Fernstrom at 8:10 P. M. Allis-Chalmers Company 961.00 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids were referred to the Village Engineer, Water Superintendent, and Chairman of the Water Department Committee for tabulation and recommendation, by unanimous vote of all Members of the Council. Assessment Hearings for Water Main Separate hearings were had on each of the proposed assessments described in the following resolution. No persons appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by the unanimous vote of all Members of the Council: ASSESSMENT RESOLUTION WHEREAS the Village Council has met at the time and place specified in the notice of assessment published in the St. Louis Park Dispatch August 19, 1954, stating the general nature of the following improvements and the area proposed to be assessed, and has heard and passed upon all objections to the proposed assess- ments, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the proposed assessments on file in the office of the Village Clerk, covering the cost of the following described improvements, be hereby adopted as special assess- ments against the lands named in said assessment rolls and there be hereby levied against each of the respective tracts and parcels of land described therein the respective assessments in the respective amounts therein set forth, and said res- pective tracts and parcels of land are hereby found to be benefited in a sum equal to the said respective assessments hereby levied. Said assessments shall be payable in equal annual installments extending over a period of ten years, the first of which shall be payable on the first Monday in January, 1955, with interest at 5% per annum. On motion of Trustee Bolmgren, seconded by Trustee Middleton, hearing was again deferred to meeting of September 27, 19542 by unanimous vote of all Members of the Council. Letter Re: Advertising Sign. - General Outdoor Advertising Resn Mayor Fernstrom read a letter from General Outdoor Advertising Company, dated September 20, 1954, concerning an advertising sign on the North Side of Excelsior Boulevard at Quentin Avenue which was placed,at a different location than the one granted. On motion of Trustee Middleton, seconded by Trustee Jorvig, action on this matter was deferred to meeting of September 27, 1954" by unanimous vote of all Members of the Council. Re: Advertising Sign for Nicollet Carpet Company George Behonek of Brede Sign Company appeared regarding an advertising sign for Nicollet Carpet Company, 4510 Excelsior Boulevard. Said he would like to put a sign on property and Highway line. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing matter was deferred to meeting of September 27, 1954, by unanimous vote of all Members of the Council. Street Light Ordered On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern States Power Company was ordered to install an 6,000 lumen street light at the Corner of Jordan Avenue and Cedar Lake Road, by unanimous vote of all Members of the Council. Letter Requesting Street Light - James Sadilek Letter from James Sadilek, 3355 Utah Avenue, dated September U, 1954, request- ing that a street light be installed on the Corner of 34th Street and Utah Avenue, was read. Street Light Ordered On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern States Power Company was ordered to place a street light at the Corner of 34th Street and Utah Avenue, by unanimous vote of all Members of the Council. Letter Requesting Street Light - Thomas H. Lentz Letter signed by Thomas,H. Lentz, 6500 Cedar Lake Road, and others, dated September 20, 1954, requesting that a street light be installed on the Corner of Edgewood Avenue and Cedar' Lake Road, was read. Street Light Ordered On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern States Power Company was ordered to place a street light at the Corner of Edgewood Avenue and Cedar Lake Road, by unanimous vote of all Members of the Council. Animal Report Animal report of Animal Rescue League of Hennepin County for week ending September 18, 1954, was read and ordered filed. 430 September 20, 1954 Ordinance No. 457 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following ordinance was adopted by unanimous vote of all Members of the Council: ORDINANCE NO. 457 AN ORDINANCE IMPOSING A TAPPING FEE FOR SEWER AND WATER MAIN CONNECTIONS IN LIEU OF AN ASSESSMENT FOR PAYMENT THEREOF The Village Council of the Village of St. Louis Park ordains: Section 1. No person shall hereafter tap or connect either directly or indirectly with any sewer or water main of the Village of St. Louis Park from any lot or tract of land unless such lot or tract of land shall have been assessed for the cost of .the construction of the sewer or water main with which the connection is made, provided that such connection or tapping may be permitted if the Village Clerk shall certify that proceedings for assessment of such cost have not been commenced or completed because of recent completion of the construction of the main and that such proceedings will be in due course commenced and completed, and pro- vided further that if application be made to tap or connect with any such sewer or water main, permit will be issued upon payment to the Village Treasurer of a sum equal to the assessable cost of construction of the main involved, assessable