REGULAR MEETING MARCH 7, 1955
A regular meeting of the City Council- was called to order by Mayor R. C.
Fernstrom at 8:00 'P.M.
'Invocation was given by Reverend Lundquist of Prince of Peace Lutheran
'Church.
The following Council Members were present at roll call:

On motion of Councilman Bolmgren, seconded by Councilman Middleton, the
above bids were referred to Acting City Manager and Water Superintendent, for
tabulation and recommendation, by unanimous vote of all Members of the Council
present.
Hearing on Application for Rezoning - Thomas E. Wheaton & Stanley R. Thomas
Pursuant to notice published in the St. Louis Park Dispatch February 242
1955, a public hearing was had'on the application of Thomas E. Wheaton and
Stanley R. Thomas for rezoning of Lot 1, Highland Avenue-Rearrangement, from
Multiple Dwelling Use to' Light Industrial Use District.
No persons appeared.
First reading of ordinance for rezoning was made. tOrdinance No, 475
On motion of Councilman Middleton, seconded by Councilman Hurd, March 14,
1955 was date set for second reading of Ordinance No. 475, for rezoning, by un-
animous vote of all Members of the Council present.
Planning Commission report on the Request for Vacation of Alley-R. N. Ruedlinger
The Planning Commission report on the request of R. N. Ruedlinger, 7924
Highway No. 7, for the vacating of South 100' of Alley, Block 312, between Texas
and Sumter Avenues and 36th and 37th Streets, was read and action deferred until
Planning Commission meets in April at which time they will take the matter up
for consideration. (PC report dated March 2, 1955)
Planning Commission report on Request for Permit to Build an Office Building-
Ray M. Tharp, 4306 Excelsior Boulevard.
The Planning Commission report on the request of Ray M. Tharp, 4306 Excelsior
Boulevard for a permit to build an office building on property located at the
intersection of Highway No. 7 and Wooddale Avenue (NE Corner), was read and
action deferred until Planning Commission meets in April at which time they will
take this matter up for consideration. (PC report dated March 2, 1955)
Planning Commission report on Request for Rezoning - Gil J. Chandler
The Planning Commission report,dated March 2, 1955, on the request of Gil J.
Chandler to rezone a 5z acre plot of ground lying south of Cedar Lake Road, west
of the Belt Dine, and east of that line which would be a southern extension of
garthan Avenue, to Commercial Use, was read.
Mr. Erwin Johnson says that if the plot is to be rezoned with restrictions as
in the Planning Commission's report of March 2, 1955, calling for non-retail use,
he will withdraw his request.
H. J. Bolmgren and C. L. Hurd both feel that this plot should be commercial

without restrictions. Councilman Torval Jorvig feels also that commercial
would be logical at this location.
On motion of Councilman C. L. Hurd, seconded by Councilman T. Jorvig,
April 4th was set as date for hearing of the request of Gil J. Chandler to re-
zone a 51 acre plot of ground lying south of Cedar Lake Road, west of the Belt
Line, and east of that line which would be a southern extension of Zarthan
Avenue, to Commercial use.
Planning Commission. report on Request of Erickson Brothers for Bldg. Permit
for a Gas Station at 5600 Excelsior Boulevard.
j The Planning Commission's report, .dated March 2, 1955, on the request of
Erickson Brothers for a building permit to build a gas station at 5600 Excelsior
Boulevard, on Lots 25 and 26, Block 2, Meadowbrook Addition, was read
The Planning Commission recommended that the application for a Special
Permit be denied for the reason that the applicant did not make it appear to the
satisfaction of the Planning Commission that the proposed use will not be detri-
mental to the Health, welfare and safety of the general public and residents of
surrounding lands, nor will not create a serious traffic congestion, nor will
not seriously depreciate property values, as indicated in Section 10.5 of the
Zoning Ordinance.
Attorney Brill says he represents Ericsons and Mr. Sandy the owner of the
property. He feels that none of the objections in the Planning Commission re-
port could stand up under test. He stated that the building permit requested
would not do any of the things so listed. They build neat appearing places and
feels by law we have no good reason ,for denying request.
Councilman C. R. Middleton said that there were too many Gas Stations on
Excelsior Boulevard. -He mentioned the one now closed-on Xenwood and Excelsior
Boulevard and he for one will oppose the granting of this permit.
Councilman H. C. Davis, explained Sec. 10.5 and stated that the granting
of this permit would be detrimental to general welfare, and feels we are -on
sound ground in denying this permit.
Attorney Brill stated that the Supreme Court has ruled that the objections
both of Councilman Middleton and Councilman Davis do not hold and it is not the
law that a permit can be denied inthis case.
Mayor R. C. Fernstrom feels that we do not have power to regulate competi-
tion, but that Mr. Davis's remarks was regarding another stations effect on the
existing-stations property value.
Councilman C. L. Hurd says it seems to be a legal question and he would like
to hear our Attorneys opinion.
. Councilman H. J. Bolmgren reminded us of the deal we had regarding the Gas
Station permit on Brunswick and Excelsior Boulevard. Our Attorney told us that
we did not have a chance to beat the case in court.
Andrew Smith, Pure Oil Station, Excelsior Boulevard and Yosemite Avenue,
spoke of the number of stations, the condition- of the streets at the present time
and feels that another station would do damage to the existing businesses.
Councilman C. L. Hurd asked if this decision had to be made tonight as he
feels that the plans of the State Highway at this intersection for under and over-
pass might conflict with plans for this station.
On motion of Councilman Hurd, seconded by Councilman Jorvig, action be post-
poned for two weeks, to give City Manager opportunity to check with State Highway
Department as to their proposed plans for under and over pass at Highway #100
and Excelsior Boulevard, by unanimous vote of all Council Members present.
PLANNING Commission report on. Request for Rezoning - Wm. Hodroff
The Planning Commission's report dated March 2, 1955, on the request of Wm.
Hodroff for the rezoning of Lots 1M, 11, and 12, Block 8, High Holborn Addition
from Residential Use to Commercial Use, was read. Mr. Currie, representing Wm.
Hodroff ways they were in favor of the set back of 50 feet and that there were
plans to take 20 feet off the front of the building on the NW corner of Louisiana
Avenue and Minnetonka Blvd., now occupied by Hodroff. They plan to construct an

