REGULAR MEETING JANUARY 25, 1954
A regular meeting of the Village Council was called to order by Mayor
R. C. Fernstrom at 8:05 P. M.
The following Council Members were present at roll call:

sedans with a trade-in of One (1) 1951 Ford Custom Two-door Coach, and One (1)

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing
bidg were referred to the Chief of Police and Chairman of the Public Safety
Committee for tabulation and recommendation, by unanimous vote of all Members of
the Council. -
Hearing on Petition to Vacate Alley - F. 0. Fogelmark
. A hearing was had on the petition of F. 0. Fogelmark and Mabel L. Fogelmark
for 'vacating the streets described in the following resolution. No persons
appeared:

On motion of Clerk Justad, seconded by Trustee Jorvig, the following resolu-
tion was adopted by unanimous vote of all Members of the Council present:
RESOLUTION VACATING PORTION-OF STREETS
WHEREAS, the Village Council has met at the time and place specified .in
the notice published in the St. Louis Park Dispatch on January 7 and 14, 1954,
relating to vacation of the streets hereinafter described, and has heard all
interested persons appearing at said hearing and determined that the petition •for
vacation of said streets of F. 0. Fogelmark-and Mabel L. Fogelmark was signed .by
a majority of owners of the property fronting on the portions of said streets to
be vacated, and that it is in the public interest that said streets be vacated,
therefore
BE-IT RESOLVED by the Village Council,of the Village of St. Louis Park
that Edgewood Avenue from Cedar Lake Road to Franklin Avenue Adjacent to Lots 1
and 2. Block 2, Supreme Park 1st Division, and Lot 4, Block 3, Westwood Park
2nd'Division, and Franklin Avenue from the west line of Edgewood Avenue east to
Dakota Avenue, as the same is now dedicated within the corporate limits of said
Village, be hereby vacated.
Hearing on Application for Rezoning' - St. Louis Park Theatre
Pursuant to notice published in the St. Louis Park Dispatch December 31,
1953, a public hearing was had on the application of St. Louis Park TheatrelCo.
for`rezoning Lots 1 thru 11, Block 2, Calhoun Addition from Residence Use District
to Commercial Use District. E. H. Rouse, 2810 Ottawa Avenue presented a
petition signed by Beatrice L. Skinner, 3044 Ottawa Avenue and others which reads
as follows:
"We, the undersigned object to the rezoning of Lots 1 thru 11,
Block 2, Calhous Addition, from Residence Use District to Com-
mercial Use District because it would greatly increase traffic '
on Ottawa Avenue which was originally a residential Street. Also
we the property holders do not wish to bear the expense of-this
street widening. Also the introduction of Commercial property
adjacent to our homes will not only decrease their value but it
will be very inconvenient for those of us who have built our
homes in this area which has always been residential."
On motion of Trustee Jorvig, seconded-by Trustee Middleton, the foregoing
matter was referred to the Committee of the -Whole for a report on February 15,
1954, by unanimous vote of all Members of the Council.

Gas Main Extension
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
gas main extension was approved by unanimous vote of all Members of the Council:

Permission to Place Pole
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company was granted permission to place One (1) pole on Nevada Avenue
and West 18th Street, by unanimous vote of all Members of the Council present.
Resolution
On motion of Trustee Middleton, seconded by Trustee Bolrgren, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION REFUNDING MAIN TRUNK SEWER #2 ASSESSMENT
V1HEPEAS it appears that by resolution of the Village Council of the Village
of St. Louis Park levying assessments for Main Trunk Sewer #2, Lot 125, Norwaldo
Addition was charged for one unit at a total cost of 0100.00; and
WHEREAS the following error was inadvertantly made: On January 30, 1950"
the owner of the above lot paid $70.00 (Receipt #2505A) as full payment for the
above assessment. Ori May 31, 1951, Lot 125 was combined with the Nz of Lot 126 as
Parcel 2640, so the above owner should have been charged for z unit (or a total of
$50.00) from 1951 on. The amount ($6.10), which appeared on the 1950 (payable
1951) tax statement was correct. However, in 1952 and 1953 the County Auditor
inadvertantly failed to credit the owner with the previous payment for Lot 125,
and he was charged with the respective amounts of x$17.70 and $17.25 instead of
$5.90 and $5.75; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the 1952 and 1953 installments of said assessment heretofore paid in the respective
amounts set forth below be refunded to the respective owner, and upon receipt of a
signed verified claim and the paid tax statements, that the Mayor and Clerk be
hereby authorized to issue a warrant in payment of such refund to the respective
property owner.

