REGULAR MEETING SEPTEMBER 289 1953
A regular meeting of the Village Council was called to order by Mayor C. L.
Hurd at 8:07 PM.
Reverend Paul Obenauf of Wooddale Luthern Church gave invocation.
The following Council Members were present at roll call:

On motion of Trustee Middleton, seconded by Trustee Jorvig, the above bids
were referred to the Village Engineer and Chairman of the Street Department Com-
mittee for tabulation and recommendation, by unanimous vote of all Members of the
Council present.
Hearing on Proposed Grading Improvement No. 53-119
Separate hearings were had on the proposed public improvements described
in the following resolution. No one appeared.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION ORDERING STREET GRADING
WHEREAS the Village Council has met at the time and place specified in the
notice published in the St. Louis Park Dispatch September 17 and 24, 1953, relat-
ing- to the public improvements hereinafter described and has heard all interested
persons appearing at said meeting and has secured from the Village Engineer a
report advising it in a preliminary way as to•whether each proposed improvement is
feasible and as to whether it should best be made as proposed or in connection
with some other improvement, and the estimated cost of the improvements as-
recommended; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the following public improvements be hereby ordered in accordance with plans
and specifications which have been prepared by the Village Engineer and filed with
the'Village Clerk, and the. Village Clerk is' hereby directed to advertise for bids
which will be opened at the meeting of the Council, Oetober--14 1953•
STREET GRADING
Improvement No. 53-119 --- 14th Street from Louisiana Avenue to Oregon
Avenue:
Hearing on Proposed Street Improvements - Bituminous Stabilized Base-
' Separate hearings were had on the proposed public improvements described in
the'following resolution. The following persons appeared: George Rokosky, 2821
Pennsylvania Avenue asked what this treatment-consists of. Mayor Hurd advised him.
Mr. -Rokosky stated that the grade now is level and the drainage is poor, and this
project should correct this. George Nelson; 2825 Pennsylvania Avenue said he was
concerned with the same problem as Mr. Rokosky.
Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council present:

Hearing on Proposed Storm Sewer Drain
Pursuant to notice published in the St. Louis Park Dispatch September 17,
1953, a public hearing was had on proposed construction of storm sewer and drain
extending from the east line of State Highway No. 100 at a point approximately 84
feet Sly, measured at right angles from the Sly line of the Chicago, Milwaukee,
St. Paul and Pacific Railway Right-of-way, thence extending westerly parallel to
said railway right-of-way to adjacent property owned by the Village of St. Louis
Park, said storm sewer and drain to be used for drainage of water used in connec-
tion with Village incinerator plant now under construction and also for future
outlet of storm sewer to be constructed in Oxford Street from Alabama Avenue to
Wooddale Avenue; thence westerly in Wooddale Avenue to Yosemite Avenue; thence
north in Yosemite Avenue to St. Louis Avenue; thence east in St. Louis Avenue to
Webster Avenue; thence north in Webster Avenue to point of connection with the
sewer and drain presently to be constructed as above described.

Hearing on Proposed Storm Sewer & Drain Construction, Cont'd.
Due to lack of proper advertisement, the entire matter was referred back
to the Village Attorney and Village Engineer. Mayor Hurd explained to those
who appeared, how the proposed project would affect them.
Hearing on Application for Rezoning - Ecklund & Swedlund
Pursuant to notice published in the St. Louis Park Lispatch September 17,
1953, a public hearing was had on the application of Ecklund & Swedlund Cons-
truction Company to rezone from Residential Use to Commercial Use, all that
portion of Lots 15 and 16, Home Addition not now zoned for Commercial Use. No
persons appeared.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action was
deferred to meeting of October 5, 1953, pending receipt of agreement as recom-
mended by the Planning Commission in their report dated September 2, 19535 by
unanimous vote of all Members of the Council present.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the foregoing
request was approved by unanimous vote of all Members of the Council present.
Letter Re: Grading State Aid Road No. 16 - Henn. Co. Highway Dept.
In reply to our letter of September 18, 1953, letter received from the
Highway Department, County of Hennepin, dated September 22, 1953, regarding their
plan which has been prepared for the grading of State Aid Road No. 16, adjacent
to the underpass of Trunk Highway No. 100 which includes the taking of dirt from
the spoil bank on the Minnesota Sand and Gravel Company's property, was read and
ordered placed with correspondence to be brought up again on October 5, 1953•
Tentative Replat of Lots 13, 14, 19, and 20, Home Addition
On motion of Trustee Middleton, seconded by Trustee Jorvig, the tentative
replat of Lots 13, 14, 19 and 20, Home Addition to St. Louis Park was approved by
unanimous vote of all Members of the Council present.

