Fernstrom at 8:00 P. M. Invocation was given by Reverend Bennett Brudevold of Aldersgate Methodist Church. No persons appeared in opposition. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following resolution was adopted by the unanimous vote .of all Members of the Council: RESOLUTION ORDERING CURB AND GUTTER CONSTRUCTION WHEREAS the Village Council has met at .the time and place specified in the notice published in the St.. Mr. Peterson of Aquila Avenue said he did not think Improvement No. 276 had been done. Village Assessor, R. B. Connery said that the work had been done. Mr. Walter IAnderson, 1600 Louisiana Avenue asked if Improvement No. 53-89 is to lie assessed to adjacent property. R. B. Connery said that it s. He asked if any other improvements have been ordered. He was told that no doubt a tar job would be ordered for next year, after the settling of water ditch. Assessment Hearings on Curb and Gutter, Water Main and Sanitary Sewer - 53-111, Etc. Separate hearings were had on each of the proposed assessments described in the following resolution. No persons appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council: ASSESSMENT RESOLUTION WHEREAS the Village Council has met at the time and place specified in the notices of assessment published in the St. Louis Park Dispatch July 15 and July 29, 1954, stating the general nature of the following improvements and the area proposed to be assessed, and has heard and passed upon all objections to the proposed assess- ments, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the proposed assessments on file in the office of the Village Clerk, covering the cost of the following described improvements, be hereby adopted as special assess- ments against the lands named in said assessment rolls and there be hereby levied against each of the respective tracts and parcels of land described therein the respective assessment in the respective amounts therein set forth, and said respective tracts and parcels of land are hereby found to be benefited in the sum equal to the said respective assessments hereby levied. Said assessments shall be payable in equal annual installments extending over the periods hereinafter respectively specified, the first of which shall be payable on the first Monday in January, 1955, with interest at 5% per annum; and to the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1954, and to each subsequent installment shall be added interest for one year. Mc Grath Mr. C. H. Mc Grath, 3540 Texas Avenue appeared. Said he learned this morning that they were getting curb and gutter, as the Contractor was there. Said they knew nothing about it. Said he did not know about the Dispatch and the official notices published therein. Asked why post cards are not sent to each lot owner. He asked the Council to take this job out of the contract. Trustee Bolmgren said that Texas Avenue should have curb and gutter so that a good black top can be put in. There didn't seem to be any disposition to change the resolution ordering the work. Trustee Bolmgren said he feels that the work should go on as ordered. Trustee Middleton said he feels that the work should go on. Trustee Jorvig said that if our procedure is changed in this case, others would ask for the same, and our improvement ' work would end up in chaos, and he doesn't see how we could change the order for curb and gutter on this street now. No action was taken. Request for Rezoning On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of Jerry Holt for owner of property, for rezoning Lots 3 and 4, Block 1, Hankes Mini- kanda Terrace from Residential Use to Commercial Use, was referred to the Planning Commission f6r checking and recommendation, by unanimous vote of all Members of the Council present. Licenses On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following applications for 1954 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1954, by unanimous vote of all Members of the Council present: Standard Oil Company of Indiana Gas Station 4 Pumps Robert E. Re: Grading of Blackstone, 'North of Lake , On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of Paul Auer and others for the grading of Blackstone Avenue from the North Line of Lot 15, Block 5, Del Monte Heights to the North Line of Lot 17, Block 2, Del Monte Heights; also an alternate for grading Blackstone Avenue from the North Line of Lot 15, Block 5, Del Monte 'Heights to 32nd Street, and 32nd Street from Alabama Avenue to Blackstone Avenue, were referred to Village 'Engineer, Phil W. Smith for estimated cost of each project, and to the Assessment Clerk, R. B. Application for Permit to Erect Sign - Brede On motion of Trustee Bolmgren, seconded by Trustee Middleton, the application of Brede,.Incorporated, dated August 11, 1954, for a permit to erect an advertising sign on the roof of building at 5825 Excelsior Boulevard for St. Louis Park Lumber Company, was -approved, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Application for Permit to Erect Two Signs - Nordquist On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application of Nordquist Sigri Company, dated August 10, 1954,- for permit to erect two advertising signs on the ground in front of Eberhard Company's Office at 3939 Excelsior Boulevard, as now located, was denied by unanimous vote of all Members of the Council. Application for Permit to Erect Sign - Nordquist On motion of Trustee Middleton, seconded by Trustee Jorvig, the application of Nordquist Sign Company, dated August 13, 1954, for a permit to erect an advertis- ing sign on roof of building at 7123 Cedar Lake Road for Micheles Beauty Salon, was read, and approved, and the Building Inspector was authorized to issue same, by unanimous vote of all Members of the Council. Advertise for Bids for Electric Motor for Pump As recommended by Water Superintendent, Ira M. Vraalstad, it was moved by Trustee Bolmgren, seconded by Trustee Jorvig, that the Clerk be instructed to advertise for bids for the furnishing of One (1) 75 HP, 1800 RPM, 200/440 Volt, 180/90 ampere, 40 degrees C, type SC "F" with a #445 frame and lubriflush ball bearings, complete with a magic grip four rubber bushing coupling, to be received on September 20, 1954, by unanimous vote of all Members of the Council. August 16, 1954 389 Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION CANCELING 51-251 SANITARY SEWER #500 AND LIFT STATION 1#6 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 15, 1952, levying assessments for 51-251 Sanitary Sewer ##500 and Lift Station #6, the following lot was inadvertantly assessed for the above improvement, from which it receives no benefit; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the 1953 and 1954 installments of such assessment heretofore paid in the respective amounts set forth below be refunded to the respective property owner, and, upon receipt of a signed verified claim and the paid tax statements, that the Mayor and Clerk be hereby authorized to issue warrants in payment of such refund to the res- pective property owner. BE IT FURTHM RESOLVED that the assessment for years 1955 thru 1962 heretofore levied against the following property be canceled, and that the Auditor and .the Treasurer of Hennepin County be hereby authorized to cancel the same upon their res- pective records. OLT 87412, with Cal Scholtz, 4621 Eyring Avenue South, Minneapolis, as insured, and Anchor Casualty Company, as insuror, covering 11 bus benches located at various locations in the Village, effective July 5, 1954, to expire July 5, 1955. Letter Re: Refund of Sewer Assessment E. M. Smith Letter from E. M. Smith, 5511 Vermont Street, dated August 12, 1954, request- ing a refund of assessment paid for sanitary sewer in the amount of $122.40 which was paid, on Lot 1, Block 1, Birchwoods Addition, due to there being no sanitary sewer in the street, was read.- On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing matter was referred to the Village Assessment Clerk, R. B. Connery for checking and report, by unanimous vote of all Members of the Council. Refund for Special Assessments Paid - J. P. Riedel Company On recommendation of R. B. Connery, Assessment Clerk, it was moved by Trustee Bolmgren, seconded by Trustee Middleton, the request of J. P. Riedel Company for a refund of special assessments paid in advance for sanitary sewer in the East 7' of Lot 6, and all of Lot 5, Block 3, Manhattan Park, in the amount of $288.00, was approved, and the Mayor and Clerk were authorized to issue warrant covering same, by unanimous vote of all Members of the Council.
