REGULAR MEETING MAY 3. 1954
•A regular meeting was called to order by Mayor R. C. Fernstrom at 8:16 P. M.

Bids for Traffic Control Signals
As advertised in the St.. Louis Park Dispatch April 22, 1954, sealed bids were
received from the following bidders for the furnishing and installing of traffic
control signals at Dakota Avenue and Minnetonka Boulevard:

On motion of Trustee Bolmgren, seconded by Trustee Bolmgren, the above bids
were referred to the Village Engineer, Chairman of the Public Safety -Committee and
Police Chief for tabulation and recommendation, by unanimous vote of all Members
of the Council.
Hearing on Petition to Vacate Streets and Alleys
A hearing was had on the petition of Independent School District of St. Louis
Park and Minneapolis, Northfield & Southern Railway to vacate the alleys and streets
described in the following resolution: Mr.. Nelson, 3300 Kentucky Avenue appeared
and asked for the location of streets and alleys. Same were shown him on the map.
He was not opposed.-
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION VACATING STREETS AND ALLEYS
WHEREAS, the Village Council has met at the time and place specified in the
notice published in the St. Louis Park Dispatch April 15 and 22, 1954, and duly
posted, relating to the petition of Independent School District of St., Louis Park
and Minneapolis, Northfield & Southern Railway to vacate the following streets and
alleys, and the Council has heard all interested persons appearing at said meeting
and determined that it is in the public interest that said streets and alleys be
vacated, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the following streets and alleys as the same are now dedicated within the corporate
limits of said Village, be hereby vacated:

Re: Condition of Minnetonka Boulevard from Dakota to Texas
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
instructed to write a letter to the County Highway Department informing them of the
bad condition of Minnetonka Boulevard between Dakota and Texas Avenues, and asked
them to put it in shape, by unanimous vote of all Members of the Council.
Petition for Sanitary Sewer - P-1440
On motion of Trustee Bolmgren, seconded by Trustee Middleton, petition signed
by Mr. and Mrs. Bernard Illies, Jr., 2953 Texa-Tonka Avenue and others, dated May
3, 1954, for the construction of sanitary sewer in TEXA-TONKA AVENUE FROM TEXAS
AVENUE TO VIRGINIA AVENUE, was referred to the Village Engineer for estimate of cost
and recommendation, and a report back to the Council within the next two weeks, by
unanimous vote of all Members of the Council.
Complaint Re: Fence - Chester Josewski
Mr. Chester Josewski, 1469 Jersey Avenue presented a complaint about a fence
between his and his neighbor's property. He was told that the Council has no juris-
diction in a matter of this kind, it being a civil matter.
Difficulties with Sign Ordinance - Brede, Inc.
George Behonek of Brede, Incorporated spoke about the Sign Ordinance and some
difficulties he was running into to get permits, especially business signs on the
nusiness man's own building. He was told that that matter had been taken care of
and only builetin boards have to be cleared with the Planning Commission. He called
attention to their application of December 23, 1953, approved by the Council on
December 28, 1953. Said the Planning Commission stopped them. No action taken.
Application for Permit to Erect Sign - Brede, Incorporated
On motion of Trustee Middleton, seconded by Trustee Jorvig, the application of
Brede, Incorporated, dated April 28, 1954, for a permit to erect an advertising sign
flatwise on building at 4215 Excelsior Boulevard for James Wong (Foo Chu Cafe) was
approved, and the Building Inspector was authorized to issue same, by unanimous vote
of all Members of the Council present.
Plat of Murray Lane West Second Addition
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the plat of MURRAY LANE
WEST SECOND 'ADDITION, presented by Associated Contractors, 5720 Wayzata Boulevard was
approved and accepted subject to approval of the Village Attorney, and the Mayor and
Clerk are hereby authorized to sign same for the Village, by unanimous vote of all
Members of the Council.
Licenses
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following applica-
tions- for 1954 licenses were approved, and the Mayor and Clerk were authorized to issue
licenses to expire December 31, 1954, by unanimous vote of all Members of the Council:

