Fernstrom at 8:04 P. M. The following Council Members were present at roll call: Councilman H. C. Davis Councilman C. L. Hurd Councilman Torval Jorvig Councilman C. R. Middleton Councilman H. W. Perkins Mayor R. C. Fernstrom Also present were City Attorney, Edmund T. Montgomery and City Clerk, Joseph Justad (Also Secretary). Bids for Four-Door Sedan for Fire Department As advertised in the St. Louis Park Dispatch May 26, 1955, sealed bids were received from the following bidders for the furnishing of One (1) four-door sedan, Fire Department red, complete with all standard equipment, less applicable State, Federal and Municipal taxes, etc. Name of Bidder Amount of Bid 1. Anderson Chevrolet 1,726.00 On motion of Councilman Middleton, seconded by Councilman Jorvig, the above bids were referred to the Acting City Manager, Fire Chief, and Chairman of the Fire Department Committee for checking and recommendation, by unanimous vote of all Members of the Council present. Bid Award for Sanitary Sewer Construction, Improvements 55-15, 16, and 18 The City Engineer's tabulation of bids received June 8, 1955, for the cons- truction of Sanitary Sewer Improvements #55-15, 16, and 18, and his recommendation for award of contract for same, was read. On motion of Councilman Middleton, seconded by Councilman Davis, the bid of Phelps-Drake Company, Incorporated for the construction of Sanitary Sewer Improve- ments #55-15, 16, and 18, was determined to be the lowest bid of a responsible bidder, and the Mayor and Acting City Manager were authorized to execute contract for the City with the Bidder for the work at price bid of $27,665.30, by unanimous vote of all Members of the Council present. Hearing on Proposed Storm Sewer Construction - Minnetonka at Oregon Separate hearings were had on the proposed public improvements described in the following resolution. Mr. Gordon R. Johnson, 3154 Pennsylvania Avenue appeared and asked if this storm sewer would drain Quebec Avenue and 32nd Street. The answer was no. He also asked for the cost per lot, and the answer was that the figure has not been determined yet but the estimated cost per lot is $40.00. Mr. Johnson asked why this job couldnit be put off until later due to excessive taxes now. Mayor Fernstrom said it is necessary to do this now due to proposed paving of Minnetonka Boulevard which is a must. Resolution #80 On motion of Councilman Davis, seconded by Councilman Perkins, the following resolution, having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present. RESOLUTION ORDERING STORM SEWER CONSTRUCTION WHEREAS the City Council has met at the time and place specified in the notice published in the St. Louis Park Dispatch June 2 and 9, 1955, relating to the public improvements hereinafter described and has heard all interested persons appearing at said meeting and has secured from the City Engineer a report advising it in a preliminary way as to whether each proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvements as recommended; therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that the 262 June 13, 1955 � Resolution ordering Storm Seiner Construction, Cont'd. following public improvements be hereby ordered in accordance with plans and specifications which have been prepared by the City Engineer and filed with the City Clerk. STORM SEWER Improvement Number Location 55-49 Extending from intersection of Minnetonka Boulevard and Oregon Avenue south in Oregon Avenue to a point opposite Lot 9, Block 4, Boulevard Heights Second Addition. BE IT FURTHER RESOLVED that Lots 1, 2, 3, 7, 9, 10, 13, 15, 22, and 25, Block 4, Boulevard Heights Second Addition, and Lots 14, 15, 172 18, and 19, Block 3, Boulevard Heights Second Addition, being a natural depository for surface waters in the vicinity thereof and a necessary depository for waters drained by the said storm sewer, it is hereby deemed necessary and proper that the said lots be_ acquired by the City for storm water drainage purposes, and the offer of W. P. Bissonnette, owner of Lots 14, 15, 17, 18, and 19, Block 3, and Lots 1, 22 31 Z, 92 10, 13, 15, 22, and 25, Block 4, Boulevard Heights Second Addition, to sell and convey the same to the city for $4,500.00, the City to pay any unpaid taxes against said lots, being determined fair and reasonable' the purchase of said lots at said price is hereby authorized on approval of the title by the City Attorney and receipt of warranty deed