COUNCIL MEETING JUNE 21, 1954
A regular meeting of the Village Council.was called to order by Mayor R. C.
Fernstrom at 8:07 P. M.
Invocation was given by Reverend Paul Obenauf of Wooddale Luthern Church.
The following Council Members were present at roll call:

The following persons appeared ----- Rowland W. Portz, 2700 Webster Avenue-said
there was only one little crack in the entire stretch. Paul H. Johnson, Jr. 2708
Webster Avenue said that the 60¢ estimate is too high; that his sidewalk is not in
bad condition, and why not wait two years? Mr. Allan E. Sklader, 2928 Ottawa Avenue
wanted to hear fr6m the Village Fngineer as to what-is needed to be repaired in front
of his house. Arvo Lappako, 3371 Brownlow Avenue said that his sidewalk was broken
by"the Contractor who drive over the sidewalk when bringing equipment into lot to
dig the basement. Said it would be fine to repair the two or three blocks. John
Shaefer, 5900 Goodrich Avenue asked if all the sidewalk had to be replaced. He was
told no, only the damaged part. He asked if it would be cheaper to do the job by
private contractor or by village contract - was answered by Donald Frantz. Mr.
Phillips asked Donald Frantz if it would*be cheaper to fill under a sunken block or
to replace the block. Mr. Frantz said replacing is more satisfactory.
Oscar Orbeck, 5819 Cambridge asked if he could tear up his entire sidewalk
and replace same with sod. Said only part of the block has sidewalk. Folke Johnson,
5815 Cambridge said that there are'only three people who have sidewalk in their block,
and asked if we could compel the other owners in the block to construct sidewalk in
front of their homes - it would make the whole block look better. Another man (name
not given) said that the people are confused as to what is going to be done. Trustee
Jorvig said that we plan to reconstruct only what is deemed necessary. The Village
Engineer will determine exactly what is to be done. M. W. Farnam, 7605 West Lake 5t.
asked what part will bei°;fixed. Engineering Department told him that four squares
needed fixing, but feels" that eight squares should be fixed. S. J. Gustafson, 3805
Jopps Avenue said the repairs needed to his sidewalk are so small that he feels the
project could be set aside. His son told him that the sidewalk round the Brookside
School is bad. Said he did not feel that any of his needed replacing. The Village
Engineer was asked to please check. A gentlemen asked regarding Mrs. Damm, 4501
Minnetonka Boulevard (sidewalk on Lynn Avenue) -- if the owner would have to pay for
the entire cost. It was suggested that possibly the adjacent owner would pay.
William B. Stewart, 4069 Webster Avenue-asked if the,Village Engineer has a
record of what has to be done. He was told that he had . Philip J. Sutton, 5901
Goodrich Avenue said he and his neighbors would Pike to take up all the sidewalks and.
seed the spot in grass. Mayor Fernstrom said this would have to be checked, and a
report made before they could answer. Kurt Scheibe, 5825 Goodrich Avenue said that
after checking with the Engineering Department today, he feels that they were very
lenient in checking the damaged spots. Said there is a matter of trees, and he and
his neighbors feel that it would be better to move the sidewalk out toward the street
so that it -will not be necessary to cut and damage the trees. Said that Goodrich
Avenue needs some further study, "and that he would rather see the sidewalk eliminated
that repaired, or move same and save the trees. Ed Smith said that he fell on
the sidewalk on front of lot just west of Miss Batels, and asked if that lot is on the
list. He was told that it is.