Sidewalk or Curb and Gutter Construction Bond
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Sidewalk or Curb
and Gutter Construction Bond with Roy Fare and John Fure, dba Fure Brothers Cement
Construction Company as principal, and Standard Accident Insurance Company as surety,
effective January 1, 1954 to expire January 1, 1955, in the amount of $10,000.00 was
approved by unanimous vote of all Members of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petitions
were referred to the Village Engineer, Water Department Committee, and Special Assess-
ment Department for checking and recommendation, by unanimous vote of all Members of
the Council:

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
petition was referred to the Village Engineer, Chairman of the Street Department

unanimous vote of all Members of the Council:

Letter from Hennepin-Lake Stationers and Zephyr Printing Company, dated April
29, 1954, requesting a permit to erect a commercial building on the following des-
cribed property (3865 Wooddale Avenue), was read ----- that part of Section 7,
Township 28, Range 24, described as follows: Commencing at a point in the West line
of said section 443.71 feet south of the NW corner thereof; thence south 393.2 feet;
thence north 76 degrees east 140 feet; thence north 358 feet; thence west 135.84
feet to the point of beginning, except that part thereof taken for highway; and
excepting all that portion of the above described property which lies southerly of
the following described line towit: Commencing at a point in the east line of the
above described property 44 feet south of the NE corner of the above described
property; thence Wly. in a straight line a distance of 126.5 feet, more or less,

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
request was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all Members of the Council.
Co-Insurance Clause - Recreational Building and Contents
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was
authorized to sign for the Village, co-insurance clause for fire insurance on
Northern Insurance Company of New York, Policy No. OC 911415, increasing the coverage
on Village Recreation Building and Contents at 6212 West Lake Street from $39,500.00
to $55,000.00 with additional premium of $107,09, by unanimous vote of all Members
of the Council.
Supplies for Civil Defense
Request of Ralph J. La Hue, Director of Civil Defense (Requisition #446),
dated May 1, 1954, for 12-books entitled EFFECTS OF ATOMIC WEAPONS, Catalog No.
Y 3 AT 7: 2 AT, 7-11-950/2 at ,$1.25 each ($15.00) was approved, and the Clerk was
authorized to issue a purchase order for same, by unanimous vote of all Members of
the Council.
Request for Replacement of Feeder Chain for Travel Loader
Recommendation of Street Commissioner, Kenneth Johnson, dated April 26, 19542
for replacement of feeder chain for Adams travel loader, was read. On motion of
Trustee Middleton, seconded by Trustee Jorvig, the foregoing request was denied by
unanimous vote of all Members of the Council.
List of Ddfective Sidewalks
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village
Engineer was instructed to turn in a list of defective sidewalks to the Council at
once so that same can be advertised for hearing, by unanimous vote of all Members
of the Council.
Letter Re: Delivering Materials to Village Incinerator - Bloomington Sanitation
Letter from Kingsley D. Holman, Attorney for Clinton Mann, owner of the
Bloomington Sanitation Service, dated April 30, 1954, stating that Mr. Mann is
interested in working out a transaction with the Village on a contract basis for
delivering materials to our incinerator- plant, was read. On motion of Trustee
Middleton, seconded by Trustee Bol.mmgren, the foregoing letter was ordered placed on
file until we have had some experience with the new incinerator to go by, by unani-
mous vote of all Members of the Council.

Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING 52-450 GRADING #504 ASSESSMENT
14HEREAS it appears that by resolution of the Village Council adopted September
7, 1953, levying assessments for 52-450 Grading #504, the following lot was inadvert-
antly assessed for 112 feet because the description of the property read the 11W 112, "
whereas the footage of said property is only 82 feet, with the additional 30 feet
being the east half of Raleigh Avenue; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
30 feet of above assessment for years 1954 thru 1956 heretofore levied against the
following property be canceled, and that the Auditor and the Treasurer of Hennepin
County be hereby authorized to cancel the same upon their respective records and to
issue the owner a corrected tax statement.

