M. Invocation was given by Reverend Oscar A. Dressel of St. Lukes Luthern Church. Williams 100.00 470 September 21, 1953 Verified Claims, Continued Twin City Brick Company 90.48 Williams Hardware 3.00 ®' 11 if it it 93.38 The Woodhead Company 114.40 if tf 101.30 DrQwning in Water Main Trench Merlin Krupp, 928 Eliotview Drive spoke about the drowning at 23rd and , September 18th, in a water main trench. Said Hampshire Avenue, Friday afternoon the trench was filled with water all the time the water main was being constructed. After the work was done the trench was filled except for a pit at 23rd and Hampshire. A Mr. Miller of Bruce Construction Company called Phelps-Drake Co. at two different times and warned them of the danger of this open pit filled with water. He asked if there is a law as to proper precautions to take care of such situations. Asked that an ordinance be adopted that would require a fence put around holes if left unatt ended.` Village Attorney said such an ordinance can be written. Mr. Krupp asked to be notified as to action taken on this matter. On motion of Trustee Middleton, secohded by Trustee Bolmgren, the Village Attorney was instructed to prepare a modification of sewer and water main contract forms providing for fencing of excavations' with water in the bottom and in deep excavation for sewer or water, by unanimou's vote of all Members of the Council present. Re: Responsibility for Calling a Doctor for Emergency Cases Mr. Merlin Krupp again referred to the drowning which occurred on September 18th. Said that a woman wanted to call a doctor and one of ,our Police Officers told her not to as they had a Doctor to call. He called and this Doctor said he was leaving on a vacation and could not come -- so the other Doctor was called and came, and gave respiration, and he expected an ambulance to come. Mr. Krupp said he feels that we should have adequate medical attention for such emergency On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Police Chief was asked to explain their policy used in calling a Doctor for emergencies, by unanimous vote of all Members of the Cduncil present. Building Permit Approved - Holt Const. Co. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Building Inspector was instructed to issue a building permit to Jerry Holt to construct an industrial building on Lots 26, 27, 2$; 29, Block 196, Rearrangement of St. Louis Park with the proper setbacks; facades to be the same as building on the NW of this location now being built by Mr: Holt, and approved by the Planning Commission. Motion was passed by unanimous vote of all Members of the Council present. Applications for Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following applications for 1953 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1953, subject to supervision and approval of the Fire Chief as required by Ordinance for gasoline storage tank, by unanimous vote of all Members of the C6uncil present; GOOD FOODS, INCORPORATED GAS STORAGE TANK R. L. .DE SCHANE PLUMBING Bonds On motion of Trustee Middleton, seconded by'Trustee Bolmgren, the following bonds were approved by unanimous vote of all Members of the Council-present: GAS INSTALLATION BOND with Lloyd Burns and Roscoe Fowler, dba Biirn Plumbing and Heating Company as principal; and The Fidelity and Casualty Company of New York as surety, effective April 22, 1953 to expire December 31, 1953, in the amount of $ 1,000.00. PLUMBING LICENSE BOND with Richard L. De Schane as principal, and Western Surety Company as surety, effective September 16, 1953 to expire December 31, 1953, in the amount of $4,000;00. September 21, 1953 471 Bonds, Continued CONTINUATION CERTIFICATE for Heating License Bond with Leon C. Hanson, dba Bjorkman Brothers Company as principal, and Continental Casualty Company as surety, effective for the year 1953, in the amount of $1,000.00. Partial Payment on Contract Work On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing partial payment on contract work in progress, presented by Village Engineer, Phil W. Smith, was approved, and the Mayor and Clerk were authorized to issue warrant covering same, by unanimous vote of all Members of the Council present: PARTIAL PAYMENT NO. 3 WATER MAIN CONSTRUCTION - 53-1 THRU 53-61, 53-8 THRU 53-17, and 53-75 Contractor, Phelps-Drake Company, Inc. Contract Date, June 8, 1953 Contract Price, $270,849.58 AMOUNT DUE ON PARTIAL PAYMENT NO. 3 - - - $30,451.22 Petition for Four Way Stop Street Petition signed by Mr. and Mrs. Dale Heissel, 7515 North Street and others, dated September 21, 1953, to make the Corner of Pennsylvania Avenue and West Lake Street a FOUR-WAY STOP STREET!, by placing stop on each corner, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above petition was referred to the Police Chief to make a traffic count and recommenda- tion, by unanimous vote of all Members of the Council present. Petitions for Street Improvements On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing petitions were referred to the Village Engineer, Chairman of the Street Department Committee and Special Assessment Department for checking and recom- mendation, by unanimous -vote of all Members of the Council present: P-1352 PETITION FOR SIDEWALK, signed by Mrs. Charles H. Levey, 2927 Virginia Avenue and others, dated September 11, 1953, for the construction of sidewalk _ on the EAST SIDE OF LOTS 1 and 9 thru 15, BLOCK 3, TEXA*TONKA ADDITION. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above matter was referred to the Committee of the Whole study, by unanimous vote of all Members of the Council present. Bingo - Eliot PPA_ Letter from Mrs. Frank Kickhafer, Secretary,, Eliot School PTA, dated September 19, 1953, requesting permission to hold a Bingo Game in connection with their Fall Festival, November 14, 1953, was read. There was no opposition. No. action taken. Application for Advertising Sign - Le Roy Sims, Inc. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the applica- tion of Le Roy Signs, Inc. for a permit to erect an advertising sign at 5001 Excelsior Boulevard was referred to the Planning Commission for checking and recom- mendation, by unanimous vote of all Members of the Council present. Application for License to Sell Soft Drinks, Route Delivery On motion of Trustee Middleton, seconded by Trustee Bolmgren, the application of The Beverage Butler Company for a license to sell soft drinks by Route Delivery was laid over for further study until September 28, 1953, by unanimous vote of all Members of the Council present. September 21, 1953 473 Building Inspector's Weekly Report The Building Inspector's report for week ending September 18, 1953, showing that 99 building permits were issued, totaling $800,335.00, was read and ordered filed. Quarterly Report of Activities of R. H. Public Health Nurses The quarterly report of activities of the Rural Hennepin Public Health Nurses (June, July, 'August, 1953) was read and ordered filed. Petition Re: Cesspool Trouble Petition signed by Richard D. Jedlund, 2930 Texa-Tonka Avenue and others, dated September 11, 1953, stating that they are having considerable trouble with the cesspools in their area, and requesting that an inspection be made to determine the cause, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, this matter was referred to the Village Engineer to report to the Council on September 28, 1953 as to whether or not these folks can come into the existing sewer now serving the Shopping Center at Texas Avenue and Minnetonka Boulevard, by unanimous vote of all Members of the Council present. American Public 1iorks Association On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Engineer, Phil W. Smith was' authorized to attend the Annual Conference of The American Public Works Association in New Orleans, October 25 to 29, 1953, with necessary expenses paid, by unanimous vote of all Members of the Council present. Petition for Street Light Petition signed by Mrs. ,J. H. Skodje, 9001 West 31st Street and others, for the installation of a street light on -existing pole at corner-of Decatur Avenue and West 31st Street, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren the above re- quest was referred to the Northern States 'Power Company to see if this light can be installed, by unanimous vote of all Members of the Council present. Letter Re: Deep Hole & Uncovered Foundations Letter signed by Mrs. Paul Estrin and others, dated September 21, 1953, stating that in the area of Minnetonka Boulevard and 29th Street between Texas and Sumter Avenues, there is a huge deep hole which after a rain or snowfall could be very dangerous; also there are foundations in this area which are un- covered, as well as dangerous equipment such as cement mixers left there at all times, was read, and copy ordered sent to Adolph Fine and Mayor C. L. Hurd. Village Attorney's Report on Claim for Damages - Mrs. Almina Westergaard Village Attorney, E. T. Montgomery's report on the claim for damages for sustained injuries due to defective sidewalk on the North Side of Minnetonka Blvd. about 15 feet east of the intersection of Edgewood Avenue and Minnetonka Boulevard by Mrs. Almina Westergaard, was read and ordered filed. Contract for Interruptible Natural Gas Service for the Village Hall On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Mayor and Clerk were authorized to sign for the Village, contract with the Minneapolis Gas Company for interruptible gas service for heating the Village Hall, by unanimous vote of all Members of the Council present; subject to approval of the Village Attorney. Employment and Wages in the United States On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Clerk was instructed to order a copy of EMPLOYMENT AND WAGES IN THE UNITED STATES at cost of $7.50, by unanimous vote of all Members of the Council present. Resolution On motion of Trustee Bo1mgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION AUTHORIZING CONVEYANCE OF LOT 10, FLOCK 11, McNAIR PARK, IN EXCHANGE FOR CONVEYANCE TO VIL- LAGE OF LOT 15, BLOCK 11, McNAIR PARK WHEREAS, the Village has heretofore acquired Lot 10, Block 11, McNair Park, from the State of Minnesota by purchase, said lot having been originally acquired for the purpose of constructing a Sewer Lift Station thereon, and WHEREAS, it is necessary that the Village have the use of Lot 15 in said Block, McNair Park, for drainage purposes, and said Lot 15 is appropriate for 417A September 21, 1953 Resolution Authorizing Conveyance of Lot 10, Etc. , Cont'd. construction of said proposed Lift Station, and K. S. Child, the owner of said Lot, has notified the Village that she will refuse the Village the right to use said Lot for drainage purposes, but she has offered to exchange said Lot for said Lot 10, and it appears to the Village Council that it is to the advantage of the Village as well as K. S. Child that said lots be exchanged, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Mayor and Clerk be hereby authorized and directed to execute a quit claim deed of the Village to said Lot 10 to said K. S. Child, and to deliver said deed upon conveyance by said K. S. Child to the Village of said Lot 15. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION VACATING PORTION OF STREET-26th BETWEEN WEBSTER AVENUE AND XEIWOOD AVENUE WHEREAS, the Village Council has met at the time and place specified in the notice published in the St. Louis Park Dispatch September 24, 1948, embracing a copy of petition for vacation of portion of 26th Street hereinafter described, which notice was also duly posted, and has heard all interested persons appearing at said meeting, and the meeting having been duly deferred for consideration, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that that portion of West 26th Street which lies between Webster Avenue and Xenwood Avenue, a public street of said Village, as the same is now dedicated and laid out therein, be hereby vacated. Minutes The minutes of meeting held September 14, 1953, were read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the minutes of meeting held September 14, 1953, were approved as read, by unanimous vote of all Members of the Council present. Meeting Adjourned On motion of Trustee Middleton, seconded by Trustee Bolmgren, the meeting was adjourned at 11:45 P.
