C. Fernstrom at 8:11 P. M. Invocation was given by Reverend Lundquist of Prince of Peace Lutheran Church. The following Council Members were present at roll call: Councilman H. J. Bolmgren Councilman H. C. Davis Councilman C. L. Hurd Councilman Torval Jorvig Councilman C. R. Middleton Mayor R. C. Fernstrom Also present were City Manager, Tom E. Chenoweth, City Attorney, Edmund T. Montgomery, and City Clerk (Secretary) Joseph Justad. Hearing on Proposed Sanitary Sewer Construction Separate hearings were had on the proposed public improvements described in the following resolution. The following persons appeared: R. J. Lampe, 2705 Xenwood Avenue said that he is already in District #1-E. Assessor Connery-said that .it is planned to eliminate the lift station now serving his property. He is paying for district sewer and lift station. Said he was informed in the City Office that he hAsno, ewer, but he knows he has. He objects to being assessed for Trunk Sewer #4. oAUrd said that he should be given credit for his other assessment, and not pay for two. There were others from the same block who held the same thoughts on additional assessment for Trunk Sewer #4. Mayor Fernstrom explained our deal with the Village of Golden Valley. Others present were Mr. M. Lehrman, 2706 Xenwood Avenue and Mr. Sam Edwins, 2701 Xenwood Avenue. Mr. Edwins asked if there would be a hearing on the assessment later. He was told that there would be. He asked if saving were to be made by the people of St. Louis Park by building this sewer, why shouldn't the entire City pay for it. District sewers and payment of same was explained. Mr. Edwins asked what he could say to change the Council's idea of constructing Trunk Sewer #4• Mayor Fernstrom said if the majority of folks ask that it not be cons- tructed, it could be considered. The people on Xenwood Avenue between 27th and 28th Streets want to go on record that they will be paying twice for sewer under the present plan. Mrs. J. J. Westheim, 2712 Xenwood Avenue, Mrs. M. G. Brill, 2713 Xenwood Avenue, Mr. J. A. Senander, 2718 Xenwood Avenue, Mr. A. J. Farrington, 2657 Xenwood Avenue all said they have sewer. Mayor Fernstrom explained the difference between assessments and taxes. Mrs. Brill asked how they would receive credit. She was told that it would depend upon the cost of the new sewer. Glenn Wilson, 2848 Kentucky Avenue said he and others are very much interested in getting this sewer as soon as possible. Mr. A. T. Magnuson, 2813 Kentucky Avenue asked about how soon he would be able to connect up to the sewer if we go ahead with this project. Was told just as soon as the majority of folks in District #4 desire the construction of same. Mayor Fernstrom said that his thinking is if Golden Valley goes through with the proposed project, that the folks in all of District #4 will be canvassed for approval of the trunk for North Side at once. Councilman Jorvig said that the General Mills project proposed for Highway No. 12 and 18 will spur Golden Valley on to build the proposed sewer. Mr. Wm. 0. o Avenue said he would like to see the balance of North Side start Cook, 2816 Idah at the same time as the Golden Valley project as he needs the sewer badly. Councilman Jorvig explained where the Council would construct a block of sewer not wanted, if it is necessary to serve a block farther out. A Great Northern Railway representative asked if there would be further hearings on the other trunk sewer, other than the Golden Valley sewer. Told there would be. He said the Great Northern enters a protest now to the proposed sewer as they have not had an opportunity to set same up. The question was raised -- would the Council publicize the project and get petitions for the North Side sewer? Answer -- Council will prepare petitions and the public must circulate and bring in. The Dispatch reporter said they would give lots of publicity. Mr. L. S. Soshnik, 2836 Kentucky Avenue asked if thereare any unplatted property owners who might object to the sewer for North Side. 372 September 12, 1955 � Hearing on Proposed Sanitary Sewer Construction, Cont'd. C'�7 Con Resolution No. 140 . On motion of Councilman Middleton, seconded by Councilman Jorvig, Resolution No. 140, ordering the construction of Sanitary Sewer Designated as Sanitary Sewer District No. 4, having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present. Resolution No. 140 in Book of Resolutions No. 1. Resolution No. 141 On motion of Councilman Bolmgren, seconded by Councilman Davis, resolution No. 141, Canceling and Refunding 52-216, 217, 218, Minnetonka Boulevard Improvement #499 Assessment ,(Lot 1, Block 1, Mc Carty's 1st Addition to Fern Hill) for Mrs. Myrtle Peterson, the reading of which was waived, was adopted by unanimous vote of all Members of the Council present. Resolution No. 141 in Book of Resolutions No. 1. Ordinance No. 501 Second reading of Ordinance No. 501 was waived by unanimous consent of all Members of the Council present. On