State Deed - Conveyance of Lot 17, Block 10, Westmoreland Park
A
, On motion of Trustee Middleton, seconded by Trustee Jorvig, the conveyance
of Lot 17, Block 10, Westmoreland Park Addition (State Deed No. 98702) to the
Village of St. Louis Park to be used for park purposes was approved, and the
Village Attorney was instructed to file same with the Office of Register of Deeds
of Hennepin County, Minnesota, by unanimous vote of all Members of the Council
present.
_Request for Permission to Install Electrolysis Test Points - Mpls. Gas Co.
Letter from Minneapolis Gas Company, dated September 18, 1953, requesting
permission to install electrolysis test points at the following locations, was
read:

On motion of Trustee Middleton, seconded by- Trustee Jorvig, the foregoing
request was approved, by unanimous vote of all Members of the Council present.
Letter Re: Rates for Prisoners for Board & Room at Workhouse
Letter from the Minneapolis City Workhouse, dated September 22, 19532
informing the Village Council that the rate for board and room of prisoners at the
Minneapolis City Workhouse will be increased to $3.50 per day, effective October
1, 1953, was read and ordered filed.
Petition for Street Light
Petition, signed by Mrs. Darwin Kenyon, 2721 Louisiana Avenue and others,
dated September 182 1953, for the installation of a. street light on the corner of
Louisiana Avenue and 27th Street, was read.
Street Light Ordered
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Northern
States Power Company was instructed to place a street light on the corner of
Louisiana Avenue and 27th Street, by unanimous vote of all Members of the Council
present.
Petitions for Street Improvements
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
petitions were referred to the Village Engineer, Chairman of the Street Department
Committee and Special Assessment Department,. for checking and recommendation, by
unanimous vote of all Members of the Council present:

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
petitions were referred to the Village Engineer, Chairman of the Water Department
Committee and Special Assessment Department for checking and recommendation, by,
unanimous vote of all Members of the Council present:

and Leonard C. Swedlund, dated September 282 1953,
for the construction of water main in PENNSYLVANIA
AVENUE AND OREGON AVENUES SOUTH OF CEDAR LAKE ROAD IN
THE PROPOSED REPLAT OF LOTS 13, 14, 19, and 20, HOME

Assessment Hearings
Separate hearings were had on each of the following various public improvements
assessments, described in the following resolution: The following persons appeared:
Richard Miller, 2525 Virginia Avenue appeared representing a group from his
area regarding Improvement #51-187 -- Feels that the benefit of this improvement
is not felt by folks north of the Great Northern-Tracks, and that the entire assess-
ment should be assessed against the entire Village. He also presented petitions
signed by Robert Wm. Rischmiller, 2520 Virginia Avenue, Thomas M. Beckley, 8306
Virginia Avenue, and George B. Phillips, 7912 West 26th Street, all dated September
281 1953, opposing the assessment for Improvement No. 51-187, and suggesting that
the cost of same be assessed against the entire Village.
Thomas Buckley, 8306 Virginia Circle North appeared. Said he feels that the
notice of hearing was defective, and he was under the impression that this would
not bean assessment hearing, and requested that this hearing be continued for one
week to give folks in the,area an opportunity to file a written objection to
Improvement No. 51-187. George B. Phillips, 7912 West 26th Street said that he
feels that this improvement should be born by the entire Village as a whole. George
'Nelson, 2825 Pennsylvania Avenue feels the area designated is too limited in scope
for the number of users of Louisiana Avenue bridge, and feels that the cost should
be paid for from the General Fund, or an all over Village assessment.
George Rokosky, 2821 Pennsylvania Avenue said he feels as the rest do that
a general all-village assessment should be made. Leo Wallman, 8407 Virginia
Circle South said he feels that the assessment should be on a general all-village
basis. Mayor Hurd explained the reasons for the assessment. Melvin Krupp,
of Eliotview Road said he was objecting basicly because he feels the assessment
is not just. He called attention to the north side water main (trunk) assessment.
Asked why-Louisiana Avenue widening is being done. Mayor Hurd explained that
75% of the cost of the bridge is being included in the general assessment. Leo
Waltman, 8407 Virginia Circle South said he feels that Business should pay a share.
Trustee Bolmgren explained that the trunk water main had not been assessed to the
Krupp property before.
John Fissler, 7931 West 25th Street asked who paid for paving of Minnetonka
Boulevard. Said Miracle Mile gets the bulk of the trade and should pay their share
of costs. George Phillips said the north side will not use the bridge. It is
only used by two Country Clubs members. Mr. Buckley asked if a survey has been
made as to who will use the bridge. The answer was "no". Asked who made the
decision as to the area to be assessed. Mayor Hurd answered that the Council
determined that the area selected was proper. Owen Ferris, Corner of 18th and
Kentucky asked what was meant by parcel that is being assessed. Said he has three
lots - 303, 304, and 305, Richmond Addition. He was told that he was being
assessed for one parcel.
Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the folloviing
resolution was adopted by unanimous vote of all Members of the Council present:
ASSESSMENT RESOLUTION
WHEREAS, the Village Council has met at the time and place specified in a
notice of assessment, stating the general nature of the following improvements
and the area proposed to be assessed, published in the St. Louis Park Dispatch
August 27, 1953, and has held a public hearing on each of said assessments and
passed upon all the objections thereto, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the proposed assessments on file in the office of the Village Clerk covering the
cost of the following described improvements be hereby adopted and shall constitute
' a special assessment against the lands named therein in the respective amounts
therein set forth which assessment with accruing interest thereon shall be a lien
upon the property included therein concurrent with general taxes, payable in such
equal installments as are hereafter indicated, the first of which installments shall
be payable concurrent with taxes levied in the year 1953 and payable in the year
1954. Deferred installments thereof hsall bear interest at the rate of 5% per
annum from the date of this resolution until August 15th of the year in which the
installment is payable.

