REGULAR MEETING JUNE 20, 1955
A regular meeting of the City Council was called to order by Mayor R. C.
Fernstrom at gall P. M.
Reverend M. C. Robinson of Grace Presbyterian Church gave invocation.
The following Council Members were present at roll call:

Bids for Grading & Graveling, Improvement #54-164
As advertised in the St. Louis Park Dispatch June 9, 1955, sealed bids were
received from the following bidders for Grading and Graveling, Improvement #t54-164,

On motion of Councilman Bolmgren, seconded by Councilman Middleton, the
above bids were referred to the City Manger, City Engineer, and Chairman of the
Street Department Committee for tabulation and recommendation, by unanimous vote
of all Members of the Council present. '
Bids for Water Main Extension, Improvement '#55-19
As advertised in the Jt. Louis Park Dispatch June 9, 1955, sealed bids were
received from the following bidders for coristruction of viater main extension in
lfth Street from Flag Avenue to Fairway Lane, and in Fairway Lane from 18th Street
north to end of Fairway Lane, known as Improvement #55-19•

2. Phelps-Drake Company, Inc. 4069.50
On motion of Councilman Middleton, seconded by Councilman Jorvig, the above
bids were referred to the City Manager, City Engineer, and Chairman of the Water
Department Committee for tabulation and recommendation, by unanimous vote of all
Members of the Council present.
Hearing on Proposed Storm Sewer Construction - Improvement '#55-4.3
Pursuant to notice published in the St. Louis Park Dispatch June,9 and 16,
1955, a public hearing was had on proposed'storm sewer, Improvement No. 55-43,
extending from the intersection of Texas Avenue and -West 37th Street SWly along
the North Service Drive of State Highway N6. 7 approximately 11000 feet to existing
storm sewer, and from outlet of said existing storm sewer westerly along said
service drive to Minnehaha Creek, at an estimated cost of $28,950.00. A petition
signed by Oliver H. Meyers, 3632 Rhode Island Avenue and others, dated June 17,
1955, opposing the construction of said storm sewer, was read. Mayor Fernstrom
explained the object of this project and spoke of the assessment area. He added
that a contract is to be made with the State Highway as to -their share in the
project, and promised that if there is to be any assessment to these folks in Area
30, all folks will be notified.
T. T. Renner appeared. Asked regarding the area and was told that this
will be defined later. He feels that this is primarily a State Highway problem.
Mr. Renner said that the area is too small and Mayor Fernstrom concurred. Mr.
Renner said that water from his home did not enter the original sewer (District
30), but that when this present project is finished, his property will. _Oscar
Erlandson asked how this assessment would be spread. Mayor Fernstrom explained
it again for him.
Mr. Lohman of Knollwood-Plaza asked how this matter would be approached and
asked for a chance to express his views on this project at some later date. Mr.
Johnson of Zinran and 36th area said that they are high and should not be included
in this storm sewer area. Mayor Fernstrom explained how the storm sewer benefited
the area and plan now in effect. They adjourned to the Engineer's Office to look
at profiles, etc.

Hearing on Proposed Storm Sewer, Improvement #55-43, Cont'd.
On motion of Councilman Bolmgren, seconded by Councilman Perkins, hearing
was adjourned to meeting of June 27, 1955, by unanimous vote of all Members of
the Council present.
On motion of Councilman Perkins, seconded by Councilman Davis, the Clerk
was directed to republish the notice of hearing for July 11, 1955 with assessment
area to include Storm Sewer District No. 30, by unanimous vote of all Members of
the Council present.
Assessment Hearings
Separate hearings were had on each of the proposed assessments described
in the following resolution. No persons appeared.
Resolution No. 87
On motion of Councilman Bolmgren, seconded by Councilman Perkins, the reading
of the following resolution was waived by unanimous vote of all Members of the
Council present.
On motion of Councilman Bolmgren, seconded by Councilman Middleton, the
following resolution was adopted by unanimous vote of all Members of the Council
present:
ASSESSKENT RESOLUTION
WHEEREAS, the City Council has met at the time and place specified in the
notice of assessment published in the St. Louis Park Dispatch May 19, 1955, stating
the general nature of the following improvements and the area proposed to be
assessed, and has heard and passed upon all objections to the proposed assessments,
therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that the
proposed assessments on file in the office of the City Clerk, covering the cost of
the following described improvements, be hereby adopted as special assessments
against the lands named in said assessment rolls and there be hereby levied against
each of the respective tracts and parcels of land described therein the respective
assessment in the respective amounts therein set forth, and said respective tracts
and parcels of land are hereby found to be benefited in a sum equal to the said
respective assessments hereby levied. Said assessments shall be payable in equal
annual installments extending over such pe iod of year as hereinafter respectively
specified, the first of which shall be payable on the first Monday in January,
1956 with interest at 5% per annum. To the first installment shall be added
interest on the entire assessment from the date of this resolution until December
313 1956, and to each subsequent installment shall be added interest for one year.

