REGULAR MEETING JULY 12, 1954
-A regular meeting of the Village Council was called to order by Mayor Fernstrom
at 8:28 P. M.
Invocation was given by Reverend M. Lyle Halverson of First English Luthern
Church,

- On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above bid was
referred to the Village Engineer and Chairman- of the Street Department Committee for

Pursuant to notice published in, thp St.. Louis Park Dispatch July 1 and 8,
separate hearings were had on the proposed public improvements described in the follow-
ing resolution. No one appeared in opposition.

The following persons appeared: Mayor Fenn§trom explained the area and zoning in
question to those present. Attorney Herbert Davis was called on for the opposition.

Mr. Davis asked Mr. Ruedlinger if any plans have been made for the warehouse, and when i
it will be built. Mr. Ruedlinger that plans have been made to build this year to be
finished in 1955• Q. will you run it yourself? A. yes. Q. What type of warehouse -
distribution or storage? A. Storage. Q. Have you decided on the heighth of the
building? A. Basement and one floor. Q. Have you approached anyone at Knollwood
Plaza regarding storage in this building? A. No. Q.Where will you get space takers?
A. Anywhere they have the materials we wish to store. Q. What about the construction?
A. It will be fireproof. Q. What will the trucking traffic be? A. Very small. The
building will be small. Q. What part of the building will you use for the Nursery?
A. About one-half. Q. Do you intend to run the warehouse? A. yes. Q. How high will
it be? A. Basement below grade, and first story about 18 feet. Q. Will the entrance
be on the south side of the building? A. Yes. South side for trucks, and West for
Railroad spur. Q. Do you plan to use 35th Street for entrance to the warehouse?
A. No. Q. Has there been any plan for employee parking, etc? A. Yes. Along the
south side of the building. Q. Is the materials to be stored to be hard goods; that
is materials not needing refrigeration? A. Hard goods. Q. On what floor will your
trackage be? A. First floor. (not basement). Q. Are you going to use the present
spur track? A. Yes. Q. Will 35th Street have an entrance for receiving materials?
A. No. Mrs. Jerome Smith asked? How many more trains will be run on this track due
to this warehouse? A. None, we, feel. Mr. Davis continued - Q. What setup will you
have on the West Side of the building. A. Room for three cars on the siding. Q.
How do we know that you will not extend north of 35th Street? A. A new petition
will have to`be placed which calls for a hearing. Q. Do you plan to sell the resi-
dential and multiple dwelling property now? A. No. If a good offer came in we might
sell, although we would like to use same for nursery stock. Q. Have you any plans
for a Medical Center? A, No, but we have been approached. Q. Will there by any nursery
stock land used after this project is finished? A. No. Mrs. Westling asked - What
can stop you from building twelve stories? A. Zoning. The Height District is 2-
stories. Q. is the permit transferable? A. No. Q. If this zoning is made, is the
permit issued to a person, or with property? A. With property. Q. Is there any -
permit needed to operate the warehouse? A. No. Q. If someone else buys the property,
can they operate without a new permit? A. Yes. Q. If you can't build higher, how
about spreading it out? A. Lack of land. There is only 200' by 200' west of Boone
extended, and south of 35th Street. Q. If a medical center is built, will it be a
hospital. A. No. Just offices and clinic. Mrs. Jerome Smith asked how many years
have you lived in St. Louis Park? A. Since 1911. Q. How close to your house is the
trackage. A. About 200 feet. Mrs. Jerome Smith said "if this warehouse is built,
then the Council will let industry into the gravel pit, which would increase the-
number of trains on the spur track, etc. Mayor Fernstrom said that that is not
probable. Mr. Smith asked who is on the Planning Commission - is Ruedlinger? the
answer was yes. Trustee Middleton said that Mr. Ruedlinger was asked to leave the
room when his project was discussed, and explained his stand. Someone in the group
said we are not against this so much, but are afraid that this will only open up
similar projects in the gravel pit. Q. Will there be more trains on the track? -
A. Not to supply this size of warehouse. Mr. Davis continued - Q. Has anyone checked
with experts in warehousing as to whether it would increase train traffic? A. no.
Q. Would this project bring in more taxes th4n homes? Trustee Middleton said yes.
Q. How much more taxes? A. It is not possible to answer without more information as
to number of lots and homes that could be built on same property. Mr. Davis spoke
about tax revenue from this project; also the Moody rating. Mayor Fernstrom explained
this, and told about our interest rate. Q. Are you going to rent to one firm, or
more? A. Several. Mr. Davis read a letter from Dewey Newcomb Appraisals, dated
July 1-2, 1954, stating their opinion on the devaluation of property in the immediate
area due to the building of proposed warehouse. He also read a letter to Mark A.
Dalquist, 8724 West 35th Street from I. S. Shattuck, Planning and Traffic Consultant,
dated July 12, 1954 in which he commented at length regarding the adverse affect this
building would have on the neighboring homes, and it is certain that additional
conflicts between residential expansion and business and industrial development in
and around the same area as well as elsewhere in the Village, Etc. Mr. Davis told
of a conversation he and others had with a warehouse man who was unable to be present
at this meeting due to a death in his family -- 1. Knollwood Plaza will not need
warehouse space. 2. So it will call for disbributors who would do a lot of trucking,
etc. to take care of goods stored. There is no shortage of warehouse space in
Minneapolis. 3. A Warehouse of the size contemplated will take lots of cash --
Much more than the money invested in a Minneapolis storage warehousem and there is a
feeling that this project could not pay out. The only folks who could use this type
of warehouse would be The May Company, etc. who distribute much goods. Mr. Davis
urged strongly for the organization he represents, and for the folks in the near
area, that the Council study this matter carefully and deny the request of Ruedlingers.
Mr. Ruedlinger was asked what he was digging on his property today? He said we were
not. That digging was being done'by the Railroad on their property. Mrs. Westling
said that a warehouse built here would start juvenille delinquency -- another ware-
house to bring rats. Q. What did the Planning Commission's consultant say about
this? (he refers to Mr. Law). A. Mr. Law was only working in the Northside District
for the Village and was not consulted regarding this matter. Q. who will stop all

