Fernstrom at 8:09 P. M. Invocation was given by Reverend M. Lyle Halvorsen of First English Lutheran Church of St. Louis Park. The following Council Members were present at roll call: Councilman H. J. Bolmgren Councilman C. L. Hurd Cduncilman Middleton Mayor R. C. Fernstrom Also present were City Manager, Tom Chenoweth, City Attorney, Edmund T. Montgomery, and City Clerk (Secretary) Joseph Justad. Hearing on Proposed Curb and Gutter and Sidewalk Improvements - #55-84 thru #55-97 Pursuant to notice published in the St. Louis Park Dispatch August 18 and 25, 1955, separate hearings were had on proposed public improvements Nos. 55-84 thru 55-97. The following persons appeared: M. W. Hill, 3545 Zinran Avenue asked that petition opposing Improvement No. 55-96 (Sidewalk on the NS of 36th Street from Texas Avenue to Aquila Avenue, be read. Said petition was read by Secretary Justad. Councilman Bolmgren spoke of this project and suggested that assessment be paid by others than owners of the abutting property. Mr. Johnston, 3544 Zinran Avenue suggested that for safety sake to put the sidewalk on the SS of West 36th Street. Resolution No. 129 On motion of Councilman Bolmgren, seconded by Councilman Middleton, Resolution No. 129, having been read by the Secretary, ORDERING BIDS FOR CURB AND GUTTER AND SIDEWALK. IMPROVEMENTS NOS. 55-84 thru 55-97, was adopted by unanimous vote of all Members of the Council present. (Resolution No. 129 in Book 1, of Resolutions). Councilman Perkins Councilman H. W. Perkins arrived at the meeting at this time - 8:50 P. M. Hearing on Proposed Reconstruction of Sanitary Sewer as Outlet to Sanitary Sewer District Number 2 Pursuant to notice published in the St. Louis Park Dispatch August 18 and 25, 1955, a hearing was had on the proposed reconstruction of sanitary sewer in West 38th Street in the City of Minneapolis between Drew Avenue South and Xerxes Avenue South to serve as an outlet for Sanitary Sewer District No. 2. No persons appreared. Resolution No. 130 On motion of Councilman Middleton; seconded by Councilman Hurd, Resolution No. 130, having been read by the Secretary, ORDERING RECONSTRUCTION OF SANITARY SEWER AS OUTLET TO SANITARY SEWER DISTRICT NO. 2, was adopted by unanimous vote of all Members of the Council present. (Resolution No. 130 in Book 1 of Resolutions). Hearing on Proposed Bituminous Street Surfacing and Stabilized Base - #55-57 thru 78 Pursuant to notice published in the St. Louis Park Dispatch August 11 and 18, 1955, a hearing was had on the proposed application of bituminous street surfacing and oil stabilized base, Improvements Nos. 55-57 thru 55-78• Fhe following persons appeared: Mr. Harding, 3425 Wyoming Avenue appeared in opposition to Improvement No: 55-73 and No. 55-74• Said street is not ready for the job and suggested that it be deferred for one year. Mr. Johnson, 9001 Stanlen Road appeared regarding Improvement No. 55-59. Said sewer is scheduled, but he is for it. Resolution No. 131 On motion of Councilman Hurd, seconded by Councilman Middleton, Resolution No. 131, the reading of which was waived by unanimous consent of the Council Members present, ORDERING BITUMINOUS STREET SURFACING AND OIL STABILIZED BASE (Improvements Nos. 55-57 thru 55-78), was adopted by unanimous vote of all Members of the Council present. (Resolution No. 131 in Book 1 of Resolutions). Assessment Hearings Pursuant to notice published in the St. Louis Park Dispatch August 11, and 18, 1955, Separate hearings were had on proposed assessments for Improvement No. 54-113 (Grading and Opening), Improvement No. 54-17 (Water & Service Connection), No. 54-24 (Sewer and-Water House Connections), ltprovements dos. 54-192 20, 21, 22, 23, 119, 120, 133; (Sanitary Sewer), Improvements Nos. 54-110, 111, 112, ('Sanitary Sewer, Water & Storm Sewer), Improvements Nos. 54-86, 88, 89, 89A,' 91, 92, 107,108, 109, 1519 1522 87)• August 29, 1955 357 Hearings (Assessment), Continued Mr. Greyburn, 8311 West 35th Street appeared regarding Improvement No. 54-113 (Grading and Opening of pylon Avenue from 35th Street to approximately 300 feet south). Said he feels that he should be given some consideration because of the land he gave for the street. Al Miller representing Bruce Construction Company asked for relief in the 12" area assessment as they have put in and paid for the 12" water main in Westdale Addition. Resolution No. 132 On motion of Councilman Bolmgren, seconded by Councilman Middleton, Resolution No. 132, the reading of which was waived by-unanimous consent of all council members present, for the levy of-assessments for Improvements Nos. 54-113, 54-17, 54-24, 54-19, 54-20, 54-212 54-222 54-232 54-119, 54-120, 54-133, 54-110, 54-111, 54-112, 54-86, 54-88, 54-892 54-89A, 54-912 54-92, 54-1072 54-1082 54-1092 54-151, 54-152, and 54-87, was adopted by unanimous vote of all Members of the Council present. Councilman Davis Councilman Davis arrived at the meeting at this time - 9:22 P. M.. C—" 133, •ADOPTING RULES GOVERNING CONDUCT OF MEMBERS OF THE ST. LOUIS PARK FIRE DEPART- MENT AND THE VOLUNTEER DIVISION THEREOF, having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present.