REGULAR MEETING JULY 6, 1954
A regular meeting of the Village- Council was called to order by Mayor R. C.
Fernstrom at 8:07 P. M.
Invocation was given by Reverend George L. Lundquist of Prince of Peace Luthern
Church.
The following Council Members were present at roll call:

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following

Preliminary Plat - Cedar Knoll Manor Third Addition
On motion of Trustee Middleton, seconded by Trustee Jorvig, the preliminary plat
of Cedar Knoll Manor Third Addition presented by Ecklund and Swedlund Contruction Co.
was referred to the Planning Commission for checking and recommendation, by unanimous
vote of all Members of the Council present.
Complaint Re: Property at 3256 Webster Avenue
Mr. and Mrs. Wm. Newstrom and Mr. and Mrs. Clarence Peterson from the 3200 Block
on Webster Avenue appeared, complaining about the disreputable homesite of the Butter's
property at 3256 Webster Avenue. The place has been vacant for two years. There is
much rubbish and tall weeds, and there was a fire last year which threatened the
neighbors property, having started to burn the neighbors fence. On motion of Trustee
Jorvig, seconded by Trustee Middleton, the foregoing matter was referred to the Village
Attorney, Fire Chief, Building Inspector and Health Officer for checking and report on
July 12, 1954, by unanimous vote of all Members of the Council present.

Bingo - St. Louis Park Volunteer Firemen's Carnival
Letter from J. A. Werner, Co-Chairman, St. Louis Park Volunteer Firemen's
Carnival Committee, dated June 22, 1954s requesting permission to operate a Bingo
Game at their annual carnival to be held July 28, 29, and 30, 1954 at Firemen's
Park-, Wooddale Avenue at 37th Street, was read. There was no opposition. No action
taken.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
applications for 1954 licenses were approved, and the Mayor and Clerk were author-
ized to issue licenses to expire December 31, 1954, by unanimous vote of all Members
of the Council present:

Petition for Sanitary Sewer
.On motion of Trustee Middleton', seconded by Clerk Justad, the following petition
was referred to the Village Engineer, Chairman of the Sewer Department Committee, and
Special Assessment Department for checking and recommendation, by unanimous vote of all
Members of the Council present:
P-1472 PETITION FOR SANITARY SEWER, signed by Victor S.
Goldsteen and others,, dated June 21, 1954, for the
construction of sanitary sewer in West 28th Street
from Ottawa Avenue to Princeton Avenue.
Petition for Street Improvements
,On motion of Trustee Middleton, seconded .by Clerk Justad, the following petition
was referred to the Village Engineer, Chairman of the Street Department Committee, and
Special Assessment Department for checking and recommendation, by unanimous vote of
all Members of the Council present:
P-1473 PETITION FOR CURB AND GUTTER, signed by Thomas J.
Lyons, 3389 Sumter Avenue and others, dated July
6, 1954, for the construction of curb and gutter on
the EAST SIDE OF ,SUMTER AVENUE FROM 33RD STREET TO

Gas Main Extensions
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following gas
main extensions were approved by unanimous vote of all Members of the Council present:

Application for Permit to Erect Sign - Shell Oil Company
On motion of Trustee Middleton, seconded by Trustee Jorvig, action on the
application of Shell Oil Company, dated June 29, 1954, for a permit to erect an ad-
vertising sign at 3920 West Lake Street (Glenhurst & Lake) was deferred to July 12,
1954 to give the Company an opportunity to consider another location for the sign,
by unanimous vote of all Members of the Council present.
Petition to Vacate Street - Haws Realty Company
Letter from Haws Realty Company, dated June 29, 1954, petitioning the Village
Council to vacate Colorado Avenue between 36th Street and the Minneapolis and St..
Louis Railroad R/W, was read. On motion of Trustee Jorvig, seconded by Trustee
Middleton, the foregoing petition was referred to the Planning Commission for check-
ing and recommendation, by unanimous vote of all Members of the Council present.
Bid Award - Sewer and Ydater Connections, Gate Valves
On motion of Trustee Middleton, seconded by Trustee Jorvig, the bid of Northern
Contracting, Incorporated, received June' 28, 1954, for the construction of sanitary
sewer and water main service connections, and gate valves (Improvements #54-17 and
54-24), was determined to be the lowest bid of a responsible bidder, and the Mayor
and Clerk were authorized to execute contract for the Village with the Bidder for the
work in the amount bid of $26,866.50, by unanimous vote of all Members of the Council
present.
Partial Payment on Contract Work
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
partial payment on contract work in progress, presented by Village Engineer, Phil W.
Smith, was approved, and the Mayor and Clerk were authorized to issue warrants cover-
ing same, by unanimous vote of all Members of the Council present:

