May 21, 1956 COUNCIL MEETING May 21, 1956
A regular meeting of the City Council was called to order by Mayor
R. C. Fernstrom at 8:07 P.M.
Invocation was given by Rev. Ben Brudevold of Aldersgate Methodist
Church.
The following Councilmen were present at roll call:
H. J. Bolmgren
H. C. Davis
Robert Ehrenberg
Torval Jorvig
Gene Schadow
Kenneth Wolfe
R. C. Fernstrom
Also present were the City Manager, City Attorney, and Secretary.
Minutes
On motion of Councilman Torval Jorvig, seconded by Councilman Robert
Ehrenberg, the minutes of meeting held May 14, 1956, were approved, by unanimous
vote of all Members of the Council present.
Petitions
On motion of Councilman Ken Wolfe, seconded by Councilman Torval Jorvig,
the following petitions were referred to the Director of Public Works and City
Assessor, by unanimous vote of all members of the Council present:
P-1654 Petition for Sanitary Sewer in Brunswick Avenue from Hamilton
Street to 35th Street. - by Nathan Levy.
P-1655 Petition for Sidewalk on the West Side of Sumter Avenue from
33rd Street to 34th Street. - by Frank T. Bro Jr. and others.
P-1656 Petition for Curb and Gutter on the East Side of Colorado
Avenue from 29th Street to Minnetonka Blvd. - by Edwin E.
{ Dahm and others.
P71657 Petition for Blacktop on West 27th Street from Xenwood Avenue
to Yosemite Avenue. - by Harvey B. Ratner and others.
Petition for Permit to Connect to Water Main
Petition for special permit to connect to water main at 8531 West 29th
Street, and to spread cost on assessment roll, by Maurice and Esther Swiller,
was read.
On motion of Councilman Bolmgren, seconded by Councilman Wolfe, the above
petition was referred to the City Attorney and the Director of Public Works for
checking to see if granting such permit conforms to the City Ordinance, covering
special permits for connecting onto water main, and to report back to the City
Council on June 4, 1956, by unanimous vote of all members of the Council present.

Petition for Rezoning
Petition for rezoning Lots 6 and 7, Block 43, St. Louis Park Center from
Commercial Use District to Light Industrial Use District, by Minnesota Rubber
and Gasket Company was read.
On motion of Councilman Torval Jorvig, seconded by Councilman Ehrenberg,
the above petition was referred to the City Planning Commission for advice and
recommendation, by unanimous vote of all Members of the Council present.
Communication Re: Initiation of a Preventive Maintenance Program
A communication from Gred Grothe, 7020 West 23rd Street and Bud Gangl, 7015
West 23rd Street requesting a preventive maintenance program of seal coating the
following streets:
1. Eliot View Road from Kentucky Lane to Hampshire Avenue.
2. Kentucky Lane from Cedar Lake Road to West 24th Street.
3. West 24th Street and West 23rd Street from Kentucky Lane
to Louisiana Avenue.
was read.
On motion of Councilman Jorvig, seconded by Councilman Bolmgren, the above
matter was referred to the Director of Public Works, by unanimous vote of all Members
of the Council present.
Request that Sidewalk not be Constructed
Request that a portion of sidAlk petitioned under Petition #1635 (Improve-
ment No. 56-17) not be constructed, by Mr. and Mrs. Vincent Rockier, 7623 West
29th Street, was read.
On motion of Councilman Ehrenberg, seconded by Councilman Jorvig, the above
communication was ordered filed until hearing on said improvement, June 4, 1956,
and that the City Manager is to notify Mr. Rockier the time of the hearing, by un-
animous vote of all members of the Council present.
Petition for Vacating Street
Petition to vacate Colorado Avenue south of 36th Street to the RR tracks,
adjacent to Lot 1, Block 40, St. Louis Park Center Addition, and Lot 6, Block 41,
Rearrangement of St. Louis Park Addition by Haws Realty Co. was read.
On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the above
petition was referred back to the petitioner for information as to the ,use the
property is proposed to be put to and also where team track loading would be, and
to be referred back to the Council, June 4, 1956, by unanimous vote of all Members
of the Council present.
Request to Subdivide Lot
Request to subdivide a lot at the NW Corner of Maryland and Franklin Avenues
into 551 lots by Russell E. Smith, was read.
On motion of Councilman Ehrenbergm seconded by Councilman Jorvig, the above
request was referred to the City Planning Commission for advice and recommendation,
by unanimous vote of all Members of the Council present.