motion of Councilman Middleton, seconded by Councilman Hurd, the following ordinance was adopted by unanimous vote of all Members of the Council present: ORDINANCE NO. 501 AN ORDINANCE AMENDING ORDINANCE NO. 488 VACATING PORTION OF DAKOTA AVENUE THE CITY OF ST. LOUIS PARK ORDAINS: Section 1. Ordinance No. 488, entitled AN ORDINANCE VACATING PORTION OF STREET, adopted by the City Council on June 13, 1955, is hereby amended to read as follows: "Section 1. It is hereby determined that a petition in writing signed by a majority of the owners of property fronting upon that portion of Dakota Avenue lying south of Cambridge Street and north of the right of way of the Chicago, Milwaukee, St. Paul & Pacific Railway, lying adjacent to Lots 24 to 36 inclusive, Block 79, Rearrangement of St. Louis Park, Lots 11 to 15 inclusive Block 78, Rearrangement of St. Louis Park, and that portion of the SE4 of the NEr, of the NE4 of Section 20, Township 117, Range 21, lying south of Block 78, Rearrangement of St. Louis Park and North of said right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Ry., has been duly filed with the City Clerk requesting vacation of said street, and the City Clerk has furnished a copy of said petition to the City Manager and re- ported- the same to the City Council, and the said City Clerk has published notice of hearing- of said petition in the St. Louis Park Dispatch May 19, 1955, as directed by the Council, and that the City Council has met at the time and place specified in said notice and conducted a public hearing on said petition and has determined that it is for the best interests of the public that said street be vacated as petitioned." September 12, 1955 3 7 3 Plat of Westwood Hills First Addition On motion of Councilman Davis, seconded by Councilman Middleton, the plat of Westwood Hills First Addition was approved and accepted, and the Clerk was authorized to sign certificate for same for the City, by unanimous vote of all Members of the Council present. Bonds On motion of Councilman Middleton, seconded by Councilman Bolmgren, the follow- ing bonds which have been approved by the City Attorney, were accepted by unanimous vote of all Members of the Council present: CONTRACTORS BOND $665,710.85 Asconite Asphalt Company, principal Continental Casualty Company,' surety Dated September 8, 1955 Covering contract for construction of Bituminous Surfacing Improvements 55-79, 82, 83. GAS INSTALLATION BOND $12000.00 John's Appliance Service, principal Western Surety Company, surety Effective September 6, 1955 Expires December 31, 1955• _Planning Commission's Report on Request for Permit to Erect Billboard - Naegele Planning Commission's report dated September 7, 1955, on the request of Maegele Advertising Company for a special permit to approve the property of Ray M. Tharp and Cecil C. Hurd, Jr., at the NE Corner of Highway No. 7 and Wooddale-Avenue as a location for a billboard was read, denying the same. On motion of Councilman Hurd, seconded by Councilman Middleton, the Council concurred with Planning Commission's recommendation, and above request for special permit to approve site for billboard, was denied, by unanimous vote of all Members of the Council present. Committee on Fees for Vending Machines On motion of Councilman Bolmgren, seconded by Councilman Hurd, -a committee of three, consisting of the Mayor, City Manager, and.City Attorney was appointed to bring in recommendations for fees to be inserted in Section 4 of proposed ordinance for the inspection, regulation and licensing of food, maintaining or operating vending machines, and to provide penalties for the violation thereof, by unanimous vote of all Members of the Council present. Planning Commission's Report on -Request for Zoning,,Exception - Acme Stone Planning Commission's report dated September 7, 1955, on the request of Acme Stone and Lumber Company for a zoning exception, to permit the construction of a storage shed on their property at 3200 France Avenue (required by Section 10.3-31 of the Zoning Ordinance) was read, approving same. Resolution No. 142 . On motion of Councilman Hurd, seconded by Councilman Bolmgren, Resolution No. 142, Granting Permit Under Section 10.3 of the Zoning Ordinance, having been read by the Secretary, was adopted by the following roll call vote: Councilman Hurd, yea; Councilman Davis, yea; Councilman Bolmgren, yea; Councilman Middleton, yea; Mayor Fernstrom, yea; Councilman Jorvig, nay. Resolution No. 112 in Book 1 of Resolutions. Planning Commission's Report on Request for Variance of Setback D. E. Dietz Planning Commission's report dated September 7, 1955, on the request of D. E. Dietz, 6206 Cedar Lake Road for variance of setback from Cedar Lake Road for his proposed garage, was read, approving same with 20 foot setback from Cedar Lake Road for his residence garage. On motion of Councilman Middleton, seconded by Councilman Bolmgren, the above request was granted as recommended by the Planning Commission, by unanimous vote of all Members of the Council present. Letter Re: Sewer and Water for New Proposed Christian Brothers High School Letter from The Brothers of the Christian Schools, dated September 9, 1955, requesting that provisions be made for sewer and water facilities for their proposed new school building to be located on the NW Corner of their tract which is located east of the Belt Line and north of 26th Street, was read. On motion of Councilman Middleton, seconded by Councilman Jorvig, the above matter was referred to the City Manager and City Engineer, for checking and report, by unanimous vote of all Members of the Council present. 