Re: Applications for Volunteer Firemen
Frank Janes and Andy Bjornson appeared regarding applications for Volunteer
Firemen. Mr. Janes requested that the age limit be increased to 40 years at this
time in order to attract more applicants.
On motion of Councilman Davis, seconded by Councilman Jorvig, the request
of Frank Janes of Fire Civil Service Commission to raise the age limit to 40 years
for Applicants desiring to take examination for Volunteer Fireman for this time
only, and the Clerk was instructed to advertise for examination to be held at
7:30 P. M., Tuesday, July 19, 1955; and further that the examination set for June
28, 1955 be canceled, by unanimous vote of all Members of the Council present.
Licenses
On motion of Councilman Middleton, seconded by Councilman Hurd, the following
applications for 1955 licenses were approved, and the City Manager and City Clerk
were authorized to issue same to expire December 31, 1955, by unanimous vote of all
Members of the Council present:

Application for License to Erect Signs and Billboards - Western Outdoor_
On motion of Councilman Davis, seconded by Councilman Hurd, the application
of Western Outdoor Advertising Company for a license to erect signs and billboards
was denied, by unanimous vote of all Members of the council present. NOTE:
The basis for above motion is that although Western Outdoor Advertising performed
under 1954 license and there being at least one sign erected without taking out
a permit, and this particular sign was the one that had some definite setback
problems.

On motion of Councilman Jorvig, seconded by Councilman Middleton, the appli-
cation of Meyers Outdoor Advertising, Inc., dated June 12, 1955, for a permit to
erect a billboard at 5300 Wayzata Boulevard was referred to the Planning Commission
for checking and recommendation, by unanimous vote of all Members of the Council
present.

Animal Report, Animal Rescue League of Hennepin County
On motion of Councilman Davis, seconded by Councilman Middleton, the animal
report of Animal Rescue League of Hennepin County for period of June 6, 1955 to
June 13, 1955, was read and ordered filed.