Request for Waiver of Setback Requirements
Request for waiver of setback requirements to permit construction side-of
of porch on side of house at 3425 Alabama Avenue, by Robert Root was read.
On motion of Councilman Schadow, seconded by Councilman Jorvig, the waiver
was granted and the Building Inspector was instructed to issue building vermit
to construct the 121 by 121 porch on the southside of house, (Hamilton Avenue
Side) Before a vote on resolution Councilman Ehrenberg moved to amend the motion
by adding; upon receipt of a petition from 5920 and 5924 Hamilton Avenue saying
that they have no objections. Vote on awendment was six yeas, Councilman
Schadow voting no.
The motion as amended was then passed by unanimous vote of all members of
the Council present.
Application for Permit to Excavate Under Ordinance No. 81 (Eliot Anderson)
The application of Eliot Anderson for a permit to excavate under ordinance
No. 81, City of St. Louis Park, Minnesota, was discussed.
On motion of Councilman Davis, Seconded by Councilman Ehrenberg, the City
Manager was instructed to notify Elliot Anderson that the Council will not
consider issuing further permits until Elliot Anderson has complied with the
requirements set up in Undertaking date May 7, 1954, by unanimous vote of
all members of the Council present. (Note: Elliot Anderson appeared later in
the meeting and was told of the above action.)
Resolution No. 244 Adopting Ordinance Establishing a Position Classification
Plan, Etc.
A proposed ordinance establishing a position classification plan, a compen-
sation plan, basic personnel policy and conditions of City employment was
presented to the Council for consideration. Mr. Stabno appeared as a representa-
tive of the Union and discussed various items.
On motion of Councilman Ehrenberg, seconded by Councilman Davis, Resolution
No. 244 was read and adopted by unanimous vote of all members of the Council
present.
Proposed Ordinance for the Licensing of Guards and Watchmen
Second reading of proposed ordinance licensing private guards and watchmen was
waived.
On motion of Councilman Wolfe, seconded by Councilman Schadow, Ordinance No.
529, entitled AN ORDINANCE LICENS-ING,PRIVATE GUARDS AND WATCHMEN was adopted by
unanimous vote of all members of the,Council present.
Report on Plat of Penn Zayta Second Addition
Report of Director of Public Works approving the Plat of Penn Zayta Second
Addition, and stating that they have a bond in the amount of $8,500.00 covering
the construction of water main and the grading and stabilizing of the streets was
read.
On motion of Councilman Davi$, seconded by Councilman Bolmgren, the final plat
of Penn-Zayta Second Addition was approved and accepted, and the Clerk, was auth-
orized to sign same for the City, by unanimous vote of all members of the Council
present.

Report on Estimate of Costs of Sanitary Sewer and Bituminous Surfacing
Report on estimate of costs of proposed sanitary sewer and the bituminous
surfacing of 44th Street between Dart and Wooddale Avenues by Director of Public
Works was read.
Hearing Date Set on Proposed Sanitary Sewer and the Bituminous SuAkcing of
44th Street between Dart and Wooddale Avenues.
On motion of Councilman Davis, seconded by Councilman Bolmgren, June 11, 1956
was set as date of hearing on proposed sanitary sewer and the bituminous surfacing
of 44th Street between Dart Avenue and Wooddale Avenue, at estimated cost of
$2449.90, area to be assessed Lots 1, 2 t? 3, Block 1, Arden Park Second Addition,
by unanimous vote of all members of the Council present.
Re-draft of Proposed Agreement with School Board and City of St. Louis Park
Re-draft of proposed agreement with School Board and the City of St. Luis
Park regarding the operation of a public recreation program was read and dis-
cussed.
On motion of Councilman Davis, seconded by Councilman Schadow, this matter
was deferred with.the understanding that the City Manager rewrite this proposed
agreement and have his recommendations ready for June 4, 1956 meeting and also
that the City Attorney have Ordinance Section revised creating Park and Recrea-
tion Advisory Commission, by unanimous vote of all members of the Council
present.
Contract - Carl Gardner and Associates and City of St. Louis Park for City
Planning
Proposed contract of Carl Gardner and Associates with the City of St.Louis
Park was read.
On motion of Councilman Davis, seconded by Councilman Schadow, the corrected
contract as presented by the City Attorney for execution between Carl Gardner
and Associates with the City of St. -Louis Park for City Planning was approved,
and the Mayor and City Manager were authorized to execute same for the City, by
unanimous vote of all members of the Council present.
Request from V.F.W. Post to Sell 3.2 Beer at Carnival
Mr. Cyril Doyle, Veterans of Foreign Wars Post,asked for permission to sell
3.2 beer on-sale at the Carnival to be held at Monk Avenue and Highway No. 7,
May 22 to May 30, 1956.
He was told that under our Ordinance this request was not legal.
Verified Claims
On motion of Councilman Jorvig, seconded by Councilman Bolmgren, the lists of
verified claims prepared by the City Clerk and presented to the Council, dated
May 21, 1956, in the total amount of $9,422.10 for vendors were approved, and the
City Manager, City Clerk, and City Treasurer were authorized to issue checks
covering same, by the following roll call vote: Councilman Bolmgren, yea;
Councilman Davis, Yea; Councilman Ehrenberg, Yea; Councilman Jorvig, yea;
Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea.

Payments on Contract Work
On motion of Councilman Schadow, seconded by Councilman Bolmgren, the follow-
ing payments on contract work, presented by the City Engineer were approved, and
the City Manager, City Clerk, and City Treasurer were authorized to issue checks
for their respective amounts, by unanimous vote of all members of the Council
present.
