Invocation was given by Reverend George L. Lundquist of Prince of Peace Luthern Church. " As advertised in the St. LouislPark Dispatch September 2, 1954, sealed bids were received from the following bidders for construction of water main extension Improvement Nos. 54-151, 152, 153, 149, and 87: 1. ' Lametti & Sons '157,752.70 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids were referred to the Village Engineer and Chairman of the Water Department Committee for tabulation and recommendation, and to get the earliest possible starting date from contractor recommended as Flagg Avenue area is very desirous of getting water as soon as possible, by' unanimous vote of all Members of the Council. September 13, 1954 4 Hearing on Proposed Erection of Ornamental Street Lights Pursuant to notice published in the St. Louis Park Dispatch August 19 and 26, 1954, a public hearing was had on the following proposed public improvements: Installation of Six (6) ornamental-style street lights on Virginia Circle North, Virginia Circle South, and Nylon Avenue from 24th Street to 25th Street, the estimated cost of which is $3,600.00, and the area proposed to be assessed is the lots and tracts of land adjacent to the portion of the streets above described. No persons appeared in opposition. Henry Carney and 9 others whose names are on the petition for these lights appeared in favor of same. Jim Gallagher and Mr. Rudolph of Northern States Power Company were present and showed locations. On motion of trustee Bolmgren, seconded by trustee Middleton, the above request was referred to the Village Engineer to work with a committee of residents to be selected by residents of the area, and to prepare plans and specifications; and that action on the hearing be deferred to October 18, 1954, by unanimous vote of all Members of the Council. Hearing on Proposed Curb and Gutter Construction, 54-130, Etc. Separate hearings were had on the proposed public improvements described in the following resolution. No persons appeared. Resolution On motion of Trustee Middleton, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION ORDERING CURB AND GUTTER CONSTRUCTION WHEREAS the Village Council has met at the time and place specified in the _ notice published in the St. Louis Park Dispatch August 19 and 26, 1954, relating to the public improvements hereinafter described and has heard all interested persons appearing at said meeting and has secured from the Village Engineer a report ad- vising it in a preliminary.way as to whether each proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvements as recommended; therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following public improvements be- hereby ordered in accordance with plans and specifications which have been prepared by the Village Engineer and filed with the Village Clerk, and the Village Clerk is hereby directed to advertise for bids which will be opened at the meeting of the Council October 4, 1954• CURB AND GUTTER CONSTRUCTION IMPROVEMENT NO. LOCATION 54-130 East Side Xylon Avenue adjacent to 3525, 3529 and 3533 54-131 West Side Xylon Avenue adjacent to 3524, 3528 and 3532 54-135 East side Sumter Avenue from West 28th Street to West 29th Street 54-136 West Side Rhode Island Avenue from West 29th Street to Minnetonka Boulevard 54-137 East Side Rhode Island Avenue from West 29th Street to Minnetonka Boulevard. Hearing on Proposed Sidewalk Construction, 54-138, Etc. Separate hearings were had on the proposed public improvements described in the following resolution: The following persons appeared --- Mr. Mc Donald, 2961 Texa-Tonka Avenue appeared in opposition to Improvement No. 54-138. Said there is a petition opposing this improvement. Robert Bell, 2925 Texa-Tonka Avenue said he was in favor of same. Kenneth C. Coon, 3525 Zinran Avenue said he was in favor of Improvement No. 54-141, and Milton Hill, 3545 Zinran Avemue and W. H. Reed., 3521 Zinran Avenue said they were opposed to same. Petitions for and against this improvement were read. Said they were opposed due to financial reasons. Robert Sheplee, 2905 Rhode Island Avenue said he was opposed to Improvement No. 54-145, due to taxes. Said there were five opposed and 4 in favor of same in the block. Hearing on Supplemental Assessment for Sanitary Sewer and Lift Station, 51-251 Pursuant to notice published in the St. Louis Park Dispatch August 5, 1954s a public hearing was had on proposed assessments for Sanitary Sewer and Lift Station, Improvement No. 51-251, described therein. Byron W. Mc Cu]lough, Attorney for the owners of the lots platted as Cedarwood Second Addition, and