Hearing on Proposed Reconstruction of Sidewalk, Continued
Kenneth G. Ellsworth, 4048 Webster Avenue said that the sewer and water cons-
truction has caused the shifting of sidewalks and settling of same. The Village
Engineer was asked to determine if there is any liability of contractor for this.
Lowell C. Anderson, 4325 Vernon and H. A. Dailey, 4329 Vernon Avenue said that the
shoulder has been cut so low that the sidewalk is high. The Village Engineer was
asked to check this with the State Highway Department to see what can be done.
Leonard G. Fischer, 3016 Salem Avenue said that sewer is to be constructed in his
street this year, and asked if the sidewalk could wait until then. Said that his
sidewalk is below the level of the street. Village Engineer was asked to check
this. John Hreha, 3237 Idaho Avenue asked for a re-check of his walk. Robert
A. Phillips, 2901 Nevada Avenue (MO 9-8406) asked for a recheck on vacant lot at
2746 Webster Avenue.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, action on this hear-
ing was deferred to July 6, 1954, by unanimous vote of all Members of the Council
present.
Speed of Traffic on Wooddale - 43rd to 44th
Mrs. B. D. Mc Graw, 4360 Wooddale Avenue, representing folks who live on Wooddale
Avenue between 43rd and 44th Streets appeared. Said they are concerned about the
speed of traffic, heavy traffic and truck traffic, etc. Would like to have same
posted so that trucks could be eliminated. They would also like to have some SLOW
CHILDREN signs. There is a 20 mile speed sign north of 43rd Street at Wooddale.
Village Attorney, E. T. Montgomery was asked for a solution. Said he feels that the
length of the block and no cross streets make it a fine place to speed. Mrs. Mc Graw
said that the truck traffic seems to be using Wooddale for a short cut. Said that
the speed sometimes reaches 50 miles per hour. Mayor Fernstrom said he would order
the Police Department to spend some time on this stretch. A letter from Mr. Haglin,
4383 Wooddale Avenue, dated June 16, 1954, concerning this matter was read at this
time. Mayor Fernstrom said that everything possible will be done to stop these
excesses.
Use of Incinerator by Other Areas
Mr. Masters, garbage collector at Robbinsdale asked about incinerating his loads.
Said he has about 20 loads a week. Mayor Fernstrom said that we do not have enough
information yet to decide on this, the costs, etc., and we also have other requests
which pre-date this request. Robbinsdale picks up garbage only, Mr. Masters said.
Trustee Middleton said we should give this some study, and then give the first
inquirers the first opportunity. Trustee Bolmgren said that we must have more
operating information before we can deal out any time to outside areas. August 1st
is the earliest we can have definite information as to costs and difficulties. Golden
Valley'and Tyrol Hills have two loads a week. Same answer was given to them .
Washouts on 32nd Street, West of Louisiana
Mr. Hillstrom, 3156 Maryland Avenue, and Mr. V. A. Schultz, 3157 Nevada Avenue
appeared. Said 32nd Street, west of Louisiana Avenue washes out after each rain, and
they get all the'washed out sand on their property. On motion of Trustee Bolmgren,
seconded by Trustee Middleton, the Village Engineer was requested to check this and
report on -
1. Plans for 32nd Street from Louisiana Avenue to Pennsylvania Avenue.
2. Cost of making a full street.
3. What can be done to relieve 3156 Maryland, and 3157 Nevada of overflow
of sand into their yarde.
A. Check 'blind corner at 32nd Street and Louisiana Avenue on Republic Creosot-
ing property to see how same can be eliminated.
Motion was passed by unanimous vote of all Members of the Council.
License to Erect Signs Reinstated - Le Roy Sign Co.
Mr. Reider of Le Roy Sign, Inc. asked about the canceling of his license. Said
they had not intended to violate the sign ordinance, and was sorry that they had done
so. Asked what they had to do to get back into business in St. Louis Park. On
motion of Trustee Jorvig, seconded by Trustee Bolmgren, the license to erect signs of
Le Roy Sign, Inc. was reinstated as of this date, by unanimous vote of all Members of
the Council.

On motion of Trustee Jorvig, seconded by Trustee Middleton, the application of
Le Roy Sign, Inc. for a permit to erect an advertising sign at 5509 Excelsior Boulevard

BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
pursuant to Chapter 4, Part 6, Chapter 345, Laws of Minnesota 1939, the existing
Election Districts of the Village of St.. Louis Park are hereby divided, consolidated
and rearranged as herein provided, that after posting a copy of this resolution 60
days, the Election Districts of the Village of St. Louis Park shall be 17 in number,
and their boundaries shall be as follows:

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request of North-
western Bell Telephone Company for permission to place buried cable across Vernon
Avenue between 28th Street and Minnetonka Boulevard; also across West 27th Street be-
tween Zarthan and Xenwood Avenue; and in West 29th Street from a point on the north
side about midway between 'Zarthari Avenue and Yosemite -Avenue; across the street and