the trucks going thru this area that will be needed to serve the warehouse.? Who
controls Aquila Avenue along side of Knollwood Plaza? A. It is the understanding
that this street will be deeded to the Village and will be under Council control.
Q. Is tax revenue an issue in this matter? A. It will bring in more than if homes
were built on this property. Ken Wolfe asked how many folks in the room tonight
live within two blocks of this proposed warehouse? Public answered -- people
two miles away are interested - all along the railroad track are interested. A
show of hands of those living within three blocks - there was quite a number. Mr.
Ruedlinger was asked about his plans. He stated that they have no definite plans,
and have approached nobody. Q. After they check all this information and decide
not to build, what will stop them from selling the commercially zoned property to
someone else. Mayor Fernstrom said if there is anything else new, we want every-
body to be heard. Someone said that this project will blight the area and will
be dangerous to children. Trustee Bolmgren spoke in general about petitions being
from too wide an area; also Mr. Davis' talk opened up other questions, and he would
like to study this matter further. 1. Get more information from Ruedlingers as to
costs, etc. 2. Get figures as to tax revenue possible. 3. Council cannot always
do things that please everybody. 4. Mentioned the opposition we have had on other
projects such As Miracle Mile and Knollwood Plaza. Letters in opposition to this
proposed warehouse were received from Jay W. Wilson, 3432 Zinran Avenue, Charles
E. Wilson, 3432 Zinran Avenue, and Phyllis A. Strand (no address given), all dated
July 12, 1954, were read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above
matter was referred to the Committee of the Whole for further study and a report
on July 26, 1954, by unanimous vote of all Members of the Council present.
Planning Commission's Report on Application for Permit to Erect Sign - General
Planning Commission's report dated July 72 1954, on the application of General
Outdoor Advertising Company for a permit to erect an advertising sign on property
located at 4920 Excelsior Boulevard, was read. On motion of Trustee Middleton, sec-
onded by Trustee Jorvig, the application of General Outdoor Advertising Company for
a permit to erect an advertising sign at 4920 Excelsior Boulevard was approved as
recommended by the Planning Commission, and the Building Inspector was authorized
to issue permit for same by the following roll call vote: Trustee Bolmgren, nay;
Trustee Jorvig, yea; Trustee Middleton, yea; Clerk Justad, yea; and Mayor Fernstrom,
yea.
Application for Permit to Erect Sign - Western Outdoor
On motion of Trustee Jorvig, seconded by Trustee Middleton, the application
of Western Outdoor Advertising Company for a permit to erect an advertising sign at
4306 Excelsior Boulevard for Chas. M. Busch Co. was approved, and the Building
Inspector was authorized to issue same, by unanimous vote of all Members of the Coun-
cil present.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the application
of Western Outdoor Advertising Company for a permit to erect 2 of advertising sign
for Acme Stone Company at 3200 France Avenue (the other 2 of sign is in Minneapolis)
was approved and the Building Inspector was authorized to issue permit for same by
unanimous vote of all Members of the Council present.
Application for Permit to Erect Sign - Naegele
On motion of Trustee Jorvig, seconded by Trustee Middleton, the application
of Naegele Advertising Company, dated July 8, 1954, for a permit to erect an adver-
tising sign at 6418 West Lake Street for Park Super Valu Food Store was referred to
the Planning Commission for checking and recommendation, by unanimous vote of all
Members of the Council present.
Planning Commission's Report on Request for Permit to Build Gas Station - Giller
Planning Commission's report dated July 7, 1954, on the request of Giller
Drug Company for a permit to build a gas station on Lots 11 and 12, Block 3, Sunset
Gables Second Addition, was read. It was moved by Trustee Bolmgren, that the request
of Giller Drug Company for a permit to build a gas service station on Lots 12 and 13,
Sunset Gables Second Addition be granted. Motion lost for lack of a second.
On motion of Trustee Middleton, seconded by Trustee Jorvig, that the above
matter be reconsidered was approved by unanimous vote of all Members of the Council.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the request of
Giller Drug Company for a permit to build a gas Station on Lots 12 and 13, Sunset
Gables Second Addition was approved, and the Building Inspector was authorized to
issue same, by unanimous vote of all Members of the Council.