Dick Thomson appeared in opposition. Mr. Mc Cullough presented a letter dated this date, stating objections to the proposed assessments, which was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, hearing on proposed supplementary assessment for sanitary sewer and lift station, Improvement No. 51-251 was continued to September 20, 1954; and referred to the Village Attorney and Assessment Clerk to check the items in Mr. Mc Cullough's letter, by unanimous vote of all Members of the Council. Assessment Hearing for Bituminous Surfacing, 54-94- and 54-104 Separate hearings were had on each of the proposed assessments described in the following resolution. No persons appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by the unanimous vote of all Members of the Council: ASSESSMENT RESOLUTION WHEREAS, the Village Council has met at the time and place specified in the notice of assessment published in the St. Louis Park Dispatch August 26, 1954, stating the general nature of the following improvement, the area proposed to be assessed and that written or oral objections would be considered, and has held a public hearing on said proposed assessment and passed upon all the objections thereto, therefore ' BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the proposed assessments on file in the office of the Village Clerk covering the cost of the following described improvements be hereby adopted and shall consti- tute a described improvements be hereby adopted and shall- constitute a special assessment against the lands named therein in the amounts respectively set forth therein, which lands are found to be benefited in said respective amounts, and which assessments, with accruing interest thereon, shall be a lien upon the property described therein concurrent with general taxes payable in three (3) equal annual installments, the first of which installments shall be payable on the first Monday in January, 1955• Deferred installments shall bear interest at the rate of 5% per annum from the date of this resolution until December 31, 1954, and to each sub- sequent installment interest shall be added for one year on all unpaid installments. The improvements above referred to for which the assessments are adopted and levied are described as follows: September 139 1954 417 Assessment Resolution, Cont'd. BITUMINOUS SURFACING IMPROVEMENT NUMBER LOCATION 54-94 29th Street from Boone Avenue East to end 54-104 Quentin Avenue from Excelsior Boulevard to 40th Street Proposed Change in Service Road - Turners Crossroad & Wayzata Boulevard Mr. Van Krevlin of Minnesota Highway Department appeared in regard to a proposed change in service road at Turners Crossroad and Wayzata Boulevard before installing traffic signals. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council: R E S O L U T I O N WHEREAS, the Commissioner of Highways of the State of Minnesota is about to designate the location of Trunk Highway No. 12 formerly designated as Trunk Highway No. 10, through the Village of St. Louis Park, as shown upon the general layout plan which is presented herewith and made a part hereof, and WHEREAS, said Commissioner of Highways proposes to make certain improvements in said trunk highway through said Village of St. Louis Park and is designating the general layout and points of access to said trunk highway as shown on the general layout plan attached hereto, which said plan is presented herewith and made a part of this resolution, and WHEREAS, the Commissioner of Highways is desirous that the Village of St. Louis Park, will not license or permit hereafter any encroachment of any nature, including curb gas pumps or gas stations or billboards or other structures of any kind whatsoever, on the right of way of said Trunk Highway No. 12 within the corporate limits of said Village of St. Louis Park, as shown upon the plan and maps hereto attach- ed, and WHEREAS, in the furtherance of the public well being and safety it is desirable and necessary to eliminate traffic hazards by eliminating any encroachments whatsoever including gas pumps or gas stations or billboards or other structures of any kind whatsoever, now or hereafter existing in or upon the said Trunk Highway right of way, and WHEREAS, said Commissioner of Highways desires, in the interest of public safety, that all parking of vehicles on said Trunk Highway be parallel with the curb and at least 20 feet from any crosswalk at all public streets intersecting said Trunk Highway within the corporate limits of said Village, and WHEREAS, it is to the best interests of said Village that all parking of vehicles be parallel to the