Resolution
On motion of Trustee Bol.mgren, seconded by Trustee Jorvig, the following reso-
lution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING 52-308 SANITARY SEWER 2W # 502 ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted August 10,
1953, levying assessments for 52-308 Sanitary Sewer 2W #502, the following property
was assessed for 162 feet from 'the survey made by John 'E. Cardarelle, which we now
find is incorrect. The mistake was discovered when the owner came to our office, in-
forming us that his footage was only 150.75 feet. The Engineering Department subse-
quently sent out men who checked this property and reported that 150.75 feet was
correct; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
11 feet of said assessment for years 1954 thru 1963 heretofore levied against the
following property be canceled, and that the Auditor and the Treasurer of Hennepin
County be hereby authorized to cancel their records to the following amounts and to
issue the owner a corrected tax statement.

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING GARBAGE ASSESSMENT
WHEREAS it appears that by resolution of the Village Council levying assess-
ments for Garbage Disposal, the following owner was charged for Garbage Disposal
on a vacant lot, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
1951 thru 1953 installments of such assessment heretofore paid in the respective
amounts set forth below be refunded to the respective property owner, and, upon
receipt of a signed verified claim and the paid tax statements, that the Mayor and
Clerk be hereby authorized to issue warrants in payment of such refund to the
respective property owner.

Request for Rezoning - R. N. Ruedlinger
On motion of Trustee Middleton, seconded by Trustee Jorvig, the request of
R. N. Ruedlinger for, Ruedlinger Nursery for rezoning the following described property
was referred to the Planning Commission for checking and recommendation, by unanimous
vote of all Members of the Council: To light industrial: Commencing at the center
of section; thence west to railroad right-of-way of Great Northern Railroad; thence
southerly along same to center of Minnehaha creek; thence down said creek to'east
line of SW4i thence north to beginning; except the north 200 feet to be rezoned for
multiple dwelling. To multiple dwelling: West z of the SWr of the NW, of the SE�
south of the north 30 feet thereof with exception of the north 125 feet. Also the
W� of the E2 of SW, of NW4 of SEr, except road.
Request for Renewal of Temporary Permit
Letter from D. W. Mc Gregor, dated April 23, 1954, requesting his temporary
permit for use of building 16 x 16 feet at 6424 Walker Street as a drive-in be
extended for a period of 24 to 36 months, was read. On motion of Trustee Bolmgren,
seconded by Trustee Middleton, the foregoing request was approved for a period of
one year, by unanimous vote of all Members of the Council.
Request for Refund of Dog Pound Fee - Mrs. John Bates
Letter from Mrs. John Bates, 5001 Interlachen Boule=vard, Edina, dated April
30, 1954 with regard to her dog being picked up on the Brookside School grounds on
November 20, 1953, and requesting that the $10.00 pound fee be refunded to her, was
read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing
request was denied, by unanimous vote of all Members of the Council.
Village Engineer's Report on Sidewalk Disrepair
Village Engineer's report dated May 3, 1954, on the letter from Ruth E. Roby,
5924 West 35th Street about the disrepair of sidewalk in front of the residence at
6007 West Lake Street where she fell on Friday, April 16, 1954, was read and ordered
filed.
Request for Meeting with Village Council - International Union of Operating Engineers
Letter from Larkin Mc Clellan, Buisness Representative, International Union
of Operating Engineers, Local No. 49, requesting that the Council arrange for a
meeting with them in the near future to discuss adjustment of wage rates paid to
certain Village Employees in the Engineering Department, was read. Discussion
ensued. Former Mayor, C. L. Hurd who happened to be present stated that Mr.
Mc Clellan waived meeting with the Council last year. On motion of Trustee
Middleton, seconded by Trustee Jorvig, the foregoing matter was referred to the
Committee of the Whole for further discussion, by unanimous vote of all Members of
the Council.
Building Inspector's Weekly Report
Building Inspector's report for week ending April 30, 1954, showing that 31
building permits were issued, totaling $ 2,7402417.00, was read and ordered filed.