Application for Permit to Erect Sign -_ Naegele
The application of Naegele Advertising Company, dated June 7, 1955, for
a permit to erect an advertising sign at 6102 Excelsior Boulevard which was read
and discussed at the June 13th meeting, and tabled until ,this meeting, was
presented at this time.
On motion of Councilman Davis, seconded by Councilman Jorvig, action on
above application was deferred until further application is made, by unanimous
vote of all Members of the Council present.
Application for Permit to Erect Sign - Naegele
On motion of Councilman Perkins, seconded by Councilman Bolmgren, the appli-
cation of N4egele Advertising Company, dated June 14, 1955, for a permit to erect
an advertising sign on roof of building at 6005 Minnetonka Boulevard was approved,
and the Building Inspector was authorized to issue same, by unanimous vote of all
Members of the Council present.
_Application for Permit to Erect Billboard - Brede
On motion of Councilman Jorvig, seconded by Councilman Middleton, the appli-
cation of Brede, Incorporated, dated June 16, 1955, for a permit to erect a -
billboard on the 2.65 acres of land at 3500 Highway No. 100, owned by Fred Hedberg,
for Powers Mercantile Company, Knollwood-Plaza Shopping Center, was referred to the
Planning Commission for checking and recommendation, by unanimous vote of all
Members of the Council present.
Application for Permit to- Erect Sign - Geheral Outdoor
.Application of General,0utdoor Advertising Company, Inc., dated June 16,
1955, for permits to erect five advertising signs on the roof of Texa-Tonka Shopping
Center, 6000 Minnetonka $oulevard, was read.
On motion of Councilman Perkins, seconded by Councilman Davis, action on
above ,application for permits to erect five advertising signs was deferred to meeting
of June 27, 1955, by unanimous vote of all Members of the Council present.
City Engineer's Report Re: Road Outlet for Acme Stone & Lumber Go.
City Engineer's report that he had contacted the Milwaukee Road regarding
some of their right-of-way property south of the tracks for street purposes which
could be used to provide an outlet for the trucks of Acme Stone & Lumber Company
other than France Avenue, was read.
Mayor Fernstrom reported a conversation he had with Charles Fellows of
Acme Stone & Lumber Company in which Mr. Fellows stated that their trucks were
taking other routes than France Avenue whenever possible.
Application for Permit to Operate Food Vending Machine at Meadowbrook Manor_
Jim Farrel, 6619 Eliot View Road appeared. He asked if it would be possible
for this Council to take the same action as the City of Minneapolis and Village of
Richfield Councils have taken with regard to food vending machines. He said that
he understands that further study is being given there.
Mayor Fernstrom said that an ordinance for vending machines as a whole, due
to the steady increase of such machines, should be considered. City Attorney,
Edmund T. Montgomery said that this machine could be used without a permit, except
for milk which would come under our milk ordinance. Mr. Farrel asked if the
present location contemplated would have to be zoned commercial. He was told no.
He then asked who would inspect this machine. Mayor Fernstrom said our Health
Officer.
George Nelson, 3720 Pennsylvania Avenue, a milkman, said a machine at
Meadowbrook Manor may be OK, but if spread all over town it would cut into the
business of the small grocery stores, etc. . Mayor Fernstrom explained that the
machines will have to be serviced at least twice a day by the owner in order to
keep the machine in service, and doesn't feel that the owner could afford to
install it except in a location such as Meadowbrook Manor. Mr. Nelson said if
the Council approves license, he trusts that ordinance will be set up with fees
to cover each machine. Mayor Fernstrom said he feels that is the Council's plan.
On motion of Councilman Middleton, seconded by Councilman Jorvig, the above
matter was referred back to the Committee of the Whole, by unanimhus .vote of all
Members of the Council present.
Building Inspector's Weekly Report
The Building Inspector's report for week ending June 17, 1955, showing that
31 building permits were issued, totaling X61752945.00, was read and ordered filed.

Resolution No. 88
On motion of Councilman Middleton, seconded by Councilman Bolmgren, the
following resolution, having been read by the Secretary, was adopted by unanimous
vote of all Members of the Council present:

WHEREAS it appears that on May 23, 1955, a resolution was adopted by the City
Council refunding the 1953 and 1954 payments and canceling the 1955 thru 1957 instal-
pents of the above assessment on Lot 46, Auditor's Subdivision #318; and
WHEREAS, before said resolution was adopted, the 1955 amount was inadvertantly
paid to the County Treasurer and therefore cannot be canceled now; therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that the
amounts in the former resolution be amended to read as follows:

Special Permit to Construct Sidewalk - Douglas E. Frank
On motion of Councilman Davis, seconded by Councilman Middleton, a special
permit was issued to Douglas E. Frank to construct sidewalk adjacent to his home
at 3363 Zarthan avenue, and the Building Inspector was authorized to issue same, by
unanimous vote of all Members of the Council present.
Special Permit to IBM Building
On motion of Councilman Middleton, seconded by Councilman Bolmgren, the
Building Inspector was instructed to issue a special building permit for the cons-
truction of building for IBM Company on Lot 1, Creek Terrace Addition as per plans
dated April 1, 1955, subject to all building code requirements, by unanimous vote
of all Members of the Council present.
Ordinance No. 490
First reading of Ordinance No. 490, entitled AN ORDINANCE REGULATING THE
DEDICATION OF STREETS AND ALLEYS NOT INCLUDED IN SUBDIVISION PLATS was made by
Secretary Justad.
It was moved by Councilman Davis, seconded by Councilman Middleton, that the
second reading of above ordinance be made on June 27, 1955, by unanimous vote of all
Members of the Council present.
Ordinance for Establishing Department of Public Works
On motion of Councilman Hurd, seconded by Councilman Davis, the City Attorney
was instructed to prepare an ordinance setting up a Department of Public Works which

which shall embrace the following:
Streets - paving, surfacing, curb and gutter, and sidewalk.
Street Lighting & Street Signs
Sanitary Sewer and Storm Sewer
Water - Mains and supply system

