REGULAR MEETING OCTOBER 11, 1954
A regular meeting of the Village Council was called to order by Mayor R. C.
Fernstrom at 8:00 P. M.
Invocation was given by Reverend Einar Martinson of Union Congregational
Church.
The following Council Members were present at roll call:

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
ASSESSMENT RESOLUTION
WHEREAS, the Village Council has met at the time and place specified in the
notice of assessment published in the St. Louis Park Dispatch September 23, 1954,
stating the general nature of the following improvements, the area proposed to be
assessed and that written or oral objections would be considered, and has held a
public hearing on said proposed assessment and passed upon all the objections thereto,
therefore
BE IT RESOLVED by the Village Council of the Village of St, Louis Park that
the proposed assessments on file in the office of the Village Clerk covering the cost
of the following described improvements be hereby adopted and shall constitute a
special assessment against the lands described therein in the amounts respectively
set forth therein, which are hereby found to be benefited in a sum equal to said
assessments, with accruing interest thereon, shall be a lien upon the property des-
cribed therein concurrent with general taxes, payable in five equal annual install-
ments, the first of which,-installments shall be payable on the first Monday in
January, 1955. Deferred installments shall bear interest at the rate of 5% per
annum from the date of this resolution until December 31, 1954, and to each subse-
quent installment interest shall be added for one year on all unpaid installments.
The improvements above referred to for which the assessments are adopted and
levied are described as follows:

Hearing on Proposed Sanitary Sewer Extensions - 54-156
Pursuant to notice published in the St. Louis Park Dispatch September 16 and 23,
1954, a public hearing was had on the following proposed sanitary sewer extensions:
Improvement Number 54-156 - Sanitary Sewer Extensions in France Avenue
from 25th Street to its intersection with Glenhurst Avenue; Glenhurst
Avenue from France Avenue to 28th Street; Cedar Lake Avenue from Glen-
hurst Avenue to France Avenue; France Avenue from Cedar Lake Avenue to

the south line of Lot 2, Block 9, Sunset Gables 2nd Addition,
the estimated cost is $29,172.00, and the area proposed to be assessed is the lots
and tracts of land adjacent to the portion of the streets above described where said
sewers are to be constructed.
The following persons appeared ----- A petition was presented and read signed
by Mr. and Mrs. R. E. Hirschtal, 2660 Glenhurst Avenue and others, opposing the
proposed construction of sanitary sewer. Frank Janes, 2668 Glenhurst Avenue spoke
in opposition due to cost as well as the cost of house connection. Said Mrs. Marion
Thompson, 2701 Glenhurst whose name appears on petition, does not want it now due
to change in family. Mr. Janes said he made a survey in the neighborhood and feels
that sewer is not needed in this area at this time. Also the cost is so high- and
it would cost them so much before they could get it to their homes, and more than
they want to pay for.
Walter-Menzel, 2656 Glenhurst Avenue spoke in opposition to this proposed
sewer. Said he also made a survey in the neighborhood and feels that no one needs
same. Dr. George M. Tangen, 2640 Glenhurst Avenue said he is anxious to have sewer
put in as he needs it.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Improvement
No. 54-156 was abandoned, by unanimous vote of all Members of the Council.
Building Permit for Addition to Hardware Store - Behning
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Building
Inspector was instructed to issue a building permit to Behning Hardware Company
for commercial building as an addition to their present building at 4815 Minnetonka
Boulevard according to plans presented therefore, and to conform with all building
regulations, by unanimous vote of all Members of the Council.
Applications for Permits
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
applications for permits were approved, and the Mayor and Clerk were authorized to
issue same-subject to- all rules and ordinances and approval of the Fire Chief, by
unanimous vote of all Members of the Council:
Permit to install One (1) 1,000 gallon gasoline
storage tank at C. Ed. Christy Service Station,
6401 West Lake Street for Phillips Petroleum Co.,
212 South Sixth Street, Minneapolis.
Permit to install One (1) 1,000 gallon gasoline
storage tank at 3360 Gorham Avenue for Henry and
William Doepke, by Clarence K. Bros., St. Louis Park.
Bonds
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
bonds which have been approved by Village Attorney, E. T. Montgomery, were approved
by unanimous vote of all Members of the Council:

On motion of Trustee Jorvig, seconded by Trustee Middleton, the bid of Donald
R. Frantz Concrete Construction, Inc. received October 4, 1954, for the construction
of Improvements #54-138, 139, 140, 1422 143, 144, 146, was determined to be the
lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute
contract for the Village with the bidder for the work at prices bid of 40¢ per SF
for 32" walk; 15¢ per SF for 22" walk, and $p2.00 per CY for pit run gravel by yea
vote of four Members of the Council; Mayor Fernstrom voting nay, stating as his
reason that he did not wish to overrule the Village Engineer's recommendation.

