C. Fernstrom at 8:10 P. M. Invocation was given by Reverend Walter Bishop of Union Congregational Church. Resolution On motion of Trustee Middleton, seconded .by Trustee Bolmgren, the following resolution was adopted by unanimous vote of aLl Members of the Council: RESOLUTION VACATING ALLEY 'WHEREAS, a proper petition, signed by Mr., and Mrs. Lloyd C. Payment for Architectural Services - Brandhorst and Leadholm On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the claim of Brandhorst and Leadholm in the amount of $4,760.43, the balance due them for pro- fessional services for preliminary studies of proposed Village Hall and Public Safety Building according to Paragraphs 4 and 5 of AGREEMENT FOR ARCHITECTURAL SERVICES, dated January 25, 1954, was approved, and the Mayor and Clerk were authorized to issue warrant covering same, by unanimous vote of all Members of the Council. Settlement for Fire Damage to Recreation Center Building On motion of Trustee Middleton, seconded by Trustee Jorvig, the offer of _"settlement for fire damage to recreation center building at 6212 West Lake Street in the amount of $1,176.48 in cash, was approved by unanimous vote of all Members of the Council. Refund for Unused Cigarette License Fee - D. K. Carter Company On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request of D. K. Carter Company for refund of cigarette license fee for 1955 for Connie's Standard Service Station, 4701 Excelsior Boulevard, , due to the fact that the station is closed, was approved, and the Mayor and Clerk were authorized to issue warrant covering same in the amount of 512.00, by unanimous vote of all Members of the Council. Letter and Custodians' Certificates from Automatic Voting Machine Corp. Letter from Automatic Voting Machine Corporation, dated December 16, 1954, en- closing custodians certificates for George Gibson and William A. Reiners, certifying that they had completed our detailed course of instruction in the preparation of Automatic Voting Machines for Primary and General Elections, was read and ordered filed. Letter Re: Improvement of Park Property Along Minnehaha Creek Letter from Hennepin County Auditor's Office, dated December 15, 1954, regarding our request for dredging Block 5, Brookside Second Addition, stating that they did not feel that this is a project they can be interested, but a local one which should be handled with local funds, was read. The Clerk was asked to write the County Board and ask how they could spend monies on Crystal Lake dredging, and not on this project. Supplies for Civil Defensb On motion of Trustee Bolmgren, seconded by Trustee Middleton, Requisitions 4595 (4.80), 4596 (33.00), and 4597 (10.00), for supplies - presented by Ralph La Hue, Director of Civil Defense, were approved, and the Clerk was authorized to issue purchase orders covering same, by unanimous vote of all Members of the Council. Salary Increase for Robert Smetak On motion of Trustee Middleton, seconded by Trustee Jorvig, the salary of Robert Smetak, Patrolman, was increased from $323.30 per month to $346.30 per month, effective December 15, 1954 to conform with automatic increase, by unanimous vote of all Members of the Council present. (This increase covers the $10.00 automatic increase and $13.00 salary increase given January 1, 1954)• Post Office On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was instructed to write Congressmen, Humphry, `i'hye and Weir, asking what we have to do to get a Post Office of our own and still receive the 'same service we are getting and a branch of the Minneapolis Office, by unanimous vote of all Members of the Council. Bill for State Legislature On motion of Trustee Jorvig, seconded by 'trustee Bolmgren, the Village Attorney was instructed to make a study and draw up a bill for legislature that will give the Village authority to regulate traffic on State Highways running thru St. Louis Park, by unanimous vote of all Members of the Council. Report of Public Health Nursing activities Report of Nursing Activities of Rural Hennepin County Nursing District for the month of November, 1954, was read and ordered filed. - Animal Report Animal report of Animal Rescue League of Hennepin County for weekending Dec- ember 18, 1954, was read and ordered filed. December 20, 1954 � Building Inspector's Weekly Reports The Building Inspector's reports for weeks ending November 23, December 3, '" 102 172 1954, showing that 75 building permits were issued, totaling $ 753,850.002. was read and ordered filed. Building Inspector's Monthly Report The Building Inspector's report for the month of November, 19542 showing a total of 68 building permits issued, totaling $4942529.00 was read and ordered filed. Letter Re: Condition of Public Sidewalk and Restoration of Bus Stops — H. Ostlund Letter from Harry Ostlund, 2753 Webster Avenue, dated December 13, 1954 con— cerning the condition of public sidewalk on the north side of Minnetonka Boulevard between Vernon and Webster Avenues, stating that the owners do not remove snow and otherwise maintain safe conditions; and suggesting that the Village consider petitioning the Twin City Rapid Transit Company to restore bus stops to their previous locations on the east side of Vernon Avenue and east side of corner of Webster Avenue, was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, the above matter regarding condition of sidewalks was referred to the Street Commissioner for check— ing and to give proper owners due notice, and if not heeded in twelve hours, to proceed under the rules of the snow removal ordinance, by vote of all Members of the Council except Mayor Fernstrom who voted nay because of the way it is being handled. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above matter regarding bus stops was referred to the Police Department for checking and recom— mendation, by unanimous vote of all Members of the Council. Authorization to Purchase U. S. Savings Bonds, Series K On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village Clerk was authorized to purchase in behalf of the Village #132500.00 in principal amount of United States Savings Bonds, Series K, to be dated December, 1954 and maturing in December, 1966; said bonds to be purchased out of proceeds of U. S. Saving Bonds, Series F. in the principal sum of $13,500.002 maturing September, 1954, held in Water Revenue Debt Redemption Fund, and out of any funds available for investment in said Fund, and the Village Clerk is hereby authorized to endorse the $13,000:00 F Bonds now due for redemption, by unanimous vote of all Members of the Council. Pneolator for Civil Defense On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was instructed to write a letter of thanks to the Frank Lundberg Post No. 282, American Legion for the gift of a pneolator to the St: Louis Park Civil Defense Department, by unanimous vote of all Members of the Council. Hearing on Application for Rezoning — L. N. and Clara W. Smith, Max Weingarden ' , tPuxsuant to notice published in the St. Louis Park Dispatch December 2, 19542 a public hearing was had on the application of Lewis N. Smith and Clara W. Smith, and Max Weingarden to rezone the property described therein from Multiple Dwelling Use District to Commercial Use District. The following persons appeared: Attorney John Yngve spoke for the petitioners. He said that Max Weingarden ' of Boulevard Furniture Company desires to erect a building for his business. Trustee Bolmgren asked how close this rezoning comes to the Smith's home. The answer was about 30 to -50 feet. A. T. Newquist, 4224 West 36th Street said that he is not opposed to the rezoning on Excelsior Boulevard but is worried about the balance of the property that faces 36th Street. He does not want to see garages facing his home, built by the store.. Trustee Bolmgren asked where the parking will be. Attorney, John Yngve said on the 20 foot setback. Mayor Fernstrom asked how large the building will be. Mr. Yngve said that it has not as yet been determined. It will depend on what arrangements can be made with Ruden on his 30 foot strip just to the west of this property. Trustee Bolmgren said that he would like to see plans as to the layout of this building and what is going to be used for driveways. We do not want any entrance from 36th Street. Trustee Middleton asked if they had tried to get together with Mr. Ruden. Mrs. Weingarden was present and -said that the plans are to build the building as large as the Council will permit and receiving will be at the front. There will be no alley on the property. Mr. _ Newquist left at this time and said he feels all will be OK. He was advised that when the building permit is issued that the Council will attend to his wishes with regard to the rear portion of the lot and driveway. Ordinance On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following ordinance was adopted by unanimous vote of all Members of the Council: December 20, 1954 3 7 Ordinance, Continued ORDINANCE NO. 464 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassifica- tion of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to as follows: All that part of the SE, of the SE4 of Section 6, Twp. 28, North Range 24, West of the 4th Principal Meridian described as follows: Beginning at a point in the .West line of said,SEr of the SE! distant 357 feet South of the Northwest corner thereof; thence East parallel with the North line of said SEy of SE41, 38.85 feet to the ,Northerly line of Excelsior Boulevard; thence NE'ly along the Northerly line of said Excelsior Boulevard, 235 feet to the actual point of the beginning of the land to be described; thence continuing NE'ly along the Northerly line of said Excelsior Boulevard, 70 feet; thence at right angles NW'ly in a straight line 140 feet; thence at right angle SW'ly 70 feet to a point 140 feet NW'ly from the point of beginning; thence 140 feet SE'ly to the point of beginning, according to the U. S. Government Survey thereof, shall be deleted from the Multiple Dwelling Use District and shall be included in the Commercial Use District, and shall be subject ,to .all of the regulations of said Ordinance relating to Commercial Use District. On motion of Trustee Bolmgren, seconded by Trustee ,Middleton, •the minutes of meeting held December 13, 1954 were approved as read, by unanimous -vote of all Members of the Council.
