Fernstrom at 8:04 P. M. Invocation was given by Reverend Milo Gerberding of Cross of Christ Luthern Church. ,The following Councilmen were present at roll call: Councilman H. J. Bolmgren Councilman H. C. Davis Councilman C. L. Hurd ' Councilman Torval Jorvig Councilman C. R. Middleton Councilman H. W. Perkins Mayor R. C. Fernstrom Also present were City Manager, Tom E. Chenoweth, City Attorney, E. T. Montgomery, and Deputy City Clerk R. B. Connery. Request for Special Permit to Build Screened Porch - Victor Peterson Letter from Victor S. Peterson, 3007 Alabama Avenue, dated July 19, 1955, requesting a special permit to build a 10 foot screened porch attached to the rear of his home, off the kitchen (copy of survey attached), was read. On motion of Councilman Middleton, seconded by Councilman Davis, the Council authorized a variation of the application of density district regulations as requested by Mr. Peterson (Sec. 20.4 of Zoning Ordinance), and the Building Ins- pector was authorized to issue building permit for above screened porch, by un- animous vote of all Members of the Council present. Licenses On motion of Councilman Middleton, seconded by Councilman Hurd, the following applications for 1955 licenses were approved, and the Mayor and Clerk were author- ized to issue same to expire December 31, 1955, by unanimous vote of all Members of the Council present. Resolution No. 116 On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the follow- ing resolution, having been read by the Deputy Clerk, was adopted by unanimous vote of all Members of the Council present: RESOLUTION SETTING ASSESSMENT HEARINGS BE IT RESOLVED by the City Council that the total expense incurred in making the•following improvements heretofore ordered is hereby determined to be in the respective amounts hereinafter set forth and the assessment rolls prepared by the City Clerk for each of said improvements are hereby approved as proposed assessments covering the assessable cost of each of said improvements. The Clerk is hereby directed to publish notice that the Council will meet to m nsider each of said pro- posed assessments on August 22, 1955, at 8 O'clock P. M. The area proposed to be assessed for each of said improvements shall be the same as set forth in the notice of hearing for the respective improvements. His house was built in 1946 and the sewer connection was made in 1955• Mr. Motzko claimed that he had to charge $125.00 more for the work due to fault of the City. On motion of Councilman Perkins, seconded by Councilman Perkins, the above matter was referred to the City Manager for checking and report, by unanimous vote of all Members of the Council present. Plat - Cobblecrest Addition On motion of Councilman Perkins, seconded by Councilman Middleton, the plat of Cobblecrest Addition, presented by Ridgeway Construction Company was referred to the City Manager for checking and recommendation, by unanimous vote of all Members of the Council present. Wage Discussions- The Members of the Council-agreed to meet at 7:30 P. Weed Spraying - Cutting On motion of Councilman Hurd, seconded by Councilman Bolmgren, those in charge of spraying weeds are hereby directed to spray only when weather conditions are ideal, and if not, to cut them, by unanimous vote of all Members of the Council present. Letter Re: Weed Spray Killing Flowers & Vegetables - Theodore Jaa_tran Letter from Theodore Jeatran, 4303 West 36th Street, dated July 19, 1955, stating that last month some of the City men sprayed an empty lot next to- theirs with weed killer - it was a windy day, and the spray blew over• on their garden and killed the flowers and tomato plants, was read. On motion of Councilman Davis, seconded by Councilman Middleton, the above matter was referred to the City Attorney for reply, by unanimous vote of all Members of the Council present. Letter Re: Damage to Station Wagon - Mrs. Elton Spier Letter from Mrs. Elton Spier, 1827 East Seventh Street, Saint Paul-4-'Vinn., dated July 20, 1955, stating that on July 19, 1955 their new 1955 station wagon was parked in the 4300 Block on West 25th Street, St. Louis Park, and a City oil truck came along and scratched and dented the rear left fender - driver of the oil truck was Warren Ushway (should be Bushway), 8224 Cedar Lake Road, was read. On motion of Councilman Middleton, seconded by Councilman Jorvig, the above matter was referred to the City Attorney for reply, by unanimous vote of all Members of the Council present. Amend License Ordinance- On motion of Councilman Davis, seconded by Councilman Hurd, the City Attorney was directed to prepare an amendment to license ordinance for the City Manager to issue licenses if requirements are met by the applicant, except for 3.2 beer on- sale and intoxicating liquor off-sale and on-sale; also that a list of applications r for licenses be mailed to @4eh Councilman weekly, and that no licenses be issued for a period of one week after mailing said list, the the following roll call vote: Councilman Bolmgren, yea; Councilman Davis, yea; Councilman Hurd, yea; Councilman Jorvig, nay; Councilman Middleton, yea; Councilman Perkins, yea; Mayor Fernstrom, July 25, 1955 327 Procedure for Claims for Damages Council Members concurred that the City Attorney be directed to prepare a plan of procedure for handling claims for damages. Report on Need for Stop Sign at 39th and Yosemite City Manager made a report on the need for a