Letter - Withdrawal of Application for 'On-Sale Liquor License - Park Tavern
Letter from George G. Harrison, Co-partner, Park Tavern, dated January 20,
1954, stating that they wished to withdraw their application for an on-sale hard
liquor license, was read. On motion of Trustee Middleton, seconded by Trustee
Jorvig, the request of Park Tavern for the withdrawal of their application for on
on-sale liquor license was approved, and the Clerk was authorized to return their
Check No. 1704, dated December, 1953, in the amount of $2,000.00 which accompanied
their application, by unanimous vote of all Members of the Council.
Letter - Withdrawal of Application for Off-Sale Liquor License - L. M. Holland
Letter from Attorney Donald C. Savelkoul, dated January 20, 1954, stating
that his Client, Lawrence M. Holland wishes to withdraw his application for an off-
sale liquor license (no location designated) for the present, was read. On motion
of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing request was
granted, by unanimous vote of all Members of the Council.
Building Inspector's Weekly Report
The Building Inspector's report for week ending January 15, 1954 and week
ending January 22, 1954, showing that 3 building permits were issued, totaling
$28,900.00, were read and ordered filed.

Letter =Withdrawal of Application for Off-Sale Liquor_License - Arthur Rubin
Letter from Arthur Rubin, dated January 20, 1954, requesting that his appli-
cation for an off-sale intoxicating liquor. license be withdrawn, was read. On
motion of Trustee Middleton, seconded by Trustee Jorvig, the foregoing request was
granted, by unanimous vote of all Members of the Council present.
Application for Off-Sale Intoxicating Liquor License - Richard Winer
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the application
of Richard Winer dated January 18, 1954, for a license to sell intoxicating liquor
off-sale at 5003 Excelsior Boulevard was referred to the Committee of the Whole,
by unanimous vote of all Members of the Council present.
Letter Re: Garbage Disposal for Edina Village
Letter from S. R. Mitchell, Edina Village Manager, dated January 11, 1954,
regarding the possibility of their using our new incinerator for garbage disposal,
was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk
was instructed to write to Mr. Mitchell stating that our position in this matter
is the same as it was when they made their first request on May 19th, 1953• Motion
was passed by unanimous vote of all Members of the Council present.
Letter Re: Survey of Municipal Protection System - Fire Underwriters Bureau
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the letter
from W. C. Freitag, Engineer for Fire Underwriters Inspection Bureau, dated January
20, 1954, stating that they would begin to make a survey of the Municipal Fire
Protection Facilities in the Village sometime during the month of March was read
and ordered placed on file, by unanimous vote of all Members of the Council.
Letter Re: Voting Machines - Board of Hennepin County Commissioners
Letter from the Board of Hennepin County Commissioners, dated January 14,
1954, relative to their purchasing voting machines and renting or selling them to
the towns and villages, was read, and the clerk was instructed to write to Com-
missioner George Matthews, stating our position in this matter.
Letter Re: New Federal Census
Letter from Jack B. Robertson, Chief, Field Division, Bureau of the Census,
dated January 19, 1954, stating that the new census for the Village is scheduled
for the early part of February was read and ordered filed. Mayor Fernstrom explained
to those present the reason for the request of the Village Council for this new
census.
Application for License to Drive Taxicab - Ole C. Johnson
On motion of Trustee Bolmgren., seconded by Trustee Jorvig, the application of
Ole C. Johnson, 3148 Longfellow Avenue, Minneapolis, for a license to drive a
taxicab for the St. Louis Park Radio Cab was referred back to Police Chief, Andy
Nelson to check with Taxicab Inspector in Minneapolis and make a report on same
to the Village Council on February 1, 1954, by unanimous vote of all Members of the
Council.
Letter Requesting I.terview -- Architects for Knollwood Plaza
Letter from Thorshov & Cerny, Incorporated, Architects for Knollwood-Plaza,
dated January 22, 1954, requesting an interview with the Council to review their
project, was read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren,
February 1, 1954, at 9:00 P. M., at the Village Hall was set as date for this inter-
view, and the Clerk was instructed to so inform Thorshov & Cerny, Inc., by unanimous
vote of all Members of the Council.
Minutes
The minutes of meeting held January 18, 1954 were read. On motion of Trustee
Middleton, seconded by Trustee Jorvig, the minutes of meeting held January 18, 1954
were approved as read, by unanimous vote of all Members of the Council.
Movie Film for Civil Defense
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of
Ralph J. La Hue, Director of Civil Defence, for approval of Requisition No. 430,
for One (1) Movie Film Titled "Operation Doorstep, including 400 foot reel and can
at the price of $27.00 F.O.B. St. Louis Park, was read, and the Clerk was authorized
to issue purchase order for same, by unanimous vote of all Members of the Council.
Contract for Architectural Services Brandhorst and Leadholm
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor and
Clerk were authorized to execute on behalf of the Village, .a contract with Brand-
horst and Leadholm for architectural services in connection with proposed e
Village Hall and Safety Building which has been prepared by the Village Attorney
on the basis of a fee of 6% of the cost of the building; $6,000.00 to be paid for
preliminary studies, 42% less the $6,000.00 for preparation of plans and specifications
and 1�% for supervision, by unanimous vote of all Members of the Council.