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the bid of
Victor Carlson & Sons, Inc. received October 4, 1954, for the construction of curb

lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to
execute contract for the Village with the Bidder for the work in the amount bid of

Planning Commission's report dated October 6, 1954, on the application of
Reliable Sign Company for a permit to erect an advertising sign at 7511 Highway No.

On motion of Trustee Jorvig, seconded by Trustee Middleton, the request of
Reliable Sign Company for a permit to erect an advertising sign at 7511 Highway No.
12 (Irlayzata Boulevard) was denied on the ground that there would not be the required
400 feet between it and another similar ground sign which was approved on an applica-
tion of an earlier date, by unanimous vote of all Members of the Council.

Planning Commission's report dated October 6, 1954, on the application of
Nordquist Sign Company for a permit to erect an advertising sign on the SW Corner
of Louisiana Avenue and Wayzata Boulevard for Bruce Construction Company, stating
that action was withheld for lack of correct information as to the definite loca-
tion of this sign in relation to surrounding improvements; was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the above
mentioned request for permit to erect sign was granted as per plat accompanying

Planning Commission's report dated October 6, 1954, on the application of

On motion of Trustee Middleton, seconded by Trustee Jorvig, the application
of Zephyr Oil Company, 5050 Excelsior Boulevard for permit to erect One (1) V shaped
billboard was approved, providing same complies with the Sign Ordinance (4001 ),
and the Building Inspector was authorized to issue permit for same, by unanimous vote
of all Members of the Council.
Schedule of Regional Meetings - League of Minnesota Municipalities
Schedule of Regional Meetings, sponsored by League of Municipalities for the
Fall of 1954, was read. On motion of Trustee Middleton, seconded by Trustee Bolm-
gren, Trustee Holmgren, Trustee Jorvig, and Clerk Justad were authorized to attend
Regional Meetings sponsored by League of Municipalities to be held at Waconia,
Minnesota, October 14, 1954, with necessary expenses paid, by unanimous vote of all
Members of the Council.
Request for Permission to Place Poles
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of
Northern States Power Company to place One (1) pole on West 28th Street between
Brunswick Avenue and Colorado Avenues was approved, by unanimous vote of all Members
of the Council.

was authorized to issue purchase order for same, by unanimous vote of all Members of

Letter from Milton I. Silverman, 2601 Huntington Avenue, dated .October 6,
1954, requesting a permit for construction of retaining wall adjacent to his
property, was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, a permit was
granted to Milton I. Silverman to maintain existing retaining wall on the south side
of 26th Street adjacent to Lot 1; Block 1, Thorpe Brothers Cedar Lake Heights,
subject to the continuing right of the Village to terminate this permit and order
removal of the wall at any time, by unanimous vote of all Members of the Council.
Ordinance No. 460
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
ordinance was adopted by unanimous vote of all Members of the Council:
ORDINANCE NO. 460
AN ORDINANCE ESTABLISHING RATES AND CHARGES
FOR THE COLLECTION AND DISPOSAL OF GARBAGE
AND REFUSE IN THE VILLAGE OF ST. LOUIS PARK
The Village Council of the Village of St. Louis Park ordains:
Section 1. It is hereby determined that the proportionate cost incurred by
the Village for the regular collection and disposal of garbage and refuse from
dwellings in the Village of St. Louis Park for the twelve-month period ending
September 1, 1954, shall be at the rate of $16.90 per dwelling, said sum consisting
of x$11.19 for cost of collection, and $5.71 for cost of disposal, and the owners of
all property served by the garbage and refuse collection service of the Village
shall be obligated to pay such sum of $$16.90 to the Village Treasurer on or before
October 15, 1954: Any dwelling served for less than a twelve-month period shall
be charged at the rate of $.88 per month or fraction thereof for cost of collection.
Section 2. Subject to subsequent amendment to this ordinance, the rate or
charge for collection and disposal of garbage and refuse from dwellings in the
Village of St. Louis Park by the Village garbage and refuse collection service for
each annual period from and after September 1, 1954, is hereby determined to be
$16.90 per dwelling per year, provided, however, that the Village Council reserves
the right to amend and modify such rate for any such annual period depending upon
the actual cost of collection and disposal during each respective annual period.
Section 3. In default of payment of the charges herein provided on or before
September 1st of each year, the Village Council shall, by resolution, levy an
assessment equal to such unpaid cost as of October 1st of each year against each
lot or parcel of land so served for which the service is unpaid.
Section 4. This Ordinance shall take effect from and after its publication.
Agreement
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
agreement by and between the Village of St. Louis Park as party of the first part,
and The Animal Rescue League, Incorporated as party of the second part, dated
October 11,•1954, was approved, and the Mayor and Clerk were authorized to sign
same for the Village, by unanimous vote of all Members of the Council.
A G R E E M E N T
THIS AGREEMENT made and entered into as of the 11th day of October, 19540
by and between the VILLAGE OF ST. LOUIS PARK; a municipal corporation (hereinafter
call the "Village",) party of the first part, and THE ANIMAL RESCUE LEAGUE, INC.,
a non-profit humane corporation, under the laws of the State of Minnesota (herein-
after called the "League",) party of the second part, WITNESSETH that
WHEREAS, the parties hereto entered into an agreement under date of May 10,
1954, wherein the League undertook to patrol the public streets of the Village and
enforce the provisions of the ordinances of the Village relating to dogs, and
WHEREAS, it will be to the mutual benefit of the parties hereto and will

