Fernstrom at 8:03 P. M. Invocation was given by Reverend Robert Turner of Most Holy Trinity Catholic Church. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis Robert Ehrenberg • Gene Schadow Kenneth Wolfe Also present were the City Manager, City Attorney, and Secretary to the City Council. Minutes On motion of Councilman Bolmgren, seconded by Councilman Schadow the minutes of meeting held March 26, 1956 were approved by unanimous vote of all members of the Council present. Request for Approval of Building Permit for Addition to Al's Liquor Store Request of Olaf Pearson, Contractor for approval of issuance of a building permit for an addition to Al's Liquor Store at 3912 Excelsior Boule- vard was presented to the Council. On motion of Councilman Wolfe, seconded by Councilman Bolmgren, the above request was approved, and the Building Inspector was authorized to issue permit for same, subject to compliance with all applicable codes and ordinances, by unanimous vote of all members of the Council present. Petition for Rezoning Petition signed by Philip C. Starkey and others, dated April 2, 1956 for the rezoning of Lots 1 -and 2, Block 69, St. Louis Park Addition, from Residential Use District to Multiple Dwelling Use, was read. (3850 Brunswick) On motion of Councilman Bolmgren, seconded by Councilman Davis, the above petition was referred to the Planning Commission for advice and recommendation, by unanimous vote of all members of the Council present. Request for Special Zoning Exception to Permit Location of Sign Request for special zoning exception to permit the location of a 6' x 15' canopy mounted sign at 4812 Excelsior Boulevard - sign erection permit applied for by Western Outdoor Advertising Company, was read. RESOLUTION NO. 227 On motion of Councilman Davis, seconded by Councilman Wolfe, Resolution No. 227, granting permit under Section 10. 3 of the Zoning Ordi- nance of the City of St. Louis Park to Western Outdoor Advertising Company for the location of a 6' x 15' canopy mounted sign at 4812 Excelsior Blvd. having been read by the Secretary, was adopted by unanimous vote of all members of the Council present, Request for Correction of Error in Resolution No. 222 Letter from Moses and Friedell, Attorney for Roto-Rooter Sewer Service Company, dated March 26, 1956, requesting correction of error in Resolution No. 222 relating to a zoning exception to permit commercial usage of property near Wayzata Boulevard and Louisiana Avenue, was read 28 April 2, 1956 Request for Correction of Error in Resolution No. 222, cont'd. 4 RESOLUTION NO. 22B On motion of CouncilmaL Davis, seconded by Councilman Bolmgren, Resolution No. 222 granting permit under Section 10. 3 of the Zoning Ordinance to Roto-Rooter Sewer Service Company is hereby amended by Resolution No. 229 by inserting the following Ilnore specific description of the premises re- ferred to in said Resolution Ni. 222: "All that part of the NE 1 /2 of the SW 1/4 of Section 5, Township 117, Range 21 lying no/1th of a line drawn parallel to Wayzata Boulevard and 275 feet south of the south line of the right-of-way of Wayzata Boulevard, and lying east of a line drawn parallel to Louisiana Avenue and 350. 6 feet west of the west line of Louisiana Avenue, except the east 150 feet of the north 125 feet of said tract. Resolution No. 222 was adopted by unanimous vote of all members of the Council present. " Request for Permission to Open a Fish Smoking Business Letter from Perry Zlotnich, 5405 Oliver Avenue South, dated March 28, 1956, requesting permission to open a fish smoking business in St. Louis Park, particularly on Excelsior Boulevard near the Miracle Mile Shopping Center, was read. Mr. Zlotrich was present and was told that an operation of this kind is not allowable in a commercial area. On motion of Councilman Ehrenberg, seconded by Councilman Schadow, the above request was ordered placed on file, by unanimous vote of all members of the Council present. Minutes of St. Louis Park Recreation Commission A copy of the minutes of the St. Louis Park Recreation Commission for meeting of March 27, 1956, making certain recommendations to the City Council, City Manager, and School Board was read. On motion of Councilman Davis, seconded by Councilman Wolfe, the copy of minutes of the St. Louis Park Recreation Commission for meeting of March 27, 1956 were referred to the City Manager for study and a report to the Council on April 16, 1956, by unanimous vote of all members of the Council present. - - Request for Special Use Permit --- Construction of New Church Letter from Wilbur Wacker, Pastor, Park Assembly of God, dated April 2, 1956, requesting a special use permit under Section 10. 