Special Permit for Water Line - For Knollwood Plaza Construction
On motion of Trustee Jorvig, seconded by Trustee Middleton, a Special Permit
was granted to Alexander & Kingbay Company to lay a temporary water line from the
hydrant at the Northwest corner of Wyoming Avenue and West 36th Street South to their
construction of Knollwood Plaza for a, water supply during this construction work.
It is hereby understood that the Water Department will meter the water used and Alex-
ander & Kingbay Company will pay the Water Rental Rate of 20¢ per 100 cubic feet as
specified in Ordinance. Motion was passed by unanimous vote of all Members of the
Council present.
Village Engineer's Report on Block 4, Cedarwood Addition
Village Engineer, Phil W. Smith's report dated July 1, 1954, stating that the
Village did not use Block 4, .Cedarwood Addition for sewage lift station, and same can
be sold if so desired, was read.
Resolution
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following reso-
lution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION AUTHORIZING CONVEYANCE OF VILLAGE PROPERTY
WHEREAS it appears that Block 4, Cedarwood Addition was conveyed to the Village
at no cost for use as a park or sewer lift station by deed dated October 26, 1950,
and the Village will have no use for said property for either of said purposes, and
David Ackerberg, owner of adjoining property has offered to purchase said property,
and j400.00 is hereby determined to be the reasonable fair market value of said tract,
therefore
BE IT RESOLVED that the Mayor and Clerk be hereby authorized to execute convey-
ance of the Village title to Block 4, Cedarwood Addition in behalf of the Village to
David Ackerberg for the sum of $400.00.
Bid Award for Plate Cutter
On motion of Trustee Jorvig, seconded by Trustee Middleton, the bid of Addresso-
graph-Multigraph Corporation, received May 10, 1954, for the furnishing of One (1)
Graphotype, Model 6381 Plate Cutter to cut style " 10" metal address plates, was de-
termined to be the lowest bid of a responsible bidder, and the Clerk was authorized
to issue a purchase order for same in the amount of the bid which is $12415.002 by
unanimous vote of all Members of the Council present.