increase the efficiency of the operations of the League under said contract to install
and use a short wave radio in the patrol truck of the League, therefore
IT IS HEREBY AGREED by and between the parties hereto, as a supplement to said
agreement of May 10, 1954, as follows:
1. The Village will purchase and install'in the patrol truck of the League
a short wave radio equipped for communication with the Village Police Department
radio transmitter, and does hereby grant permission to the League to use said radio
equipment in connection with its law enforcement operations under said agreement
with the Village, upon the terms and conditions hereof. The said radio equipment
installed in the patrol truck of the League will remain the property of the Village,
and the League will remove the same and deliver it to the Village and the Village
shall be entitled to reposses the same at any time.
2. The League will maintain the said radio equipment in its truck with
reasonable care and will use the same only in connection with its services rendered
to the Village under said agreement of May 10, 1954•
3. The League will reimburse the Village, within thirty days after installa-
tion of said radio equipment in the League's patrol truck, for one-half of the cost
thereof including the cost of installing the equipment in the League's truck. If
the said agreement between the parties hereto, dated May 10, 1954, is terminated,
or the said radio equipment is repossessed by the Village for reasons other than
termination of said agreement, the Village will pay to the League a sum equal to the
amount so paid to the Village covering the original cost and installation expense,
less 20% for each year or fraction thereof that the radio equipment remains installed
in the truck of the League, said payment to be made forthwith upon delivery of the
radio equipment to the Village, it being understood that the equipment re-delivered
will be in good condition, subject to reasonable wear resulting from proper use
thereof. Any costs of maintenance and repair of said radio equipment while being
used in the truck of the League shall be paid equally by the parties hereto.

RESOLUTION AUTHORIZING ADVERTISEMENT FOR BIDS
FOR IMPROVEMENT BONDS
WHEREAS, the Village Council has heretofore ordered donstruction of various
improvements and contracts have been entered into for construction thereof or the
work has been completed as authorized by Sections 412.401 to 412.481, Minnesota
Statutes, and the aggregate cost of said improvements which has been heretofore
incurred or is estimated to be incurred will be in excess of $46,000.00 and it is
deemed necessary in order to defray the cost of said improvements that the Village
issue its improvement bonds in said amount, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park as
follows:
1. That the Clerk be hereby directed to advertise for bids for improvement
-bonds of the Village of St. Louis Park to be issued for the financing of said im-
provements, said advertisement to be published in the St. Louis Park Dispatch and
Commercial West, specifying that bids will be opened at the meeting of the Village
Council to be held October 25, 1954•

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the -application
of Naegele Advertising Company for a permit to erect an advertising sign-on canopy
of Cusack & CarlsonJs building at 4021 Vernon Avenue was approved, and the Building
Inspector was authorized to issue same, by unanimous vote of all Members of the
Council.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION LEVYING ASSESSMENT FOR COLLECTION
AND DISPOSAL OF GARBAGE AND REFUSE
WHEREAS, the Village Council has heretofore determined by Ordinance No. 460
that the owners of all property in the Village served by the garbage and refuse
collection service of the Village shall be obligated to pay the sum of $16.90 per
dwelling to the Village Treasurer on or before October 15, 1954, for the cost of
such service for the 12 month period ending September 1, 1954, and
WHEREAS, the Village Clerk has prepared an assessment roll setting-forth an
assessment in the sum of $16.90 against each dwelling served by the garbage and
refuse collection service of the Village during said 12-month period prior to Sept-
ember 1, 1954, at a proportionate sum per dwelling served only during a portion of
said 12- month period, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
said assessment roll is hereby adopted and approved and there is hereby levied
and assessed against each and every tract of land described therein an assessment
in the amounts respectively therein set forth, which assessments are hereby de-
termined to represent the cost of collection of garbage and refuse from said
respective premises during the 12-month period ending September 1, 1954•
BE IT FURTHER RESOLVED that the Village Clerk be hereby authorized to deliver
said assessment roll to the Auditor of Hennepin County for collection of assessments
therein set forth in like manner as state, county and other taxes are collected
and payment thereof enforced.