3-33 of the City Zoning Ordinance for the purpose of constructing a church on Lots 21, 22, 23, 24, (Minnetonka & Gettysburg); Lots 13, 14, 15, 16, (Flag Avenue) of North 1/2 of Section 18, Township 117, Range 21, of the J. F. Lyons Addition to St. Louis Park, was read. On motion of Councilman Ehrenberg, seconded by Councilman Davis, the above request was referred to the Planning Commission, by unanimous vote of all members of the Council present. Proposed Ordinance First reading of proposed ordinance to amend the zoning ordinance of the City of St. Louis Park 5y repealing Sections 10. 3-31, 10. 3-32, amid 10. 3-33 thereof was made by the City Attorney. It was moved by Councilman Davis, seconded by Councilman Bolmgren that Subdivision 10. 3-30 be inserted in above proposed ordinance, and that Subdivision 10. 3-33 be deleted. Motion was passed 5y unanimous vote of all members of the Council present. 29 April 2, 1956 • Proposed Ordinance, continued On motion of Councilman Davis, seconded by Councilman Bolmgren, April 9, 1956 was set for second reading of foregoing proposed ordinance, by unanimous vote of all members of the Council present. Proposed Ordinance First reading of ordinance entitled "An Ordinance Authorizing the transfer of Sums From the Unexpended Balance of the Budget to Other Purposes was made by the Secretary. On motion of Councilman Schadow, seconded by Councilman Davis, April 9, 1956 was set as date for second reading of above proposed ordinance, by unanimous vote of all 'Members of the Council pre sant. Proposed Ordinance Second reading of proposed ordinance entitled entitled An Ordinance Amending the Zoning Ordinance of the City of St. Louis Park was waived by unanimous consent, of all members of the Council present. ORDINANCE NO. 521 On motion of Councilman Wolfe, seconded by Councilman Schadow, Ordinance No. 521 rezoning Lots 8 and 9, Block 3, Browndale Addition from Residential Use District to Limited Commercial Use District; and permitting the construction of an office building thereon, was adopted by unanimous vote of all members of the Council present. Report of City Attorney Re: Authority to Waive Interest Pay- ments in Connection with Pre-paying Special Assessments Report from the City Attorney in response to the City Council's re- quest for an opinion as to the City's authority to waive interest payments in connection with pre-paying special assessments --- specific request made by Ecklund & Swedlund on January 12, 1956, was read. On motion of Councilman Davis, seconded by Councilman Ehrenberg, the above request was denied, and the City Clerk was directed to send a copy of the City Attorney's legal opinion to Ecklund & Swedlund, by unanimous vote of all members of the Council present. Report on Cost of Fencing the Sump Playground at 31st & Oregon Report of Director of Public Works concerning the cost of fencing the sump playground at 31st Street and Oregon Avenue was read. On motion of Councilman Davis, seconded by Councilman Schadow, the above report was ordered placed on file, by unanimous vote of all members of the Council present. Report Re: Preliminary Studies Relating to Re-location of Texas Avenue, Etc. Report of Director of Public Works in response to the City Council's request for preliminary studies relating to the relocation of Texas Avenue between Franklin Avenue and Highway No. 12 was read and discussed. It was suggested that a study be made of the present right-of-way and a report on what can be done to make same a better roadway. Report Re: Quality of Recent Street Tree Trimming The City Manager made a verbal report on quality of recent street tree trimming. No action. Report Re: Advisability of a Street Tree Spraying Program The City Manager made a verbal report regarding the advisability of a street tree spraying program in 1956. No action. Re-draft of Proposed Ordinance Re: Garbage Collection and Disposal Re-draft of proposed ordinance entitled An Ordinance Establishing a Municipal Service for the Collection and Disposal of all Garbage and Refuse Accumulated in the City, Etc. was read by the City Attorney. 30 = April 2, 1956 krog n Re-draft of Proposed Ordinanc- Relative to Garbage Collection, Etc. continued On motion of Councilm-n Davis, seconded by Councilman Bolmgren, April 9, 1956 was set as date for second reading of above proposed ordinance, by unanimous vote of all memoers of the Council present. Deferred Action Re: Tentative Statement to Highway Taxes Distribution Co , ission Action on request for pews of City Councils and City Engineers upon the tentative statement to Highway Taxes Distribution Commission by The League of Minnesota Muni ipalities presented to the Council on March 26, 1956, and deferred by the, to this meeting was again discussed. It was moved by Counc lman Davis, seconded by Councilman Wolfe, that the City Council recomme' d to The League of Minnesota Municipalities that Amendment No. 2, which will be voted on at the November general election be approved, providin;; that Item #5 be amended to read: "Allocatio of the other 50% on the basis of population, according to the last decennial or special federal census". Motion was