Resolution
On tion of Trustee Bolmgren, seconded by Trustee Middleton, the following '
resolutions were adopted by the unanimous vote of all Members of the Council
present:
R E S' 0 L U T I O N
DIRECTING PURCHASE OF PROPERTY FOR OPENING EXTENSION OF
CEDAR LAKE ROAD
WHEREAS, the Village Council did under date of August 17, 1953, order the
acquisition of property for the extension of Cedar Lake-Road from the East line of
Township 30, Section 29, Range 24, to the intersection of the existing Cedar Lake
Road with the right of way of the Great Northern Railway, and
WHEREAS, it appears that the necessary right-of-way for said street extension
consists of two tracts of land in two separate ownerships, which are hereinafter
more particularly described, and that the Mayor has negotiated for purchase of each
of said tracts by the Village and as the result of said negotiations recommends the
purchase of the following tract owned by David Klatke and others for the sum of
$5,000.00, .and the tract owned by A. C. Kavli for the sum of $3,600.00, plus con-
veyance to A. C. Kavli of that tract consisting of approximately one acre hereinafter
described which constitutes a part of the tract purchased from said David Klatke,
and it appearing to the Council that said offers to sell said tracts to the Village
are fair and reasonable, therefore
BE IT RESOLVED by the Village Council of St. Louis Park that the following
described premises be purchased by the Village for right-of-way for extension of Cedar
Lake Road at the prices hereinafter specified:
The following tract, owned by David Klatke and others, for the sum of $5,000.00:
That part of the South j of the Southeast 1 of Section
30, Township 29, Range 24, described as follows: Begin-
ning at the point of intersection of the Northwesterly
line of the right of way of the Great Northern Railway
Company with the Northeasterly line of County Road No.
16 (also known as Cedar Lake Road); thence Northeasterly
along the Northwesterly line of said Great Northern
Railway Company right-of-way a distance of 872 feet;
thence at right angles Northwesterly a distance of 190
feet; thence Southwesterly parallel with the Northwesterly
line of said Railroad right-of-way a distance of 793.08
feet; thence Northwesterly making an angle of 72 degrees
47 feet to the right from said last described course, a
distance of 162.4 feet; thence Westerly making an angle of
56 degrees to the left from said last described course a
distance of 174.9 feet; thence at a right angle Southerly 169.18
feet to a point in the Northerly line of said County Road No.
16; thence Easterly and Southeasterly along the Northerly and
Northeasterly line of said road 293.68 feet to the point of be-
ginning.
The following tract owned by A. C. Kavli for the sum of $32600.00:
All that part of the Southeast Quarter of the Southeast
Quarter of Section 30, Township 292 Range 24, described as
follows: Commencing at the intersection of the Easterly
line of existing Cedar Lake Road which has a 66 foot R/W and
the Northerly right-of-way line of- Great Northern Railroad;
thence Northeasterly along the Northerly line of said rail-

owners of said tracts to be purchased by the Village upon certificate of the Village
Attorney that the persons to whom payment is to be respectively made are the owners