against the lot or tract to be served by said tapping or connection. Said assessable cost is to be determined by the Village Engineer upon the basis of any assessment previously made for the water,or sewer main requested or, if no such assessment has been made, on the basis of the cost thereof as allocated against all of the property served thereby. In all cases where such cost cannot be determined the charge is hereby fixed at $100.00. Section 2. The provisions of this Ordinance as to payment of a fee or charge shall not apply in the case of connection to any lot or tract of land the owner of which has previously paid to the Village a sum of money equivalent to the assessable cost of constructing the main to which tapping or connection is made. Section 3. This Ordinance shall be construed as supplementary to existing and future Ordinances of the Village regulating tapping and connections with Village sewer and water mains. Section 4. Any person who shall violate any provision of this Ordinance shall upon conviction thereof be punished by a fine of not less than $50.00 nor more than $100.00, or by imprisonment for not more than ninety days. Section 5. This Ordinance shall take effect and be in force from and after its publication. Partial Payments on Contract Work On motion of Trustee Bolmgren, seconded by Trustee Middleton the following partial payments on contract work in progress, presented by Village Engineer, Phil W. Smith, were approved, and the Mayor and Clerk were authorized to issue warrants covering same, by unanimous vote of all Members of the Council: PARTIAL PAYMENT NO. September 20, 1954 43 1 Bid Award for Water Main Construction, 54-151, Etc. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the bid of Wm. V. Terry Excavating Company, Inc. received September 13, 1954, for the cons- truction of water main extensions Nos. 54-151, 152, 153, 149, and 87 (54-153 to be taken out), was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with the Bidder in the amount of $147,621.50, by unanimous vote of all Members of the Council. Ordinance No, 458 On motion of Trustee Middleton, seconded by Trustee Jorvig, the following ordinance was adopted by unanimous vote of all Members of the Council: ORDINANCE NO. 458 AN ORDINANCE AMENDING ORDINANCE NO. 219 ESTABLISHING CONDITIONS OF EMPLOYMENT The Village Council of the Village of St. Louis Park ordains: Section 1, Section 7 of Ordinance No. 219, entitled AN ORDINANCE ESTABLISH- ING CONDITIONS OF EMPLOYMENT FOR NON-ELECTED OFFICERS AND EMPLOYEES OF THE VILLAGE" adopted by the Village Council February 5, 1945, is hereby amended by adding thereto the following paragraph: Employees of the Village shall be retired upon attaining sixty-five years of age; provided that persons now in the employ of the Village who are sixty-three years of age or over may continue in the employ of the Village and shall not be retired until January 1, 1958. Section 2. This Ordinance shall take effect from and after its publication. Ordinance No. 159 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following Ordinance was adopted by unanimous vote of all Members of the Council: ORDINANCE NO. 459 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. Section 19.18 of the Zoning Ordinance of the Village of St. Louis Park, adopted by the Village Council January 20, 1932, as heretofore amended, is hereby further amended to read as follows: 19.18 No land shall hereafter be platted or sub- divided so as to create any lot with a lot width of less than sixty (60) feet measured along its frontage on the adjacent street or at the front building line, and an area of less than seven thousand two hundred (7200) square feet. Section 2. This Ordinance shall take effect from and after its publication. Application for Permit to Erect Advertising Sign - Meyers On motion of Trustee Bolmgren, seconded by Trustee Middleton, the application of Meyers Outdoor Advertising, Inc. dated September 20, 1954, for a permit to erect a double faced sign reading WESTWOOD SHOPPING CENTER, on the existing structure on the parking lot of said shopping center was approved with a 20 foot setback from Louisiana Avenue and Cedar Lake Road, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application foxy Permit to Erect Advertising Sign - Le Roy Sign, Inc. On motion of Trustee Middleton, seconded by Trustee Jorvig, the application of Le Roy Sign, Inc. dated September 14, 1954, for a permit to erect an advertis- ing sign on building at 7115 Cedar Lake Road for Westwood Drug Store, was approved, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Report of Rural Hennepin Nursing Distbict for August, 1954 Report of activities of Rural Hennepin County Nursing District for August, 1954, was read and ordered filed. ` 432 September 20, 1954 r� Proposed Addition to Park Tavern On motion of Trustee Middleton, seconded by Trustee Jorvig, the request of Park Tavern, 7201 Minnetonka Boulevard for a. permit to extend their present building 4 feet on the east, according to accompanying sketch for same, was approved, and the Building Inspector was authorized to issue permit with setback of 7 feet from the sidewalk,_by unanimous vote of all Members of the Council. Petition to Annex Lot 1, Block 2, Wooddale Heights - C. L. Mullen Clerk Justad reported on the petition of C. L. Mullen, 4501 Morningside Road for annexation of Lot 1, Block 2, Wooddale Heights Addition, from Morningside Village. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the fore- going petition was denied, by unanimous vote of all Members of the Council. Payment for Damage to Hydrant On motion of Trustee Jorvig, seconded by Trustee Bolmgren, Check No. 271508, dated September 13, 1954, from The Ohio Casualty Insurance Company, covering damage to hydrant located in front of Linde Air Products (Monitor Street), in the amount of $208.26, was approved and accepted by unanimous vote of all Members of the Council except Mayor Fernstrom who feels that insurance and overhead of $31.26 should be paid. Letter Re: Retaining Wall for 6100 Minnetonka Boulevard - Nagel Letter from Thomas Nagel, 6100 Minnetonka Boulevard, dated September 162 19542 stating that he would like to have a 55 foot retaining wall put in adjacent to his property (shown on accompanying sketch), and that he is willing to pay for one-half of the cost of same, was read. Also read was a release from claim for damages, signed by Thomas Nagel and Virginia Nagel, dated June 23, 1953, in the sum of $210.00, releasing the Village from any and all claims, due to Minnetonka Boulevard paving project. On motion of Trustee Bolmgren, seconded by Trustee Middleton, foregoing proposition made by Mr. Nagel was denied, by unanimous vote of all Members of the Council. Request for Permission to Install Sewer and Water Mains Hippe Construction Company requested permission to install sewer and water mains in Utah Avenue from 35th Street to a point approximately 292 feet south thereof, according to specifications prepared by Village Engineer, Phil W. Smith therefore, in order to get same done at once, with the understanding that they pay cash for same. On motion of Trustee Bolmgren, seconded by Trustee Middleton, Hippe Cons- truction Company was granted permission to construct sanitary sewer and water main by own contractor under the supervision of the Village Engineer in Utah Avenue from 35th Street south approximately 292 feet, with the understanding that they post the necessary bond with a written contract, and pay all costs of same, by un- animous vote of all Members of the Council. Advertise for Bids for i Ton Pick-up Truck for Water Department On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was authorized to advertise for bids for a .1954 J ton pick-up truck for the Water Department, complete with steel cab, five heavy duty tires 6.50-15 or 6.50-16 size, six ply with natural rubber inner tubes and one spare wheel, directional lights, front and rear bumper, fresh air ventilating heater and defroster, rear view mirror, two sun visors, manual control spot light on roof of cab, two windshield wipers, heavy duty battery, one 50 ampere or more capacity generator, three speed trans- mission, color of truck shall be dark green; cost of installing mobile radio in truck shall be included in bid price, and with trade-in of 1950 Chevrolet iZ ton pick-up truck, to be received October 18, 1954, by unanimous vote of all Members of the Council. Advertise for Bids for � Ton Panel Truck for Fngineering Department On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to advertise for bids for a 1954 panel truck for the Engineering Depart- ment, --- the truck to be furnished shall be similar,in design to the 1954 Suburban Carryall Model #3106 as manufactured by Chevrolet, complete with five 6:00-16 6 ply tires with natural rubber tubes and one spare wheel, directional lights, front and rear bumpers, fresh air ventilating heater and defroster, rear view mirror, two sun visors, two windshield wipers, heavy duty battery, right and left-hand push button door locks, 50 ampere generator, three speed transmission, panel type rear doors, and the color shall be juniper green. REALTORS OVERPAYMENT ON SPECIAL ASSESSMENTS On August 18, 1954, Cusack & Carlson, Realtors requested statements for payment iA full of the special assessments against Tracts A & D, Registered Land Survey #328. Invoice #1379 for Tract A was paid September 2, 1954 (Receipt #24807) in the amount of $859.24; and Invoice #1380 for Tract D was paid September 1, 1954 (Receipt 24758) in the amount of $725.19. 1 After these assessments were paid, we discovered that when the division of the property from acreage into the above tracts was made, all the assessments except Tar Mat were figured incorrectly, so that C. & C., Realtors were overcharged a total of $253.92 for Tracts A & D; therefore - BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the amount of $253.92 overpaid on invoices 1379 and 1380 be refunded to Cusack & Carlson, Realtors; and, upon receipt of a signed verified claim, that the Mayor and -Clerk be hereby authorized to issue a warrant for same. Report on Claim for Damages - Fred Schnabel Village Street Commissioner's report on damage to Mr. Fred Schnabel's tomato plants by the Village crew who were spraying weeds with a DDT solution on June 21, 1954, and his recommendation that the Village pay the $9.65 claimed as damages by Mr. Schnabel, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor and Clerk were authorized to issue warrant in the amount of $9.65 to Mr. Schnabel upon receipt of a verified account signed by him, by unanimous vote of all Members of the Council.