(Book 1 of Resolutions.) _Special Permit to Connect to Water Main - Allan Garrison On motion of Councilman Middleton, seconded by Councilman Bolmgren, Allan Garrison is hereby granted a special permit to connect building now under cons- truction on the West 30 feet of Dakota Avenue, now vacated (6325 Cambridge,Street) to the water main in Cambridge Street for water service; said owner will be required to pay an assessment of $97.50 at the time he takes out the regular permit, by unanimous vote of all Members of the Council present. Certificate of Correction to Plat of Westdale Certificate of Correction to Plat of Westdale Addition, submitted by Registered Surveyor, Harold Hofstrand, and Deputy County Surveyor, Elmer J. Peterson, dated August 16, 1955, was read. On motion of Councilman Davis, seconded by Councilman Bolmgren, the above mentioned certificate of correction to plat of Westdale Addition was approved, and accepted, and the Clerk was authorized to sign same for the City, by unanimous vote of all Members of the Council present. Resolution No. 134 On motion of Councilman Perkins, seconded by Councilman Hurd, Resolution No. 134, APPROVING ASSIGNMENT OF SECURITIES IN LIEU OF BOND (Northwestern National Bank of Minneapolis), having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present. (Resolution No. 134 in Book 1 of Resolutions) Ordinance No. 500 First reading of Ordinance No. 500, entitled AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK was made by Secretary Justad. It was moved by Councilman Davis, seconded by Councilman Middleton, that the second reading of above ordinance be made on September 6, 1955, by unanimous vote of all Members of the Council present. , Plan and Profile - Mtka. Blvd. from Texas Avenue west to RR Bridge, Etc. - A meeting of August 15, 1955, action on grades as shown on City Engineer's plan and profile of Minnetonka Boulevard from Texas Avenue West to Railroad Bridge , and on Virginia Avenue from Minnetonka Boulevard to 2 block north, was deferred to this meeting to provide time for Councilman Davis to discuss this matter with the citizens in the area. On motion of Councilman Bolmgren, seconded by Councilman Hurd, the above matter was referred to the Committee of the Whole to provide for a meeting on the spot to review same with citizens in area, by unanimous vote of all Members of the Council present.. Report of Minn. RR & Warehouse Commission Re: Petition for Transfer of Bus Routes Report of Minnepota Railroad and Warehouse Commission, dated August 15, 1955, in the matter of the joint petition of the Twin City Motor Bus Company and the Deephaven Bus Company, Inc. for the transfer of certain bus routes and the abandon- ment of certain bus routes and so forth, was read. On motion of Councilman Davis, seconded by Councilman Bolmgren, the above mentioned report of the Minnesota Railroad and Warehouse Commission was ordered filed, by unani- mous vote of all Members of the Council present. Report of Minn. RR & Warehouse Commission Re: Change in Bus Routes Report of Minnesota Railroad and Warehouse Commission, dated- August 15, 1955, in the matter of the application of Minneapolis Street Railway Company for an amend- ment to its routes in the City of St. Louis Park, was read. On motion of Councilman Davis, seconded by Councilman Bolmgren, the above mentioned report of the Minnesota Railroad and Warehouse Commission was ordered filed, by unanimous vote of all Members of the Council present. City Limit Markers The matter of placing City Limit markers at the west end of the City on Excelsior Boulevard, and Highway No. 7, was discussed. On motion of Councilman Bolmgren, seconded by Councilman Middleton, the City 1�ngineer and City Manager were instructed to establish the legal city limits and mark same by signs on Excelsior Boulevard, and Highway No. 7, by unanimous vote of all Members of the Council present. August 29, 1955 359 Traffic Signals at Highway No. 7 and Monk Avenue A discussion was had in the matter of traffic signals at Highway No. 7 and Monk