C. Fernstrom at 8:06 P. M. Invocation was given by Rabbi Rabinowitz of Adath Jeshuran Church. The following Council Members were present at roll call: Councilman H. J. Bolmgren Councilman H. C. Davis Councilman Torval Jorvig Councilman C. R. Middleton Councilman H. W. Perkins Mayor R. C. Fernstrom Also present were City Manager, Tom Chenoweth, City Attorney, Edmund T. Montgomery, and City Clerk, Joseph Justad. _Letter Re: Release -of Sewer Easement - Attorney Laurence M. Nelson (For Husby) Letter from Attorney Laurence M. Nelson, dated October 72 1955, for his clients Ole J. Husby, Oscar Husby and Joseph M. Husby, requesting the release of the Easterly 5 feet of premises West of Al's Liquor Store currently owned by the City of St. Louis Park to be used for sewer easement, was read. The following recommendation was made by the City Engineer: "Attached is a letter asking release of a sewer easement over the herein described property. The information contained in this letter is correct and the sewer has been installed in a different location. We recommend release of this easement as it is not -needed." On motion of Councilman Middleton, seconded by Councilman Jorvig, the Mayor and City Manager were authorized to execute a release of sewer easement over property of Ole J. Husby and others created by deed recorded in Book 1862 of Deeds, Page 552 as Document No. 2650579 upon the approval of the City Attorney, by unani- mous vote of all Members of the Council present. Plat of Cedar Knoll Manor Fourth Addition On motion of Councilman Bolmgren, seconded by Councilman Davis, action on acceptance of the record plat of Cedar Knoll Manor Fourth Addition was deferred to October 24, 19550 by unanimous vote of all Members of the Council present. Bonds On motion of Councilman Davis, seconded by Councilman Middleton, the follow- ing bonds which have been approved by City Attorney, Edmund T. Montgomery were accepted by unanimous vote of all Members of the Council present: CONTRACTORS BOND $19,862.96 Victor Carlson & Sons, Incorporated, principal American Automobile Insurance Company, surety Dated October 5, 1955, covering contract for construction of curbs and gutters, Projects #55-84 thru #55-97. CONTRACTORS BOND $4,944.50 Phelps-Drake Company, Incorporated Fire Association of Philadelphia, surety Dated October 142 1955, covering contract for construction of sanitary sewers in Colorado Avenue, Improvement No. 55-55. Petitions The following petitions received by the City Clerk have been referred to the City Engineer and City Assessor: P-1621 Curb and Gutter On West Side of Virginia Avenue from 33rd Street to 34th Street P-1622 Sidewalk On West Side of Sumter Avenue from 29th Street to South End. Ordinance No.. 507 Second reading of Ordinance No. 507 entitled AN ORDINANCE ESTABLISHING SALARIES OF COUNCIL MEMBERS FOR 1956 was waived by unanimous consent of Council Members present. October 17, 1955 407 Ordinance No. 507, Continued On motion of Councilman Perkins, seconded by Councilman Middleton, Ordinance No.. 507 was adopted by unanimous vote of all Members of the Council present. Ordinance No. 507 in Book 3 .of Ordinances. Partial Payment on Contract Work On motion of Councilman Bolmgren, seconded by Councilman Middleton, the following partial payment on contract work in progress, presented by City Engineer, Phil W. Smith was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue warrants covering same, by unanimous vote of all Members of the Council present: PARTIAL PAYMENT N0. 3 $5,330.81 WELL NO. 8 Contractor, Bergerson-Caswell, Incorporated Contract Date, June 6, 1955 Contract Price, $p18,894.00. Application for Permit to Erect Sign - Suburban Sign Company Application of Suburban Sign Company -to erect an advertising sign at 5100 West 36th Street, was read. On motion of Councilman Perkins, seconded by Council- man Jorvig, the application of Suburban Sign Company for a permit to erect adver- tising sign at 5100 West 36th Street was approved based on the fact that same is to advertise the business conducted at said location, and the Building Inspector of was authorized to issue same, by unanimous vote of all Members' of the Council present. Report on Complaint - Police Officer, J. R. Dahl Report of Police Officer, J. R. Dahl, dated October 14, 1955, stating that he had talked with Mrs. Jacobson_ regarding her complaint against Gleason Black Top Company that dirt, sand and dust blows onto her washing and into her home when the plant is in operation was read, stating that he told Mrs. Jacobson to call