C. Fernstrom at 8:09 P. M. Wilhelm 5.00 Williams Hardware Co. 9.70 " " It 325-40 Committee of Whole Report on Application for Rezoning - St. Louis Park Theatre Mayor Fernstrom spoke for the Committee of the Whole -- explained that the Applicant (St. Louis Park Theatre Company) for rezoning Lots 1 thru 11, Block 2, Calhoun Addition from Residence Use District to Commercial Use District would be satisfied if the property would be rezoned to Commercial Use for Parking Only with no ingress or egress on Ottawa Avenue: Ed Rousch said that the neighbors in the area were against any change in the zoning of this property. A discussion of the proposed alley between Minnetonka Boulevard and 31st Street adjacent to Block 1, Calhoun Addition ensued. Mayor Fernstrom explained that this had no bearing on the petition for rezoning. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Attorney was instructed to prepare an amendment to the Zoning Ordinance for the rezoning of Lots 1 thru 11, Block 2, Calhoun Addition, to be used for parking only, with restriction of ingress or egress on Ottawa Avenue or 31st Street, and screening along'the north boundary of L6t 1 and the east boundaries of Lots 1 thru 11, Block 2, Calhoun Addition to, be covered by an agreement to be prepared by the Village Attorney, E. T. Montgomery. Motion was passed by unanimous vote of all Members of the Council. Regiiest for Permit to Move Ditch - George A. Wahlman Report of Village Engineer, Phil W. Smith, dated February 1, 1954, on the request of George A. Wahlman for permission to move the ditch in the back of Lot 1, Block 7, Wooddale Park Addition, was read. With the approval of Village Attorney, E. T. Montgomery, it was moved by Trustee Middleton, seconded by Trustee Bolfigren that George A. Wahlman be granted permission to move the drainage ditch known as County Ditch No. 17 over Lots 1 and- 2., Block 7, Wooddale Park Addition by Construction of a new ditch of equivalent depth and size over the SW 10 ft. of the NE 112 ft. of said Lots 1 and 2, Block 7, Wooddale Park Addition on approval by the Village Attorney of easement deed from the owner of property; work to be done under the supervision of the Village Engineer. Motion was passed by unanimous vote of all Members of the Council present. Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following applications for 1954 licenses were approved.,, and the Mayor and Clerk were author- ized to issue licenses to expire December 31, 1954, subject to- approval of the Building Inspector, by unanimous vote of all Members of the Council. Permission to Place Poles • On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern States Power Company was granted permission to place poles at the following loca- tions within the Village, by unanimous vote of all Members of the Council: One pole on Joppa Avenue between Highway No. 7 and Minnetonka Boulevard; Four poles on Cedar Lake Road from Nevada Avenue to Pennsylvania Avenue; and Eight poles on Nevada Avenue from Depot Avenue to Cedar Lake Road. , New Zone Areas - NW Bell Telephone Company Trustee Jorvig reported that he had an interview with Roy Anderson with the Northwestern Bell Telephone Company and he requested that he be present at our March lst meeting to give us the details on the new proposed telephone zone areas. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous,vote of all Members of the Council: RESOLUTION CANCELING 52-308 SANITARY SEWER 2W #502 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted August 102 1953, levying assessments for 52-308 Sanitary Sewer 2W #502, the following lot was inadvertantly assessed for 60 feet instead of 50 feet; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that 10 feet of the above assessment for years 1954 thru 1963 heretofore levied against the following lot be canceled, that .the 1955 installment be reduced by $14.26, the amount overpaid for 1954; and that the Auditor and the Treasurer of Hennepin County be hereby authorized to cancel the same and correct their' records to the following amounts: CORRECTED AMOUNTS FOR COUNTY AUDITOR NAME LOT BLOCK ADDITION t ' A. Applications for Permits to Erect Advertising Signs Nordquist On motion of Trustee Bolmgren, seconded by Trustee, Middleton, the application of Nordquist Sign Company, dated February 11, 1954, for permits to erect two ad- vertising signs on the building at 3900 Excelsior Boulevard for Standard Oil Company was referred to the Planning Commission for _checking and recommendation, by unanimous vote of all Members of the Council. Application for Permit to Erect Advertising Sign - NW Sign Erectors On motion of Trustee Bolmgren, seconded by Trustee Middleton, the application of Northwest Sign Erectors, dated February 11, 1954, for a permit to erect an ad- vertising sign (four-face) on Excelsior Boulevard and Kipling Avenue for Jiffy Car Wash was referred to the Planning Commission for checking and recommendation by unanimous vote of all Members of the Council. 