Fernstrom at 8:08 P. M. Invocation was not given due to no Ciergyman present, The following Council Members were present at roll call: Trustee Holmgren Trustee Jorvig. He was told that he could not run a restaurant, but could carry on a home occupation and bake and sell. Licenses • On motion of Trustee Middleton, seconded by Trustee Jorvig, the following applications for 1954 licenses were approved, and the Mayor and Clerk were authorized • to issue licenses to expire December 31, 1954, by unanimous vote of all Members of the -Council: Wallace Haggberg Taxicab Driver G. V. Heating & Sheet Metal Heating Bonds • On motion of Trustee Middleton, seconded by Trustee Jorvig, the following bonds which have been approved by Village Attorney, Edmund T. Montgomery, were approved by unanimous vote of all Members of the Council: August 9, 1954 377 Bonds, Continued HEATING LICENSE BOND $61,000.00 G. V. Heating & Sheet Metal, as principal Standard Accident Insurance Company, as surety Effective July 23, 1954 - Expires December 312 1954. CONTRACTORS BOND $10,000.00 Morris A. Finstad, dba Finstad & Sons, as principal United Pacific Insurance Company, as surety Dated July 22, 1954, covering concrete sidewalk, and curb and gutter construction, for period ending December 312 1954. CONTRACTORS BOND with Victor Carlson & Sons, Inc. as principal, and American Automobile Insurance Company of St. Louis, Missouri as surety, dated August 4, 1954, in the amount of $$11,000.00, covering construction of sidewalk, curb and gutter Improvements 54-76 to 54-85, and 54-115• Complaint Re: House at 3817 Brunswick Mrs. Erling Hanson, 3919 Brunswick Avenue, Mrs. Paul J. Hodgdon, 5924 Carte bridge Street, and Mrs. P. J. Mueller, 6019 Cambridge Street appeared regarding the condition of house at 3817 Brunswick Avenue which has been previously condemned, stating that it is a nuisance and is dangerous to the children in the neighborhood. On motion of Trustee Middleton, seconded by Trustee Jorvig, the above matter was referred to Building Inspector, Peter Stienstra, Health Officer, Dr. H. W. Darby, M. D., and Fire Chief, C. M. Williams for checking and a report; also to check houses at 3813 and 3821 Brunswick for structural, and sanitary conditions as well as for fire hazard, by unanimous vote of all Members of the Council. Gas Main Extension On motion of Trustee Jorvig, seconded by Trustee Middleton, the following gas main extension was approved, by unanimous vote of all Members of the Council present: Job s-224 Dacatur and Cavell Avenues-'South-of West 24th Street. Vraalstad, it was moved by Trustee Middleton,, seconded by Trustee Jorvig, that the old abandoned gasoline storage tank under Excelsior Boulevard adjacent to gas station located at Excelsior Boulevard and Brookside Avenue be removed by Miller & Holmes within 7 days, or ,same will be removed by the Village, by unanimous vote of all Members of the Council. Petitions for Ornamental Street Lighting Petitions signed by Henry M. Carney, 8306 Virginia Circle North, and others for the placement of six ornamental style street lights on Virginia Circle North, Virginia Circle South, and Xylon Avenue between 24th and-25th Streets, were read. On motion of Trustee Jorvig, seconded by Trustee Middleton, September 13, 1954 was set as date for hearing on above mentioned petitions, the estimated cost of same being $3,600.00, and the proposed area to be assessed is the adjacent property, by unanimous vote of all Members of the Council present. Planning Commission's Report on Request for Permit to Erect Office & Store Building Planning Commission's report dated August 4, 1954, on the request of Alfred W. Hay for a permit to erect an office and store building at 6400 Walker Street, was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, the Council con- curred with the recommendation of the Planning Commission to issue a permit to Alfred W. Hay, for the erection of an office and store building at 6400 Walker Street, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Bid Award for Grading, Graveling,_ S�abilizing - 54-113 On recommendation of Village Engineer, Phil W. Smith, it was moved- by Trustee Middleton, seconded by Trustee Bolmgren, that the bid of Terry Brothers received August 2, 1954, for grading, graveling and stabilizing Improvement No. 54-113 be determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with the Bidder for the work in the amount bid of $1,527.50, by unanimous vote of all Members of the Council. Bid Award for Construction of Wire Fence On recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that the bid of Crowley Fence Company for construction of wire fence around drainage pond at the NE Corner of Minnetonka Boulevard and Nevada Avenue, received August 2, 1954, be determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with the Bidder for the work in the amount bid of $796.00, by unanimous vote of all Members of the Council. Bid Award for Sanitary Sewer Construction - 54-114 On recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Bolmgren, seconded by Trustee Jorvig, that the bid of Lametti and Sons, Inc., received August 2, 1954, for the construction of Sanitary Sewer Improvement No. 54-114 -- in Xylon Avenue from West 35th Street to 300' South, be determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with the Bidder in the amount of bid of $2,351.00, by unanimous vote of all Members of the Council. Application for Permit to Erect Sign - Western Outdoor Advertising Co. On motion of Trustee Jorvig, seconded 'by Trustee Middleton, the application of Western Outdoor Advertising Company, dated August 4, 1954, for a permit to erect an advertising sign flat on front of brick building at 6104 Excelsior Boulevard, for Prudential Insurance Company, was approved, and the Building Inspector was authorized to issue permit for same, by unanimous vote of all Members of the Council. Planning Commission's Report on Request for Permit to erect Service Station Planning Commission's report dated August 6, 1954, on the request of Gluek Brewing Company for permit to erect a gas service station for Western Oil & Fuel Company at the NW Corner of Turner's Cross Road and Wayzata Boulevard, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on the foregoing request was deferred until further information can be secured on revised plat of intersection of Trunk Highway No. 12 and Turners Cross Road as submitted by J.E.P. Darrell of the Minnesota Highway Department on August 5, 1954, by unanimous vote of all Members of the Council present. Building Inspector's Report for Week Ending August 6, 1954 The Building Inspector's report for week ending August 6, 1954, showing that 55 building permits were issued, totaling $451,300.00, was read and ordered filed. August 9, 1954 379 Application for Permit to Erect Sign - Nordquist Sign Company On motion of Trustee Jorvig, seconded by Trustee Middleton, the application of Nordquist Sign Company, dated August 5, 1954, for a permit to erect an advertis- ing sign on roof of building at 7111 Cedar Lake Road for Westwood Hardware, was approved, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application for Commercial Electric Service On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to sign for the Village, APPLICATION FOR COMMERCIAL ELECTRIC SERVICE to power traffic control signals at the Intersection of France Avenue and Excelsior Boulevard, by unanimous vote of all Members of the Council. Bingo - Holy Family Church Letter from Mrs. T. T. Renner, Chairman, Holy Family Bazaar Committe, dated August .9, 1954, requesting permission to play bingo at their Fourth Annual Bazaar at the .Holy Family Catholic Church, located at Lake Street and Zarthan Avenue, on October. 23 and 24, 1954, was read. No action taken. Plat of Texa-Tonka Fourth Addition Approved On motion of Trustee Middleton, seconded by Trustee Jorvig, the permanent plat of Texa-Tonka Fourth Addition, presented by Adolph Fine, Incorporated, was approved and accepted according to report of Planning Commission, and the Mayor and Clerk were authorized to sign same for the Village, by unanimous vote of all Members of the Council. Advertise for Bids for Filling, Grading and Sodding at Well #5 As recommended by eater Superintendent, Ira M. Vraalstad, it was moved by Trustee Bolmgren, seconded by Trustee Middleton, that the Clerk be instructed to advertise for bids for filling, grading and sodding premises at Well No. 5 at 8301 West 34th Street, same to be received on September 7, 1954, by unanimous vote of all Members of the Council. Appointment to Fire Civil Service Commission - Frank Curtis Esterly, Jr. On motion of Trustee Middleton, seconded by Trustee Jorvig, the appointment of Frank Curtis Esterly, Jr., 2630 Xenwood Avenue, to the Fire Civil Service Commission for term beginning September 20, 1954 and expiring September 20, 1957, by unanimous vote of all Members of the-Council. Quit Claim Deeds On motion of Trustee Jorvig, seconded by Clerk Justad, the following quit claim deeds were approved and accepted subject to Village Attorney's approval of same, and the Village -Attorney was instructed to file same with the Office of Register of Deeds of Hennepin County, Minnesota, by unanimous vote of all Members of the Council: FOR USE AS PUBLIC ALLEY, quit claim deed with Texas Investment Company as party of the first part, and the Village of St. Louis Park as party of the second part, the rear or easterly Twelve (121 ) feet of Lots One (1) through Twelve (12), both inclusive, Block Three (3), Golf