Village Engineer's report on estimated cost of constructing sidewalk at the
following locations of $2.50 per foot, was read,

Letter from Walter, Woody and Heimerdinger, Cincinnati, Ohio, dated April 26,
1954, stating that they are interested in buying our $500,000 Civic Center Bonds to
be voted on June 8th, was read; and the Clerk was instructed to answer same.
Certification as Water Works Operator, Grade C - Maynard Kays
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the letter to
Water Department Employee, Maynard Kays, dated April 28, 1954, from the Minnesota
Department of Health, informing him' that he had fulfilled the requirements as a water
works operator grade C, and enclosing a certificate therefore was read and ordered
filed, by unanimous vote of all Members of the Council.
Temporary Heating Inspector - Earl Jones
On motion of Trustee Middleton, seconded by ,Trustee Bolmgren, the Building
Inspector was authorized to use Engineering Department Employee, Earl Jones as
heating inspector for a period of two weeks in,-the absence of Heating Inspector,
C. H. Farmer who is ill; salary to be $2.05 ,per hour plus mileage at 7¢ per mile, by
unanimous vote of all Members of the Council.
Building Inspectorts Report 'for April, 1954
On motion of Trustee Middleton,- seconded by Trustee Bolmgren, the Building
Inspector's report for the-month of April, 1954, showing a total of 109 building per-
mits issued, totaling $3,484,412.00 was read and ordered filed, by unanimous vote of
all members of the Council.

Agreement with Knollwood Plaza Incorporated
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor and
Clerk were authorized to execute agreement in behalf of the Village with Knollwood
Plaza, Incorporated which has been prepared by the Village Attorney and executed
by Knollwood Plaza, Incorporated to comply with Ordinance No. 422, by unanimous
vote of all Members of the Council.
Supplies for Incinerator
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
authorized to issue a purchase order for the following list of supplies for the new
Village incinerator, by unanimous vote of all Members of the Council:
3 heavy garden hoses 50 feet long
2 garbage and refuse hooks
2 #12 scoop shovels
2 100 foot drop cord lights
2 fibre street brooms
2 office push brooms
1 1811 pipe wrench
2 24" pipe wrenches
1 1 pint Zerk grease gun

The minutes of meeting held April 26, 1954 were read. On motion of Trustee
Bolmgren, seconded by Trustee Jo'rvig,,,the minutes of meeting held April 26, 1954
were approved as read, by unanimous vote of all Members of the Council.
Committee of Whole Report on Application for Rezoning - Adolph Fine
Hearing was had on April 12, 1954 on the application of Adolph Fine, Inc. for
rezoning Lots 1, 22 3, and 4, Block 3, Adolph Fine's Addition, from Residential Use
to Commercial Use, at which time the matter was referred to the Committee of the
Whole. Mr. James Frank appeared and asked if the Petitioner was present. He was
told that he was not. Mr. Frank said-that he and his neighbors feel the same now
as they did before and do not want these lots zoned for commercial use. With more
time they feel they could buy these lots from Mr. Fine and pay taxes. He asked for
one more week.
Mayor Fernstrom asked Mr. Frank-if he felt that the commercial zoning of
these lots would lower the value in the 3000 block on Colorado Avenue. He said yes,
due to facing of brick wall, etc. Mayor Fernstrom asked is the value of the homes
in this block. Mr. Frank estimated $12,000.00 each. Mr. �Frank said that maybe
if Mr. Fine is going to put in something in services they needed and had come to the
meeting, they might possibly deal with him. Mayor Fernstrom repeated his question.
Mr. Frank said he just does not like the possible improvements contemplated. Said
that lots near a store or super market have less value than others. The Fine
salesman who sold them their house said that no change in zoning will be made. Mayor
Fernstrom remarked that salesmen make a number of promises such as that the _bus
stops on every corner, etc.
Dumping in these lots was discussed and Mr. Frank said he feels our garbage
service is good, and cheap, and this type of dumping is not necessary. He asked
again for one more week to allow some-neighbors who work Monday nights to get
next Monday night off and come to the meeting. Mr. Halverson is one, on Lot 5,
next to the proposed rezoning. He also feels that Mr. Fine should have someone
here to explain and discuss this matter with us.
Mr. Meyers (Hardware) said unless Mr. Fine can have his way and build what he
wants to he will not do anything about the lots. He should at least attempt to care
for the lots now. Also, Mr. Fine should be' here to speak for himself and not leave
it up to the Council to speak for him. People come in every two years for this
same petition. Mr. Meyers said he didn1t care what kind of stores are to be built,
it is wrong to rezone this property without Mr. Fine being represented.
Mayor Fernstrom said that the petition we have on file in opposition to this
proposed rezoning show names only and asked if they were all residents in the 3000
block on Colorado avenue. Mr. Frank said they were. Mayor-Fernstrom read the
petition in opposition.