curb; now, therefore BE IT RESOLVED, that said general layout plan for the location, improvement and designation of points of access to said Trunk Highway through said Village be and the same is hereby approved; and BE IT FURTHER RESOLVED, that when plans and specifications of said improvement on Trunk Highway No. 12 have been completed and submitted to this Council in accord- ance with the above proposal, the same will be approved by further resolution; and BE IT FURTHER RESOLVED, that said Village does hereby agree and covenant that it will never permit or suffer, within its corporate limits, any encroachment of any kind whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon the right-of-way of Trunk Highway No.. 12 as shown on said plans and that to the above end said Village hereby agrees that it will never issue any license, permit, or grant, or give any leave or liberty or any other consent of whatever form for the construction or maintenance of any encroachment whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon said right of way; and that said Village will cooperate insofar as possible to eliminate existing encroachments constituting traffic hazards and will further take any necessary action to eliminate any encroachment that may hereafter exist on said Trunk Highway right of way; and BE IT FURTHER RESOLVED, that said Village does hereby agree to require the parking of all vehicles on said Trunk Highway to be parallel with the curb-and at least 20 feet from any crosswalks at all public streets intersecting said Trunk Highway within the corporate limits of said Village. A18 September 13, 1954 Proposed Change in Service Road - Turners Crossroad •& Wayzata Blvd., Cont'd. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, that while we accepted the plan outlined in foregoing resolution presented by the State Highway Department, we still object to the 30 foot opening of Hennepin County Road #41 going west from Turners Crossroad just north of Wayzata Boulevard, by unanimous vote of all Members of the Council. Application for License On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application of Reliable Sign Erectors, 4515 Wentworth Avenue, Minneapolis, dated July 19,_ 195_4, for a license to erect signs in the Village was approved, and the Mayor and Clerk were authorized to issue license to expire December 31, 1954, by unanimous vote of all Members of the Council. Bonds On motion of Trustee Bolmgren; seconded by Trustee Jorvig, the following bonds were approved, which were previously approved by Village Attorney, Edmund T. Mont- gomery, by unanimous vote of all Members of the Council: SIGN ERECTORS BOND $1,000.00 Reliable Sign Erectors, principal` Western Surety Company, surety Effective, August 12� 1954 Expires, December 31, 1954. CONTRACTORS BOND $22351.00 Lametti & Sons, Incorporated, principal Seaboard-Surety Company, surety Covering construction of sanitary sewer Improvement No. 54-114, in Xylon Avenue from West 35th Street to 300 feet south. Rebolution On motion of Trustee Jorvig; seconded by Trustee Bolmgren, the following reso- lution was adopted by unanimous vote of all Members of the Council: RESOLUTION REQUESTING EXTENSION OF BUS LINE IN VILLAGE OF ST. LOUIS PARK WHEREAS a continuing increase in population due to new residential construction in the area of the Village of ,St.. Louis Park lying west of France Avenue and east of State Highway No. 100 in the vicinity of West 26th-Street has resulted in a stead- ily increasing demand for bus service, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Minneapolis Street Railway Company be hereby requested to provide extension of its Bryn Mawr bus line from its present terminus on France Avenue south to France Avenue at 26th Street, and west on 26th Street to Natchez Avenue; that schedules of service be submitted to the Council for approval, and that the Company petition the railroad and Warehouse Commission for certificate authorizing such extension'and service. Application for Permit to Erect Sign - Western Outdoor " On motion of Trustee Middleton, seconded by Trustee Jorvig, the application of Western Outdoor Adverbsing Company, dated September,102 1954, for a permit to erect an advertising sign on building at 5420 Excelsior Boulevard for Super Valu Stores, was approved, 'and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application for Permit to Erect Sign = Reliable Sign Erectors On motion of Trustee Middleton, seconded by Trustee Jorvig, the application of Reliable Sign Erectors, dated July 19, 1954, for a permit to erect an advertising sign at 8026 Minnetonka Boulevard