Avenue. On motion of Councilman Bolmgren, seconded by Councilman Davis, the City Manager was requested to make inquiry as to traffic signals at Highway No. 7 and Monk Avenue, by unanimous vote of all Members of the Council present. Purchase of Lot 9. Block 1. Del Monte Heights Authorized City Engineer's recommendation that the City purchase Lot 9, Block 1, Del Monte Heights Addition for spillway for discharging storm water from Zarthan Avenue was read. On motion of Councilman Davis, seconded by Councilman Perkins, the City Manager was instructed to negotiate for the purchase of Lot 9, Block 1, Del Monte Heights Addi- tion, by unanimous vote of all Members of the Council present. Report on Claim to Recover $100.00 from Western Underground Construction Co., Report of the City Attorney, dated August 5, 1955, on the claim of the City of St. Louis Park against Western Underground Construction Company to recover $100.00 in damages on account of that CompaiW not furnishing a sewer house con- nection for 3833 Kipling Avenue under their contract, was ready stating that the Company is no longer doing business, and is" insolvent, that the City accepted the work in 1948, and that any claim that the City might have had for failure to persorm the" contract has been outlawed, and therefore the City has no action I�against the surety on the Contractor's bond, was read. On motion of Councilman Hurd, seconded by Councilman Bolmgren, the above report was ordered filed. Proposal for Auditing City Financial Affairs and Operations The Secretary read proposals from the following Certified Public Accountants for auditing the City financial affairs and operations for the year 1955 ---- Flesher & Aanenson e - George M. Hansen Larson & Allen It was moved by Councilman Perkins, seconded by Councilman Middleton the recommendation of the Committee of the Whole 'for the appointment of George M. Hansen as City Auditor be approved, and the the City Attorney prepare a proposed contract with George M. Hansen for auditing service at a reasonable fee. Motion was passed by the unanimous vote of all Members of the.Council present. Partial Payment on Contract Work On motion of Councilman Hurd, seconded by Councilman Bolmgren, the following partial payment on contract work in progress, presented by City Engineer, Phil W. Smith was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue warrants covering same, 'by unanimous vote of all Members of the Council present: PARTIAL PAYMENT NO. 1 $7022.67 GRADING WEST 35th STREET FROM TEXAS TO WEST LINE OF AQUILA Contractor, Twin City Dirt Movers Contract Date, June 27, 1955 Contract price, $5,785.56• Removal of Triangular Island at Meadowbrook •Manor The City Engineer reported that he had talked with John Cassidy of Meadowbrook Manor about removing of triangular island ai Meadowbrook 'Manor, and he expects the County and City *to agree to re-set the signpost, shrubbery and stone enclosure for flowers, at •no expense to them. On motion of Councilman Hurd, seconded by Council- Perkins, mari/ The City Engineer was directed to contact Hennepin County to include this cost in the paving project as a minor extra so the City will not be obligated to pay .the full amount, by unanimous vote of ail Members of the Council present. Resolution No. 135 On motion of Councilman Bolmgren, seconded by Councilman Middleton, Resolution No. 135, SETTING HEARING ON PROPOSED SANITARY SEWER CONSTRUCTION FOR SANITARY SEWER TO BE DESIGNATED AS DISTRICT N0. 4, having been read by the Secretary, adopted by unanimous vote of all Members of the Council present. On motion of Councilman Davis, seconded by Councilman Middleton, the Building Inspector was instructed to remove Lots 13, 14, 152 16, 17, Block 1, and Lots 8 and 9, Block 2, Eides & Martins Second Addition from exempted list so that permits may be issued to owner for the building of homes on same, if requested, by vote of all Members of the Council except Councilman Bolmgren who voted no. Letter Re: Traffic Hazard to School Children - John J. Novotney Letter from John J. Novotney, 3537 Zinran Avenue, dated August 18, 1955, stating that now that 36th Street has been extended to the West and adjoined to Knollwood` Plaza Shopping Center, and traffic has already increased noticeable, he is wondering where his children are going to walk the six blocks they have to go to school, as there are no sidewalks, was read. No action taken other than ordering bf bids for the sidewalk in other action taken this meeting (Improve- ment No.