that the total cost of each of said improvements is hereby determined to be in
the respective amounts hereinafter set forth in the following list and the amount
of benefits conferred by said improvements upon each lot, part of lot, pierce or
parcel of ground so benefited thereby rateably and in proportion to the special
benefits conferred upon it is hereby determined to be as, respectively set forth
in the following list, and there is hereby levied and assessed against each lot,
part of lot, piece or parcel of ground described therein an assessment equal to
the sums therein respectively set forth as authorized by Chapter 382, Laws of
Minnesota, 1903, payable in three equal annual installments, the first of which
shall be payable concurrent with real estate taxes levied in 1953 and collected
in 1954 together with a penalty of ten per cent if not paid in full within 30 clays
after publication of this resolution, and interest at 5% per annum from the date

Request for Rezoning - A. N. Underhill
Letter from A. N. Underhill, 925 Marquette Avenue, dated September 25, 1953,
requesting the rezoning of Lots 18, 19, 20, and 21, Block 4, J. F. Lyons Addition,
from residential use to commercial use, was read.
On motion of Trustee Middleton, seconded by Clerk Justad, the ,above request
was referred to Trustee Jorvig for checking and recommendation, by unanimous vote
of all Members of the Council present.
Partial Payment on Contract Work
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
partial payment on contract work in progress, presented by Village Engineer, Phil

Bid Award - Water Main #53-110
On motion of Trustee Middleton, seconded by Trustee Jorvig, the bid
of Phelps-Drake Company, Incorporated, received September lk, 1953, for the
construction of water main in West 35th Street from Texas Avenue to Yukon
Avenue was determined to be the lowest bid of a responsible bidder, and the
Mayor and Clerk were authorized to execute contract for the Village with
the bidder for the work at price bid of $15,202.00, by unanimous vote of all
Members of the Council present.
Report on Sanitary Sewer for Texa Tonka & 29th Area - Village Engineer
As requested at meeting of September 212 1953, Village Engineer, Phil W.
Smith reported that the sanitary sewer just completed in the area west of Louisi-
ana Avenue and north of 32nd Street and Oregon Avenue lift station cannot be
extended any further north or west, and that effective this date they will
continue their study and design for that area, and in a few weeks they will
be able to give quite definite information.
Quit Claim Deed
On motion of Trustee Middleton, seconded by Trustee Jorvig, the quit
claim deed with Arthur J. Ruedlinger and Ann Ruedlinger his wife, and Rudolf N.
Ruedlinger and Jessie W. Ruedlinger, his wife as parties of the first part,
and the Village of St. Louis Park, a municipal corporation under the laws of
Minnesota as party of the second part, dated August 25, 1953, for the following
described property to be used for sewer purposes was approved, and the Village
Attorney was instructed to file said deed with the Office of the Register of
Deeds of Hennepin County, by unanimous vote of all Members of the Council
present:
"An easement for sewer over a strip of land fifteen (15) feet wide
_described as follows: The east fifteen (15) feet of the Northeast
Quarter (NE-41) of the Northeast Quarter (NES) of the Southwest Quarter
(SW-41) of Section 18, Township 117, Range 21, said easement being more
particularly described as the free right to enter upon said premises
to excavate the soil and to construct and install therein a sanitary
sewer and to forever-use and maintain said sewer, including the
right to enter upon said premises at all reasonable times to inspect,
repair and reconstruct said sewer."

showing that 28 building permits were issued, totaling $1852925.002 was read
and ordered filed.