On motion of Trustee Jorvig, seconded by Trustee IZiddleton, the Clerk was
authorized to purchase a used paper cutter with 252 inch blade from Northwestern
Type Foundry, 6504 Walker Street at price of $300.00, by unanimous vote of all
Members of the Council.
Contractors Bond
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, Contractor's bond
with Peter Lametti Construction Company as principal, and Seaboard Surety Company as
surety, executed as of June 10, 1954, in the amount of $34,000.00, covering contract
for construction of storm sewer Improvement No. 54-16, extending from the East Line
of Highway No. 100 at a point approximately 84 feet southerly, measured at right
pgles from the southerly line of Chicago, Milwaukee, St. Paul and Pacific Railway
W; thence west to the Village incinerator plant, was approved and accepted by un-
animous vote of all Members of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, Certificate of
Insurance with Peter Lametti Construction Company named as the insured, and Royal
Indemnity Company named as insuror, covering liability Policy Numbers RCS 999775,
and RLC 17466, effective June 11, 1954, to expire February 1, 1955, for Storm Sewer
Improvement No. 54-16, was approved and accepted, by unanimous vote of all Members
of the Council.
Letter Requesting Street Light at 37th & Joppa
Letter signed-by Charles H. Warren of Warren Drug Company, 3651 Joppa Avenue
and others; dated June 17, 1954, requesting the installation of a street light at the
corner of 37th Street and Joppa Avenue, was read. On motion of Trustee Bolmgren,
seconded by Trustee Jorvig, the Northern States Power Company was instructed to
install a street light on the East Corner of 37th Street and Joppa Avenue, by unani-
mous vote of all Members of the Council.
Shrubs for Louisiana Avenue Bridge Approaches
Request of Village Engineer, Phil W. Smith, dated June 21, 1954, for permission
to contract with Ruedlinger Nursery to plant shrubs on the east slope of Louisiana
Avenue from Cedar Lake Road to the new railroad bridge on the Bruce Construction
Company's property at price quoted of $492.00, was read. On motion of Trustee Midd-
leton„ seconded by Trustee Bolmgren, the Village Engineer was authorized to contract
with Ruedlinger Nursery to furnish and plant shrubs on the east slope of Louisiana
Avenue from Cedar Lake Road to the new railroad bridge on the Bruce Construction
Company's property (in place of sod) to fulfill easement agreement with Wallace Bruce;
same to be charged as part of the grading of Louisiana Avenue bridge approaches, not
to exceed price quoted of $492.00, by unanimous vote of all Members of the Council.
Temporary Employee for Water Department - Howard Hallgren
On the request of Water Superintendent, Ira Vraalstad, it was moved by Trustee
Bolmgren, seconded by Trustee Middleton, that Howard Hallgren be hired as a temporary
employee for the'water department to replace the regular employees who are on vacation,
at a rate of $1.80 per hour, effective June 16, 1954, by unanimous vote of all Mem-
bers of the Council.
Temporary Employee -for Engineering Department - John David Hyatt
On the request of Village Engineer, Phil W. Smith, it was moved by Trustee
Middleton, seconded by Trustee Jorvig, that John David Hyatt, 3136 Edgewood Avenue
be employed as a laborer in the Engineering Department at the beginners rate of
$1.80 per hour, effective June 23, 1954, by unanimous vote of all Members of the
Council.
Report on Bus Route - 44th Street
Report of Railroad and Warehouse Commission of the State of Minnesota, dated
June 14, 1954, on the application of the Minneapolis Street Railway Company for an
extension of its Como-Xerxes-France bus route into the Villages of Morningside, St.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
ordinance was adopted by unanimous vote of all Members of the Council:

AN ORDINANCE AMENDING ORDINANCE NO. 298
RELATING TO LICENSING AND REGULATING
OF DOGS
The Village Council of the Village of St. Louis Park ordains:
Section 1. Section 4 of Ordinance No. 298, entitled All ORDINANCE LICENSING
AND REGULATING DOGS AND REPEALING ORDINANCE NO. 8A, adopted by the Village Council
April 26, 1948, is hereby amended by adding thereto the following sentence:
"The Village Council may designate as dog catcher The Animal Rescue League,
Incorporated, pursuant to any contract it may have with said corporation
providing for enforcement of this Ordinance by said corporation, and the
duly designated employees and representatives of said The Animal Rescue
League, Incorporated during such times as any such contract shall be in
force shall have the authority of dog catcher under this Ordinance for carry-
ing out the duties and responsibilities assumed by said The Animal Rescue
League, Incorporated under any such contract with the Village."
Section 2. Section 5 of said Ordinance is hereby amended to read as follows:
"Section 5. Impounding of Unlicensed Dogs. It shall be the duty of the
police officers of the Village and the dog catcher to impound any dogs found in the
Village without the tag provided for in Section 2, or found running at large, harbored,
or kept, contrary to any provision of this ordinance."
Section 3. - Section 6 of said Ordinance, as heretofore amended by Ordinance
No. 417, is hereby further amended to read as follows:
"Section 6. Redemption of Impounded Dogs. Any dog impounded may be
redeemed by the owner within the time for redemption by payment to the Village
Treasurer of the current license fee if unpaid, and an impounding fee of
$$10.00. The said license fee may be paid on authorization of the Village
Council to The Animal Rescue League, Inc. pursuant to any contract that may
be currently in effect providing for the impounding of dogs within the Village
at its kennels."
Section 4. This Ordinance will take effect from and after its publication.
Ordinance No. 453
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following Ordi-
nance was adopted by unanimous vote of all Members of the Council:

AN ORDINANCE REGULATING THE CONSTRUCTION AND
REMOVAL OF SIDEWALKS, CURBS AND CURB AND
GUTTER FROM THE PUBLIC STREETS OF THE VILLAGE,
AND REPEALING PREVIOUS ORDINANCES RELATING THERETO
The Village Council of the Village of St. Louis Park ordains:
Section 1. No person shall construct or install any sidewalk, curb, or curb
and gutter, nor cut or remove any sidewalk, curb, or curb and gutter, in any public
street or right-of-way within the corporate limits of the Village of St. Louis Park
without first obtaining a permit for the same from the Village Building Inspector.
Section 2. Applications for permit to construct or remove sidewalk, curb, or
curb and gutter shall be made to the Village Building Inspector on forms, provided
by him, which shall set forth the location where sidewalk, curb, or curb and gutter
is to be constructed or removed, the name of the owner of the adjacent property in
whose name the application is made, and the name of the person who will actually do
the owrk. No such permit shall be granted until the applicant shall have paid a fee
to the Village Treasurer in the sum of Five Dollars ($$5), and shall have executed
and filed with the Village Clerk an undertaking and bond, with such surety as the
Village Council shall approve, conditioned as specified in Section 3 hereof. No curb
shall be cut or removed for the purpose of installing a driveway and no driveway shall
be constructed across a public sidewalk until permit for the same has been approved
by the Village Council. Upon payment of the said fee and filing of duly approved
bond, the Building Inspector shall issue permits for construction or reconstruction
of sidewalk, curb, or curb and gutter, except in cases where Council approval is re-
quired as above.

Section 3. No person shall be granted a permit for constructing any sidewalk,
or curb, or curb and gutter, hereunder, until he shall have filed with the Village
Clerk a bond and undertaking with at least two sureties if individuals, and at least
one surety if a corporate surety, acceptable to the Village Council, to guarantee
the construction which the applicant is undertaking and agreeing to construct such
sidewalk, curb, or curb and gutter, in accordance with the specifications on file in
the office of the Village Clerk for construction and repair of sidewalks, curbs, and
curbs and gutters, in the Village of St. Louis Park, and also to indemnify and save
the Village harmless from any loss or damage that may arise by reason of the negli-
gence of the principal, his agents, employees, or contractors, while engaged in the
laying or construction of said sidewalk, curb or curb and gutter, or any portion
thereof, or from the obstruction or condition of the public streets or sidewalk res-
ulting from the acts or omissions of said principal, his contractors, agents or
employees, or from any other cause whatever, and obligating the principal to main-
tain said sidewalks, curbs, or curbs and gutters, for a period of two (2) years
after completion thereof, in a good and sufficient condition and free from all defects,
settlement and cracks caused by the use of imperfect material or workmanship, or
by proper use of said sidewalks or curbs and gutters for the purpose intended, or by
action of the elements. �1-
Section 4. Any person engaged in the business of constructing and installing
sidewalks, curbs and gutters, may file with the Village Clerk a penal bond in the sum
of not less than Ten Thousand Dollars ($10,000.), with corporate surety, conditioned
as provided in the bond required under Section 3 hereof, and while such bond is in
force and effect such bond shall serve as a sufficient compliance with said Section
3 and a permit shall be issued to any person making application therefor, on condition
that the work is to be done by the contractor whose bond in such sum has been filed
and approved by the Village Council.
Section 5. Any person convicted of violating any provision of this Ordinance
shall be punished by a fine of not less than Five Dollars ($5. ) and not more than
One Hundred Dollars ($100.).
Section 6. Ordinance No. 103, entitled AN ORDINANCE. TO REGULATE THE CONS-
TRUCTION OF SIDEWALKS, CURB, CURB AND GUTTER, adopted by the Village Council October
5, 1936, as hereby amended, is hereby repealed.
Section 7. This Ordinance shall take effect and be in force from and after
its publication.
Quit Claim Deed
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the quit claim
deed with The Pure Oil Company as party of the first part, and Village of St. Louis
Park as party of the second part, dated June 4, 1954, for the following described
property was approved and accepted, and the Village Attorney was instructed to file
same with the Office of Register of Deeds of Hennepin County, Minnesota, by unani-
mous vote of all Members of the Council:
An easement in and over the West One-half (W2) of Lot Nine (9), Home
Addition, according to the plat thereof on file and of record in the
office of the Register of Deeds of said Hennepin County, for the purpose
of entering thereon and constructing and installing therein a drain or
storm sewer for the purpose of draining the intersection of Cedar Lake
Road and Louisiana Avenue and to permit the water to drain from said
intersection and flow upon said premises, provided that in the event that
said West One-half (W�) of Lot Nine (9), Home Addition, should be improved
by construction of a building thereon the easement herein granted may be
terminated upon sixty days' notice in writing to the second party, unless
the drain be extended by the second party over and across said Lot 9 in
such a manner as to provide for drainage of such surface waters onto
property other than said Lot 9.