Building Department - including permits and inspections
Motion was passed by unanimous vote of all Members of the Council present.
Re: Execution of Agreement for Division of Cost for Grading, Etc.
The matter of authorizing execution of agreement for division of cost for
grading, concrete surfacing and other related improvements of State Aid Road No. 3,
(known as Excelsior Boulevard) west of Webster Avenue was duscussed. City Attorney,
E. T. Montgomery was asked to amend agreement and have same ready as soon as
possible - June 27th, if possible.
Ordinance No. 491
The matter of rezoning the Charles M. Freidheim and Ernest Jacobsen and
Clifford Andreasen property from Open Development Use to Light Industfial Use, upon
which a hearing was had on June 13, 1955, was discussed further.
On motion of Councilman Davis, seconded by Councilman Bolmgren, the first
reading of Ordinance No. 491, entitled AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF ST. LOUIS PARK was made by Secretary Justad, and June 27th2 1955
was set as date of second reading of same, by unanimous vote of all Members of the
Council present.
Resolution No. 89
On motion of Councilman Hurd, seconded by Councilman Middleton, the following
resolution, having been read by the Secretary, was adopted by unanimous vote of all
Members of the Council present:
RESOLUTION GRANTING SPECIAL PERMIT UNDER
ZONING ORDINANCE FOR USE OF PREMISES
WHEREAS, application has been filed with the City Council by St. Louis Park
Theatre Company for permit to utilize Lots 16, 17, and 18, Oak Manor, for auto-
mobile parking purposes in connection with the St. Louis Park Theatre Building,
and
WHEREAS, it appears desirable in order that there may be adequate parking
facilities in connection with the use of said building in accordance with the re-
quirements of Section 14.5 of the Zoning Ordinance of the City, and the Council
has determined that use of said lots for such purpose would be in harmony with the
fundamental purpose and intent of the provisions of such ordinance and practical
difficulties would be encountered if said lots were not available for parking
purposes without rezoning to a more restricted use district, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that a
special permit be hereby granted to St. Louis Park Theatre Company to use Lots 16,
17 and 18, Oak Manor, for parking of motor vehicles in connection with its store
and office building across Minnetonka Boulevard therefrom, said petn it to be
granted on condition that said lots will be suitably surfaced to prevent dusty
and muddy conditions and will be maintained in a neat and presentable condition
at all times, and subject to the further right of the Council which is hereby
reserved to terminate this permit, on 60 days' notice in writing, for such use
of the premises unless the same shall be rezoned to a use district which will
otherwise permit the same.
City Engineer's Report on Dusty Condition of Highway No. 100
City Engineer's report an addition to his report dated June 13, 1955) on
dusty condition at edges of pavement on Highway No. 100 between Excelsior Boulevard
and South City Limits, was read.
On motion of Councilman Bolmgren, seconded by Councilman Middleton, the
Acting City Manager, and City Engineer were instructed to contact the Commissioner
of of State Highways with regard to this problem, by unanimous vote of all Members
of the Council present.