The minutes of meeting held September 21, 1953, were read. On motion
of Trustee Middleton, seconded by Trustee Jorvig, the minutes of meeting held
September 21, 1953 were approved as read, by unanimous vote of all Members of
the Council present.
Letter Re: Dog Picked Up by Dog Catcher - Marvin A. Holt
Letter from Marvin A. Holt,3920 Lynn Avenue, dated September 23, 1953,
concerning the Dog Catcher picking up his Boxer a short distance from their
home, and condemning what he calls a mass and indiscriminate catching of dogs
for financial returns, was read.
Letter Re: Nuisance Caused by J. V. Gleason Asphalt Plant
Letter from Willard T. Gove, Corresponding Secretary, South Westwood
Hills Improvement Association, Incorporated, dated September 252 1953, with
regard to the nuisance caused by the operation of the J. V. Gleason Asphalt
Company, 2201 Louisiana Avenue, St. Louis Park, stating that same is a continual
menace to health and is continuing to cause damage to property in the area,
was read. George B. Phillips, 7912 West 26th Street was present and said he
would sign a complaint on this. matter to be tried in Justice Court.
Christmas Decorations for Mirable Mile
Mr. Olefson of First Federal Savings and Loan Association at Miracle
Mile appeared regarding permission to erect Christmas decorations at Miracle
Mile to be displayed from Thanksgiving until Christmas.
On motion of Trustee Middleton, seconded by Trustee Jorvig, Miracle
Mile Merchants Association was granted a permit to erect Christmas decorations
along Excelsior Boulevard adjacent to the Miracle Mile Shopping Center,
subject to setbacks the same as existing light poles along Excelsior Boulevard,
and the requirements of the Building Inspector, Village Engineer, and Electrical
Inspector as to snow removal, lighting, etc., by unanimous vote of all Members
of the Council present.

Pursuant to notice published in the St. Louis Park Dispatch September 17,
1953, a public hearing was had on the application of Clifford 0. Anderson and
Donna May Anderson for rezoning from Residential Use to Light Industrial Use, the
following described property ---- Lots 23 and 24, Block 1, John A. Johnson Addn.,
lying north of the south 175 feet of said lots, south of the southerly right-of-way
of Trunk Highway No, 12, and Lot 22, Block 1, John A. Johnson Addn, beginning at
the intersection of the east line of said Lot 22, with Minnesota State Highway No.
12; thence south on said line 1201 ; thence west to a point in the west line of said

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
ordinance was adopted by unanimous vote of all Members of the Council present:
ORDINANCE NO. 428
AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF ST. LOUIS PARK
The Village Council of the Village of St. Louis Park ordains:
Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted
January 20, 1932, as heretofore amended, is hereby further amended by reclassifi-
cation of the area of the respective use districts as defined in Section 2.2 of
said ordinance and the use district maps therein referred to as follows:
Lot 15, Block 3, Sunset Gables Second Addition shall be deleted from the
Residence Use District and included in the Multiple Dwelling -Use District and shall
be subject to all of the regulations of said ordinance relating to said Multiple
Dwelling Use District.
Section 2. Section 2.2 of said ordinance and the use district maps therein
referred to are hereby further amended as follows:
Lots 23 and 24, Block 1, John A. Johnson Addition, lying north of the south
175 feet of said lots and south of the southerly right-of—way of Trunk Highway
No. 12, and
Lot 22, Block 1, John A. Johnson Addition, beginning at the intersection
of the east line of said Lot 22 with Minnesota State Highway No. 12, thence south
on said line 120 feet, thence west to a point in the west line of said Lot 22
which is 120 feet south of the intersection of the west line of said Lot 22 with

A hearing was had on proposed vacation of alley in Block 2, Texa-Tonka
Addition. No one appeared.

resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION VACATING ALLEY
WHEREAS, the Village Council has met at the time and place specified in the
notice published in the St. Louis Park Dispatch September 10 and 17, 1953, and duly
posted, and has heard all interested persons appearing at said meeting and determined
that it appears for the public interest to vacate alley in Block 2, Texa-Tonka
Addition, on petition of Adolph Fine, Incorporated, the owner of all land abutting
on said alley, therefore
BE IT RESOLVED, by the Village Council of the Village of St. Louis Park that
alley in Block 2, Texa Tonka Addition, as the same is now laid out in the Village
of St. Louis Park, be hereby vacated and the Clerk be directed to record a notice
thereof with the'Register of Deeds of Hennepin County.