approved by the City Attorney conveying title to said lots to the city and the payment of said sum for the purchase of said lots is authorized. The Clerk is authorized to advertise for bids, to be opened by the City Manager July 11, 1955, -at 10:00 o'clock A. M. for the construction of said storm sewer.in accordance with plans and specifications prepared by the City Engineer which are hereby approved. Hearing on Proposed Sidewalk Construction, Improvements 55-33 thru 38 Separate hearings were had on the proposed public improvements described in the following resolution. No persons appeared in opposition. Charles Grayburn, 8211 West 35th Street appeared in opposition to Improvements 55-24 and 25 - East and West Sides of Xylon Avenue from West 35th Street to West 36th Street (except existing curb). Said due to need of grading of lots on both sides of Xylon on the North End, it should not be done now. E. C. Roberts, 8431 West 35th Street appeared in opposition to•-Improvement 55-40 - South Side of West 35th Street from Zinran Avenue to Yukon Avenue, due to need of grading of Lots on both sides of Xylon Avenue. Letter from Adolph Fine, dated May 31, 1955, opposing Improvement #55-23 - West Side of Utah Avenue "from Minnetonka Boulevard to West 32nd Street, stating that this improvement is un- necessary and unwarranted adjacent to this property at this time, was read. Hearing on Application for Rezoning Pursuant to notice published in the St. Louis Park Dispatch May 26, 1955, a public hearing was had on the petitions of Charles M. Freidheim and Ernest Jacobson and Clifford Andreasen, for the rezoning of property described in said notice, from Open Development Use Districts to .Light Industrial Use Districts. Mr. and Mrs. C. W. Muzzy, 3613 Raleigh Avenue appeared. Said they feel this property should not be rezoned. They have their homes fixed up and they feel that Mr. Freidheim will put in heavy industry and do as he pleases. They also complained of the Freidheim activities in his sand and gravel pit. They said they represented the others in this area. Mayor Fernstrom asked he would propose for this area. Mr. Muzzy said a park for the children in the area. He was told of the land owned by the City in Westmoreland Addition. Ernest Jacobsen asked Mr. Muzzy if he was opposed to his rezoning request. He said no. Mr._Fernstrom explained light industrial use. Councilman Davis told of the Council's checking to protect folks living 6n 36th Street east of the Freidheim property, and feels that the Council is prepared to do the right thing in all cases. 26 4 June 13, 1955 Hearing on Application for Rezoning, Cont'd. On motion of Councilman Hurd, seconded by Councilman Davis, the foregoing matter was referred to the Committee of the Whole to work out the setbacks, etc., by unanimous vote of all Members of the Council present. Request for Permission to Operate a Fruit and Vegetable Market - City Banana, Inc. Letter signed by Sidney Katz, President, City Banana, Inc., requesting permission to operate a fruit and vegetable market at 4700 Excelsior Boulevard, was read. Mr, Katz was present. Letter from Peter Kosmas, owner of the property, was read. On motion of Councilman Davis, seconded by Councilman Middleton, a special permit was granted to Sidney Katz to operate a fruit and vegetable market at 4700 Excelsior Boulevard for the remainder of the calendar year, subject to inspection of the City Health Officer, by unanimous vote of all Members of the Council present. Letter Re: Lands Annexed to City - Ecklund & Swedlund, Et Al Letter dated June 8, 1955, signed by Stanley A. Ecklund and Leonard C. Swedlund of Ecklund & Swedlund Construction Company, stating that "due to a mistake of fact, when the undersigned petitioned to have lands annexed to the City of St. Louis Park, which was annexed by Ordinance No. 451, the homestead of Magna M. Gabrielson was included in said annexation when it'stiould not have been." was read. On motion of Councilman Davis, seconded by Councilman Jorvig, the above matter was referred to the City Attorney for checking and recommendation, by unanimous vote of all Members of the Council present. Resolution #83 On motion of Councilman Davis, seconded by Councilman Perkins, the following resolution, having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present: RESOLUTION BE IT RESOLVED, that the City of St. Louis Park as a condition of the receipt by the County of