View Terrace, according to the map or plat thereof on file and of record -in the Office of the Register of Deeds in and for said County and State. Smith, it was moved by Trustee Bolmgren, seconded by Trustee Middleton that September 7, 1954 be set as date for hearing on proposed application of heavy duty bituminous surfacing, inclusing base, prime coat, wearing course and seal coat to the following streets in Hopkins • Terminal: 54-150 Meadowbrook Road from Excelsior Boulevard to Powell Road; Powell Road from Meadowbrook Road to Hopkins Village Limits, the estimated cost of which is $41,580.00, and the area proposed to be assessed is the Hopkins Terminal property adjacent to said streets. Motion was passed by un- animous vote of all Members of the Council. Justice of Peace Report of Fines - Yngve Justice of Peace Anton Yngvels report of fines dated August 2, 1954, was read and ordered filed. 380 August 9, 1954 Hearing Date Set on Proposed Sidewalk Construction On recommendation of Village Engineer, Phil W. Special Permit to Make Six-Inch Connection to Water Main On motion of Trustee Bolmgren, seconded by Trustee Middleton, Harris Plumbing Company, 217 West Lake Street is hereby given a special permit to make a six-inch service connection to the water main in Webster Avenue adjacent to Lot 29, Norwaldo Addition to St. Louis Park to supply the new Ethel Baston School now under cons- truction with water and for fire protection with the following stipulations -- regular permit to be taken out. The tap to be made using a split sleeve and tap in valve with mechanical joints and rubber gaskets, that a manhole be constructed around said valve, the six- inch pipe and fittings shall be Class 150 cast iron with mechanical joints and rubber gaskets, the fire hydrant shall be a Mueller or Waterous hydrant of the same model and type as now used by the Village of St. Louis Park, a six inch- gate valve and valve box shall be installed on the hydrant lead, water mains shall have not less than seven and one-half feet of earth cover to prevent freezing in winter, a test of 150 pounds per square inch pressure shall be placed on this main and checked by the Water Department Inspector before the ditch is back filled. Construction shall be done as directed by the Superintendent of the Water Department. Motion was passed by unanimous vote of all Members of the,Council. Revised Plat of Intersection of Trunk Highway No. 12 and Turner's Cross Road Letter from J. E. P. Darrell, Traffic and Planning Director for Minnesota Highway Department, dated August 5, 1954, enclosing a revised plat showing changes in connection with plat of Intersection of Trunk Highway No. 12 and Turner's Cross Road, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was instructed to advise M. J. Hoffman, Commissioner of Highways, State of Minnesota that the Coiincil does not concur with the revised plat of Wayzata Boulevard (T. H. No. 12) and Turner's Cross Road because of traffic hazard shown, and same would be detrimental to valuation of business property in St. Louis Park, by unani- mous vote of all Members of the Council. Hearing Date Set for Proposed Curb and Gutter Construction On recommendation of Village Engineer, Phil W. Adjacent property to be assessed Letter Re: Method of Placing Village Insurance Letter from Carroll J. Ahlstrand of Park Agency, Incorporated, dated August 5, 1954, inquiring how the Village insurance is placed and written, was read. Agreement for Radio Set for Dog Catcher's Car On motion of Clerk Justad, seconded by Trustee Jorvig, the Mayor and Clerk were authorized to execute agreement for the Village with the Animal Rescue League, providing for a radio set for the Dog Catcher's car, by unanimous vote of all Members of the Council. August 9, 1954 381 Hearing Date Set for Construction of Sanitary Sewer - 54-147 On recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Bolmgren, seconded by Trustee Middleton, September 7, 1954, was set as date for hearing on proposed construction of sanitary sewer and lift station for Hopkins Terminal as follows: 54-147 Meadowbroo}d Road from Excelsior Boulevard to Powell Road. Powell Road from Meadowbrook Road to Hopkins Village Limits. Estimated cost, $29,617.50. 