stop sign at Corner of 39th Street and Yosemite Avenue, as requested by the City Council on July 11th. On motion of Councilman Davis, seconded by Councilman Middleton, the Police Department was ordered to place a STOP SIGN at corner of 39th Street and Yosemite Avenue, by unanimous vote of all Members of the Council present. City Engineer's Report on Oregon Avenue Storm Sewer City Engineer reported that he and Don Spielman of the County Engineer's Office had made a thorough investigation on the site of Oregon Avenue Storm Sewer, from Minnetonka Boulevard to 32nd Street, and stated that they agreed that the most logical solution to the drainage problem there, is to drain all the water into the low area on the West side of Oregon Avdnue between 31st and 32nd Streets -- lots owned by the City. Also agreed that it would be best for residents in the vicinity and all parties concerned to grade and level off the lots, and catch basins constructed at Minnetonka Boulevard and 31st Street. i Mr. Hoffman and two others appeared, and subject discussed at length. On motion of Councilman Middleton,- seconded by Councilman Hurd, the City Engineer was instructed to proceed-with construction of above storm sewer as per plans, by unanimous vote of all Members of the Council present. Report on Sanitary Sewer at 3650 France City Engineer made a report on his investigation of the claim of Tom Motzko of Motzko Plumbing Company that he had to lower the service connection under the' sidewalk at 3650 France Avenue, necessitating a considerably higher charge for the work, etc., and stating that he does not•feel that there is any liability on the part of the City insofar as the re-laying of the four (4') feet of 6" sewer pipe is concerned. (actual amount $19.00). - City Attorney said as far as the City is concerned, there is no liability and that the claim should be denied. On motion of Councilman Hurd, seconded by Councilman Perkins, the above claim for damages was denied with the understanding that if proof is furnished that of a two-foot fall from the house to the'house connection, the subject can be re- opened at that time, by unanimous vote of all Members of the Council present. Letter Re: Extension of West 36th Street, North of Highway No. 7 Letter from Peterson and Lefler, Attorneys for R. N. Ruedlinger with regard t6 the condemnation of portions of-his property for the extension of West 36th Street north of Highway No. 7, was read.' On motion of Councilman Davis, seconded by Councilman Jorvig, the above matter was referred to the City Attorney for recommendation, and to the City Engineer to determine the size of pipe to be used; and the amount of dirt for fill necessary to fill the Ruedlinger property to grade of proposed street, by unanimous vote of _ all Members of the Council present. Letter Re: Refund of Deposit Guaranteeing Assessments for Grading Letter from Ecklund & Swedlund Construction Company, dated July 202 19552 requesting the refunding of the $2,700.00 deposited with the Village of St. Louis Park; July 29, 1953, under the terms of their contract, guaranteeing payment of assessments for grading of Cedar Lake Road from Virginia Avenue to Flag Avenue, J and their agreement written therein, was-read. r1t'J�Y( It was moved Councilman Perkins• seconded by , by Councilman Hurd that agree- l ,• ment of Ecklund & Swedlund Construction Company outlined in their letter dated Ji11y 20, 1955-be approved, and that upon-receipt of a signed verified claim, the $2,700.00 deposited with the Village of St. Louis Park, July 29, 1953, guaranteeing payment of assessments for grading of Cedar Lake Road from Virginia Avenue to Flag Avenue be paid to them, by unanimous vote of all Members of the Council present. Proposed Plan for Assessing for Sidewalk-Repairs The City Assessor's proposed plan for assessing property for sidewalk repairs n6w under contract was read --- up to $25.00 could be assessed over a one-year period, and"the assessments over $25.00 over a period of five years. On motion'of Councilman Perkins, seconded by Councilman Middleton, the pro- p6sed plan for Assessing sidewalk repairs now under contract as outlined above was approved, and the City Assessor was authorized to proceed accordingly, by unanimous v6te of all Members of the Council present. 328 July 25, 1955 Traffic Violation Bureau i Proposed by City Manager City Manager outlined a proposed traffic violation bureau for satisfying non-moving traffic violations by means of violators paying their fines to the City Treasurer instead of to the Justice of Peace, Etc. On motion of Councilman -Bolmgren, seconded by Councilman Middleton,-the City Attorney, with the two Justices of Peace were directed to set up the proper procedures as described in the Minnesota Statutes of 1953 to take care of non- moving traffic violations, by unanimous vote of all Members of the Council present. Straightening of Texas Avenue, North of Cedar Lake Road, and establishing street lines. City Band - Establishing, Cost, Cost of Maintenance. Where money to come from, etc. Make survey of sewer rates (service charge). Proposed vault to be built outside west wall of City Hall. Sidewalk Replacement on Alabama and Goodrich Avenues City Engineer reported on replacement of sidewalk on Alabama and Goodrich Avenues. Standard width is 5 feet, and present walks are 4 feet. The City Engineer was instructed to replace walk on Alabama Avenue with standard width, and