168 February 15, 1954 Re: Special Election for Bonds On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the matter of ordering a special election to vote for/bonds to finance the construction of a Public Safety and Village 'Hall Building was referred to the Committee of the Whole to be discussed on February 27, 1954, by unanimous vote of all Members of the Council. Request for Refund of Dog Pound Fee - R. C. Nelson Letter from R. C. Nelson, 3916 Kipling Avenue, dated February 11, 1954 concerning his Labrador pup picked up by the Dog Catcher on the Brookside School Grounds and impounded at Marryhill Kennels, and requesting that the fee he paid of $10.00 be refunded to him, was read. After discussion of this matter, it was moved by Trustee Bo]mgren, seconded by Trustee Middleton, the request of Mr. Nelson for a refund of the $10.00 fee he paid for the return of his dog was denied, by unanimous vote of all Members of the Council. Parking Lot for Village Employees On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Street Com- missioner was instructed to prepare the lot on the NW Corner of Alabama Avenue and 37th Street for a parking lot at a cost not to exceed $200.00, by unanimous vote of all Members of the Council. Petition for Water Main On motion of Trustee Bolmgx'en, seconded by Trustee Jorvig, the folloiring petition was referred to the Vill-age Engineer, Chairman of the Water Department Committee, and Special Assessment Department for checking and recommendation, by unanimous vote of all Members of the Council: PETITION FOR WATER MAIN, signed by Charles Kinser, 3106 Inglewood Avenue and others, dated February 15, 1954,' for the construction of water main in INGLEWOOD AVENUE FROM WEST 31ST STREET TO 200 FEET SOUTH. Automobile (Fleet) Insurance On motion of Trustee Bolmgren, seconded by Trustee Middleton, American Automobile Insurance Company Policy No.' K-20$-0297, effective March 12, 1954 to expire March 12, 1955, covering fleet of Village owned trucks and passenger cars listed therein at a premium of $4,656.11, was approved and accepted, by unanimous vote of all Members of the Council. Committee of Whole Report Re: Residence of Village Employees On motion of Trustee Middleton, seconded by Trustee Jorvig, the matter of residence of Village Employees was referred back to the Committee of the Whole for further study and deliberation, by unanimous vote of all Members of the Council. Disposal of Old Village Hall Stoker Authorized Letter from Pfaintenance Service Company, dated November 3, 1953, offering to purchase the old Village Hall stoker for $25.00 including controls and motor. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to sell as junk, the old Village Hall stoker without motor for not less than $15.00, by unanimous vote of all Members of the Council. Legal Opinion Re: Salaries of Village Employees Serving with National Guard Legal opinion of Village Attorney, E. T. Montgomery, dated February 53 1954, concerning the salaries of Village Employees serving with the National Guard was read and ordered filed. Letter Re: Revised Drawing of Commercial Plot - Bruce Construction Co. Copy of letter from Bruce Construction Company to Village Engineer, Phil W. Smith, dated February 10, 1954, concerning the revised drawing of their com- mercial plot on Cedar Lake Road and Louisiana Avenue (in and out traffic and drainage, etc.), was read and ordered filed. Employee for Assessor's Office - N. Epstein On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Assessor was authorized to hire N. Epstein to work in the assessing department at $2.00 per hour, effective March 15, 1954, by unanimous vote of all Members of the Council. Report on Public Health Nursing Service for 'January,_ 1954 Report of Rural Hennepin County Nursing District of Nursing Services for January, 1954, was read and ordered filed. Building Inspector's Weekly Report ' The Building Inspector's report for week ending February 12, 1954, showing that 16 building permits were issued, totaling $1663200.00 was read and ordered filed. February 15, 1954 Certificate of Insurance - Victor Carlson & Son, Inc. & Carlson-Lavine, Inc. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, Certificate of Insurance for Workman's Compensation (police C-267-3436), and Employer's Liability (policy K-20$-0290) with Victor Carlson and Son, Incorporated and Carlson-Lavine, Incorporated named as the insured, and American Associated Insurance Companies named as the insuror, covering all work operations in the State of Minnesota, effective January 1, 1954, to expire January 1, 1955, was approved and accepted by unanimous vote of all Members of the Council. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION DETERMINING POLICY WITH RESPECT TO FINANCING OF IMPROVEMENTS CONSTRUCTED IN NEW SUBDIVISIONS WHEREAS, the Village Council deems it undesirable that the credit of the Village be further extended for the financing of public improvements to be cons- tructed in new subdivisions, such as water and sewer mains, sidewalk, curb and gutter, and street grading and surfacing, and WHEREAS, ,it was desirable for the Village to facilitate the financing of such improvements during the period following World War II when there was a serious shortage of housing, and it appears to the Council that there is no longer any such housing shortage, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that it ,shall hereafter be the policy of said Village Council to order no public im- provements as above described for construction in newly subdivided areas of the Village, until such time as the petitioners for such improvements shall have de- posited with the Village •Treasurer a sum equal to the estimated cost of the improve- ment to be ordered. The sum so deposited shall be expended to defray the cost of the improvement if ordered, and credited against the assessable vost of the project. Any excess -over the estimated cost is to be assessed against the benefited property, and if the funds deposited shall exceed the estimated cost, the excess is to be refunded to the depositors. Settlement Authorized - Christianson vs Village of St. Louis Park On motion of Trustee Bolmgren, seconded by Trustee Middleton, the settlement of• action pending in District Court of Hennepin County by Robert Christianson vs Village of St. Louis Park for damage to premises at 2907 Dakota Avenue on•account of flooding from storm sewer at Colorado and 27th Street, be hereby authorized in the sum of $450,00, it being understood that the'Minneapolis, Northfield & Southern Railroad will contribute $350.00 toward-the settlement in addition to the $450.00 to be paid by the Village; the slum of $450.00 will be payable on delivery of releases and dismissal of said action to the Village Attorney. Minutes The minutes of meeting held February 8, 1954 were read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the minutes of meeting held February 8, 1954 were approved as read, by unanimous vote of all Members of the Council. Licenses Provisionally Approved - Nelson's Plumbing and Heating On motion of Trustee Middleton, seconded by Trustee Jorvig, the applications of Duane A. Nelson, dba Nelson's Plumbing and Heating for Plumbing, .Heating and Gas Installation licenses were approved subject to approval of Building Inspector when he returns from his vacation, and the Building Department was authorized to issue one permit for sewer (to take care of a bad cesspool situation) for 6613 Minnetonka Boulevard, by unanimous vote of all Members of the Council. Bond Terminated - Miracle Mile On motion of, Trustee Middleton, seconded by Trustee Bolmgren, the Clerk was authorized to notify the Surety of bond with Sheldon-Thomas Company, Shopping Centers, Incorporated and Wood-Excel, Incorporated as principals and Saint Paul- Mercury Indemnity Company as surety, in the sum of $10,000.00, covering planting screen at Miracle Mile premises, that the conditions of bond have been fulfilled, and that bond may be terminated, by unanimous vote of all Members of the Council.