- 55-96). Settle Cl&im - Shapiro vs Village of St. Louis Park On motion of Councilman Davis, seconded by Councilman Hurd, the City Attorney was authorized to settle the District Court Action of Shapiro vs Village of St. Louis Park for $250.00, by iinanimous vote of all Members of the Council present. City Engineer's Report on Landscaping Adjacent to Knollwood-Plaza, on 36th City Engineer, Phil W. Smith reported that he has checked the planting at Knollwood-Plaza and" find it does not conform with the official landscaping plat on file in the City Clerk's office. City Manager, Tom Chenoweth said he will make further study of this matter. Letter Re: Permit to Erect Dead Storage Shed - Acme Stone & Lumber Co. Letter from Acme Stone and Lumber Company, dated August 25, 1955, regarding a special. permit to a zoning exception to permit the location of a storage shed on their property at 3200 France Avenue (Required by Section 10.3-31 of the Zoning Ordinance) was read. On motion of Councilman Davis, seconded by Councilman Perkins, the above matter was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. Building Inspector's Weekly Reports On motion of Councilman Hurd, seconded by Councilman Middleton, the Building Inspector's reports for week ending August 19, 1955 showing that 28 permits were issued, totaling $179,550.00; and week ending August 26, 1955, showing that 30 permits were issued, totaling $225,250.00, were read and ordered filed, ,by unanimous vote of all Members of the Council present. August 29, 1955 362 Application for Approval of Transfer of Off-Sale Liquor License - Andy Johnson Application of Andy Johnson, 7835 Wayzata Boulevard, St. Louis Park, for approval of transfer of his off-sale liquor license to Ralph Green, et al, was to have been presented to the Council this evening by Attorney Matthew Levitt. The Clerk reported that he phoned him this afternoon at 5 o'clock and asked that this matter be deferred to the September 6th meeting. The matter was discussed by the Council generally, and Councilman Hurd told of his conversation as to who is buying this business from Mr. Johnson. No action taken at this time. Bids for Bituminous Surfacing and Oil Stabilized Base - 55-57- thru 55-78 Pursuant to advertisement for bids in the St. Louis. On motion of Councilman Middletbn, seconded by Councilman Davis, the bids of J. V. Gleason for Improvements Nos. 55-80 and 55-81, were determined to be the lowest bids of a responsible bidder, and the Mayor and City Manager were authorized to execute contract for the City with the Bidder in the amount bid of $10055.20 for Improvement No. 55-80, and $12,136.00 for Improvement No. 55-81, by unanimous vote of all Members of the Council present. On motion of Councilman Middleton, seconded by' Councilman Davis, the bids of Asconite Asphalt Company for Improvements Nos. 55-79, 55-82 and 55-83, were determined to be the lowest bids of a responsible bidder, and the Mayor and City Manager were authorized to execute contract for the City with Bidder in amount of bids of $18,712.60 for Improvement No. 55-79; $24,548.25 for Improvement No. 55-82; and $22,450.00 for Improvement No. 55-83, by unanimous vote of all Members of the Council present. The City Manager was asked to confer with the Fire Civil Service Commission regarding Rule #8 with the suggestion that the ninety calendar day limit for suspension be reduced to sixty days, and that a statement to the effect that employee will be paid for time in suspension if not proved guilty of the charges made, and bring rules back to the Council for approval. Report on Cost of Wells, pumps, piping, Steel Surge Tanks and Chemical Feeders Report of Water Superintendent, Ira Vraalstad on cost of City Wells, pumps, piping, steel surge tanks, and chemical feeders, was read. On motion of Councilman Bolmgren, seconded by Councilman Middleton, the City Manager was instructed to bring in a report incorporating the following information, by unanimous vote of all Members of the Council present: (1) Estimated cost of a building large enough to accommodate pumps and iron removal equipment -- to be built all at once. (2) Estimated cost of a building only large enough for pumps. (3) Estimated cost of an addition to small building (Item 2) to accommodate iron removal if used in the future. (4) An opinion as to why square foot and cubic foot costs of pump houses are so much higher than for residential and commercial buildings. Minutes The minutes of meeting held August 15, 1955 were read. On motion of Council- man Middleton, seconded by Councilman Hurd, the minutes of meeting held August 15, 1955 were approved, by unanimous vote of all Members of the Council present.