On motion of Councilman Bolmgren, seconded by Councilman Middleton, April 11,
1955 was set as date for hearing for the rezoning of Lots 10, 11 and 12, Block 8,
High Holborn Addition from Residential Use to Commercial Use, by unanimous vote of
all Council Members present.
Petition for Sidewalk
On motion of Councilman Middleton, seconded by Councilman Davis, the following
petition was referred to the City Engineer, Chairman of the Street Department
Committee, and Special Assessment Clerk for checking and recommendation, by unanimous
vote of all Members of the Council present.
P-1. 527 PETITION FOR SIDEWALK, signed by Marshall P. Hein and others, dated
March 2, 1955, for the construction of Sidewalk on the East Side of
Quebec Ave. Adjacent to Lots 6 thru 10, Block 1, Replat of Fide's
and Marten's Addition.
Application for Licenses, Restaurant, Cigarettes & 3.2 Beer On-Sale-Joseph George
Nagel, 8316 Highway No. 7
Mayor R. C. Fernstrom asked Joseph George Nagel, 8316 Highway No. 7 if he
would accept the Restaurant License without the 3.2 Beer On-Sale.License, and he
said, yes, but he would like to have the 3.2 Beer On-Sale license in order to please
the customers.
On motion of Councilman Jorvig, seconded by Councilman Davis, the appli-
cation of Joseph George Nagel, 8316 Highway No. 7, for Restaurant and Cigarette
license was approved by unanimous votba of all Council Members present.
On motion of Councilman Middleton, seconded by Councilman Bolmgren, the
request of Joseph George Nagel, 8316 Highway No. 7, for a 3.2 .Beer On=Sale license
was referred to the Committee of the Whole, by unanimous vote of all Council
Members present.
Mr. R. N. Tharp re: Dairy Queen
Mr. R. N. Tharp asked the Council if a Dairy Queen business would be
allowed on the NE Corner of Wooddale and Highway No. 7, and if it had been dis-
cussed by the Planning Commission. He was told no it had not been discussed.
Report from Railroad and Warehouse Commission regarding the permanent order for
the Bryn Mawr Bus ,
Report from Railroad and Warehouse Commission regarding the permanent order
for the Bryn Mawr Bus, was read as follows: That the Minneapolis Street Railway
Company be granted a certificate for the transportation of passengers, as ari ex-
tension of its above-described Bryn Mawr Bus Line, which extension shall be over
the following route, to-wit:
Commencing at 22nd and Eging Avenue in the City of Minneapolis, thence on
France Avenue to 26th Street, thence on 26th Street in the City of St.
Louis Park to the intersection of Natchez and 26th Street, and return
over the same route.
IT IS FURTHER ORDERED that the time schedule hereinabove set forth shall
be approved for initial application.
IT IS FURTHER ORDERED that a fare of 5 cents shall be charged for the trans-
portation of passengers over and between any points on the proposed extension, which
fare shall be in addition to the regularly authorized fare for the transportation
of passengers by petitioner in the. City of Minneapolis, when such passengers shall,
be transported on said Bryn Mawr-Northwest Termihal Bus Line from either direction
beyond 22nd and Eyring Avenues.