Hearing on Application for Rezoning - Landers-Norblom-Christenson Company
Pursuant to notice published in, the St. Louis Park,-Dispatch January 14,
1954, a public hearing was had on the application of Landers-Norblom-Christenson
Company for rezoning from Open Development District to Light Industrial District,
the gravel pit-property owned by them between Minnetonka Boulevard and West
33rd Street, and between the Great Northern Railway Right-of-Way and Texas
Avenue, excepting a strip of land 200 feet wide lying directly south of Minne-
tonka Boulevard between Utah Avenue and the Great Northern Railway Right-of-Way
which is now zoned within the Commercial Use District.
Due to size of attendance, the hearing was adjourned to the St. Louis Park
High School Auditorium. Approximately 600 persons appeared.
The Clerk read the Planning Commission's•report dated January 4, 1954.
M. A. Davitt, President of Urbanite, Incorporated was called on first. He
explained his project and showed a drawing of what he said would be beautiful
well-landscaped buildings which would in no way blight the area.
The following persons spoke in opposition to the rezoning and directed many
questions to Mr. Davitt, Mayor Fernstrom, and John Louis, of the St. Louis Park

Mayor Fernstrom and John Louis of the Chambee of Commerce explained the present
uncomfortable tax situation now existing in the Village and pointed out that more
industry must be attracted if the home owners can expect .tax relief. Mayor Fernstrom
made reference to the future school building program which faces the community do
to the rapidly increasing number of homes and school-age children.
Herbert P. Lefler, Attorney for Texa-Tonka Buisnessmen's Association filed a
brief in opposition to the petition of Landers-Norblom-Christenson Company for
rezoning of the gravel pit at the intersection of Minnetonka Boulevard and Texas
Avenue, St. Louis Park, Minnesota, from Open Development to Light Industry. The
Members of this association appearing-on said brief are ----- Penny Super Market,
Suburban Dry Cleaners, Mike Zoss Variety, Mike Zoss Drug, Texa-Tonka Clinic,
Hobby Shop, Mac's Men's Shop, Swenson Furniture, Tonka Liquor Store, Freer Bakery,
Friedman Department Store, Bonhus Hardware, Midwest Shoe Repair, Rainmaker Soft
Water, Tonka Barber Shop, Dale's Apparel, Evenson Paints, Texa-Tonka Service, and
Three Tees'-Hot Food Take-out.
A petition signed by 990 residents in the area was presented, stating that
all the property bounded by Minnetonka BouleV&rd on the North, the Great Northern
Railroad tracts on the West, Utah Avenue on the, East, and 33rd Street on the South
be rezoned and zoned as residential property, except that the property adjoining
Minnetonka Boulevard be zoned as Commercial.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on
above rezoning was deferred to the meeting of February 8, 1954, by unanimous vote
of all Members of the Council present.