Resolution No. 90
On motion of Councilman Perkins, seconded by Councilman Jorvig, the follovring
resolution, having been read by the Secretary, was adopted by unanimous vote of all
Members of the Council present:
RESOLUTION GRANTING PERMIT FOR SAND AND
GRAVEL EXCAVATION
WHEREAS, application has been received from Ruth C. Cornish, as owner of
the•land hereinafter described, for a permit under Ordinance No. 81 for excavating
of sand and gravel from said premises, and the Council has duly determined that it
is proper to grant such a permit upon the conditions hereinafter stipulated,
therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that a permit
be hereby granted Ruth C. Cornish under the provisions of Ordinance No. 81 of the
City of St. Louis Park to excavate sand and gravel from the premises, situated within
the corporate limits of said city, described as follows, to—wit:
That part of SEP of NE4, lying South of Superior Boulevard
and east of a line running from a point in center line of
Su�erior Boulevard distant 328.7 feet east of west line of
SEt of NE4 to a point in South line of SE4 of NF-, distant
330 feet east of SW4 thereof, excepting roads. Plat 38101,
Parcel 3600, Township 117, Range 22, Dist. 34, in area- 12.92
acres.
Subject, however, to the following terms and conditions which are hereby imposed
as a prerequisite to the granting of this permit and to the continuance of the
right to remove sand and gravel from said premises:
(a) The bank created by the excavation along the southerly boundary of said
premises shall be sloped at all times during the progress of- the excavation so as
not to be dangerous from caging or sliding banks, and upon completion of excavation
the soil along the southerly boundary of said premises shall be so sloped and
shaped as to conform to plans for final slope of Ruth 'Cornish property prepared
by Philip W. Smith, City Engineer, under date of April 18, 1955, which have been
filed with the City Clerk, said plans consisting of two sheets, Sheet A being
entitled "Plat of Cornish Property," and Sheet B being entitled "Typical Cross
Section."
(b) In the event that the said owner of said premises shall fail to comply,
with the conditions of this permit the City may at any time upon thirty days'
notice in writing to said owner, by registered mail, or posted notice upon the
premises if the address of the owner is unknown, terminate this permit and may there—
after enter upon the premises and grade and slope the land in conformity with the
provisions of this permit, and the said owner shall be obligated to reimburse the
City for the costs expended in connection therewith, and in default of such payment
the City shall be entitled to recover such sum upon the surety bond furnished as
provided in the following paragraph hereof, and if the sum so due the City is not
otherwise paid the City shall be entitled to assess the amount thereof against the
premises above described as a special assessment.
(c) The owner of said premises shall enter into an agreement with the said
City accepting the conditions of this permit and shall file with the City Clerk a
surety bond, in form approved by the City Attorney, in the penal sum of $2,000.00,
which shall be conditioned upon compliance by the owner of the premises with the
conditions of this permit.
(d) This permit shall not be assignable.
_Report on Petition for Sanitary Sewer
City Engineer's report and recommendation for sanitary sewer in Yosemite
Avenue from Brookside Avenue south across Minnehaha Creek to the M. N. & Southern
Railroad, and also in Wood Lane from Yosemite Avenue to 450' East, was read.
Hearing Date Set for Proposed Sanitary Sewer
On motion of Councilman Bolmgren, seconded by Councilman Middleton, July 11,
1955 was set as date for hearing on proposed sanitary sewer in Yosemite Avenue
from Brookside Avenue south across Minnehaha Creek to the M. N. & Southern Railroad,
4nd• also in Wood Lane from Yosemite Avenue to 450' East, the estimated cost being
$27,449.75, was passed by unanimous vote of all Members of the Council present.

Letter from Edward H. Boyle, Financial Secretary, St. Louis Park Council,
No. 3949, Knights of Columbus, dated June 13, 1955, requesting permission to play
Bingo at their picnic at Oak Hill Park on July 17, 1955, was read. No objections
raised. No action taken.