Hennepin of Federal Funds for the construction, reconstruction or improvement of any State Aid Road within the City enter into an agreement with the County, a copy of which is attached hereto and made a part hereof: BE IT FURTHER RESOLVED; that the Mayor and Clerk be and they hereby are authorized to execute said Agreement for and on behalf of the City. Agreement On motion of Councilman Davis, seconded by Councilman Perkins, the following agreement was approved for execution by the Mayor and Clerk for and on behalf of the City. AGREEMENT BETWEEN MUNICIPALITY AND COUNTY FOR FEDERAL AID HIGHWAY IMPROVEMENT THIS AGREEMENT made by the City of St. Louis Park, Minnesota, hereinafter called the "Municipality" with the County of Hennepin, hereinafter called the "County", WITNESSETH: ^ WHEREAS the United States Government, through the Bureau of Public Roads of the Department of Commerce does apportion Federal funds for the construction, reconstruction and improvement of highway projects on approved systems of public , roads, and WHEREAS said State-Aid Roads within the limits of a Municipality are now or may be eligible for-the participation of these Federal funds in their improvement or construction, and WHEREAS the Bureau of Public Roads as a condition to the use of Federal funds*on approved State-Aid projects requires the agreement of the municipality to control road signs, traffic control devices, advertising signs, miscellaneous installations, 'speed and parking, NOW, THEREFORE, The Municipality in consideration of the expenditure and use of Federal funds for'the construction, reconstruction, or improvement of any State-Aid Road within the limits of the Municipality agrees 'with the County as follows: 1. No signs, traffic control devices or other protective structures shall be erected on any Federal Aid secondary project within the Municipality limits except as shall conform with the Manual on Uniform Traffic Control Devices dated June 13, 1955 265 Agreement, Continued August 1948, prepared by the American Association of State Highway Officials, ' approved by the State of Minnesota, and concurred in by the Commissioner of Public Roads, or any subsequent revisions. 2. All right of way within the limits of the Municipality on any Federal Aid Secondary Project shall be held and maintained inviolate as a public highway and no signs, other than traffic control or protective devices, posters, billboards, roadside stands, curb pumps, curb service devices or other private installations shall be permitted within the right of way limits of the project. The Municipality will•with respect to such items as are within its jurisdiction which may be or cause an obstruction or interfere with the free flow of traffic or which may be or cause a hazard to traffic or which may vitiate or impair the usefulmess of the project and which may be required to be removed by the County at its own election or at the request of the Commissioner of Public Roads remove or cause removal of the same. 3. The speed limits on any Federal Aid Secondary Project shall not be less than 30 miles per hour. 4. Parking regulations generally recommended by the Commissioner of Highways and the Commissioner of Public Roads for use under similar conditions shall be adopted on any Federal Aid Secondary Project, Re: Drainage in Ecklund & Swedlund Subdivision The matter of drainage of property of Ecklund & Swedlund in the East J of the Southeast Quarter (SEy) of Section, Township117, outlined in letter to County Surveyor, Howard Perkins, dated April 27, 1955, from Township of Minnetonka, was discussed. The question at hand wa`s who would repair the broken tile, etc. There seemed to be no answer as far as the City of St. Louis Park is concerned. City Manager to Order Street Lights On motion of Councilman Davis, seconded by Councilman Perkins, the power to order street lights was delegated to the City Manager, by unanimous vote of all Members of the Council present. Replat of -Part of Block 1. Golf View Terrace Approved and Accepted On motion of Councilman Perkins, seconded by Councilman Jorvig, the Replat of Part of Block 1, Golf View Terrace was approved and accepted, by unanimous vote of all Members of the Council present. Ordinance No. 487 Second reading of the following ordinance was waived by unanimous consent of all Members of the Council present. On motion of Councilman Perkins, seconded by Councilman Jorvig, the following