54-148 Lift Station at Powell Road and Meadowbrook Road. Estimated cost, $29,040.00. The area proposed to be assessed is adjacent property. Motion was passed by unanimous vote of all Members of the Council. Appraisal of Village Owned Buildings - Patchin Appraisals Letter from George Patchin of Patchin Appraisals, dated July 21, 1954, pro- posing to furnish the Village with an appraisal of Village owned buildings and contents for insurance purposes, fora total of y$540.00, was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, the above offer for an appraisal was approved and ordered, by unanimous vote of all Members of the Council. New Employee for Engineering Department On recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Jorvig, seconded by Trustee Middleton, that Ronald Johnson be placed on Engineering Department payroll, effective August 11, 1954, at beginner's rate of x$1.80 per hour, to replace John David Hyatt who resigned on August 6, 1954, by unanimous vote of all Members of the Council present. Office Employee for Civil Defense On recommendation of Ralph La Hue, Director of Civil Defense, St. Louis Park, it was moved by Trustee Jorvig, seconded by Trustee Middleton, that Harriet Simonson be placed on the Civil Defense payroll effective September 1, 1954, at a salary of $$240.00, by unanimous vote of all Members of the Council. Letter Re: Excessive Sounding of Whistles - C. M. St. P. and Pacific RR Co. Letter from R. F. Fairfield, Supt., Office of Division Superintendent, Chicago, Milwaukee, St. Paul and Pacific Railroad Company, dated August 3, 1954, in response to our letter dated July 30, 1954, concerning excessive sounding of train whistles while passing through the Village, and stating that they are again issuing ins- tructions for keeping the whistling at a minimum, to their engine crews, was read and ordered filed. Mc Pherson, Vice President and General Manager of Minneapolis, Northfield and Southern Railway, dated August 2, 1954, in response to our letter dated July 30, 1954, concerning excessive sounding of train whistles while passing through the Village, and stating that a bulletin will be sent to all Engineers ad- vising them to be judicious in the volume of the air horns when passing through St. Louis Park, was read and ordered filed. Letter Re: Resolution Requesting That St. Louis Park Be Placed on Official Road Map of Minnesota - Governor C. E. Anderson Letter from Governor C. Elmer Anderson, dated August 5, 1954, in response to our letter dated July 30, 1954, requesting that St. Louis Park be placed on the official road map of Minnesota, and stating that the matter was immediately taken up with the Highway Department, and that there will be no recurrence of this over- signt in the preparation of the 1955 highway map, was read and ordered filed. Letter Re: Resolution Requesting That St. Louis Park be Placed on the Official Road Map of Minnesota - M. J. Hoffmann, Commissioner Letter from M. J. Hoffman, Commissioner of Highways, dated August 3, 1954, in response to our letter dated July 30, 1954, requesting that St. Louis Park be placed on the official road map of Minnesota, and stating that since St. Louis Park is the fourth largest municipality in the state, they certainly will see to it that some rearrangement is devised which will enable us to indicate by name the location of St. Louis Park on the general map as well as on the insert, was read and ordered filed. 382 August 9, 1954 Flag Avenue Water Project A group of persons appeared regarding the Flag Avenue Water Project. Mayor Fernstrom explained the method proposed to be used in financing the 12 inch main to run on Flag Avenue from Club Road to Franklin, Franklin avenue west to Hillsboro Avenue, Hillsboro Avenue north to 16th Street, 16th Street west to Highway No. 18, Highway No. 18 north 800 feet from 16th Street. He also explained his conference with the Fire Underwriters regarding fire insurance rating is the water is installed, stating that they had suggested Class 6. Trustee Bolmgren explained the route to be taken by the 12 inch water main. After considerable discussion, Mr. C. A. Pratt complimented the Council on their patience in handling this matter. He asked about the prospects of getting sewer in the Crestwood area. Trustee Bolmgren explained the sewer setup and re- marked that it may be five years or more as all of this area will have to come via Tyrol Hills area, etc. Mr. Pratt asked if interest would accrue on the deferred payments. He was assured that interest would have to be collected to pay interest on bonds as paid by the Village. A representative from the Golf Club said that the Golf Club appreciated very much the Councils efforts in this water matter. On motion-of Trustee Bolmgren, seconded by Trustee Middleton, September 7, 1954 was set as date for hearing on above proposed water main with bids to be taken the same date, and the Village Attorney was instructed to prepare a resolution therefore, by unanimous vote of all Members of the Council present. Minutes The minutes of meetings held July 19 and 26, August 2, 1954, were read. On motion of-Trustee Jorvig, seconded by Trustee Middleton, the minutes of meetings held July 19 and 26, August 2, 1954 were approved as read, by unanimous vote of all Members of the Council present.
