Fernstrom at 8:16 P.M. Invocation was given by Rev. Robert Landes of the Grace Presbyterian Church, of Minneapolis, Minnesota. The following Councilmen were present at roll call: H. J. Bolmgren H. C. Davis Robert Ehrenberg Torva ; Jorvig Gene Schadow Kenneth Wolfe Also present were the City Manager, City Attorney, Secretary, City Manager Interne, City Assessor and Carl T. Miller. Minutes On motion of Councilman Wolfe, seconded by Councilman Schadow, the minutes of meetings held September 18, 21 and 24, 1956, were approved, by unanimous vote of all Members of the Council present. Hearing on Petition for Rezoning Property at 4100 Excelsior Boulevard Pursuant to notice published in the St. Louis Park Dispatch September 20, 1956, a public hearing was had on petition of James Resop for the rezoning of property at 4100 Excelsior Boulevard from Multiple Dwelling Use District to Limited Commercial Use District. No persons appeared in opposition. First reading of Ordinance AMENDING THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK (rezoning of property at 4100 Excelsior Boulevard from Multiple Dwelling Use District to Limited Commercial Use District) was made by the Secretary. It was moved by Councilman Bolmgren, seconded by Councilman Jorvig, that the second reading of Ordinance AMENDING THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK (rezoning property at 4100 Excelsior Boulevard) be made on October 8, 1956. Motion passed by unanimous vote of all members of the Council present. Assessment Hearings Pursuant to notice published in the St. Louis Park Dispatch September 13, 1956, a public hearing was had on proposed assessments for Improvement No. 55-48, Widening, grading and bituminous surfacing of West 36th Street from Zinran Avenue west to a point midway between Zinran Avenue and Aquila Avenue, including acquisi- tion of additional right-of-way; and Improvement No. 55-19, Construction of water main extension in West 18th Street from Flag Avenue to Fairway Lane to north end of turn around. Reading of Resolution No. 301 was waived by unanimous consent of all members of the Council present. 246 October 1, 1956 Assessment Hearing Continued On motion of Councilman Wolfe, seconded by Councilman Schadow, Resolution No. 301, ordering assessments for the above improvements, was adopted by, unani- mous vote of all members of the Council by the following roll call: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, yea; Councilman Jorvig, yea; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea. Hearing on Proposed Street Surfacing and Street Stabilizing Pursuant to notice published in the St. Louis Park Dispatch, September 20 and 27, 1956 a public hearing was had on proposed Street surfacing and street stabilizing, Improvements 56-22, 70, 71, 73, 74, 75, 76, 77, 78, 79, 80, 81, 82, 83 and 84, described therein. The following persons appeared: Mr. Mc Namara, 1420 Nevada Avenue objected to No. 56-84. Motion made by Councilman Davis, seconded by Councilman Jorvig, that action be deferred until October 8, 1956 on 'Improvement Nos. 56-22, and 70 thru 76, until the City Engineer can determine if 4" stabilization is in or needed before 2" Bituminous Surfacing is put in. Motion was passed by unanimous vote of all members of the Council present. Motion made by Councilman Davis, seconded by Councilman Jorvig, that action be deferred on Improvement Nos. 56-77 thru 56-84 to October 8, 1956. Motion was passed by unanimous vote of all Members of the Council present. Request for Building Permit - Park Tavern. 7200 Minnetonka Boulevard Request from J. Philip Jordan, owner and Richard V. Mouchka, builder, dated September 27, 1956 for approval of the issuance of a building permit for the construction of an addition to the Park Tavern, 7200 Minnetonka Boulevard, was read. On motion of Councilman Bolmgren, seconded by, Councilman Schadow, the build- ing inspector was authorized to issue above permit subject to compliance with all applicable codes, by unanimous vote of all members 'of the Council present. Communication from Waco Manufacturing Co. regarding Garbage v Refuse Collection Communication received from Waco Manufacturing Company, dated September 25, 1956, (3565 Wooddale Avenue) regarding the garbage and refuse collection ordinance, was read. On motion of Councilman Wolfe, seconded by Councilman Schadew the above communication was ordered to be placed on file, by unanimous vote of all members of the Council present. Petition for Stabilized Base on Aquila Lane etc. Martin C. Graning and others Petition received for stabilized base on Aquila Lane from 31st Street to Minnehaha Creek; 34th Street from Great Northern Railway Spur to Aquila Lane; and Cavell Lane from Aquila Lane Northwesterly to dead end signed by M. C. Graning, 3220 Aquila Lane and others, was read. On motion of Councilman Davis, ,seconded by Councilman Schadow, the above petition was referred to the City Engineer for preliminary report for the meeting of October 8, 1956 and the City Attorney was directed to prepare a resolution for setting hearing date, to be ready for October 8, 1956, by unanimous vote; of all members of the Council present. 