Petition for Sign Removal
Petition signed by E. M. Wiegert, 2955 Jordan Avenue and others, asking for
removal of advertising sign on the corner of Jordan Avenue and Minnetonka Boulevard,
was read. On motion of Trustee Jorvig, seconded by Trustee Middleton, the General
Outdoor Advertising Company was requested to remove their sign located on the north-
east Corner of Jordan Avenue and Minnetonka Boulevard within sixty days from this
date, by unanimous vote of all Members of the Council.
Petition for Discontinuance of Woodworking Shop
Petition signed by M. E. Lundquist, 9210 Minnetonka Boulevard and others,
asking for the discontinuance of of woodworking shop at 9445 Minnetonka Boulevard,
was read. Owner says that he works alone making cabinets to sell at retail in
the building. He says his principal business is to sell cabinets, etc. as he makes
them. He says he makes only small items and purchases and sells other makers'
cabinets. Village Attorney, E. T. Montgomery explained the Zoning Ordinance, quot-
ing 6-1-32. Mr. Peterson said the Building Inspector has already told the man
that he was operating in Violation of the Zoning Ordinance. Village Attorney, E. T.
Montgomery said at this point there is no evidence of the violation as he has not
started work. Trustee Jorvig said that the Building Inspector is supposed to
enforce the Zoning Ordinance, and he should advise the owner what the ordinance re-
quires. He was told to be sure he stays within the ruling of 6-1-32 of the Zoning
ordinance.
Memorandum Re: Disapproval of trend Toward Commercial & Industrial Encroachment
Memorandum signed by Elsie Wiegert, 2955 Jordan Avenue and others, expressing
their disapproval of the growing trend in the Village toward Commercial and Indus-
trial encroachment on Residential property; also stating that there are sufficient
areas presently designated as Commercial or Industrial to adequately serve the
Village, and that it is their wish that areas"zoned Residential should remain that
way, and that undeveloped areas should be directed toward Residential or Public Park
usage, was read. No action taken.
Permission to Place Buried Cable -NW Bell Telephorre Co.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Northwestern
Bell Telephone Company was granted permission to place buried cable in the Alley
at West Lake Street and Dakota Avenue, by unanimous vote of all Members of the Coun-
cil present.

Village Engineer's report dated June 25, 1954, on the petition of Mannie

moved to cover their parkway and left a strip of from two to three feet between
their lots and the sidewalk at the time Minnetonka Boulevard was paved, and request-
ing that parkways adjacent to their property be replaced, was read. It was moved
by Trustee Jorvig, seconded by Trustee Bolmgren, that no further action be taken,

Planning Commission's Report on Ruling on Setbacks - E. W. Lindvall
Planning Commission's report dated July 7, 1954, on the request of E. W.
Lindvall for a ruling on setbacks for a commercial building and residence on Lots
233 and 234, Richmond Addition, was read. On motion of Trustee Middleton, seconded
by Trustee Jorvig, the request of E. W. Lindvall to build a combination home and
store building on commercially zoned property on the corner of Jersey Avenue and
Wayzata Boulevard (Lots 233 and 234, Richmond Addition) was approved according to
the Planning Commission's recommendation, with a 15 foot setback from Jersey Avenue
and a 20 foot setback from Wayzata Boulevard, and the Building Inspector was
authorized to issue building permit for same, by unanimous vote of all Members of
the Council.
Planning Commission's Report on Application for Permit to Build Office Building
Planning Commission's report dated July 7, 1954, on the.application of Jerry
Holt to build an office building on Lots 3 and 4. Block 1, Hankes Minikanda Terrace,
was read. On motion of Trustee Middleton, seconded by Trustee Jorvig,, action on
application of Jerry Holt for a permit to build an office building on Lots 3 and 4,
Hankes Minikanda Terrace was deferred until such time as Mr. Holt presents a proper
application and plans for same, which have been approved by the Planning Commission
by unanimous vote of all Members of the Council.
Planning Commission's Report on Deeds for Street - Richard Beauman
Planning Commission's report dated June 2, 1954 on the request of Richard
Beauman, 8440 West 35th Street for approval of deeds to the Village for 30 feet for
half of Yukon Avenue as proposed, and 30 feet for half of Xylon Avenue as proposed,
part of his proberty, for street purposes, was read. The.Village Engineer reported
that he is in accord with Mr. Beauman's request for approval of deeds for afore-
mentioned property for street purposes as well as the deed for 35th Street, all of
which could be handled with one transaction. On motion of Trustee Bolmgren, seconded
by Trustee Middleton, the above matter was referred to the Village Attorney to try
to work out the plan suggested by the Village Engineer, by unanimous vote of all
Members of the Council.