make a survey of walk on Goodrich Avenue and report back on same next week. Private Dump (Adolph Fine) The City Manager reported on the condition of Adolph Fine's private dump located North of Hopkins Great Northern Line, West of Virginia Avenue. Said he inspected same and found that Adolph Fine was dumping refuse from new building construction, and not from his apartment buildings. Reviewed some of the exist- ing ordinances, and read a letter from Mr. Fine. Said he would like to review this matter with Mr. Fine and said he would report back to the Council later. Street Work The City Manager made a report on proposed seal coating and resurfacing of Streets. City Engineer's maps for same were shown. Resurfacing using A. C. was estimated at $3.25 per lineal; stabilized base at $2.50 per lineal ft. Seal coating to be paid for out of the General Raid. On motion of Councilman Perkins, seconded by Councilman Davis, all streets south of Excelsior Boulevard from France Avenue to the Belt Line, and streets from 36th Street to Excelsior Boulevard, west of the Belt Line (Center) in need of seal coating be done by the City Street Department in 1955; also The City Engineer was directed to prepare plans and specifications showing location of all streets to be re-surfaced where utilities have been installed; all streets where all utilities are in to be treated with A. C. application, and all streets where more utilities are to come to be treated with stabilized base, by unanimous vote of all Members of the Council present. Letter Re: Re-grading Mtka. Blvd. from Utah to Wyoming and Vacating Part of Virginia Avenue North of Mtka. Blvd. A. Fine Letter from Adolph Fine, dated July 21, 1955, regarding the re-grading of Minnetonka Boulevard from Utah Avenue to Wyoming Avenue in order to eliminate the traffic hazards in that area; also the matter of vacating Virginia Avenue north of Minnetonka Boulevard, was read and discussed. Councilman Perkins was asked to check regarding the lowering of water mains, if it becomes necessary, and see if the County will pay for replacement of blacktop on parking lot of Shopping Center, and access walk on proposed vacated Virginia Avenue, and make reports on same at August 1st meeting. Proposed Vending Machine Ordinance The City Attorney presented a proposed vending machine ordinance, which was read, section by section, and discussed at length. George Nelson, 3720 Pennsylvania Avenue appeared. Asked about zoning with regard to vending machines - must it be commercial, or may it be residential. Mayor Fernstrom said all State Laws and City Ordinances must be complied with. The matter of sanitation, return of money or coins, etc. were discussed. Jim Farrell, 6819 Eliot View Road asked about the time and dates of inspection of machines. Iner Johnson, 1605 Louisiana Avenue asked about vending machines using coins up to 10¢, like gum and peanuts, 1¢, and what will be done about spoilage. Mr. Strauss asked for a copy of proposed ordinance in the present form. Councilman Jorvig said he could see nothing wrong in giving them out. It was suggest- ed that each sheet be marked WORKING DRAFT ONLY. In answer to a question it was brought out, that the proposed ordinance would apply to vending machines now in operation and in the future. eye�� July 25, 1955 Proposed Vending Machine Ordinance, Continued The matter of Service ,Clubs came up. Will they be exempt from paying for licenses. The matter of revoking licenses was discussed. The City Attorney was directed to prepare a revised vending machine ordinance for meeting of August 1,, 1955. Building Inspector's Weekly Report The Building Inspector's report for week ending July 22, 1955, showing that 12 building permits wore issued, totaling $79,900, was read and ordered filed. Minutes The minutes of meeting held July 18, 1955 were read. On motion of Councilman Middleton; seconded by Councilman Jorvig, the minutes of meeting held July 18, 1955 were approved, by unanimous vote of all Members of the Council present. _Advertisement for Bids for Street Resurfacing On motion of Councilman Perkins, seconded by Councilman Davis, The City Clerk was authorized to advertise for bids for resurfacing of streets as per plans and specifications as prepared by City Engineer, bid to be opened at the earliestpossible date. The payment of the cost of resurfacing is to be as follows: The monies now on deposit for r esurfacing,with City Treasurer, to be applied to the cost, and the balance from general fund, by unanimous vote of all Council Members present. Policy — Surfacing of Streets because of Installation of Utilities On motion of Councilman Perkins, seconded by Councilman Davis, the present policy of including resurfacing of streets in the proposal for bids is now eliminated, and all surfacing work is to be done on bid, and not by City Street Department. The Notice of Hearing, on all Sanitary Sewer, Storm Sewer and Water Main Con— struction, shall include not only the kind of utility to be installed, but also the kind of surfacing, as recommended by the City Engineer. _ For assessment the Cost of Construction of the Utility and cost of surfacing shall be treated as one cost and assessed together, by unanimous vote of all Council Members present. Meeting Adjourned On motion of Councilman Middleton, seconded by Councilman Bolmgren, the meeting was adjourned at 1:30 a.m., by unanimous vote of all Members of the Council present. R. C.