City Engineer's Report on Requests of Bud Moldestad for Extension of
Zarthan, Building Permit, and Special Permit to Connect to Water Main
City Engineer's report on requests of Bud Modlestad for extension of Zarthan
Avenue, Building Permit, and Special Permit to connect to water main, was read.
On motion of Councilman Davis, seconded by Councilman Jorvig, the Building
Inspector was directed to issue a building permit for the construction of a one—
family home on property in 2800 Block on Zarthan Avenue, described as the South
52 feet of the North 233 feet of Lot 61, Auditor's Subdivision #350, subject.to
Mr. Mddestad's making proper arrangements with the City Attorney for the extension
of Zarthan Avenue, by unanimous vote of all Members of the Council present.
NOTE: The water main extension was discussed and it was suggested that Bud
Moldestad have the 6" main extended to serve the property he is interested in
and pay cash for same.
Bid Award for Four—Door Sedan for Fire Department
On motion of Councilman Middleton, seconded by Councilman Bolmgren, the
bid of Larson Brothers, received June 8, 1955, for the furnishing of One (1) 1955
four—door sedan for the Fire Department, complete with all standard equipment,
less applicable Federal, State and,Municipal taxes, ,as per City Engineer's report,
was deemed to be the lowest bid of a responsible bidder, and the City Manager was
authorized• to issue purchase order for same, by unanimous vote of all Members of
the Council present.
Resolution. No. 91
On motion of Councilman Davis, seconded by Councilman Hurd, the following
resolution, having been read by the Secretary, was adopted by unanimous vote of all
Members of the Council present:
R E S O L U T I O N
WHEREAS, there are now pending before the Federal Communications Commission
in Washington, D. C. two applications, each seeking a radio broadcasting license,
and
WHEREAS, said applications indicate that the signal to be broadcast by
such a station would be one which would most beneficially serve and reach several
suburban municipalities, of which our City of St. Louis Park is one, and
WHEREAS, the facilities of such a station would provide an excellent medium
for informing and advising the residents of our community of all matters of public
interest, including our local governmental affairs and civic activities, and also
assist us in matters of civil defense, now therefore, ,
BE IT RESOLVED by the City of_St. Louis Park through its council, lawfully
assembled, and let it be recorded that said City of St. Louis Park favors such a
radio station, and particularly a station meeting the following qualifications,
among others:
1. The facilities of such a station should be available to representatives
of our government as an accomodation to the residents of our city for
public service broadcasts.
2. The facilities of such a station should also be available to noteworthy
and responsible civic groups with a view toward keeping our residents
informed of civic affairs.
Report on Plans for Sewer Extensions — Minnesota Department of Health
On motion of Councilman Hurd, seconded by Councilman Davis, the report-of
Minnesota Department of Health, Section of Water, Pollution Control, dated May 16,
1955, on examination of plans for sewer extensions in the City of St. Louis Park,
was read and ordered filed.
Report on Drainage over Freidheim Property
. City Attorney.- Edmund T. Montgomery reported on the problem of ditch serving
Highway No.. 100, east to Bass Lake, stating that Mr. Freidheim wants to change
the location of same and put in tile in 35th Street, etc.
On motion of Councilman Bolmgren, seconded by Councilinan Jorvig, the above
matter was referred to the City Engineer to keep in touch with same and keep
the Council advised, by unanimous vote of all Members of the Council present.

Problem of Paving Cedar Lake Road from Louisiana to Flag
Councilman Davis presented the problem of paving Cedar Lake Road from Louisiana
Avenue to Flag Avenue for discussion. It was suggested that Street Commissioner,
Kenneth Johnson meet with L. P. Pederson and Mr. Kirkland of the County Highway
Department for checking and recommendation.
New-Proposed Rates for Dog Catcher - The Animal Rescue League
Letter from The Animal Rescue League of Hennepin County, Inc., dated May 20,
1955 regarding new proposed rates for Dog Catcher, and enclosed schedule for services,
were read.
On motion of Councilman Davis, seconded by Councilman Hurd, the Mayor and
City Manager were authorized to sign the following AMENDM24T TO DOG CONTROL CONTRACT
for-the City, by unanimous vote of all Members of the Council present.
AMEUDMENT TO DOG CONTROL CONTRACT
"THIS AGREEMENT made and entered into this lst day of June, 1955, by and
between the CITY OF ST. LOUIS PARK, hereinafter referred to as the "City," and THE
ANIMAL RESCUE LEAGUE OF HENNEPIN COUNTY, INC,, hereinafter called the "League,"
WITTNESSETH that

