when many of our streets within our present boundaries are in need of immediate and long-range care. No one has yet shown me figures that previous annexed territories have paid their full cost on those services mentioned above. - (2) I am against forcing annexation and status on an area that the majority of residents and homeowners are against. Many of these people pre- sently concerned are being forced to become citizens of a community against their will. To me this is not in the interests of democratic self-government, nor does it tend to foster a positive-thinking citizen group within a community. (3) In fairness to both developers and residents, I strongly feet that platting and subdivision regulations should be enacted, ordained, and adhered to before acquiring further territory within our city. I feel that the terms of such regulations should be fully known and fully understood --- and also fully accepted --- before the act of annexation takes place. We recently hired a city planner to do a comprehensive planning job for us over the next 2 years. I have yet to see a positive recommendation from our planner advocating immedi- ate annexation of the petitioned properties -- much less regarding such matters as zoning and land use. I have not even seen a recommendation from our own Planning Commission. It would seem to me that logic would tell us to defer this matter until a realistic, comprehensive, and acceptable recommendation would come from the Planning Authorities. This is no way prevents the land from being developed. 8 • June 4, 1956 Petitioned Annexation in Minnetonka Township continued Services could be contracted for such as water, etc. without requiring annexa- tion. This has been done between many communities within the state and within other states. These services could be contracted for at a rate that would guarantee no burden on the rest of the community. The City Manager read a statement giving the estimated amount of taxes to be received and the cost of services for this area. Councilman Wolfe gave an oral statement. Preliminary Plat of Penn Realty Subdivision On motion of Councilman Schadow, seconded by Councilman Jorvig, action on the Plat of Penn Realty Subdivision was deferred to June 11, 1956, by unani- mous vote of all memebers of the Council present. Employment of Police Officers The matter of employing ,the four additional police officers provided for in the budget was presented by the City Manager. On motion of Councilman Wolfe, seconded by Councilman Schadow, the City Manager was authorized to requisition the Police Civil Service Commission for four men, effective July 1, 1956, by unanimous vote of all memebrs of the of the Council present.