VillageEngineer's Report on Cost of Fence Around Drainage Pond
Village Engineer, Phil W. Smith reported that his estimated cost of a four-
foot high fence around the drainage pond between Nevada Avenue and Maryland Avenue
just north of Minnetonka Boulevard is $950.00, including a ten foot wide gate for
trucks. On motion of Trustee Jorvig, seconded by Trustee Middleton, the Clerk
was authorized to advertise for bids for construction of a wire fence around the
drainage pond between Nevada and Maryland Avenues just north of Minnetonka Boule-
vard as per specifications prepared by the Village Engineer for same; bids to be
opened August 2, 1954, by unanimous vote of all Members of the Council present.
Advertise for Bids for Accounting Machines
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was
authorized to advertise for bids for the furnishing of two electrically operated
accounting machines for utility billing, general municipal accounting, current
appropriations balances, payroll, etc., bids to be opened August 2, 1954, by unanimous
vote of all Members of the Council present.
Letter Re: Salary Increases, Sick Leave, and Classification - SLP Assn. of Fire Fighters
Letter from Willard J. Mirphy, Secretary-Treasurer, St. Louis Park Association
of Fire Fighters, dated June 28, 1954, concerning a salary increase of $30.00 per
month for all Firemen, classification and $15.00 increase per month for six drivers,
and, and 20 days sick leave immediately after the six-month probationary period for
new Firemen, was read. On motion of Trustee Jorvig, seconded by Trustee Middleton,
the Clerk was instructed to acknowledge letter and state that a meeting for cons-
ideration of requests will be set sometime in the future and notification of same
-will be given to the st. Louis Park Association of Fire Fighters, by unanimous vote
of all Members of the Council present.
Change Order No. 1 - Municipal Incinerator
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was
authorized to sign for the Village, Change Order No. 1, Contract with Pittsburgh Des
Moines Steel Company for Municipal Incinerator, in the amount of $318.13 to cover
installation of pressure reducing valve in the gas burner piping and extend the ash
hopper drain piping down to the ash tunnel floor, by unanimous vote of all Members
of the Council present.
Change Order No. 3 - Municipal -Incinerator Building
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Clerk was
authorized to sign for the Village, Change Order No. 3,, Contract with Knutson Cons-
truction Company for Municipal Incinerator Building, in the amount of $297.16, to
cover the furnishing and installing of gas burner wiring and relocatd the compressor
from the steel post to the wall, by unanimous vote of all Members of the Council
present.
Village Engineer's Report on Proposed Widening of Joppa between Excelsior
Boulevard and the South Property Line of West 37th Street
The Village Engineer, Phil W. Smith's report on the estimated cost of proposed
widening of Joppa Avenue between Excelsior Boulevard and the South property line of
West 37th Street, in the amount of $1,641.74, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, July 26, 1954 was
set as date of hearing on proposed widening of Joppa Avenue between Excelsior Boule-
vard and West 37th Street; the estimated cost is determined to be $1,641.74, and
the area proposed to be assessed is the adjacent property. Motion was passed by
unanimous vote of all Members of the Council present.
Hearing on Refund Proceeding in the Eighth Circuit Court of Appeals
Letter from Kenneth B. Lucas, Vice President in Charge of Suburban Division,
Minneapolis Gas Company, dated June 29, 1954, informing the Village Council that a
hearing, or oral argument before the court on the various issues involved will take
place at Omaha, Nebraska, in the Federal Court Building, commencing at 10 A. M.,
July 13, 1954, was read and ordered filed.
Hennepin County Safety Award Luncheon Announcement
Announcement of Board of Hennepin County Commissioners of the Hennepin County
Safety Award Luncheon to be held July 14, 1954, at Mc Carthy's Cafe, 5600 Wayzata
Boulevard at 12:00 Noon, was read and ordered filed.
Notice of Special Revenue Committee Meeting
Notice of Large City Special Revenue Committee Meeting to be held at Austin,
Minnesota, July 10, 1954, was read. On motion of Trustee Jorvig, seconded by
Trustee Middleton, the Village Attorney and any Member of the Village Council were
authorized to attend the Large City Special Revenue Committee to be held at Austin,
Minnesota, July 10, 1954, at the Fox Hotel, with necessary expenses paid, by unanimous
vote of all Members of the Council present.

Resolution
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION CANCELING SANITARY SEWER ASSESSMENT
WHEREAS, on or about January 7, 1954, supplementary assessment for Sanitary
Sewer Lift Station #51-246, providing for assessments against Lots in Cedarwood
2nd Addition was inadvertently forwarded to the County Auditor prior to hearing and
Council resolution; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
assessments contained in the list set forth below be hereby canceled, and the
Auditor and Treasurer of Hennepin County hereby authorized and requested to cancel
the same upon their respective records.

Building Inspector's report for week ending July 2, 1954, showing that twelve
building permits were issued, totaling $77,200.00, was read and ordered filed.

Request to Use Village Property for VFW Carnival & Play_ Bingo
Letter from Del Belden, VFW Commander, dated June 24, 1954, requesting their
use of property owned by the Village, located West of Highway No. 100, just south
of the VFW Clubhouse for their annual carnival to be held July 16 thru 22nd, 1954;
also requesting permission to run an outdoor bingo game on the same dates, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, permission was
granted to VFW Post #5632, St. Louis Park, to use Village property located West of
Highway No. 100, just south of the VFW Clubhouse for their annual Carnival, subject
to filing not less than 20 days before the opening of the Carnival and approved _
certificate of liability, noting the Village of St. Louis Park as additional assured
in amounts of $25,000 for injury, $50,000 for one accident, and $25,000 for property
damage; the original policy and certificate to be furnished the Village Attorney
for approval more than twenty days before the Carnival opens. Motion was was -passed
by unanimous vote of all Members of the Council present.
With regard to request to play Bingo at above mentioned Carnival. No objections
were raised. No action taken.