ordinance was adopted by unanimous vote of all Members of the Council present: ORDINANCE NO. 487 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK THE CITY OF ST. LOUIS PARK ORDAINS: Section 1. The Zoning Ordinance of the City of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassifi— cation of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to as follows: LOTS 1 and 2, BLOCK 4, BOUIE VARD HEIGHTS, shall be deleted from Residential Use District and included in Multiple Dwelling Use District for erection of a double bungalow and use thereof as a double bungalow, and shall be subject to all of the regulations of said ordinance relating to the Multiple Dwelling Use District. Ordinance No. 488 Second reading of the following ordinance was waived by unanimous consent of all Members of the Council present. On motion of Councilman Middleton, seconded by Councilman Davis, the following ordinance was adopted by unanimous vote of all Members of the Council present: ORDINANCE NO. 488 AN ORDINANCE VACATING PORTION OF STREET 266 June 13, 1955 Ordinance No. 488, Continued Com: THE CITY OF ST. LOUIS PARK ORDAINS: Section 1. It is hereby determined that a petition in writing signed by a majority of the owners of property fronting upon that portion of Dakota Avenue lying south of Cambridge Street and north of the right-of-way of the Chicago, Milwaukee, St. Paul & Pacific Railway, lying adjacent to ,Lots 24 to 36 inclusive , Block 79, Rearrangement of St. Louis Park, Lots 11 to 15 inclusive, Block 78, Rearrangement of St. Louis Park, and that portion of the SES of the NE, of the SE4 of Section 20, Township 117, Range 21, lying south of Block-78, Rearrangement of St. Louis Park and north of said right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railway, has been duly filed with the City Clerk requesting vacation of said street, and the City Clerk has furnished a copy of said petition to the City Manager and reported the same to the City Council, and the said City Clerk has published notice of hearing of said petition in the St. Louis Park Dispatch May 192 1955, as directed by the Council, and that the City Council has-met at the time and place specified in said notice and conducted a public hearing on said petition and has determined that it is for the best interests of the public that said street be vacated as petitioned. Section 2. Ordinance No. 489 Second reading of the following ordinance was waived by unanimous consent of all Members of the Council present. On motion of Councilman Middleton, seconded by Councilman Hurd, the follow- ing ordinance was adopted by unanimous vote of all Members of the Council present: ORDINANCE NO.' 489 AN ORDINANCE VACATING ALLEY THE CITY OF ST. LOUIS PARK ORDAINS: Section 1. It is hereby determined that a petition in writing signed by a Majority of the owners of property abutting the alley hereinafter described, has been duly filed with the City Clerk requesting vacation of said alley, and the City Clerk has furnished a copy of said petition to the City Manager and reported the same to the City Council, and the said City Clerk has published notice of hearing of said petition in the St. Louis Park Dispatch May 12, 1955, as directed by the Council, and that the City Council has met at the time and place- specified in said notice and conducted a public hearing on said petition and has determined that it is for the best interests of the public that said alley be vacated as petitioned. Section 2. The following described alley, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, be hereby vacated: That portion of alley in Block 1, Golf View Terrace Addition, adjacent to Lots 1 thru 12 inclusive, all according to the plat of said Golf View Terrace Addition on file and of record in the office of the Register of Deeds of Hennepin County. Partial Payments on Contract Work On motion of Councilman Hurd, seconded by Councilman Middleton, the following partial payments on contract work in progress, presented by City Engineer, Phil W. Planning Commission's Report on Request for Directional Sign - John Yngve Planning Commission's report dated June 1, 1955, on the request of John Yngve for a directional sign for the benefit of his Drive-In Restaurant located in Golden Valley, was read, the location of said sign to be North of Wayzata Boulevard and East of Colorado Avenue. L. P. ,Pederson of the Planning Commission said the Com- mission had approved