Asbury Hospital
On recommendation of Committee of Whole, it was moved by Trustee Jorvig,
seconded by Trustee Bolmgren, the Village Attorney was directed to prepare an ordi-
nance rezoning to Multiple Dwelling the South 1200 feet o� the East 600 feet of the
proposed Asbury Hospital Tract on the following conditions:
1. No building to be erected within 135 feet of the west line of the
Brooklawns Addition, and said area not to be used for guest parking.
2. The East 135 feet to be used for driveway and landscaping only.
3. The premises rezoned to be used for hospital purposes only, and if
not so used by commencement of a hospital building within three years
from this date the rezoning to be void.
The question was asked "will Asbury Hospital purchase the 35' just west of Brooklawns
with easement for Northern States Power Company for High Lines. Wm. Cusack said
that it is in the purchase agreement. The proposed ordinance was read and Mr.
Kraft said he was opposed to Sections 3 and,4, and suggested that #3 be changed to
read "No Public Parking Area", and to leave out the "no parking of vehicles shall
be permitted." Mr. Spry was asked who would park there. He said Doctors. He was
asked how many Doctors. He said 60 plus those on staff. He was asked the average
number of cars each morning. Dr. Hoffert said about 30. Mr. Spry said that the
employees should have low priority. Trustee Jorvig asked if, in designing the
hospital, a plan for parking of employees. cars could be worked out which would not
be objectionable. Mr. Spry said ambulances should have a continuous route in and
out of the hospital grounds. Mr. Doimer spoke in opposition to the change in parking
section. Mr. Spry said that after the help goes home and after visiting hours, there
will be very little parking.

On motion-of Trustee Middleton, seconded by Trustee Jorvig, the following
ordinance was adopted by unanimous vote of all Members of the Council:
ORDINANCE NO.. 461
AN ORDINANCE XHENDING THE, ZONING ORDINANCE OF,
THE VILLAGE OF ST, LOUIS PARK
The Village Council of the.Village of St.- Louis Park ordains:
Section 1. The Zoning Ordinance of,the Village of St. Louis Park. adopted
January 20, 1932, as heretofore amended, is hereby further amended by reclassifica-
tion of the. area of the respective use diptricts as defined in Section 2.2 of said
ordinance, and. the use district maps therein referred to, as follows:
That part of the E2 of the NE4 of Section 20, township
117, Range 21, lying west of Brooklawns Addition, south of
a line drawn parallel to and 1200 feet north of Excelsior
Boulevard, east of line drawn parallel to and 600 feet west
of the west line of Brooklawn5 Addition, northerly of Minnehaha
Creek, and also all that part, of the NE4 of the SE4 of Section
20, Township 117, Range 21, lying northerly of 14innehaha Creek
and Excelsior Boulevard and west of the west line of Brooklawns
Addition,
shall be deleted from the Residence Use District, the "A" Density District and the
Two and one-half Story Height District, and shall be included in the Multiple Dwelling
Use District, the I'D" Density District and the Six Story Height District, subject,
however, to the following conditions and restrictions:
1. The use of said premises shall be restricted to the uses authorized in
Sections 5.1-1, 5.1-7, 5.1-8, 5.1-10 and 5.1-11 of this ordinance, and none of the
uses authorized. by Sections 5.1-2, 5.1-3, 5.1-4, 5.1-5 and 5.1-9 of. this, ordinance
shall be permitted on said premises; and if construction of a hospital building
has not been commenced on said premises within three years from the date of this
ordinance the reclassification herein provided for shall be null and void and the
premises shall be subject to and included in the use, height and density districts
in which they were included prior to the adoption of this ordinance.
2. No building shall be erected within 135 feet of the West boundary of
Brooklawns Addition except, with the approval of the Village Council, a parking
area to accommodate not to exceed thirty passenger automobiles may be provided and
maintained within seventy-five feet of the hospital building for emergency and
medical staff parking.

3. No parking area shall be constructed or maintained and no parking of
vehicles shall be permitted within 135 feet of the west line of Brooklawns Addition.
4. A driveway may be permitted, with the approval of the Village Council,
within said area lying 135 feet west of Brooklawns Addition.
5. Said area within 135 feet west of the west line of Brook;awns Addition
shall be landscaped and sod and lawn shall be maintained thereon.
Slope Property to Curb
Owner of property on the SW Corner of Minnetonka Boulevard and Nevada Avenue
called Council's attention to the need for sloping the east side of her property
to the curb, now that the curb is in.
On motion of Trustee Bol.mgren, seconded by Trustee Jorvig, the above matter
was referred to Trustee Middleton to take up with the Street Commissioner and
Village Engineer, by unanimous vote of all Members of the Council.