24-7 October 1, 1956 Request for Building Permit - 2633 Louisiana Avenue - Ideal Equipment Company Request from Ideal Equipment Company, 6424 Walker Street, dated September 28, 1956, for approval of the issuance of a building permit for the construction of a commercial building at 2633 Louisiana Avenue, was read. On motion of Councilman Schadow, seconded by Councilman Wolfe, the building inspector was authorized to issue the above permit subject to compliance with all applicable codes, by unanimous vote of all members of the Council present. Request to Divide Lots 29 & 30, Blk. 1, Blvd. Heights 2nd Add. - R. Barton Request from Robert Barton, to divide lots 29 & 30, Block 1, Boulevard Heights Second Addition and sell the front 62.5 feet for another house (3101 Maryland Avenue) was read and discussed. On motion of Councilman Schadow, seconded by Councilman Wolfe, the above request was referred to the Planning Commission for advice and recommendation by unanimous vote of all members of the Council present. Request from Clinton Corp. - Rezone Lots 4 & 5. Blk. 1, Hankers Mkhda Terrace Request from the Clinton Corporation to rezone Lots 4 & 5, Block 1, Hankers Minikanda Terrace, from Residential Use District to Commercial Use District was discussed. Motion was made by Councilman Ehrenberg, that the above petition be referred to the Planning Commission for advice and recommendation but was lost because of no second. On motion of Councilman Bolmgren, seconded by Councilman Davis, the above request for rezoning of Lots 4 & 5, Block 1, Hankers Minikanda Terrace from Residential Use District to Commercial Use District was denied by unanimous vote of all members of the Council present, except Councilman Ehrenberg who voted nay. Resolution No. 302 - Eliminating Street Improvement Nos. 56-29 and 55-79 from Contr. On motion of Councilman Bolmgren, seconded by Councilman Wolfe, Resolution No. 302 ELIMINATING STREET IMPROVEMENT NOS 56-29 and 55-79 FROM CONTRACTS was adopted by the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, yea; Councilman J;brvig, yea; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea. Resolution No. 303 - State Highway Improvements on Highway No. 100 On motion of Councilman Wolfe, seconded by Councilman Jorvigy Resolution No. No. 303 Agreeing to Join with the State Highway Department in order to effect Improvement of Highway No. 100, was adopted by the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman 'Ehrenberg, yea; Council- man Jorvig, yea; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea. 248 1-3341.4 October t, 1956 Modification of Ordinance No. 525 - Building Permit Fees On motion of Councilman Schadow, seconded by Councilman Wolfe, Table No. `3-A as set forth in Section 5:109 of Ordinance No. 525, adopted by the City Council on April 16, 1956, but which ordinance has not been previously published, is hereby modified to read as follows: TABLE NO. 3-A --- BUILDING PERMIT FEES For residential construction cost of which is $10,000 or less the fee shall be based on cost of the Building as follows: I Less than $20.00 No Fee $20.00 to and including $100.00 - $ 1.00 More then $100.00 to and including $400.00 2.00 More than $400.00 to and including $700.00 4.00 More than $700.00 to and including $1000.00 6.00 Each additional $1000.00 or fraction to and including $10,000.00 - - - - 2.00 For residential construction, including buildings accessory thereto, the cost of which exceeds $10,000, and for all other buildings the fee shall be based upon cubic content of the building as follows: $.90 per 1000 cubic feet for semi-fireproof and residential construction; $1.00 per 1000 cubic feet for fireproof construction. Computation of fees for building permits: In computing the cubic content of any building or an additionito an existing building of approximately uniform height throughout, the product shall be obtained by multiplying the ground area covered by such building or addition by the distance from a point six inches below the floor line of the basement or cellar where there is to be a basement or cellar, or from the top of the foundation where there is neither basement or cellar, to the average height of the upper surface of a flat roof, or to the average height of the roof surface of the main gable of a pitched roof. and as so modified said ordinance is hereby readopted and the Clerk be hereby directed to publish said ordinance forthwith. Motion was passed by unanimous vote of all members of the Council present. Curfew Ordinance First reading of Proposed Curfew Ordinance was waived by unanimous consent of all members of the Council present. It was moved by Councilman Schadow, seconded by Councilman Jorvig, that the second reading of the Proposed Cur'ew Ordinance be made on October 8, 1956, Motion passed by unanimous vote of all Members of the Council present. 