Fernstrom at 8:04 P. M. Invocation was given by Reverend George Lundquist of Prince of Peace Luthern Church. The following Council Members were present at roll call: H. J. Bolmgren H. C. Davis C. L. Hurd Torval Jorvig C. R. Middleton H. W. Perkins R. C. Fernstrom Also present were City Manager Tom Chenoweth; City Attorney Edmund T. Montgomery; and City Clerk (Secretary) Joseph Justad. Re: Permit Fees for Christian Brothers High School George Conners, Attorney for Christian Brothers spoke about theirp plans for building a High School for boys. He made a plea to have the fees for building permits waived, or reduced to a minimum cost. The City Attorney said that Ordinance 113 specifies fees and there is no basis set for waivers. On motion of Councilman Davis, seconded by Councilman Middleton, the above request was referred to the City Manager and Building Inspector to determine what has been done in the past in regard to other schools similar to proposed Christian Brothers High School, and Churches; and that Christian Brothers be permitted to proceed with the construction of their school on the approval of plans by the Council, City Engineer and Building Inspector without the payment of fees until the Council has the report before them regarding waiver of fees, by unanimous vote of all Members of the Council present. On motion of Councilman Perkins, seconded by Councilman Bolmgren, the plans for proposed Christian—Brothers High School are hereby approved subject to approval of the Building Inspector and City Engineer, and the matter of parking and drainage on school property was referred to the City Engineer, by unanimous ote of all Members of the Council present. Request for grade Crossing at 31st & Aquila across Great Northern Tracks Request of Independent School District No. 205 for a grade crossing to provide access to Minnetonka Boulevard School site was read by Mayor Fernstrom. On motion of Councilman Davis, seconded by Councilman Bolmgren, the City Attorney was requested to prepare a resolution directed to the Minnesota Railroad and Warehouse Commission, requesting a grade crossing over the Great Northern Railroad tracks from Aquila Avenue west approxi- mately at 31st Street, by unanimous vote of all Members of the Council present. Linnee Request for Special Use Permit to Build a Mortuary Ralph Rutledge appeared requesting a special use permit to construct a mortuary on the NW corner of Excelsior Boulevard and Webster Avenue. On motion of Councilman Davis, seconded by Councilman Middleton, the request of Mr. Rutledge for a special use permit for Lots 25 and 26, Block 2, Meadowbrook Addition (NW corner of Excelsior Boulevard and Webster Avenue) to build a mortuary was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. , 46 January 3, 1956 1 Ornamental Light in Front of Home at 8607 Virginia Circle North Mr. and Mrs. L. B. Corwin, 8607 Virginia Circle North appeared regarding the ornamental street light in front of their home. Due to illness in the home, they would like to have this light shaded. Northern States Power Company has suggested that a certain part of this light could be painted with black paint to deflect the light. Mr. G. D Bock, 8612 Virginia Circle North who lives on the other side of the street would also like some relief from this light shining in his home. The matter was referred to the City Manager to check with Northern States Power Company for correction of this trouble. City Property at 28th & Joppa Letter from Ralph Wittgraph, President of Fern Hill PTA, dated December 20, 1955, calling attention to the City owned property at 28th and Joppa adjacent to the Fern Hill School property was read, stating that same Ds an eyesore and physical hazard as well as a breeding spot for teen-age trouble. The City Engineer's report on this matter was read, estimating the cost of wrecking the building on this property, etc. Discussion ensued. On motion of Councilman Bolmgren, seconded by Councilman Hurd, the City Manager was directed to take bids for the wrecking of building known as the Stageberg building located on the S 1 /2 of Section 31, Twp. 29, Range 24, Parcel 1006, Plat 49731, with the view of salvaging and/or disposing of all meterial thereon, by unanimous vote of all Members of the Council present. Final Payments on Completed Contracts On motion of Councilman Hurd, seconded by Councilman Davis, the following final payments on completed contracts hereinafter described and certified by the City Engineer were approved, and the City Manager, City Clerk and City Treasurer were authorized to issue checks for the respective amounts payable to Wm. V. Terry Excavating Company, Inc. , the Contractor, and Fire Association of Philadelphia, Assignee, by unanimous vote of all Members of the Council present. Improvements No's 54-86, 88, 89, 89A, 91, 92, 107, 108, and 109. Contract dated August 2, 1954. Contract Price, $133, 686. 10. Balance due $3, 240. 77. Improvements No's. 54-110, 111, 112. Contract dated August 2, 1954. Contract Price, $37, 568. 00. Balance due $4, 538. 96. Partial Payment on Contract Work On motion of Councilman Hurd, seconded by Councilman Bolmgren, the following partial payment on contract work in progress& presented by the City Engineer was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks for their respective amounts, by unanimous vote of all Members of the Council present: FINAL PAYMENT $385. 40 GRADING, Improvement No. 54-164 Contractor, Twin City Dirt Movers Contract Date, June 27, 1955 Contract Price, $5, 785. 56. Resolution No. 196 Resolution No. 196 DESIGNATING VOTING PRECINCTS was read by the Secretary. On motion of Councilman Bolmgren, seconded by Councilman Hurd, Resolution No. 196 was adopted by unanimous vote of all Members of the Council present. Resolution No. 196 in Book 1 of Resolutions. 462 January 3, 1956 Strip of Land for 31st Street West of Utah On motion of Councilman Davis, seconded by Councilman Hurd, the �. City Manager and the City Attorney in concert with Attorney of School Board and some other appropriate School Board official were directed to discuss with Landers-Norblom-Christenson Company the possibility of securing a strip of land to be used as 31st Street west from Utah Avenue to Aquila Avenue, and also to discuss the problem of acquiring Lots 5, 6, and 7 facing East to Utah Avenue at 31st Street also for use of 31st Street, the same to be reported on at the earliest possible time, by unani- mous vote of all Members of the Council present. Examination for Six Police Sergeants City Manager, Tom Chenoweth reported on the meeting with the Police Civil Service Commission at noon this date. On motion of Councilman Davis, seconded by Councilman Jorvig, the City Manager was instructed to request the Police Civil Service Commission to conduct an examination for six sergeants for the Police Department, by unanimous vote of all Members of the Council present. Correction with Respect to Classification On motion of Councilman Hurd, seconded by Councilman Perkins, it being determined that the Salary and Wage Scale adopted December 27, 1955 was in error with respect to classification of "Dale" under Clerk II, Range 9, the said scale was corrected as to that item to read as follows, by unani- mous vote of all Members of the Council present: "Clerk II Range 9 - Dale Step A Bi-weekly Salary $120. 00. " Verified Claims On motion of Councilman Bolmgren, seconded by Councilman T. Jorvig, the list of verified claims prepared by the City Clerk and presented to the Council, dated January 3, 1956 in the total amount of $6, 933. 05 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Hurd, yea, Councilman Middleton, yea; Mayor Fernstrom, yea. Councilman Perkins was out of the room. Minute s On motion of Councilman Middleton, seconded by Councilman Jorvig, the minutes of meeting held December 27, 1955 were approved by unanimous vote of all Members of the Council present.