passed by unanimous vote of all members of the Council present. Proposed New Building Code The matter of a proposed new building code presented at Council meeting of March 26, 1956, al d deferred to this meeting, was discussed. r On motion of Councilman Davis, seconded by Councilman Schadow, the City Attorney was instructed to prepare an appropriate ordinance adopting by reference, the Uniform Building Code of Pacific Coast Building Officials Conference including dwelling house construction under the Uniform Building Code; and the Electrical Ordinance of the City of Minneapolis with an amendment that any type of wiring approved by the- National Board of Under- writers, etc. , by unanimous dote of all members of the Council present. Re: Fencing of Sump in Block Between 29th & Minnetonka, and Texas & Sumter The matter of fencing bf sump in the block between 29th Street and Minnetonka Boulevard, and between Texas Avenue and Sumter Avenue was presented by the City Manager. No action taken. Preliminary Draft of Ordinance Establishing a Position Classification, A Compensation Plan, Basic Pe sonnel Policy and Conditions of Employment On motion of Councilmen Davis, seconded by Councilman Schadow, the preliminary draft of ordinance establishing a position classification, a compensation plan, basic personnel policy and conditions of City employment was referred to the Committee of the Whole, by unanimous vote of all members of the Council present. Agenda for Joint School-Board-City Council Meeting The agenda for Joint School Board-City Council Meeting to be held at 6:30 P. M. , Tuesday, April 3, at Lilac Lanes was reviewed by the City Council, and ordered filed. Expiration of Terms of Park Commissioner and Recreation Commissioner Notification of expiration of terms of Walter Menzel and Joseph Bartole to the Park Commission and to the Recreation Commission res- pectively at of April 1st was presented to the Council. No action taken at this time. Recommendations of Local 22 ,, AFL Re: Civil Service Recommendations of Members of Local 224 of the American Federa- tion of State, County, and Municipal Employees relating to the establishment of Civil Service status for all City EMployees were read,. and discussed. Dick Knutson and Stanley Stabno were present. 31 April 2, 1956 Recommendations of Local 224, AFL Re: Civil Service, cont'd. It was moved by Councilman Ehrenberg, seconded by Councilman Bolmgren, that letter from Dick Knutson, Secretary of Local 224 AFL re- lating to the establishment of civil service status for all City employees, and proposed ordinance be referred to the Committee of the Whole. Motion was passed by affirmative vote of all members of the Council present except Councilman Davis who voted no. Application for On-Sale Intoxicating Liquor License L. Strickler, Attorney for Bernard A. Dahlberg presented an appli- cation for an on-sale intoxicating liquor license to be used on ground located on the SW corner of Wayzata Boulevard and Highway No. 100. On motion of Councilman Schadow, seconded by Councilman Ehrenberg, the above application was referred to the Committee of the Whole, by unani- mous vote of all members of the Council present. Bonds On motion of Councilman Davis, seconded by Councilman Schadow, the following bonds which have been approved by the City Attorney were accepted by unanimous vote of all members of the Council present: Gas Installation Bond Burkes Heating Company Heating License Bond Burkes Heating Company. Petition for Vacation of Streets Petition signed by John D. O'Brien, Attorney for Petitioners Thomas H. Lentz and Joyce C. Lentz, his wife, dated April 2, 1956 for vacating "That part of Franklin Avenue, as laid out and dedicated in the plat of Supreme Park, First Division, Village of St. Louis Park, lying West of the Easterly line of Lot 1, Block 2, Supreme Park, First Division, Village of St. Louis Park, extended Northerly to the North line of said Franklin Avenue and lying Easterly of the Southwesterly line of Lot 2, Block 2, Supreme Park , First Division, Village of St. Louis Park, extended Northwesterly across Lot 1, Block 2, and Northwesterly to the North line of said Franklin Avenue" was read. On motion of Gene Schadow, seconded by Councilman Davis, April 16, 1956 was set as date for hearing on above petition, by unanimous vote of all members of the Council present. Verified Claims On motion of Councilman Davis, seconded by Councilman Wolfe, the lists of verified claims prepared by the City Clerk and presented to the Council, dated April 2, 1956 in the total amounts of $1, 091. 51 for payroll, and $11, 752. 09 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, yea; Councilman Schadow, yea; Councilman Wolfe, yea; and Mayor Fernstrom, yea. Meeting Adjourned On motion of Councilman Davis, seconded by Councilman Schadow, the meeting was adjourned at 12:24 AM, April 3, 1956, by unanimous vote of all members of the Council present.