Letter Re: Residue from Incinerator for Dump Fill - Belt Line Pay Dump
Letter from Ernest Jacobsen of Belt Line Pay Dump, dated July 92 1954, was
read, explaining that the residue from the Village Incinerator which they have
been accepting free for top fill for their dump is not desirable as it gives off
a strong offensive odor and in order to eliminate this odor it is necessary for
them to work this in with their other fill and cover it over at once with dirt.
This entails considerable expense and they are asking to be paid $75.00 per month,
effective June 1, 1954, to cover the cost of this, pending such time as when this
odor can be eliminated, at which time they will be glad to accept the fill free.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the foregoing offer
of $75.00 per month was accepted, retroactive to June.l, 1954, by unanimous vote of
all Members of the Council.

Planning Commission's report, dated July 7, 1954s on the petition of Haws
Realty Company for the vacation of Colorado Avenue between 36th Street and the
Minneapolis and St. Louis Railroad R/W, was read. On motion of Trustee Middleton,
seconded by Trustee Jorvig, the Council concurred with the Planning Commission in
their report, and the Clerk was instructed to contact representatives of the
Minneapolis and St. Louis Railroad, Pockrandt Lumber & Fuel Company, and Culligan
Soft Water Service for consultation in regard to their consent to such vacation, by
unanimous vote of all Members of the Council present.

1, 1954, stating that they are interested in exploring the feasibility of arranging
with our Village for the disposal of their garbage and rubbish by means of our new

Planning Commission's-Report on Preliminary Plat of Cedar Knoll Manor Third Addition
Planning Commission's report, dated July 7, 1954s on the preliminary plat of
Cedar Knoll Manor Third Addition,-was read. Inasmuch as the Village Engineer, and
Hennepin County Highway Engineer have been consulted in this matter, and as the
probable widening of County-Highway No. 18 to a four lane highway, and the County
Highway Department is asking for only one road outlet from plat to Highway 18; it
was moved by Trustee Middleton, seconded by Trustee Jorvig, that said preliminary
plat of Cedar Knoll Manor Third Addition be approved, by unanimous vote of all
Members of the Council.
Plat Approved - Erwin's Gard6n Addition
On motion of Trustee Jorvig, seconded by Trustee Middleton, the plat of Erwin's
Garden Addition was approved and-accepted, and the Mayor and,Clerk were authorized
to sign same for the Village, by unanimous vote of all Members of the Council.
Supplies For Civil Defense
On motion of Trustee Middleton, seconded by Trustee Bolmgren, request of
Civil Defense Director, Ralph La Hue (Requisition #4554) for 10M Air Raid Instruction
Cards in the amount of $90.65 was approved, and the Clerk was instructed to issue
Purchase Order for same, by unanimous vote of all Members of the Council.
Water Main Extensions 54-87 and 54-90
At the-time of water main hearings on June 28, 1954, action on Improvements
54-87 (construction of water main in Flag Avenue from the south line of Brucedale
Addition to Club Road), and 54-90, (all streets as dedicated in Subdivision Plat
known as Brucedale Addition) was deferred to this meeting. A group of persons from 1'
the foregoing area appeared. Trustee Bolmgren was asked to explain the projects.
He told of his talks with Bruce Construction Company and Ecklund and Swedlund as to
whether they would be adverse to paying a premium for this water. He presented the
following letter from Bruce Construction Company and Ecklund and Swedlund Construction

We make the following proposal in order to help expedite the procurement

The folks from West 22nd Street said they do not want the water, and
presented the following petition opposing same -----

We, the undersigned residents of West 22nd Street, hereby petition against
the installation of a watermain down the length of said West 22nd Street:

These folks were told that the main area assessment, would be about 35¢ a foot,
while the 6 inch part of the 12 inch main used as lateral would cost approximately
$3.50 per front foot. Mrs. Burke on West 22nd Street said all the folks on Flag
Avenue and 22nd Street do not want it, and Brucedale and Ecklund and Swedlund would
be the only users. Trustee Bolmgren said if we change the route to go along 22nd
street, a new hearing would have to be held. Also, if this change is made to 22nd
Street North on Flag Avenue to serve Crestview Addition, ,it would necessitate an
8 inch main. The folks at 1820 and 1810 Flag Avenue want the water. Someone
suggested that the 12" main extend on Cedar Lake Road to Highway No. 18 and then
North; or West on Club Road extended to Highway No. 18, then North; or North on
Flag Avenue to Franklin; then West on Franklin to Highway. No. 18; then North to
North Village Limits.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on- this
hearing was deferred to August 9, 1954, by unanimous vote of all Members of the
Council.