249 October 1, 1956 Ordinance No. 544 - Vacating Colorado Avenue Second reading of Ordinance No. 544, entitled AN ORDINANCE VACATING STREET (Colorado Avenue - South of 36th Street to the Railroad, etc.) was waived by un- animous consent of all members of the Council present. On motion of Councilman Schadow, seconded by Councilman Wolfe, Ordinance No. 544 was adopted by the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Ehrenberg, yea; Councilman Jorvig, yea; Councilman Schadow, yea; Councilman Wolfe, yea; Mayor Fernstrom, yea. Report on Commercial Garbage Pickup etc. - City Manager Report on enforcement of commercial garbage pickup and refuse burning re- gulations. James Rssop, representing the Chamber of Commerce, was present and discussed the problem. ' The City Manager presented a prepared report and also gave additnnal data on use of private pickups and use of incinerators. On motion of Councilman Wolfe, seconded by Councilman Schadow, the report was ordered to be placed on file, by unanimous vote of all members of the Council present. Report on Firemen's Relief Association Report on Firemen's Relief Association (requested September 17, 1956) by the City Manager. Action deferred until October 8, 1956, to give the City Attorney opportunity to check statutes as to monies to be paid into the Fire Relief Association. Report on Permission to Cut Land by Director of Public Works Report from the Director of Public Works, dated September 27, 1956, on the request of Adolph Fine to cut land, was read. (Outlot A) On motion of Councilman Jorvig, seconded by Councilman Schadow, action on the above request was deferred to October 8, 1956 by unanimous vote of all members of the Council present. Alley Report on Request of N. A. Coggeshall. for Designation of a Private Alley for Public/ Report from the Director of Public Works, dated September 27, 1956, on the request of N. A. Coggeshall, 3707 Gienhurst Avenue, for the designation of a private alley as a public alley (deferred from September 17, 1956) was read. On motion of Councilman Wolfe, seconded by Councilman Jorvig, the above re- quest was denied by unanimous vote of all members of the Council present. 250 October 1, 1956 Report on Driveways at' Texas Ave. & Mtka. Blvd. Report from Director of Public Works, dated September 27, 1956, on the communication from Adolph Fine concerning the finishing of the paving of Minnetonka Boulevard with regard to the driveways at Texas Avenue and Minnetonka Boulevard, was read. On motion of Councilman Wolfe, seconded by Councilman Schadow, the above report was ordered placed on file, by unanimous vote of all members of the Council present. Report on Erection of Speed Limit Signs - City Manager Report by the City Manager on the erection of speed limit. signs was discussed, but no action was taken. Preliminary Report of Engineer etc. Re: Sidewalk on WS of Texas Avenue Preliminary report from the City Engineer, and recommendations of the City Assessor, dated September 27, 1956, with respect to the construction of sidewalk on the West Side of Texas Avenue from 33rd Street to 34th Street (deferred from the September 24, 1956 meeting) "was read. On motion of Councilman Wolfe, 'seconded by Councilman Schadow, the City Attorney was requested to prepare a Resolution setting date for hearing to be read at the October 8, 1956 meeting, by unanimous vote of all members of the Council present. Report on Damage to Fender of Car - E. A. Kinnon. 3048 Hampshire Avenue Report on damage to fender of car belonging to E. A. Kinnon, 3048 Hampshire Avenue during City Street sweeping operations was made by the City Manager. The City Manager explained how the damage was caused and claim for damage was approved with the other Verified Claims, this date. Report on Claim of H. Hatfield, 3360 Zarthan - Re: Adi. of Sewer Assessment Report of the City Attorney, dated September 18, 1956, on the claim of H. Hatfield, 3360 Zarthan Avenue for adjustment of sewer assessment,as requested August 6, 1956, was read. Action was deferred to October 8th, 1956 for additional check by City Manager. Bids for One Automobile and Three Tucks As advertised in the St. Louis Park Dispatch September 13, 1956, sealed bids were received by the City Manager at 10 o'clock a.m. this date for the furnishing of one 1956 Automobile with a trade in, two 1956 3/4 Ton Pick Up trucks with trade ins, and One 1956 z Ton Pick Up truck and no trade in.