37 September 12, 1955 � Planning Commission's Report on Request for Permit to Erect Sign - Le Roy Planning Commission's report dated September 7, 1955 on the request of Le Roy Signs, Inc. for a permit to erect an advertising sign for Knollwood- Plaza at 8330 Highway No. 7, was read, approving same if 20 foot setback is maintained as required under Section 19.19 of the Zoning Ordinance, The Secretary read a letter from Robert L. Henretta, Attorney for Knollwood- Plaza, dated September 12, 1955, requesting the City to approve the pylon sign presently located 6 feet from the right-of-way, rather than the 20 foot setback required by the Zoning Ordinance, stating that this installation was due to an error made by the Architects during the rush and confusion of completing for the opening of the Shopping Center. On motion of Councilman Davis, seconded by Councilman Middleton, a special permit was granted to Knollwood-Plaza for variation of setback regulation required by Section 20.4-6 of the Zoning Ordinance, by unanimous vote of all Members of the Council present. Resolution No. 143 By unanimous consent of all Members of the Council present, the reading of Resolution No. 143 was waived. On motion of Councilman Middleton, seconded by Councilman Jorvig, Resolution No. 143, GRANTING PERMIT UNDER SECTION 10.3 OF THE ZONING ORDINANCE FOR ERECTION OF ADVERTISING SIGN AT KNOLLWOOD-PLAZA SHOPPING CENTER, was adopted by unanimous vote of all Members of the Council present. Resolution No. 143 in Book 1 of Resolutions. Planning Commission's Report on Request for Permit to Construct Gas Station - Husby Planning Commission's report dated September 7, 1955, on the request of 0. J. Husby & Sons for a permit to construct a gasoline service station on the north side of Excelsior Boulevard between Huntington Avenue and France Avenue, was read, approving same. Resolution No. 144 By unanimous consent of all Members of the Council present, the reading of Resolution No. 144 was waived. On motion of Councilman Bolmgren, seconded by Councilman Hurd, Resolution No. 144, GRANTING PERMIT UNDER SECTION 10.3 OF THE ZONING ORDINANCE FOR CONSTRUCTION AND USE OF GASOLINE SERVICE STATION ON THE NORTH SIDE OF EXCELSIOR BOULEVARD BE- TWEEN GLENHURST AVENUE AND FRANCE AVENUE, WEST OF AL'S LIQUOR STORE, to 0. J. Husby & Sons, was adopted by unanimous vote of all Members of the Council present. Planning Commission's Report on Availability of Firms, Fees, Etc. for City Planning .Planning Commission's report dated September 7, 1955, on 'their investigation of the qualifications, availability and fees of persons or firms experienced in City planning, was read, stating that various planning institutes and societies, American Land Institute, American Society of Planning Officials, P. A. S., Minneapolis and St. Paul Planning Commissions, and others could be contacted regarding same. Planning Commission's Report on Petition for Rezoning - E. L. Lambin & Mrs. Mabel Christy Planning Commission's report dated September 7, 1955, on the petition of E. J. Lambin and Mrs. Njabel Christy to rezone Lots 11 thru 15, Block 1, Rearrangement of St. Louis Park, from Residential Use to Commercial Use, was read, approving same. A hearing date was set on September 6, 1955 for September 26, 1955• Letter Requesting Permission for Minor to Work in Store Selling 3.2 Beer Letter from Vernon Nelson, Manager, Walgreen Drug Store, Knollwood-Plaza Shopping Center, dated September 8, 1955, requesting permission for Mary Bloomquist, age 18, to work for them as a cashier-check-out employee (3.2 beer sold in store), was read; also written permission from her mother, Mrs. 0tterness, was read. On motion of Councilman Davis, seconded by Councilman Hurd, permission was granted to Mary Bloomquist to work as a check-out-cashier employee for Walgreen's Drug Store in Knollwood-Plaza Shopping Center where 3.2 beer is sold, by unanimous vote of all Members of the Council present. Letter Ordered to Refrain from Using Lot for Driveway Purposes On motion of Councilman Bolmgren, seconded by Councilman Middleton, the City Attorney was instructed to write to the owner of Lot 3, Block 1, Suburban Homes Addition to regain from using same for driveway purposes, by unanimous vote of all Members of the Council present. September 12, 1955 3 75 Planning Commission's