The Building Inspector's report for week ending-March 4, 1955, showing
that 12 Building permits were issued, totaling $150025.00, was read and ordered
filed.

Appointment of Two Police Officers
On motion of Councilman Jorvig, seconded by Councilman Middleton, Sherman
Aplin, 3324 Utah Avenue and Edward Thompson, 5626 W. 36th Street, having qualified
by examination held by the St. Louis Park Police Civil Service Commission on June
17, 1953, and by physical examination made by Dr. Archie Smith on February 21, 1955
and February 17, 1955, respectively,were appointed as City Patrolmen, effective
March -15., 1955, at a starting salary of $348.30, by unanimous vote of all Members of
the Council present.

On the recommendation of City Assessor, R. B. Connery, it was moved by
Councilman •Middleton, seconded by Councilman Jorvig, that Dorathy Chase be put
on a full time bases, instead of part time, in the Assessors Office, as of March
11$ 1955 at a salary of $243.00 a month, by unanimous vote of all Council Members
present.
Resolution - No. 29
By unanimous consent reading of the following Resolution was waived, and
on motion of Councilman Bolmgren, seconded by Councilman Jorvig, the following
Resolution was adopted by unanimous vote of the Council:
R E S O L U T I O N
RESOLVED, THAT Water Main Improvement No. 54-158 and Sanitary Sewer Im-
provement No. 54-157 ordered by the Village Council October 25, 1954, be hereby
abandoned, and
BE IT FURTHER RESOLVED that the Clerk be directed to publish notice of
hearing, for the following proposed sewer and water main improvements, to be held
at the Council meeting ,March 28, 1955:

Request of Mr. Stienstra to Attend the Annual School for Building. Officials
The request of Peter Stienstra to attend the Ninth Annual School for Build-
ing Officials and Inspectors, to be held at Urbana Illinois, March 21 thru 25, 19552
was read. Councilman Hurd suggested that at this time we should have an understudy
for the Building Inspector position and if we have such in our employ, that he t`
should start getting this education, and also feels that our Acting City Manager
should do some checking on this and make some recommendations regarding same.-

On motion of Council/Davis, seconded by Councilman Hurd,, Mr. Stienstra
was authorized to attend the Ninth Annual School for Building Officials and In-
spectors, to be held at Urbana Illinois, March 21st thru 25th, 1955, with one
other, with necessary expenses paid, by unanimous vote of all Council Members
present.
Re: Changes in the Hennepin County Road System - Wayzata Boulevard
Letter received from the Hennepin County Highway Department, dated .March
1, 1955, regarding changes in the Hennepin County Road System, was read and .ordered
placed on file.
_Letter received from Hennepin County Schools Re: County Fair
Letter received from the Superintendent of Schools, Mrs. Viola S. Thompson,
of the Hennepin County Schools, in response to our request of their views with re-
gards to the Hennepin County !Fair, 'was read and the Secretary of the Council was
asked to contact Superintendent Enestvedt and ask if St. Louis Park Schools parti-
cipate in the County Fair School Display.
Request for Cars - Street Department and Engineering Department
City Manager Phil W. Smith_, presented a request for three cars to be used
for the Engineering Department and the Street Department, he also explained the
condition of the cars in question.
On motion of Councilman Bolmgren, seconded by Councilman Middleton, The
City Manager was authorized to advertise for bids for two cars and one z ton pick-up
truck, each car to be bid on separately; bids to opened on April 4, 1955, by un-
animous vote of all Members of the Council present.
Second reading of Ordinance No. 473 - Annexing Lands - deferred
On motion of Councilman Middleton, seconded by Councilman Jorvig, and
carried by unanimous vote, the second reading of proposed Ordinance Annexing Lands
in Northeast Quarter of Sectionl, Township 117, Range 22 was deferred until the
next adjourned or regular meeting of the Council.
_Second reading of Ordinance No. 474 = Amending Zoning Ordinance - Deferred
On motion of Councilman Middleton, seconded by Councilman .Jorvig, .and
carried by unanimous vote, the second reading of Ordinance No. 474, Amending the
Zoning Ordinance, was deferred until the next adjourned or regular meeting of the
Council.
Re: Dividing of Lot 5. Block 2, Brookside Second Addition
On motion of-Councilman Middleton, seconded by Councilman Hurd, that we
reconsider the action taken on February 28, 1955 on the request for dividing of
Lot 5, Block 2, Brookside 2nd Addition, five Councilman voting yea, Mayor R. C.
Fernstrom voting no, and Councilman Bol.moren abstained from voting.
The attorney, E. T. Montgomery, •said that Sec. 19:18 as amended of
Zoning Ordinance provides that no lot can be subdivided into less than 60ft. width.
It was suggested that the Ordinance could be amended to take care of similar sit-
uations before us, after considerable discussion.
On motion of Councilman Bolmgren, seconded by Councilman Jorvig, action on
the matter of dividing Lot 5, Block 2, Brookside 2nd Addition was deferred to March
211 1955, six Councilman voting yea, Councilman Davis voting no.
Re: Purchase of 500 City Charters
On motion of Councilman Davis, seconded by Councilman Jorvig, the City
Manager was instructed to purchase 500 City Charters from Hoffman Printing Company
at the cost of $245.00, by unanimous vote of all Members of the Council present.