for Grossman TV Service, was approved, and the Building 'Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application for Permit to Erect Sign - Nordquist On motion of Trustee Middleton; seconded by Trustee Bolmgren, the application of Nordquist Sign Company, dated September 9, 1954, for a permit to erect an adver- tising sign on building at 6318 Cambridge Street for Insulation Engineers, was approved, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application for Permit to erect Sign - Reliable Sign Erectors On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application of Reliable Sign Erectors, dated September 13, 1954, for a permit to erect a sign at 7511 Highway No. 12, was referred to the Planning Commission, by unanimous vote of all Members of the Council present. September 13, 1954 419 Request for Permission to Set Poles and Anchor - NW Bell Telephone Co. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northwestern Bell Telephone Company was granted permission to set two poles and one anchor on the West Side of Alley between Hampshire Avenue and Georgia Avenue, between West 26th Street and West 27th Street, by unanimous vote of all Members of the Council. Petitions for Street Improvements On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following petitions were referred to the Village Engineer, Chairman of the Street Department Committee, and Special Assessment Department, for checking and recommendation, by unanimous vote of all Members of the Council: P-1508 PETITION FOR CURB AND GUTTER, signed by S. Meyerson, 2651 Yosemite Avenue and others, dated September 13, 1954s for the construction of Curb and Gutter on the EAST SIDE OF YOSEMITE AVENUE FROM 26TH STREET TO 27TH STREET. P-1509 PETITION FOR CURB AND GUTTER, signed by Irving Kasdan, 2636 Yosemite Avenue and others, dated September 13, 1954 for cohstruction of Curb and Gutter on the WEST SIDE OF YOSEMITE AVENUE FROM 26TH STREET TO 27TH STREET. Letter Re: Change of Name Letter from Peter Josmas, partner Jennings Tavern, dated September 10, 1954, stating that after September 17, 1954, the name of their business establishment will be changed from Jennings to The Park House, was read. Councilmen agreed to accept the name of The Park House as of September 17, 1954, and that their bonds and licenses be changed to carry the new name, and that the Clerk be instructed to so inform the State Liquor Control Commissioner. Improvement No. 54-132 The Village Engineer's report of estimated cost of Improvement No. 54-132, the construction of sanitary sewer in West 28th Street from Ottawa Avenue to Princeton Avenue, in the amount of $2,933.70, and the area to be assessed to be the abutting property, was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the foregoing Improvement No. 54-132 was dropped by unanimous vote of all Members pf the Council. Letter Re: Proposed Lincoln Bakery Letter from Audrey 0. Johndreau, 2921 Huntington Avenue and others, dated September 10, 1954, requesting that action on request for permit to construct a baking plant at Huntington Avenue and Lake Street scheduled for September 27, 1954, be deferred to October 4, 1954, due to the 27th being the first day of a high religious holiday, and a fair representation of persons interested could not attend, was read. No action taken. Estimated Costs of Sanitary Sewer Village Engineer, Phil W. Smith's report on estimated cost of constructing sanitary sewer in the following streets in the amount of $85,624.00 (without piling and test holes), was read: In West 36th Street from Natchez Avenue to Raleigh Avenue; in Raleigh . Avenue extended from West 36th Street to 650 feet North; in New Street from Raleigh Avenue extended East 1,400 feet, and from Raleigh Avenue extended West 950 feet. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, hearing was set on proposed sewer above described for the Council Meeting of October 4, 1954, the Village Engineer's estimate is approved and the area proposed to be assessed is adjacent tracts including area South of the Right-of-Way of the Chicago, Milwaukee, St. Paul and Pacific Railway, East of State Highway No. 100, North of South Line of tracts lying South of 36th Street, East of Raleigh Avenue, and West of North and South Line intersecting the South Line of said Chicago, Milwaukee, St. Paul and Pacific Railway at a point measured 2369.95 feet Northeasterly from State Highway No. 100; the estimated cost of $85,624.00 is approved; and the Clerk is authorized to advertise for bids to be opened October 11, 19542 by unanimous vote of all Members of the Council. Building Inspector's Weekly