LEAS, under date of May 10, 1954, the League entered into,an agreement
with the Village of St. Louis Park for dog control services, and
WHEREAS, the City has succeeded to the Village under said contract by reason
of adoption of a Home Rule Charter, and the parties hereto desire to modify the
terms of payment provided in said contract, therefore
IT IS HEREBY AGFA= by and between the parties hereto that paragraph 6
of said agreement of May 10, 1954, effective, as of June 1, 1955, shall be hereby
amended to read as follows:
6. In consideration of the furnishing of the services and facilities
above specified, the City will payto the League the sum of One
Hundred Seventy-five Dollars ($175..00) per month for each calendar
month during which patrolling services are rendered under this
agreement, provided that in addition to said sum of One Hundred
Seventy-five Dollars ($175.00) per month the League will be paid
the sum of Four and 50/100, Dollars ($4.50) for each truck call made
within the city during any twenty-four hour period and not within the
two-hour period of patrolling services to be rendered under para-
graph 1 of this agreement. The League shall also be paid the sum
of seventy-five cents (75¢) per day, but not to exceed five days,
for each dog taken into custody ,by the League within the corporate
;imits of the City and impounded by the League. Payments due under
this agreement will be made at the end of each calendar month upon
presentation of proper verified claim certifying that the services
required under this agreement have been performed during the cal-
endar month in question.
2. It is understood that all references in said agreement of May 10, 1954,
to .the "Village" shall be construed to meanthe City of St. Louis Park.
3. Said agreement of May 10, 1954, except in so far as herein modified and
amended is hereby ratified and confirmed.
Water Cooler Authorized
On motion of Councilman Bolmgren, seconded by Councilman Perkins, the City
Manager was authorized to,purchase Model OP-10 Oasis, with pre cooler at a cost of
$177.50, from Sterling I.ectric Company, by unanimous vote of all Members of the
Cogncil present.
Bid Award for Water Main Extension, Improvement 55-19
On motion of Councilman Bolmgren, seconded by Councilman Hurd, the bid
of ,Peter Lametti Construction Company received this date for construction of water
main Improvement No. 55-19 - In 18th Street from Flag Avenue to Fairway Lane, aid
in,Fairway Lane from 18th Street north to end of Fairway Lane, was determined to
be ,the lowest bid of a responsible bidder, and the Mayor and City Manager were
authorized to execute contract with bidder for the work at price bid of $5,588.00,
by.unanimous vote of,all Members, of the Council present.

Re: Appel Sewer Assessment, Etc,.
It was moved by Councilman Middleton, seconded by Councilman Perkins that
action taken by ,the Council at meeting of January 24, 1955, concerning refund of
sewer assessment to Miss Eleanor Appel, 3833 Kipling Avenue be opened for reconsider-
ation at this time. Motion was passed by unanimous vote of all Members of the
Council present except Councilman Davis who voted no.
The matter of Miss Appel's request that she be reimbursed for cost of making
house connection for sanitary sewer at her home was discussed.
Resolution No. 92
On motion of Councilman Middleton, seconded by Councilman Jorvig, the follow-
ing resolution, having been read by the Secretary, was adopted by unanimous vote of
all Members of the Council present, except Councilman Davis who voted no.

WHEREAS the Council has determined that no house service connection appears
to have been furnished to premises at 3833 Kipling Avenue, owned by Miss Eleanor
Appel who was obliged to furnish her own connection at a cost of $100.00, therefore
BE IT RESOLVED that the motion of the Council passed January 24, 1955s
canceling assessment for said sewer connection be recinded and the claim of Miss
Appel be allowed in the sum of $100.00, and the Treasurer be authorized to issue
check in said amount.
City Attorney Instructed to Recover $100.00 from Contractor
On motion of Councilman Davis, seconded by Councilman Hurd, the City Attorney
was instructed to proceed to recover the $ 100.00 in Miss Eleanor Appel's case from
the Contractor who constructed the original sewer in front of her home at 3833
Kipling Avenue, by unanimous vote of all Members of the Council present. NOTE:
Original sewer construct6d by Western Underground Construction Company (Contract
2-B) in 1948.
Report of Committee of Whole Meeting, June 16, 1955
Meeting of Committee of Whole was called to order by Mayor Fernstrom at
8:00 P. M«, June 16, 1955, at the City Hall.
The following Members were present: H. C. Davis, C. L. Hurd, Torval Jorvig,
C. R.' Middleton, H. W. Perkins, and R. C. Fernstrom. Also present were City
Attorney, Edmund T. Montgomery, and Council Secretary, Joseph Justad.
Item ;#1. Councilman Perkins made the following report on 'proposed arterial routes:
"In order to adequately take care of present day traffic demands and
allow for a sensible pattern of traffic regulations restricting truck use
of our streets to designated routes and thereby reducing maintenance cost
not only on the streets that are a part of the proposed improvement
program but also on all other streets by eliminating their use by excessive
loads, the following plan is proposed:

Cesspool and Sewer Connections for 4007 and 4015 Cedarwood Road.
Councilman Middleton suggested that due to the fact that the owners and
builder of the two homes at 4007 and 4015 Cedarwood Road were told to dig cesspools
in the rear of the homes at the time of building, and that now plans were being
formulated to construct sewer in front of homes, that the city should share in the
cost of changing plumbing so that same will go out the front of house into sewer
in street. After much discussion as to the liability of the City in this case it
was determined that no relief can be given.
On motion of Councilman Hurd, seconded by Councilman Jorvig, it is the
consensus of the Council that claims arising from circumstances such as prevail in
the matter of sewer connections at 4007 and 4015 Cedarwood Road, are not to be
allowed, by unanimous vote of all Members of the Council present, excepting Council-
man Middleton who voted no.

Clerk Justad reported who the City is purchasing gasoline from. The use of
City owned cars was also discussed, and the Clerk was instructed to ask all drivers
of City owned cars not to leave the engines idling during coffee breaks, or at other
times when not in immediate use.

The matter of advertising for bids for road materials was discussed. On
motion of Councilman Jorvig, seconded by Councilman Perkins, the City Manager was
instructed to advertise for bids for this season's needs for sand, gravel, blacktop,
and road tar, by unanimous vote of all Members of the Committee of Whole present.
Item #6
A report from the Building Inspector to the effect that sign on roof at front
of building at 6006 Excelsior Boulevard had been erected the latter part of December,
1954 without a permit, by the Western Outdoor Advertising Company. On motion of
Councilman Davis, seconded by Councilman Jorvig, the Building Inspector was instructed
to serve notice on the erector of above sign to remove same, by unanimous vote of
all Members of the Committee present.

The problem of whether or not to assess the City for improvements made adjacent
to City owned lots was discussed at length, and in particular the assessing of Lot
17, Block 2, Del Monte Heights (City owned) for grading (Project No. 54-154).
On motion of Councilman Hurd, seconded by Councilman Jorvig, it was determined that
in this case of Lot 17, Block 2, Del Monte Heights, the grading assessment (Project
No. 54-154) should be paid by the City, by unanimous vote of all Members of Committee.
Item 8
The letter regarding use of lots in Block 3100, Quebec Avenue from Adolph
Fine, dated May 4, 1955, was again discussed. It was reported that possibly the
water now settling on these lots could be drained to the new storm basin at Oregon
Avenue and 32nd Street, lots for which have just been acquired. It was stated that
the Engineer's Office was making a survey to determine this fact.

The adoption of Pacific Code for building inspection was discussed. It was
pointed out that a thorough check of this Code had been made by H. W. Fridlund, an
Architect, that that his report indicated the adviseability of the City adopting
this Code tarith:.certain few amendments suggested by the Building Inspector. The City
Attorney was asked to prepare a proper ordinance that could adopt this code and
amendments by reference, etc.,

Committee of Whole Report Accepted
On motion of Councilman Jorvig, seconded by Councilman Davis, the foregoing
report of the Committee of Whole meeting was approved and accepted in its
entirety, and all actions taken, as recorded therein were approved, by unanimous
vote of all Members of the Council present.
Minutes
The minutes of meeting held June 13, 1955 were read. On motion of Councilman
Middleton, seconded by Councilman Perkins, the minutes of meeting held June 13,
1955 were approved as read, by unanimous vote of all Members of the Council present.

On motion of Councilman Davis, seconded by Councilman Bolmgren, the meeting
was adjourned at 2:15 A. M., Tuesday, June 21, 1955, by unanimous vote of all
Members of the Council present.