Report on Meeting held at County Commissioners Office re: Minnehaha Creek
Councilman Hurd gave a report on the meeting held at the County Commissiohers
Office regarding the changing of Minnehaha Creek locations etc. He learned that
marginal lands that were used for ponding could not be filled, if by so doing it
would raise the water level either before or after. He also discussed the poor
condition of Grays Bay dam and the dangers attached thereto. Mr. Hurd feels that
we should be interested in this matter to the extent of a resolution to County
Commissioner asking them to face this matter and do something now before any
damage by flodding takes place.
Re: Northside Sanitary Sewer
Councilman Davis asked regarding the Northside Sanitary Sewer as he has had
many calls regarding the need for same. Considerable discussion on this matter
was had and a study of Sanitary Sewer map was studied.
Re: Sign Ordinance Amending
On motion :of Councilman Davis, seconded by Councilman Jorvig, that the City
Attorney, E. T. Montgomery, check the Sign Ordinance to see if same has been
amended and report to the Council, with the regard to taxing, by unanimous vote
of all Council Members present.
City Managerb Report on Incinerators Chimney
' The City Manager, Phil W. Smith, made a report on the need for some care of
the Chimney at the Incinerator. He has worried that the excessive heat and then
the aopling off can do some damage to stack and he has been studying plans to
take care of this by drafts. A thermostatic control can be put in for around
$1,000.00 estimated cost.
Planning Commission's Report Re: Report of Morell & Nichols Inc.
The Planning Commission's report dated March 2, 1955, was read as follows:
Mr. B. K. Wbhrman presented a preliminary report from-Morell & Nichols, Inc.,
Planning Engineers, containing recommendations for the rezoning of the area (1)
of the property of Mr. Gil M. Chandler -on the south side of Cedar Lake Road
opposite and east of the connection with Zarthan Ave. projected, and (2) of the
property of Mr. Charles M. Freidheim bounded by Highway #100, W. 36th Street,
Raleigh Ave. and the south edge of the dump on W: 39th Street. This was filed
for `further reference.
With further reference to this report the Secretary was instructed to con-
tact Mr. R. W. Lam and Mr. Charles M. Freidheim and arrange a Joint Special
Meeting 'of the City Council and Planning Commission with Mr. Law and Mr. Freidheim
present.
The Report of Morell & Nichols, dated March 1, 1955, was read as follows:
1. Petition of Gil J. Chandler to rezone to Comiercial, a 51 acre plot of ground
lying south of Cedar Lake Road, west of the Belt -Line and east of that line which
would be a southern extension of Zarthan Avenue. -
This tract of land is nicely wooded, has interesting topography and ,the
general development in the vicinity is a good class of residential. In order to
protect' the residential values and to encourage the expansion of the residential
area,` it is recommended that the petiti6n to rezone commercial be denied.
2. Petition for rezoning to heavy industrial, the tract of land bounded generally
by the Belt Line, West 36th Street, Raleigh Avenue and West 39th Street. Attention
is directed to the retail commercial area directly south of the above tract. If
property values (and tax revenues) are to be stabilized in this commercial area,
it is imperative to have a contiguous residential area to create demand for products
sold 'in the commercial area. With proper development this could be a good residential
area of modest value homes. It takes families to support retail areas. We, therefore,
recommend that the petition to rezone heavy industrial be denied.
May we add a further comment on this general area. The expansion of the
present commercial zone to include the area now occupied by the public dump appears
desirable. As the demand for goods grows in the present commercial zone, there
will be need fof adjacent expansion including ample parking space.
Councilman Middleton, asked that the Clerk be instructed to contact Mr.
Ludwig to set the joint meeting qt- the earliest date.
Planning Commission did not want to pass ori Mr. Laws report without a
Conference with them.

The Planning Commission's Report, dated March 7, 1955, regarding the

given to each Councilman and the Mayor.