Mr. Frank said that though they do not agree that there should be commercial
zoning, we do feel that if Commercial Zoning is put in, then there should be no
ingress or egress on Colorado Avenue. He asked again for one more week before the
Council makes their decision. At this point Mr. C. L. Hurd said he has offered Mr.
Fine $10,000 for these four lots with the provision that no commercial buildings
would be built on them and Mr. Fine would not deal with him. Trustee Jorvig
reviewed this matter, and offered the following -----
It was moved by Trustee Jorvig, seconded by Clerk Justad that the rezoning of
Lots 1, 2, 32 4, Block 3, Adolph Fine's Addition from Residential Use to Commercial
Use be denied.
Further discussion ensued regarding Mr. Fine and his method of caring for these
lots.
The following roll call vote was taken on the above motion: Trustee Bolmgren,
nay, Trustee Middleton, nay, Trustee Jorvig, yea, Clerk Justad, yea; Mayor Fernstrom,
nay. Motion lost.
Mr. Frank said the Trustee Middleton said two years ago that he felt that he
was a one-year term Councilman, and was for commercial enterprises for tax relief,
etc. Remarks were made about how hard it has been for the Council to make Mr.
Fine move sign and office building, etc.
Mr. Mc Call of Mc Call's Drug Store on Dakota and Minnetonka Boulevard asked
how delinquent Mr. Fine was in taxes on those "lots. No one present seemed to know.
The discussion turned to lots owned by the Village on Dakota Avenue north of 31st
Street. Lots of guesses were made as to what -would happen to them. Mr. Frank
asked if Minnetonka Boulevard is to be paved goon. He was told that it would not be
done -this year. A representative from Swatez Department Store, Minnetonka Boulevard
and Dakota Avenue asked if the Council had a right to take Mr. Fine's place in this
hearing. Mayor Fernstrom said we have a petition from Mr. Fine and are acting on
this petition. The representative from Swatez Department Store said he is opposed
to this rezoning and asked why Mr. Fine hasn't taken care of the land up to now and
feels that he should be forced to fill up the corner lot and beautify same.
Jorvig
Trustee/asked that we consider the question again. It-was moved by Trustee
Middleton, seconded by Trustee Bolmgren that the petition of Adolph Fine, Incorporated
for rezoning Lots 1, 2, 3, and 4, Block 3, Adolph Fine's Addition from Residential Use
to Commercial Use be granted, and that an amendment to the Zoning Ordinance be prepared
by the Village Attorney to include necessary screening, etc. to be presented to the
Village Council on May 10, 1954• The following roll call vote was taken -----_Trustee
Bolmgren, yea; Trustee Middleton, yea; Trustee Jorvig, nay; Clerk Justad, nay, Mayor
Fernstrom, yea.