this sign. On motion of Councilman Jorvig, seconded by Councilman Hurd, the above request for installation of a directional sign to be located North of Wayzata Boule- vard and East of Colorado Avenue was approved, and the Building Inspector was author- ized to issue permit for same, by unanimous vote of all Members of the Council present. Application of Naegele Advertising Company for Permit to Erect Sign The application of Naegele Advertising Company, dated June 7, 1955, for a permit to erect an advertising sign at 6102 1�=elsior Boulevard, was read. Dis- cussion ensued and the exact location of proposed sign was not clear. On motion of Councilman Middleton, seconded by Councilman Jorvig, the above application for permit to erect sign was tabled until the June 20th meeting so that the Council may have the opportunity to check same, -by vote of four Members of the Council present - Councilmen Davis and Hurd voting no. Request for Street Light at Division and Rhode Island On motion of Councilman Perkins, seconded by Councilman Jorvig, the request of Mrs. Grace Burg, 7710 Division Street, dated June 2, 1955, that a street light be placed at the corner of Division Street and Rhode Island Avenue was approved, and the Northern States Power Company was directed to install same, by unanimous vote of all Members of the Council present. Letter Re: Extension of Zarthan Avenue, Building Permit, and Special Permit to Connect to Water Main - Bud Moldestad Letter from Bud Moldestad, 2629 Yosemite Avenue, dated June 7, 1955, request- ing a building permit for building a one-family home on property in the 2800 block on Zarthan Avenue, described as the South 52 feet of the North 233 feet of Lotfnl, Auditor's Sub-division #350, which would necessitate the extending of Zarthan Ave. past the proposed lot line, and a special permit to connect to water main to serve said property, was read. On motion of Councilman Davis, seconded by Councilman Jorvig, the above letter was referred to the City Engineer, Building Inspector, and Water Superintend- ent for checking and recommendation and report on same at June 20th meeting, by unanimous vote of all Members of the Council present. City Manager's Report on Assessment for Grading 34�lk Street from Texas to Wyoming City Manager, Phil W. Smith report dated June 13, 1955, on the request for information b� Emil H. Duemke, 8010 West 342 Street, regarding assessment for grading of 34 SStreet from Texas Avenue from Texas Avenue to Wyoming Avenue, was read. On .motion of Councilman Davis, seconded by Councilman Hurd, the request of Emil H. Duemke to waive the assessment for grading of 342 Street from Texas Avenue to Wyoming Avenue was denied, and the Clerk was directed to notify him to that effect, by unanimous vote of all Members of the Council present. 26� June 13, 1955 � City Engineer's Report on Proposed Alley - Dr. James W. Request for Change of Street Light - First Luthern Church Letter from First Luthern Church of St.. Louis Park, tequesting a street light on Xenwood Avenue where the alley intersects it, close to the front entrance of their church, was read. On motion of Councilman Hurd, seconded by Councilman Jorvig, the Northern States Power Company was ordered to move present street light located adjacent to the South wall of the First Luthern Church of St.-Louis Park to Alley Line North of said church, by unanimous vote of all Members of the Council present. City Engineer's Recommendation for Hearing on Proposed Water Main City Engineer, Phil W. Smith's recommendation for a hearing on proposed construction of Water Main Improvements 55-41, 44, 45, 46, 47, and Alley in Auditor's Subdivision No. 308, adjacent to Lot 17; and 40th Street from Quentin Avenue to Dead End, at estimated cost of $42,372.25, was read. (The latter two without job numbers not to be assessed) City Engineer's Report on Estimated Cost of Sanitary Sewer in Cedarwood Rodd The City Engineer's report dated June 13, 1955, on estimate of costs together with plan and profile of Sanitary Sewer requested by Dr. Walter Johnson, 4007 Ceda - ood Road and others, was read. Dr. Johnson and others were present. There was discussion regarding cesspools being at the rear of their homes, and would the City pay to change their plumbing necessary to go out in front of the homes inas- much as they were told to put the cesspools at the read. June 13, 1955 2 6 9 Request for Special Permit to Build Garage - Don Glassing Request of Donald Glassing, 3445 Texas Avenue for a special permit to build a garage 9 feet from the south lot line, and 1 foot from the alley line of his lots (Lots 25, 26, Block 302, Rearrangement of St. Louis Park), was read. On motion of Councilman Middleton, seconded by Councilman Perkins, a special permit was granted to Donald Glassing, 3445 Texas Avenue to build a garage 9 feet from the south lot line, and 1 foot from the alley line of his lots (Lots 25, 262 Block 302, Rearrangement of St. Louis Park), and the Building Inspector was author- ized to issue same, by unanimous vote of all Members of the Council present. Report of Health Officer on Application for Hawker's License - Rosenblum Report of Dr. H: W. Darby, M. D., City Health Officer on the application of Harry Rosenblum, 3220 Girard avenue South, Minneapolis, to sell fruits and vegetables from house to house was read, stating that the method would be objectionable and unsanitary and that he would not approve same. On motion of Councilman Davis, seconded by Councilman Jorvig, the application of Harry Rosenblum for a license to sell fruits and vegetables from house to house was denied, by unanimous vote of all Members of the Council present. Petition The following petition received by the City Clerk was referred to the City Engineer, Assessment Clerk, and Chairman of the Street Department Committee: P-1575 Petition for curb and gutter on the West side of Rhode Island Avenue from 28th Street to 29th Street. _City Engineer's Report Re: Assessments on Lot 4, Auditor's Subdivision #318 City Engineer's report dated June 13, 1955 concerning assessments for improve- ments on Lot 4, Auditor's Subdivision No. 318, owned by Gordon Moscoe, was read. Mr. Moscoe was present. No action taken. City Engineer's Report on Dusty Condition of Highway No. 100 between Excelsior Boulevard and South City Limits City Engineer's report on dusty condition at edges of pavement on Highway No. 100 between Excelsior Boulevard and South City Limits was read, stating that they are unable to do any work to correct the above mentioned situation without a direct order from the District Engineer's Office of the State Highway Department. City Engineer's Report on Request for Sanitary Sewer in 2800 Block, Kentucky Ave. City Engineer's report dated June 13, 1955, on the request of Mr. T. D. Christman for sanitary sewer in the 2800 Block, Kentucky Avenue, was read, suggesting that a petition is in order for this work, and the map shows that this is proposed for the system. City Engineer's Report on Property Required for West 39th Street City 1�igineer's report dated June 13, 1955, with plat attached showing the portion of property which would be taken for West 39th Street - Lot 4 and the North 16' of Lot 5, Block 5, Minikanda Vista Second Addition (Grossman property), was read. It was moved by Councilman Hurd, seconded by Councilman Perkins that Mr. Max Grossman be advised that 39th Street is proposed to occupy all of Lot 4 and North 16' of Lot 5, Block 5, Minikanda Vista,Second Addition. Building Inspector's Weekly Report The Building Inspector's report for week ending June 10, 1955, showing that 21 'building permits were issued, totaling 5160,550.00, was read and ordered filed. On motion of Councilman Middleton, seconded by Councilman Perkins, the minutes of meeting held June 6, 1955, were approved as read, by unanimous vote of all Members of the Council present. 270e June 13, 1955 � Resolution #86 On motion of Councilman Middleton, seconded by Councilman Perkins, the following resolution, having been read by the Secretary, was adopted by unanimous vote of all Members of the Council present: RESOLUTION AUTHORIZING CONTRACT FOR INTERCONNECTION OF SEWERS WHEREAS it is necessary to make provision for an outlet for the Sanitary Sewers to be constructed to serve the northerly portion of the City, and the Council has determined the most economical and advisable route for such outlet is through the Village of Golden Valley to the City of Minneapolis, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that agreement between the Village of Golden Valley and the City of St. Louis Park for joint construction and for joint use and maintenance of certain ,sanitary sewer facilities which has been prepared by the City Attorney be hereby approved, and the Mayor and Acting City Manager be authorized to execute such contract on behalf of the City.