us when conditions were bad on windy days so that City Officials could make an inspection of conditions. No action taken. Ordinance No. 508 First reading of Ordinance No. 508 entitled AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK (regarding Section 10 and adding Section 10.6) was made by the City Attorney. On motion of Councilman Davis, seconded by Councilman Middleton, October 24, 1955 was set as date for second reading of Ordinance No. 508, by unanimous vote of all Members of the Council present. Report of Progress on Condemnation for Excelsior Paving - City Attorney City Attorney, Edmund T. Montgomery reported on progress of condemnation for Excelsior Boulevard Paving. He mentioned in particular the SW Corner of Brunswick Avenue and Excelsior Boulevard where the damage claimed is between $2,700 and $3,000. Said that next meeting of the Commissioners will be November 15th and suggested that the Council m4ke a study of the requested slope and other easements to determine whether they need or want all of them and if they are absolutely necessary. On motion of Councilman Perkins, seconded by Councilman Bolmgren, the above matter was referred to the City Manager to confer with County Engineer, L. P. Pederson and to bring in a recommendation as to the absolute need for slope ease- ments and land for widening Excelsior Boulevard now before the Commissioners, by unanimous vote of all Members of the Council present. Solicitors Bond or License George Williams of Chamber of Commerce spoke regarding solicitors in St. Louis Park. Suggested that they have a bond or license, etc. This matter was referred to the City Attorney to study same and make a recommendation. City Manager and City Clerk to Meet with Recreational Director on 1956 Budget On motion of Councilman Bolmgren, seconded by Councilman Perkins, the City Manager and City Clerk were instructed to meet with Recreation Director, Miss Dorothea Nelson to discuss the 1956 recreation budget and get a detailed breakdown and comparison with other years, by unanimous vote of all Members of the Council present. Health Officers Report for September, 1955 On motion of Councilman Davis, seconded by Councilman Middleton, report of Health Officer, Dr. H. W. Darby, M. D., on health inspections made during September, 1955, was read and ordered filed, by unanimous vote of all Members of the Council present. 408 October 17, 1955 City Engineer to Secure Cost of Lowering Grade - Minnetonka at Virginia Avenue ] On motion of Councilman Perkins, seconded by Councilman Middleton, profile of grade of Minnetonka Boulevard at Virginia Avenue was referred to the City Engineer for estimated cost of lowering grade to previously proposed grade, by unanimous vote of all Members of the Council present. Re: Lots to Build Three Homes - Victor Formo Victor Formo appeared and spoke about his desire to build three houses on Lots 1, 2, and 3, Block 1, Eliot View Addition. He claims the County wants to take part of these lots for Cedar Lake Road, but can get no definite information from them. Councilman Perkins suggested that Mr. Formo figure out what he could do with the balance of these three lots as for instance -- build 2 houses on parts of these lots and make a proposition to the Council for the purchase of the balance of the lots they will need for Cedar Lake Road widening, etc. Building Inspector's Weekly Report On motion of Councilman Davis, seconded by Councilman Middleton, the Building Inspector's report for week ending October 14, 1955, showing that 18 building permits were issued, totaling $45,115.00 was read and ordered filed, by unanimous vote of all Members of the Council present. Verified Claims On motion of Councilman Davis, seconded by Councilman Bolmgren, the list of verified claims prepared by the City Clerk and presented to the Council, dated October 17, 1955 in the total amount of $8,826.30 for vendors was approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks covering same, by the following roll call vote: Councilman bolmgren, yea; - Councilman Davis, yea; Councilman Jorvig, yea; Councilman Middleton, yea; Council- man Perkins, yea; and Mayor R. C. Fernstrom, yea. Minutes On motion of Councilman Perkins, seconded by Councilman Middleton, the minutes of meeting held October 10,1955 were approved, by unanimous vote of all Members of the Council present. Meeting Adjourned On motion of Councilman Middleton, seconded by Councilman Jorvig, the meeting was adjourned-at 11:55 P. M., by unanimous vote of all Members of the Council present. R. C.