Report The Building Inspector's report for week ending September 10, 1954s showing that 34 building permits were issued, totaling $265,450.00, was read and ordered filed. zo() September 13, 1954 Bid Award for Widening of Joppa Avenue between Excelsior Boulevard and South Line of 37th St. (� On motion of Trustee Middleton, seconded by Trustee Bolmgren, the bid of Victor Carlson and Sons, Inc., received September 7, 1954, was determined to be -the lowest-bid of a responsible bidder, for WIDENING OF JOPPA AVENUE BETWEEN EXCELSIOR BOULEVARD AND SOUTH LINE OF 37TH STREET, and the Mayor and Clerk were authorized to execute contract for the work at price bid of $2,018.75, by unanimous vote of all Members of the Council. Bid Award for Filling, Grading & Sodding at Well #5 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the bid of Kinney Lawn Service received September 7, 1954, for filling, grading & Sodding at Well #5, 8301 West 34th Street, was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract with the bidder for the work in the amount of bid of $945.75, by unanimous vote of all Members of the Council present. Proof of Loss Statement Re: Lightning Damage to Pump House On motion of Trustee Jorvig, seconded by Trustee Middleton, the Clerk was authorized to execute on behalf of the Village the proof of loss statements cover- ing the damage to pump house at Natchez Avenue and 41st Street caused by lightning on June 28, 1954 in the accumulative amount of $461.60; claims to be paid by the following named insurance policy writers, in the amounts listed --- Policy Number Name of Company Amount 26-123758 American Equitable Insurance Company $ 25.75 26-123761 n . Insurance Covering Engineering Department's Equipment On motion of Trustee Middleton, seconded by Trustee Bolmgren, Insurance Policy No. 310103, with the Village of St. Louis Park named as insured, and Republic Insurance Company of Dallas, Texas as insuror, dated August 18, 1954, in the amount of $3,599.40, covering equipment listed thereon, was approved, and the Mayor and Clerk were authorized to issue warrant covering premium for same in the amount of $179.97, by unanimous vote of all Members of the Council. Request for Permit to Build Gas Station The application of Gluek Brewing Company per a permit to build a gasoline station on the NW Corner of. Turners Crossroad and Wayzata Boulevard was discussed. On motion of Trustee Jorvig, seconded by Trustee Middleton, the request of Gluek Brewing Company for a permit to•build a Gas Station on the NW Corner of Turners Crossroad and Wayzata Boulevard was approved, and the Building Inspector was authorized to issue same, by unanimous. vote of all Members of the Council. Tax Revenue Meeting On motion of Trustee Bolmgren, seconded by Trustee Middleton Trustee Jorvig and Mayor Fernstrom were authorized to attend the Tax Revenue Meeting to be held September 18, 1954, with necessary expenses paid, by unanimous vote of all Members of the Council. Meeting to be held at Duluth, Minnesota. Animal report for Week Ending September 11, 1954 Animal report of Animal Rescue League of Hennepin County for week ending September 11, 1954, was read and ordered filed. September 13, 1954 �2 1 Manuals and Pamphalets for Civil Defense On motion of Trustee Middleton,, seconded by Trustee Bolmgren, the Clerk was authorized to issue purchase order to U. S. No person, Firm or corporation shall keep, store, handle, use, transport or otherwise dispose of flammable liquids, except transportation by petroleum carriers as covered in Laws of Minnesota 1947, Chapter 281, contrary to the Rules and Regulations of the Fire Marshal of the State of Minnesota governing the Handling, Storage and Transportation of Petroleum and Petroleum Products as amended effective as of January 28, 1954, and all requirements of said Regulations shall be complied with within the corporate limits of the Village of St. Louis Park. Said Regulations, containing Sections numbered 100 to 800 inclusive, are hereby adopted by reference and three copies thereof shall be deposited with and remain on file with the Village Clerk. Section 2. It shall be the duty of the Fire Chief of the Village to investi- gate the handling, storage and transportation of petroleum and petroleum products within the Village and to determine violations and compliances with the requirements of this Ordinance, to report violations to the State Fire Marshal, and to enforce the provisions of this Ordinance. Section 3. Ordinance No. A-10, entitled AN ORDINANCE REGULATING AND HANDLING OF DANGEROUS LIQUIDS, adopted July 20, 1926, is herdby repealed. Section 4. .