Report on Request for Special Use Permit - Planning Commission's report dated September 7, 1955, on the request of Shell Oil Company for a special use permit for Lot 3, Block 1, Suburban Homes Addi- tion, to use same for ingress and egress to the station on adjoining property, and for parking purposes, was read, denying same On motion of Councilman Hurd, seconded by Councilman Jorvig, the Council concurs with the Planning Commission's report, and the request of Shell Oil Company for a special use permit to use Lot 3, Block 1, Suburban Homes Addition for ingress and egress to the station on adjoining property, and for parking purposes, was denied, by unanimous vote of all Members of the Council present. Planning Commission's Report on Petition for Rezoning - Mabel W. Clarke Planning Commission's report dated September 7, 1955, on the petition of Mabel W. Clarke for rezoning the following described property from Open Development Use to Commercial Use, was read, stating their approval of rezoning of the easterly 125 feet of property described: "That part of the NW's of the SW4 of Section 5, Township 117, Range 21, commencing at the NW-corner of said NW4; thence running East on the north line of said NW4 - 198-feet to a ,point; thence at right angles south 165 feet to a point; thence' at right angles west 12 rods to a point in the west line of said Section 5, said point being 165 feet south of the NW corner of said NW4; thence north on the said Section line 165 feet to the point of beginning, containing approxi- mately 3/4 acres of land." On motion of Councilman Bolmgren, seconded by Councilman Middleton, October 3, 1955 was set as date of hearing for the rezoning of above described property from Open Development Use to Commercial Use, by unanimous vote of all Members of the Council present. Ordinance No. 502 First reading of Ordinance No. 502, entitled AN ORDINANCE PROVIDING FOR REVISION, REARRANGEMENT AND CODIFICATION OF THE ORDINANCES OF THE CITY OF ST. LOUIS PARK AND ADOPTING SECTIONS 1:101 THROUGH 1:110 AND 1:120 THEREOF, was made by Secretary Justad. On motion of Councilman Davis, seconded by Councilman Middleton, September 19, 1955 was set as date for second reading of Ordinance No. 502, by unanimous vote of all Members of the Council present. Additional Voting Machines On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the City Manager was instructed to advertise for bids. for ten additional voting machines, by unanimous vote of all Members of the Council.present. City. Manager Reports on Knollwood-Plaza Planting Screen The City Manager made an oral report on the Knollwood-Plaza planting screen. On motion of Councilman Middleton, seconded by Councilman Jorvig, the City Manager was instructed to enforce the Zoning- Ordinance for Knollwood-Plaza, Inc. property, and to enforce their agreement with the City dated April 28, 1954 with regard to the planting arrangement along West 36th Street, by unanimous vote of all Members of the Council present. Permit for House Trailer On motion of Councilman Bolmgren, seconded by Councilman Davis, the application of Milo D. Nagel for permit to park house trailer on lot at 4185 Zarthan Avenue for period of September 16, 1955 to October 1, 1955 while preparing house to move into, was approved by the following roll call vote: Councilman Bolmgren, yea; Councilman Middleton, yea; Councilman Jorvig, yea; Councilman Davis, yea; Mayor Fernstrom, yea; Councilman Hurd, nay. Dispatcher for Police Radio . On motion of Councilman Davis, seconded by Councilman Jorvig, the City Manager was instructed to hire one additional police.patrolman (top man) from the list of eligibles certified by the Police Civil Service Commission, by unanimous vote of. all Members of the Council present. Bus Route . On motion of Councilman Jorvig, seconded by Councilman Davis, the Twin City Rapid Transit Company were authorized to route bus leaving Minneapolis at 1:00 AM and 5:00 AM over Minnetonka Boulevard to Louisiana Avenue; thence south on Louisiana Avenue to Brownlow Avenue returning eastward over West Lake Street with no layover 376 September 12, 1955 Bus Route, Cont'd. at Brownlow Avenue, by unanimous vote of all members of the Council present. ` Animal Report On motion of Councilman Hurd, seconded by Councilman Jorvig, animal report of Animal Rescue League of Hennepin County for period of August 8 thru September 2, 1955 was read and ordered filed. Building Inspector's Weekly Report The Building Inspector's report for week ending September 9, 1955, was read. On motion of Councilman Hurd, seconded by Councilman Jorvig, the Building Inspector's report for week ending September 9, 1955, showing that 18 building permits were issued, totaling $125,630.00, was ordered filed. Health Officer's Report for August, 1955 On motion of Councilman Hurd, seconded by Councilman Jorvig, report of Health Officer, Dr. H. W. Darby, M. D., on health inspections made during August, 1955, was read and ordered filed.
